| Chapter I General Provisions | | 第一章 总则 |
| Article 1 These Measures are developed according to the Meteorology Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, and the Regulations on Administration of Weather Modification for the purposes of ensuring the quality of special meteorological technical equipment, meeting the needs of meteorological business and meteorological disaster prevention, and regulating the license for the use of special meteorological technical equipment. | | 第一条 为了保证气象专用技术装备质量，满足气象业务和气象灾害防御的需要，规范气象专用技术装备使用许可行为，依据《中华人民共和国气象法》、《中华人民共和国行政许可法》和《人工影响天气管理条例》的规定，制定本办法。 |
| Article 2 In the areas of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China, the implementation, supervision and administration of the license for the use of special meteorological technical equipment shall comply with these Measures. | | 第二条 在中华人民共和国领域和中华人民共和国管辖的其他海域内，气象专用技术装备使用许可的实施和监督管理，应当遵守本办法。 |
| For the purposes of these Measures, “special meteorological technical equipment” means meteorological equipment, instruments, meters, consumables and corresponding software systems specially used for meteorological observation, forecasting, service, weather modification, space weather, and other meteorological service. | | 本办法所称气象专用技术装备，是指专门用于气象探测、预报、服务以及人工影响天气、空间天气等气象业务的气象设备、仪器、仪表、消耗器材及相应软件系统。 |
| Article 3 The meteorological administration of the State Council shall be responsible for the implementation, supervision and administration of the license for the use of special meteorological technical equipment. | | 第三条 国务院气象主管机构负责气象专用技术装备使用许可的实施和监督管理。 |
| Local meteorological institutions at all levels shall be responsible for the supervision and administration of the use of special meteorological technical equipment within their respective administrative regions. | | 地方各级气象主管机构负责本行政区域内气象专用技术装备使用的监督管理。 |
| Article 4 The implementation of the license for the use of special meteorological technical equipment shall follow the principles of openness, fairness and impartiality. | | 第四条 实施气象专用技术装备使用许可，应当遵循公开、公平、公正原则。 |
| Article 5 In meteorological business, engineering design and construction, special meteorological technical equipment with valid licenses shall be used. | | 第五条 在气象业务、工程设计建设中，应当使用具备有效许可证的气象专用技术装备。 |
| Article 6 The meteorological administration of the State Council shall regularly announce the catalogue of special meteorological technical equipment and the list of licenses obtained, canceled or revoked. | | 第六条 国务院气象主管机构应当定期公告气象专用技术装备目录和取得或者注销、撤销许可的名录。 |
| Chapter II Application and Acceptance | | 第二章 申请与受理 |
| Article 7 An application for the license for the use of special meteorological technical equipment shall be filed by a producer and the following conditions shall be met: | | 第七条 气象专用技术装备使用许可应当由生产者提出申请，并具备下列条件： |
| (1) It has legal person status. | | （一）具有法人资格； |
| (2) It has passed the identification of the quality management system. | | （二）通过质量管理体系认证； |
| (3) The product satisfies the national standards, the standards of the meteorological industry or the technical requirements prescribed by the meteorological administration of the State Council. | | （三）产品满足国家标准、气象行业标准或者国务院气象主管机构规定的技术要求； |
| (4) It has production, testing, sales, service and other systems suitable for the products that it produces. | | （四）具备与所生产产品相适应的生产、检测、销售、服务等体系； |
| (5) It complies with other relevant provisions of the state. | | （五）符合国家其他有关规定。 |
| An applicant for a license for the use of three types of equipment including rocket launchers, artillery shells and rocket shells for weather modification shall comply with the relevant provisions of the state on weaponry and civilian explosives and the relevant mandatory technical standards of the state. | | 申请人工影响天气作业用火箭发射装置、炮弹、火箭弹三类设备使用许可证的，应当符合国家武器装备、民用爆炸物品的相关规定和国家有关强制性技术标准。 |
| Article 8 An applicant shall submit the following application materials to the meteorological administration of the State Council: | | 第八条 申请人应当向国务院气象主管机构提供下列申请材料： |
| (1) an Application Form for a License for the Use of Special Meteorological Technical Equipment; | | （一）气象专用技术装备使用许可证申请表； |
| (2) the technical documents on products, including the following materials: technical indicators and configuration list of products, standards for enterprise, complete sets of technical drawings, process documents, standardization review reports, economic analysis reports, operation instruction, and self-test reports on product quality; and | | （二）产品技术文件，应包括下列材料：产品技术指标和配置一览表、企业标准、成套技术图纸、工艺文件、标准化审查报告、经济分析报告、使用说明书、产品质量自测报告； |
| (3) relevant materials set forth in items (3) through (5) of Article 7. | | （三）第七条第三项到第五项的相关材料。 |
| An applicant shall be responsible for the authenticity of the application materials submitted. | | 申请人应当对所提交的申请材料的真实性负责。 |
Article 9 The meteorological administration of the State Council shall, within five working days of receipt of all application materials, make a written decision of approval or disapproval according to the conditions prescribed by Article 32 of the Administrative Licensing Law of the People's Republic of China and these Measures. Where the application is disapproved, the reasons shall be explained in writing.
