The States Parties to the present Agreement, 本协定于2002年9月10日在纽约联合国总部开放供各国签署,直至2004年6月30日为止。
Whereas the Rome Statute of the International Criminal Court adopted on 17 July 1998 by the United Nations Diplomatic Conference of Plenipotentiaries established the International Criminal Court with the power to exercise its jurisdiction over persons for the most serious crimes of international concern; 本协定缔约国,鉴于联合国设立国际刑事法院全权代表外交会议1998年7月17日通过的《国际刑事法院罗马规约》设立国际刑事法院,有权就受到国际关注的最严重犯罪对个人行使管辖权;
Whereas article 4 of the Rome Statute provides that the International Criminal Court shall have international legal personality and such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes; 鉴于《罗马规约》第四条规定,国际刑事法院具有国际法律人格,并享有为行使其职能和实现其宗旨所必需的法律行为能力;
Whereas article 48 of the Rome Statute provides that the International Criminal Court shall enjoy in the territory of each State Party to the Rome Statute such privileges and immunities as are necessary for the fulfilment of its purposes; 鉴于《罗马规约》第四十八条规定,国际刑事法院在每一《罗马规约》缔约国境内,应享有为实现其宗旨所需的特权和豁免;
Have agreed as follows: 议定如下:
Article 1Use of terms   第1条 用语
For the purposes of the present Agreement: 为了本协定的目的:
(a) "The Statute" means the Rome Statute of the International Criminal Court adopted on 17 July 1998 by the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court; (a)“《规约》”是指联合国设立国际刑事法院全权代表外交会议1998年7月17日通过的《国际刑事法院罗马规约》;
(b) "The Court" means the International Criminal Court established by the Statute; (b)“法院”是指《规约》所设立的国际刑事法院;
(c) "States Parties" means States Parties to the present Agreement; (c)“缔约国”是指本协定缔约国;
(d) "Representatives of States Parties" means all delegates, deputy delegates, advisers, technical experts and secretaries of delegations; (d)“缔约国代表”是指各代表团全体代表、副代表、顾问、技术专家和秘书;
(e) "Assembly" means the Assembly of States Parties to the Statute; (e)“大会”是指《规约》缔约国大会;
(f) "Judges" means the judges of the Court; (f)“法官”是指法院法官;
(g) "The Presidency" means the organ composed of the President and the First and Second Vice-Presidents of the Court; (g)“院长会议”是指以法院院长及第一和第二副院长组成的机关;
(h) "Prosecutor" means the Prosecutor elected by the Assembly in accordance with article 42, paragraph 4, of the Statute; (h)“检察官”是指大会依照《规约》第四十二条第四款选出的检察官;
(i) "Deputy Prosecutors" means the Deputy Prosecutors elected by the Assembly in accordance with article 42, paragraph 4, of the Statute; (i)“副检察官”是指大会依照《规约》第四十二条第四款选出的副检察官;
(j) "Registrar" means the Registrar elected by the Court in accordance with article 43, paragraph 4, of the Statute; (j)“书记官长”是指法院依照《规约》第四十三条第四款选出的书记官长;
(k) "Deputy Registrar" means the Deputy Registrar elected by the Court in accordance with article 43, paragraph 4, of the Statute; (k)“副书记官长”是指法院依照《规约》第四十三条第四款选出的副书记官长;
(l) "Counsel" means defence counsel and the legal representatives of victims; (l)“律师”是指辩护律师和被害人的法律代理人;
(m) "Secretary-General" means the Secretary-General of the United Nations; (m)“秘书长”是指联合国秘书长;
(n) "Representatives of intergovernmental organizations" means the executive heads of intergovernmental organizations, including any official acting on his or her behalf; (n)“政府间组织代表”是指政府间组织的行政首长,包括以其名义行事的任何官员;
(o) "Vienna Convention" means the Vienna Convention on Diplomatic Relations of 18 April 1961; (o)“《维也纳公约》”是指1961年4月18日《维也纳外交关系公约》;
(p) "Rules of Procedure and Evidence" means the Rules of Procedure and Evidence adopted in accordance with article 51 of the Statute. (p)“《程序和证据规则》”指依照《规约》第五十一条通过的《程序和证据规则》。
 Article 2 Legal status and juridical personality of the Court   第2条
The Court shall have international legal personality and shall also have such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes. It shall, in particular, have the capacity to contract, to acquire and to dispose of immovable and movable property and to participate in legal proceedings. 法院的法律地位和法律人格法院应具有国际法律人格,并享有为行使其职能和实现其宗旨所必需的法律行为能力。法院应特别具有下列行为能力:订立契约,取得和处理不动产和动产及参加诉讼。
 Article 3General provisions on privileges and immunities of the Court   第3条 法院特权和豁免的一般规定
The Court shall enjoy in the territory of each State Party such privileges and immunities as are necessary for the fulfilment of its purposes. 法院在每一缔约国境内,应享有为实现其宗旨所需的特权和豁免。
 Article 4Inviolability of the premises of the Court   第4条 法院房地不得侵犯
