| Chapter I General Provisions | | 第一章 总则 |
| Article 1 This Regulation is developed for the purpose of strengthening the administration of collection and use of pollutant discharge fees. | | 第一条 为了加强对排污费征收、使用的管理，制定本条例。 |
| Article 2 The entities and individual industrial and commercial households which directly discharge pollutants into the environment (hereinafter referred to as the “dischargers”) shall pay pollution discharge fees in accordance with the provisions of this Regulation. | | 第二条 直接向环境排放污染物的单位和个体工商户（以下简称排污者），应当依照本条例的规定缴纳排污费。 |
| For the dischargers who discharge sewage into centralized urban sewage treatment facilities and have paid fees for sewage treatment shall no longer pay the pollution discharge fees. Where the facilities or sites built by the dischargers for storage or disposal of industrial solid waste meet the environmental standards, or such facilities or sites owned by the dischargers meet the environmental standards after a renovation, these dischargers shall no longer pay the pollutant discharge fees from the date of completion of the construction or renovation. | | 排污者向城市污水集中处理设施排放污水、缴纳污水处理费用的，不再缴纳排污费。排污者建成工业固体废物贮存或者处置设施、场所并符合环境保护标准，或者其原有工业固体废物贮存或者处置设施、场所经改造符合环境保护标准的，自建成或者改造完成之日起，不再缴纳排污费。 |
| The State will actively promote the industrialization of urban sewage and waste disposal. The measures for the collection of fees for urban centralized sewage and waste disposal shall be developed separately. | | 国家积极推进城市污水和垃圾处理产业化。城市污水和垃圾集中处理的收费办法另行制定。 |
| Article 3 The environmental protection administrative departments, financial departments, and competent price departments of the people's governments at or above the county level shall, according to their respective duties, strengthen the guidance to, administration of and supervision over the collection and use of pollutant discharge fees. | | 第三条 县级以上人民政府环境保护行政主管部门、财政部门、价格主管部门应当按照各自的职责，加强对排污费征收、使用工作的指导、管理和监督。 |
| Article 4 The collection and use of pollutant discharge fees shall be strictly subject to the principle of “separation between revenue and expenditure,” i.e., the pollutant discharge fees collected shall be all turned over to the financial departments, and the funds required for environmental protection law enforcement shall be included in the budget of respective departments and be guaranteed by the public finance departments at the same level. | | 第四条 排污费的征收、使用必须严格实行“收支两条线”，征收的排污费一律上缴财政，环境保护执法所需经费列入本部门预算，由本级财政予以保障。 |
| Article 5 Pollutant discharge fees shall be all used for the prevention and control of environmental pollution. No entity or individual may withhold such funds or use such funds for similar or other purposes. | | 第五条 排污费应当全部专项用于环境污染防治，任何单位和个人不得截留、挤占或者挪作他用。 |
| Any entity or individual shall have the right to file a report, an accusation or a compliant against the act of withholding such funds or using such funds for similar or other purposes. | | 任何单位和个人对截留、挤占或者挪用排污费的行为，都有权检举、控告和投诉。 |
| Chapter II Assessment of Categories and Quantities of the Pollutants Discharged | | 第二章 污染物排放种类、数量的核定 |
| Article 6 The dischargers shall, in accordance with the provisions of the environmental protection administrative department of the State Council, report the categories and quantities of the pollutants discharged and provide the relevant information to the environmental protection administrative departments of the local people's governments at or above the county level,. | | 第六条 排污者应当按照国务院环境保护行政主管部门的规定，向县级以上地方人民政府环境保护行政主管部门申报排放污染物的种类、数量，并提供有关资料。 |
| Article 7 The environmental protection administrative departments of the local people's governments at or above the county level shall, according to the authority granted by the environmental protection administrative department of the State Council for assessment, assess the categories and quantities of the pollutants discharged by dischargers. | | 第七条 县级以上地方人民政府环境保护行政主管部门，应当按照国务院环境保护行政主管部门规定的核定权限对排污者排放污染物的种类、数量进行核定。 |
| The amount of sulfur dioxide discharged by the power enterprises with an installed capacity of more than 300,000 kw shall be assessed by the environmental protection administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. | | 装机容量30万千瓦以上的电力企业排放二氧化硫的数量，由省、自治区、直辖市人民政府环境保护行政主管部门核定。 |
| After completing the assessment of the categories and quantities of the pollutants discharged, the environmental protection administrative departments responsible for the assessment shall notify the dischargers in writing. | | 污染物排放种类、数量经核定后，由负责污染物排放核定工作的环境保护行政主管部门书面通知排污者。 |
| Article 8 If any discharger have an objection to the assessed category and quantity of the pollutants discharged by it, it may, within seven days upon receipt of the notice, file a review application with the environmental protection administrative department issuing the notice; and the environmental protection administrative department shall, within ten days upon receipt of the review application, make a decision on review. | | 第八条 排污者对核定的污染物排放种类、数量有异议的，自接到通知之日起7日内，可以向发出通知的环境保护行政主管部门申请复核；环境保护行政主管部门应当自接到复核申请之日起10日内，作出复核决定。 |
| Article 9 In the assessment of the categories and quantities of pollutants discharged, if monitoring conditions are met, an environmental protection administrative department responsible for the assessment shall conduct assessments according to the monitoring methods prescribed by the environmental protection administrative department of the State Council; if monitoring conditions are not met, it shall conduct assessments according to the material balance method prescribed by the environmental protection administrative department of the State Council. | | |
| Article 10 Where any discharger uses the automatic pollutant discharge monitoring instrument subject to compulsory verification as prescribed by the State to monitor the discharge of pollutants, the monitoring data shall be deemed as the basis for the assessment of the categories and quantities of the pollutants discharged. | | 第十条 排污者使用国家规定强制检定的污染物排放自动监控仪器对污染物排放进行监测的，其监测数据作为核定污染物排放种类、数量的依据。 |
| The automatic pollutant discharge monitoring instrument installed by dischargers shall be checked on a regular basis in accordance with the law. | | 排污者安装的污染物排放自动监控仪器，应当依法定期进行校验。 |
| Chapter III Collection of Pollutant Discharge Fees | | 第三章 排污费的征收 |
Article 11 The competent price department, financial department, environmental protection administrative department, and foreign economic and trade department of the State Council shall develop the national standards for collection of pollutant discharge fees according to the needs for pollution control industrialization development, the requirements of pollution prevention and control, the economic and technical conditions, and the affordability of the dischargers.
