国际货币基金协定

 (1944年7月22日在布雷顿森林召开的联合国货币金融会议通过,1945年12月27日生效。1968年5月31日在经理事会第23—5号决议同意修改,自1969年7月28日生效。经1976年4月30日理事会第31—4号决议同意修改,自1978年4月1日起生效。)

The Governments on whose behalf the present Agreement is signed agree as follows: 签字于本协定的政府同意如下:
Introductory Article 引文
(i)The International Monetary Fund is established and shall operate in accordance with the provisions of this Agreement as originally adopted and subsequently amended. 一、国际货币基金组织根据原通过的本协定的规定及以后经修改的规定建立并开展业务活动。
(ii)To enable the Fund to conduct its operations and transactions,the Fund shall maintain a General Department and a Special Drawing Rights Department.Membership in the Fund shall give the right to participation in the Special Drawing Rights Department. 二、为使基金进行业务与活动,在基金内分设普通帐户与特别提款权帐户。基金会员国有权参与特别提款权帐户。
(iii)Operations and transactions authorized by this Agreement shall be conducted through the General Department,consisting in accordance with the provisions of this Agreement of the General Resources Account,the Special Disbursement Account,and the Investment Account;except that operations and transactions involving special drawing rights shall be conducted through the Special Drawing Rights Department. 三、除涉及特别提款权的业务活动应通过特别提款权帐户外,本协定所规定的业务与活动均应通过普通帐户办理,按本协定规定,普通帐户包含普通资金帐户,特别支付帐户和投资帐户。
Article Ⅰ Purposes   第一条 宗旨
The purposes of the International Monetary Fund are: 国际货币基金组织的宗旨是:
(i)To promote international monetary cooperation through a permanent institution which provides the machinery for consultation and collaboration on international monetary problems. 一、通过设置一常设机构,便于国际货币问题的商讨与协作,以促进国际货币合作。
(ii)To facilitate the expansion and balanced growth of international trade,and to contribute thereby to the promotion and maintenance of high levels of employment and real income and to the development of the productive resources of all members as primary objectives of economic policy. 二、便利国际贸易的扩大与平衡发展,以促进和维持高水平的就业和实际收入,以及所有会员国生产资源的发展,作为经济政策的首要目标。
(iii)To promote exchange stability,to maintain orderly exchange arrangements among members,and to avoid competitive exchange depreciation. 三、促进汇价的稳定,维持会员国间有秩序的外汇安排,并避免竞争性的外汇贬值。
(iv)To assist in the establishment of a multilateral system of payments in respect of current transactions between members and in the elimination of foreign exchange restrictions which hamper the growth of world trade. 四、协助建立会员国间经常性交易的多边支付制度,并消除妨碍世界贸易发展的外汇管制。
(v)To give confidence to members by making the general resources of the Fund temporarily available to them under adequate safeguards,thus providing them with opportunity to correct maladjustment in their balance of payments without resorting to measures destructive of national or international prosperity. 五、在充分保障下,以基金的资金暂时供给会员国,使有信心利用此机会调整其国际收支的不平衡,而不致采取有害于本国的或国际的繁荣的措施。
(vi)In accordance with the above,to shorten the duration and lessen the degree of disequilibrium in the international balances of payments of members. 六、依据以上目标,缩短会员国国际收支不平衡的时间,并减轻其程度。
The Fund shall be guided in all its policies and decisions by the purposes set forth in this Article. 基金的一切政策与决定,均应以本条所列宗旨为原则。
Article Ⅱ Membership   第二条 会员资格
Section 1 Original members 第一节 创造会员国
The original members of the Fund shall be those of the countries represented at the United Nations Monetary and Financial Conference whose governments accept membership before December 31,1945. 凡参加联合国货币和金融会议的国家,其政府在1945年12月31日前接受会员席位的,皆为创始会员国。
Section 2 Other members 第二节 其他会员国