The premises of the Court shall be inviolable. 法院房地不得侵犯。
 Article 5 Flag, emblem and markings   第5条 旗帜、徽章和标志
The Court shall be entitled to display its flag, emblem and markings at its premises and on vehicles and other means of transportation used for official purposes. 法院有权在其房地及在用于公务的车辆和其他交通工具上展示其旗帜、徽章和标志。
 Article 6 Immunity of the Court, its property, funds and assets   第6条 法院、其财产、资金和资产的豁免
1. The Court, and its property, funds and assets, wherever located and by whomsoever held, shall be immune from every form of legal process, except insofar as in any particular case the Court has expressly waived its immunity. It is, however, understood that no waiver of immunity shall extend to any measure of execution. 1.法院及其财产、资金和资产,不论位于何处,也不论由何人持有,对各种法律程序享有豁免,但法院明示放弃其豁免的特定情况,不在此限。但放弃豁免应被理解为不适用于任何执行措施。
2. The property, funds and assets of the Court, wherever located and by whomsoever held, shall be immune from search, seizure, requisition, confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action. 2.法院的财产、资金和资产,不论位于何处,也不论由何人持有,均免受以执行、行政、司法或立法行为所进行的搜查、扣押、征用、没收、征收和任何其他形式的干扰。
3. To the extent necessary to carry out the functions of the Court, the property, funds and assets of the Court, wherever located and by whomsoever held, shall be exempt from restrictions, regulations, controls or moratoria of any nature. 3.为履行法院职能时之必要,法院的财产、资金和资产,不论位于何处,也不论由何人持有,均免受任何性质的限制、管制、控制或延期措施。
 Article 7 Inviolability of archives and documents   第7条 档案及文件不得侵犯
The archives of the Court, and all papers and documents in whatever form, and materials being sent to or from the Court, held by the Court or belonging to it, wherever located and by whomsoever held, shall be inviolable. The termination or absence of such inviolability shall not affect protective measures that the Court may order pursuant to the Statute and the Rules of Procedure and Evidence with regard to documents and materials made available to or used by the Court. 法院的档案,及法院收发、持有或拥有的任何形式的文书和文件及材料,不论位于何处,也不论由何人持有,均不得侵犯。这种不得侵犯权的终止或缺乏,不影响法院根据《规约》和《程序和证据规则》可能对法院所获得或使用的文件和材料下令采取的保护措施。
 Article 8 Exemption from taxes, customs duties and import or export restrictions   第8条 捐税、关税和进出口限制的免除
1. The Court, its assets, income and other property and its operations and transactions shall be exempt from all direct taxes, which include, inter alia, income tax, capital tax and corporation tax, as well as direct taxes levied by local and provincial authorities. It is understood, however, that the Court shall not claim exemption from taxes which are, in fact, no more than charges for public utility services provided at a fixed rate according to the amount of services rendered and which can be specifically identified, described and itemized. 1.法院,其资产、收入和其他财产,以及其业务和交易应免纳一切直接税,除其他外,包括所得税、资本税和企业税以及地方和省级当局所课征的直接税。但此项规定应理解为,法院对于事实上纯为公用设施服务费用的捐税不得要求免除,如果这些服务是根据所提供的数量按照固定费率收费,而且可以为此提供明细记录。
2. The Court shall be exempt from all customs duties, import turnover taxes and prohibitions and restrictions on imports and exports in respect of articles imported or exported by the Court for its official use and in respect of its publications. 2.对于法院为公务用途而进口或出口的物品及其出版物,应免除一切关税和进口营业税及进出口的禁令或限制。
3. Goods imported or purchased under such an exemption shall not be sold or otherwise disposed of in the territory of a State Party, except under conditions agreed with the competent authorities of that State Party. 3.根据上款规定进口或采购的货物,除非依照与有关缔约国主管当局商定的条件,不得在该缔约国境内出售或以其他方式处置。
 Article 9 Reimbursement of duties and/or taxes   第9条 税款的退还
1. The Court shall not, as a general rule, claim exemption from duties and/or taxes which are included in the price of movable and immovable property and taxes paid for services rendered. Nevertheless, when the Court for its official use makes major purchases of property and goods or services on which identifiable duties and/or taxes are charged or are chargeable, States Parties shall make appropriate administrative arrangements for the exemption of such charges or reimbursement of the amount of duty and/or tax paid. 1.法院原则上不应要求免除动产和不动产价格所含的税项和为服务支付的税款。但法院为公务用途而采购大宗财产和货物或服务时,对于已课征或应课征的专项税款,缔约国应作出适当行政安排,免除这些税项或退还已付税款。
