| Announcement of the China National Intellectual Property Administration on Amending the Measures for the Protection of Foreign Geographical Indication Products | | 国家知识产权局关于修改《国外地理标志产品保护办法》的公告 |

| In accordance with the requirements of the Institutional Reform Proposal of the State Council adopted at the 1st Session of the Thirteenth National People's Congress and the Decision of the State Council on the Issues concerning the Adjustment of Functions of Administrative Agencies Prescribed by Administrative Regulations in the Institutional Reform of the State Council, for the purpose of improving the protection of foreign geographical indication products, the China National Intellectual Property Administration has decided to amend the Measures for the Protection of Foreign Geographical Indication Products as follows: | | 根据第十三届全国人民代表大会第一次会议通过的《国务院机构改革方案》和《国务院关于国务院机构改革涉及行政法规规定的行政机关职责调整问题的决定》要求，为了完善国外地理标志产品保护制度，国家知识产权局决定对《国外地理标志产品保护办法》作如下修改： |
| I. Subparagraph (3) of Article 4 is amended to read: “The aforesaid names are not generic names in China or do not conflict with the names of China's geographical indication products or other prior rights.” | | 一、将第四条第（三）项修改为：“上述名称在中国不属于通用名称，且未与中国的地理标志产品名称等其他在先权利相冲突。” |
| II. Article 5 is amended to read: ”The China National Intellectual Property Administration (“CNIPA”) shall uniformly administer the protection of foreign geographical indication products in China. The administrative departments of intellectual property at all levels shall implement protection of foreign geographical indication products in accordance with their respective functions and duties.” | | 二、将第五条修改为：“中国国家知识产权局（以下简称“国家知识产权局”）统一管理国外地理标志产品在华保护工作。各级知识产权管理部门依据职能对国外地理标志产品实施保护。” |
| III. Article 6 is amended to read: “In accordance with these Measures, a foreign geographical indication product shall apply for protection in China under the agreement concluded between the country which the product is from and the People's Republic of China, or the international treaty acceded to by China and the country, or in accordance with the principle of reciprocity.” and is renumbered as Article 3. | | 三、将第六条修改为：“依照本办法，申请在华保护的国外地理标志产品，应当按其所属国和中华人民共和国签订的协议或者共同参加的国际条约办理，或者按对等原则办理。”并置于第三条。 |
| IV. “AQSIQ” in Articles 7, 11, 12, 14, 20, 21, 27, 29, 32 and 36 are replaced with “CNIPA.” | | 四、将第七条、第十一条、第十二条、第十四条、第二十条、第二十一条、第二十七条、第二十九条、第三十二条、第三十六条中的“国家质检总局”修改为：“国家知识产权局”。 |
V. Article 8 is amended to read: “The applicant for protection of a foreign geographical indication product may designate its institution in China as the contact person for the protection in China, or may consult with and ask any staff member of the embassy of the country or region of origin in China as the contact person or designated representative for the protection in China.”
