Procedures of Shanghai Municipality on the Administration of Residential Tenancy

《上海市居住房屋租赁管理办法》已经2011年6月20日市政府第111次常务会议通过,现予公布,自2011年10月1日起施行。
Article 1 (Purposes and Basis)

With a view to strengthening the administration of residential tenancy in this Municipality, standardizing the behavior of residential tenancy, protecting the legitimate rights and interests of the parties to residential tenancy, and promoting the healthy development of residential tenancy market, these Procedures are formulated in accordance with the Contract Law of the People's Republic of China, the Law on the Administration of Urban Land and Housing of the People's Republic of China, the Regulations of Shanghai Municipality on Residential Tenancy, and other relevant laws and rules, and in the light of the actual circumstances of this Municipality.

上海市居住房屋租赁管理办法
Article 2 (Application Scope) 
(2011年7月7日上海市人民政府令第68号公布)

These Procedures apply to the residential tenancy and the supervision and administration thereof in this Municipality's administrative area.
 

   第一条 (目的和依据)
Article 3 (Definition) 
为了加强本市居住房屋租赁管理,规范居住房屋租赁行为,保护居住房屋租赁当事人的合法权益,促进居住房屋租赁市场的健康发展,根据《中华人民共和国合同法》、《中华人民共和国城市房地产管理法》、《上海市房屋租赁条例》和其他有关法律、法规,结合本市实际,制定本办法。

"Residential tenancy" in these Procedures refers to the behavior of a landlord permitting a tenant to occupy a rental unit, and the tenant paying the rent that both sides have agreed on.
 

   第二条 (适用范围)
Article 4 (Principle) 
本办法适用于本市行政区域内的居住房屋租赁及其相关监督管理活动。

Residential tenancy shall follow the principle of equality, voluntary action, legality, and good faith.
 

The parties to residential tenancy in this Municipality are encouraged and supported to establish a long and stable tenancy relationship.
   第三条 (定义)

 
本办法所称的居住房屋租赁,是指出租人将居住房屋交付承租人居住使用,并由承租人按照双方协商确定的租金标准支付租金的行为。
Article 5 (Administrative Departments) 

The municipal housing administration department is the competent administrative department of residential tenancy in this Municipality. The district/county housing administration department is responsible for the specific supervision and administration work related to residential tenancy under its jurisdiction, and is professionally under the direction of the municipal housing administration department.
   第四条 (原则)

The public security department shall be responsible for the management of public security and fire prevention related to residential tenancy and the residence registration of tenants.
 
居住房屋租赁应当遵循平等、自愿、合法和诚实信用的原则。

The administrative departments of industry and commerce, public health, quality and technical supervision, food and drug administration, culture, radio, film & TV shall be responsible for investigating and punishing the behavior of doing unlicensed business by residential tenancy.
 
本市鼓励和支持居住房屋租赁当事人建立长期、稳定的房屋租赁关系。

The administrative departments of taxation, public affairs, population and family planning, construction, and planning shall, according to their respective duties and functions, cooperate in implementing these Procedures.
 

   第五条 (管理部门)
Article 6 (Territorial Administration) 
市房屋行政管理部门是本市居住房屋租赁的行政主管部门。区、县房屋行政管理部门负责本辖区内居住房屋租赁的具体监督管理工作,业务上受市房屋行政管理部门领导。

The district/county people's government shall bring the administration of residential tenancy into the scope of comprehensive administration of the community. The town/township people's government or the sub-district office shall be in charge of coordinating and handling affairs and disputes of residential tenancy within its jurisdiction, and shall be responsible for the registration and filing of the residential tenancy contract (hereinafter referred to as the tenancy contract).
 
公安部门负责居住房屋租赁的治安管理、消防管理和居住房屋租赁当事人的居住登记。

Neighborhood committees or village committees shall cooperate in doing well the administration of residential tenancy, and urge the parties to residential tenancy to observe the relevant provisions of the State and this Municipality on residential tenancy.
 
工商行政、卫生、质量技监、食品药品监督、文广影视等行政管理部门负责查处利用租赁居住房屋进行无证无照经营的行为。

 
本市税务、民政、人口计生、建设、规划等行政管理部门按照各自职责,协同实施本办法。
Article 7 (Parties to Tenancy) 

The landlord of a residential house shall be the owner of the house who has obtained according to law the title deed or other legal proof of title, or other proprietor defined by the provisions of laws and rules.
   第六条 (属地管理)

The tenant of a residential house may be a natural person, a legal person or other organization at home or abroad, but where laws and rules have other provisions, such provisions shall prevail.
 