2. Goods purchased under such an exemption or reimbursement shall not be sold or otherwise disposed of, except in accordance with the conditions laid down by the State Party which granted the exemption or reimbursement. No exemption or reimbursement shall be accorded in respect of charges for public utility services provided to the Court. 2.根据上款规定采购的货物,除非依照给予免税或退税待遇的缔约国所定的条件,不得出售或以其他方式处置。向法院提供的公用设施服务不享有任何免税或退税待遇。
 Article 10 Funds and freedom from currency restrictions   第10条 资金和货币管制的免除
1. Without being restricted by financial controls, regulations or financial moratoriums of any kind, while carrying out its activities:(a) The Court may hold funds, currency of any kind or gold and operate accounts in any currency; 1.在其活动不受任何财政管制、条例或延期偿付令的限制下,(a)法院可持有资金、任何货币或黄金,并以任何货币运用账款;
(b) The Court shall be free to transfer its funds, gold or its currency from one country to another or within any country and to convert any currency held by it into any other currency; (b)法院可自一国至另一国或在一国境内自由转移其资金、黄金或货币,并可将其持有的任何货币换成任何其他货币;
(c) The Court may receive, hold, negotiate, transfer, convert or otherwise deal with bonds and other financial securities; (c)法院可收受、持有、流通、转让、兑换或以其他方式处理债券或其他金融证券;
(d) The Court shall enjoy treatment not less favourable than that accorded by the State Party concerned to any intergovernmental organization or diplomatic mission in respect of rates of exchange for its financial transactions. (d)在法院财务交易的汇率方面,法院应享有不低于有关缔约国给予政府间组织或外国使团的优惠待遇。
2. In exercising its rights under paragraph 1, the Court shall pay due regard to any representations made by any State Party insofar as it is considered that effect can be given to such representations without detriment to the interests of the Court. 2.法院在行使第1款规定的权利时,应适当顾及任何缔约国所作出的陈述,但须确定考虑到所作陈述不会损害法院的利益。
 Article 11 Facilities in respect of communications   第11条 通讯便利
1. The Court shall enjoy in the territory of each State Party for the purposes of its official communications and correspondence treatment not less favourable than that accorded by the State Party concerned to any intergovernmental organization or diplomatic mission in the matter of priorities, rates and taxes applicable to mail and the various forms of communication and correspondence. 1.法院的公务通讯和来往公文,在每一缔约国境内,应享有不低于有关缔约国在适用于邮件及各种通讯和书信的优先权、费率和税捐方面给予任何政府间组织或外交使团的优惠待遇。
2. No censorship shall be applied to the official communications or correspondence of the Court. 2.不得对法院公务通讯或来往公文施行检查。
3. The Court may use all appropriate means of communication, including electronic means of communication, and shall have the right to use codes or cipher for its official communications and correspondence. The official communications and correspondence of the Court shall be inviolable. 3.法院可使用一切适当通讯手段,包括电子通讯手段,并有权为其公务通讯和来往公文使用明码或密码。法院的公务通讯和来往公文不得侵犯。
4. The Court shall have the right to dispatch and receive correspondence and other materials or communications by courier or in sealed bags, which shall have the sameprivileges, immunities and facilities as diplomatic couriers and bags. 4.法院有权经由信使或以密封邮袋收发书信和其他材料或通讯;这些信使和邮袋应享有与外交信使和邮袋相同的特权、豁免和便利。
5. The Court shall have the right to operate radio and other telecommunication equipment on any frequencies allocated to it by the States Parties in accordance with their national procedures. The States Parties shall endeavour to allocate to the Court, to the extent possible, frequencies for which it has applied. 5.法院有权在缔约国按本国程序分配给法院的频率上操作无线电和其他通讯设备。缔约国应尽可能努力将法院申请的频率分配给法院。
 Article 12 Exercise of the functions of the Court outside its headquarters   第12条 法院在总部以外行使职能
In the event that the Court, pursuant to article 3, paragraph 3, of the Statute, considers it desirable to sit elsewhere than at its headquarters at The Hague in the Netherlands, the Court may conclude with the State concerned an arrangement concerning the provision of the appropriate facilities for the exercise of its functions. 法院根据《规约》第三条第三款认为适宜于在荷兰海牙总部以外其他地方开庭时,可以与有关国家就提供适当设施以便法院行使其职能达成协议。
 Article 13 Representatives of States participating in the Assembly and its subsidiary organs and representatives of intergovernmental organizations   第13条 参加大会及其附属机关的国家代表和政府间组织代表