Membership shall be open to other countries at such times and in accordance with such terms as may be prescribed by the Board of Governors.These terms,including the terms for subscriptions,shall be based on principles consistent with those applied to other countries that are already members. 其他国家的政府,依照基金理事会规定的日期和条件,这些条件包括认缴的条件,应依据适用于其他现有会员国的相同原则为基础。
Article Ⅲ Quotas and Subscriptions   第三条 基金的份额和认缴
Section 1 Quotas and payment of subscriptions 第一节 份额和认缴的支付
Each member shall be assigned a quota expressed in special drawing rights.The quotas of the members represented at the United Nations Monetary and Financial Conference which accept membership before December 31,1945 shall be those set forth in Schedule A.The quotas of other members shall be determined by the Board of Governors The subscription of each member shall be equal to its quota and shall be paid in full to the Fund at the appropriate depository. 对每一会员国将分配以特别提款权表示的份额。凡出席联合国货币和金融会议,在1945年12月31日前加入基金的会员国,其缴纳基金份额列于附录一。其它会员国的份额,由基金理事会决定。每一会员国的认缴额应等于其份额,并在适当的存款机构全部缴付给基金。
Section 2 Adjustment of quotas 第二节 份额的调整
(a)The Board of Governors shall at intervals of not more than five years conduct a general review,and if it deems it appropriate propose an adjustment,of the quotas of the members.It may also,if it thinks fit,consider at any other time the adjustment of any particular quota at the request of the member concerned. 一、基金应每隔一定时期(不超过五年)进行一次总检查,并在认为必要时,得提出调整会员国之份额。根据某一会员国的要求,基金如认为合适,也在任何其它时候考虑单独调整该国之份额。
(b)The Fund may at any time propose an increase in the quotas of those members of the Fund that were members on August 31,1975 in proportion to their quotas on that date in a cumulative amount not in excess of amounts transferred under Article V,Section 12 (f)(i)and (j)from the Special Disbursement Account to the General Resources Account. 二、基金可在任何时候提议给那些1975年8月31日已是会员的国家,按照该日它们份额比例增加份额,累计数额不超过依第五条第十二节第六、九和十款从特别支付帐户转到普通资金帐户的金额。
(c)An eighty—five percent majority of the total voting power shall be required for any change in quotas. 三、份额的任何变更,需经85%的多数票通过。
(d)The quota of a member shall not be changed until the member has consented and until payment has been made unless payment is deemed to have been made in accordance with Section 3 (b)of this Article. 四、未经会员国的同意,并出支付(除非依据本条第三节第二款可视作业已支付)不得改变该会员国的份额。
Section 3 Payments when quotas are changed 第三节 份额变更时的付款办法
(a)Each member which consents to an increase in its quota under Section 2 (a)of this Article shall,within a period determined by the Fund,pay to the Fund twenty—five percent of the increase in special drawing rights,but the Board of Governors may prescribe that this payment may be made,on the same basis for all members,in whole or in part in the currencies of other members specified,with their concurrence,by the Fund,or in the member's own currency.A non—participant shall pay in the currencies of other members specified by the Fund,with their concurrence,a proportion of the increase corresponding to the proportion to be paid in special drawing rights by participants.The balance of the increase shall be paid by the member in its own currency.The Fund's holdings of a member's currency shall not be increased above the level at which they would be subject to charges under Article V,Section 8 (b)(ii),as a result of payments by other members under this provision. 一、任何依本条第二节第一款同意增加其份额的会员国,应在基金规定的期限内以特别提款权支付增加部分中的25%,但理事会可以规定,对所有会员国一样,也可全部或部分地用基金指定的其它会员国货币(经该会员国同意)或会员国本国货币支付。未参加特别提款权帐户的会员国应用基金指定的其它会员国货币(经该会员国同意)支付所增加份额中的一定比例(相当于参与国以特别提款权支付的比例),所增加份额的其余部分以会员国本国货币支付。基金所持有的一会员国货币,不能因此项规定下其它会员国的支付而超过依第五条第八节第二款第(二)项而须支付手续费的水平。