区、县人民政府应当将居住房屋租赁管理纳入社区综合管理的范围。乡、镇人民政府或者街道办事处应当负责协调和处理辖区内居住房屋租赁事务和纠纷,承担居住房屋租赁合同(以下简称租赁合同)登记备案工作。

The landlord shall not lease a residential house to a natural person who can not provide his or her identity document or to a legal person or other organization that can not provide a business license or other approval document.
 
居民委员会或者村民委员会应当协助做好居住房屋租赁管理工作,督促居住房屋租赁当事人遵守国家和本市有关居住房屋租赁管理的规定。

 
Article 8 (Houses Prohibited to be Leased)   第七条 (租赁当事人)

The leased residential premises shall have structures and auxiliary facilities secure and firm and shall have the necessary living conditions such as the water supply, power supply. Residential premises in any of the following conditions shall not be leased:
 
居住房屋的出租人应当是依法取得房地产权证或者其他合法权属证明的房屋所有权人,以及法律、法规规定的其他权利人。

 
居住房屋的承租人可以是境内外的自然人、法人或者其他组织,但法律、法规另有规定的,从其规定。
1. belonging to illegal building; 
出租人不得向不能提供身份证件的自然人、不能提供营业执照或者其他批准文件的法人和其他组织出租居住房屋。

 
2. being identified as dangerous premises;   第八条 (禁止出租房屋的情形)

 
出租的居住房屋的结构及其附属设施应当安全、牢固,并具备供水、供电等必要的生活条件。有下列情形之一的居住房屋,不得出租:
3. not conforming to the compulsory standards for engineering construction in terms of safety, disaster prevention; 

 (一)属于违法建筑的;
4. changing the use nature of premises in violation of provisions; or 

 (二)被鉴定为危险房屋的;
5. other circumstances provided by laws, rules or regulations in which the premises shall not be leased. 

 (三)不符合安全、防灾等工程建设强制性标准的;
Article 9 (Minimum Rental Unit) 

The minimum rental unit shall be a room which is originally designed as a living accommodation, and it is prohibited to lease a room partitioned or added or to take a bed as a rental unit.
 (四)违反规定,改变房屋使用性质的;

Those parts originally designed as kitchen, bathroom, balcony, and underground storeroom shall not be leased for living accommodation.
 

 (五)法律、法规、规章规定不得出租的其他情形。
Article 10 (Minimum Per Capita Rental Area) 

The per capita living area of a tenant in a rental unit shall not be less than 5 square meters.
   第九条 (最小出租单位)

The living area mentioned in the preceding clause refers to the use area of a room originally designed as living accommodation.
 
出租居住房屋,应当以一间原始设计为居住空间的房间为最小出租单位,不得分隔搭建后出租,不得按照床位出租。

 
原始设计为厨房、卫生间、阳台和地下储藏室等其他空间的,不得出租供人员居住。
Article 11 (Central Tenancy Management) 

In the same residential property management area, where there are more than 15 occupants of residential premises leased by one landlord, the landlord shall define an administrator and submit his/her contact way to the community affairs service center set up by the local town/township people's government or sub-district office.
   第十条 (最低人均承租面积)

The residential houses in a residential property management area shall not be leased as dormitory of employees.
 
出租居住房屋,居住使用人的人均居住面积不得低于5平方米。

 
前款所称居住面积,是指原始设计为居住空间的房间的使用面积。
Article 12 (Tenancy Contract) 

The parties to a residential tenancy shall enter into a written tenancy contract according to law. The tenancy contract shall include the following contents:
   第十一条 (集中出租管理)

 
在同一居住物业管理区域内,同一出租人出租的居住房屋居住使用人达到15人以上的,出租人应当明确管理人员,并将管理人员联系方式报房屋所在地乡、镇人民政府或者街道办事处设置的社区事务受理服务中心。
1. the names, addresses, type and number of the effective identity certificate of the parties to tenancy ( including the occupants of the rental unit); 
居住物业管理区域内的居住房屋,不得出租用作单位的集体宿舍。

 
2. the location, area, structure, auxiliary facilities, and the condition of equipment;   第十二条 (租赁合同)

 
居住房屋租赁,租赁当事人应当依法订立书面租赁合同。租赁合同包括下列主要内容:
3. the purpose of tenancy; 

 (一)租赁当事人(包括居住使用人)的姓名、住所、有效身份证件的种类及号码;
4. the date of delivery of the rental unit; 

 (二)房屋坐落、面积、结构、附属设施和设备状况;
5. the term of tenancy and renewal; 

 (三)租赁用途;
6. the amount of rent, the mode and date of payment; 

 (四)房屋交付日期;
7. the payment of all property service and utility charges including water, electric power, gas, communication; 

 (五)租赁期限和续租;
8. requirements for the use of the house, and responsibility for maintenance; 

 (六)租金标准、支付方式和期限;
9. the condition of the house on eviction;