1. Representatives of States Parties to the Statute attending meetings of the Assembly and its subsidiary organs, representatives of other States that may be attending meetings of the Assembly and its subsidiary organs as observers in accordance with article 112, paragraph 1, of the Statute, and representatives of States and of intergovernmental organizations invited to meetings of the Assembly and its subsidiary organs shall, while exercising their official functions and during their journey to and from the place of meeting, enjoy the following privileges and immunities: 1.出席大会及其附属机关的会议的《规约》缔约国代表、可能按照《规约》第一百一十二条第一款以观察员身份出席大会及其附属机关的会议的其他国家代表,及应邀出席大会及其附属机关的会议的国家和政府间组织代表,在执行公务期间和在往返开会地点的旅程中,应享有下列特权和豁免:
(a) Immunity from personal arrest or detention; (a)人身不受逮捕或羁押;
(b) Immunity from legal process of every kind in respect of words spoken or written, and all acts performed by them in their official capacity; such immunity shall continue to be accorded notwithstanding that the persons concerned may have ceased to exercise their functions as representatives; (b)以官方身份发表的口头或书面言论及实施的一切行为,豁免各种法律程序;有关人员不再执行代表职务时,仍应继续享有这种豁免;
(c) Inviolability of all papers and documents in whatever form; (c)任何形式的文书和文件均不得侵犯;
(d) The right to use codes or cipher, to receive papers and documents or correspondence by courier or in sealed bags and to receive and send electronic communications; (d)有权使用明码或密码,经由信使或以密封邮袋收发文书和文件或书信,及收发电子信函;
(e) Exemption from immigration restrictions, alien registration requirements and national service obligations in the State Party they are visiting or through which they are passing in the exercise of their functions; (e)在他们为执行职务而前往或途经的缔约国,免除移民限制、外侨登记要求和国民服役义务;
(f) The same privileges in respect of currency and exchange facilities as are accorded to representatives of foreign Governments on temporary official missions; (f)在货币和汇兑便利方面,享有给予执行临时公务的外国政府代表的同样特权和便利;
(g) The same immunities and facilities in respect of their personal baggage as are accorded to diplomatic envoys under the Vienna Convention; (g)其私人行李享有根据《维也纳公约》给予外交使节的同样豁免和便利;
(h) The same protection and repatriation facilities as are accorded to diplomatic agents in time of international crisis under the Vienna Convention; (h)在发生国际危机时,享有根据《维也纳公约》给予外交人员的同样保护和遣送返国便利;
(i) Such other privileges, immunities and facilities not inconsistent with the foregoing as diplomatic agents enjoy, except that they shall have no right to claim exemption from customs duties on goods imported (otherwise as part of their personal baggage) or from excise duties or sales taxes. (i)外交人员所享有而与上开各项不相冲突的其他特权、豁免和便利,但他们无权要求免除进口货物(除为其私人行李的一部分外)关税、消费税或销售税。
2. Where the incidence of any form of taxation depends upon residence, periods during which the representatives described in paragraph 1 attending the meetings of the Assembly and its subsidiary organs are present in a State Party for the discharge of their duties shall not be considered as periods of residence. 2.对于税务负担取决于居留期的情况,第1款所述出席大会及其所属机关的会议的代表因履行其职责而留在缔约国的期间,不应视为居留期间。
3. The provisions of paragraphs 1 and 2 of this article are not applicable as between a representative and the authorities of the State Party of which he or she is a national or of the State Party or intergovernmental organization of which he or she is or has been a representative. 3.本条第1款和第2款的规定,在任何代表与为其国籍国的缔约国当局之间,及在任何代表与其代表或曾代表的缔约国或政府间组织当局之间,不予适用。
 Article 14 Representatives of States participating in the proceedings of the Court   第14条 参加法院诉讼的国家代表
Representatives of States participating in the proceedings of the Court shall, while exercising their official functions, and during their journey to and from the place of the proceedings, enjoy the privileges and immunities referred to in article 13. 参加法院诉讼的国家代表,在执行公务期间和在往返诉讼地点的旅程中,应享有第13条提到的特权和豁免。
 Article 15 Judges, Prosecutor, Deputy Prosecutors and Registrar   第15条 法官、检察官、副检察官和书记官长
1. The judges, the Prosecutor, the Deputy Prosecutors and the Registrar shall, when engaged on or with respect to the business of the Court, enjoy the same privileges and immunities as are accorded to heads of diplomatic missions and shall, after the expiry of their terms of office, continue to be accorded immunity from legal process of every kind in respect of words which had been spoken or written and acts which had been performed by them in their official capacity.