(b)Each member which consents to an increase in its quota under Section 2 (b)of this Article shall be deemed to have paid to the Fund an amount of subscription equal to such increase. 二、依本条第二节第二款同意增加其份额的各会员国,应被视作已向基金支付相当于其增加部分的认缴额。
(c)If a member consents to a reduction in its quota,the Fund shall,within sixty days,pay to the member an amount equal to the reduction.The payment shall be made in the member's currency and in such amount of special drawing rights or the currencies of other members specified,with their concurrence,by the Fund as is necessary to prevent the reduction of the Fund's holdings of the currency below the new quota,provided that in exceptional circumstances the Fund may reduce its holdings of the currency below the new quota by payment to the member in its own currency. 三、如会员国同意减少其份额,基金应在60天内将减少的部分退回该国。基金将以会员国的货币,一定数量的特别提款权或基金指定的其它会员国货币(经该会员国同意)支付,须避免基金持有的货币减少到新份额以下,但在特殊情况下,基金可以向该会员国支付其本国货币从而使基金持有的货币减少到新的份额以下。
(d)A seventy percent majority of the total voting power shall be required for any decision under (a)above,except for the determination of a period and the specification of currencies under that provision. 四、依上述第一款所作的任何决定,除有关期限和所有货币的规定外,需要总投票权的70%的多数票通过。
Section 4 Substitution of securities for currency 第四节 用证券替代货币的办法
The Fund shall accept from any member,in place of any part of the member's currency in the General Resources Account which in the judgment of the Fund is not needed for its operations and transactions,notes or similar obligations issued by the member or the depository designated by the member under Article ⅫⅠ,Section 2,which shall be non—negotiable,non—interest bearing and payable at their face value on demand by crediting the account of the Fund in the designated depository.This Section shall apply not only to currency subscribed by members but also to any currency otherwise due to,or acquired by,the Fund and to be placed in the General Resources Account. 基金如对于一会员国所应缴于普通资金帐户的本国货币的任何部分认为在业务上不需要时,应该受该会员国或其依照第十三条第二节所指定的存款机构发行的证券或同类负债凭证作为替代。此项证券应不能转让,无利息,按票面见票即付,在指定存款机构收入基金帐户内。此节不仅适用于会员国认缴的货币,而且对任何负欠基金的货币,或基金所获得之货币亦均适用,并应存入普通资金帐户。
Article Ⅳ Obligations Regarding Exchange Arrangements   第四条 关于外汇安排的义务
Section 1 General obligations of members 第一节 会员国的一般义务
Recognizing that the essential purpose of the international monetary system is to provide a framework that facilitates the exchange of goods,services,and capital among countries,and that sustains sound economic growth,and that a principal objective is the continuing development of the orderly underlying conditions that are necessary for financial and economic stability,each member undertakes to collaborate with the Fund and other members to assure orderly exchange arrangements and to promote a stable system of exchange rates.In particular,each member shall: 鉴于国际货币制度的主要目的是提供一个便利国与国之间商品、劳务和资本的交流和保持经济健康增长的体制,鉴于主要目标是继续发展保持金融和经济稳定所必要的有秩序的基本条件,各会员国保证同基金和其它会员国进行合作,以保证有秩序的外汇安排,并促进一个稳定的汇率制度。具体说,各会员国应该:
(i)endeavor to direct its economic and financial policies toward the objective of fostering orderly economic growth with reasonable price stability,with due regard to its circumstances; (一)努力以自己的经济和金融政策来达到促进有秩序的经济增长这个目标,既有合理的价格稳定,又适当照顾自身的境况;
(ii)seek to promote stability by fostering orderly underlying economic and financial conditions and a monetary system that does not tend to produce erratic disruptions; (二)努力通过创造有秩序的基本的经济和金融条件和不会产生反常混乱的货币制度去促进稳定;
(iii)avoid manipulating exchange rates or the international monetary system in order to prevent effective balance of payments adjustment or to gain an unfair competitive advantage over other members;and (三)避免操纵汇率或国际货币制度来妨碍国际收支有效的调整或取得对其它会员国不公平的竞争优势;
(iv)follow exchange policies compatible with the undertakings under this Section. (四)奉行同本节所规定的保证不相矛盾的外汇政策。
Section 2 General exchange arrangements 第二节 总的外汇安排
(a)Each member shall notify the Fund,within thirty days after the date of the second amendment of this Agreement,of the ex.change arrangements it intends to apply in fulfillment of its obligations under Section 1 of this Article,and shall notify the Fund promptly of any changes in its exchange arrangements. 一、各会员国应在本协定第二次修改日之后30天内把它在履行本条第一节规定的义务方面打算采用的外汇安排通知基金,在外汇安排方面如有任何改变应及时通知基金。
(b)Under an international monetary system of the kind prevailing on January 1,1976,exchange arrangements may include (i)the maintenance by a member of a value for its currency in terms of the special drawing right or another denominator,other than gold,selected by the member or 二、根据1976年1月1日当时通行的国际货币制度,外汇安排可以包括:(一)一个会员国以特别提款权或选定的黄金之外的另一种共同标准,来确定本国货币的价值;
(ii)cooperative arrangements by which members maintain the value of their currencies in relation to the value of the currency or currencies of other members,or (二)通过合作安排,会员国使本国货币同其它会员国的货币保持比价关系;
(iii)other exchange arrangements of a member's choice. (三)会员国选择的其它外汇安排。
(c)To accord with the development of the international monetary system,the Fund,by an eighty—five percent majority of the total voting power,may make provision for general exchange arrangements without limiting the right of members to have exchange arrangements of their choice consistent with the purposes of the Fund and the obligations under Section 1 of this Article. 三、为适应国际货币制度的发展,基金可以总投票权85%的多数规定总的外汇安排,不限制各会员国根据基金的目的和本条第一节规定的义务选择外汇安排的权利。
Section 3 Surveillance over exchange arrangements 第三节 对外汇安排的监督
(a)The Fund shall oversee the international monetary system in order to ensure its effective operation,and shall oversee the compliance of each member with its obligations under Section 1 of this Article. 一、基金应监督国际货币制度,以保证其有效实行,应监督各会员国是否遵守本条第一节规定的义务。
(b)In order to fulfill its functions under (a)above,the Fund shall exercise firm surveillance over the exchange rate policies of members,and shall adopt specific principles for the guidance of all members with respect to those policies.Each member shall provide the Fund with the information necessary for such surveillance,and,when requested by the Fund,shall consult with it on the member's exchange rate policies.The principles adopted by the Fund shall be consistent with cooperative arrangements by which members maintain the value of their currencies in relation to the value of the currency or currencies of other members,as well as with other exchange arrangements of a member's choice consistent with the purposes of the Fund and Section 1 of this Article.These principles shall respect the domestic social and political policies of members,and in applying these principles the Fund shall pay due regard to the circumstances of members. 二、为了履行上述第一款规定的职能,基金应对各会员国的汇率政策行使严密的监督,并应制定具体原则,以在汇率政策上指导所有会员国。各会员国应该向基金提供为进行这种监督所必要的资料,在基金提出要求时,应就会员国的汇率政策问题同基金进行磋商。基金制定的原则应该符合各会员国用以确定本国货币对其他会员国货币比价的合作安排,并符合一个会员国根据基金的目的和本条第一节规定选择的其它外汇安排。这些原则应该尊重各会员国国内的社会和政治政策,在执行这些原则时,基金应该对各会员国的境况给予应有的注意。
Section 4 Par values 第四节 平价
The Fund may determine,by an eighty—five percent majority of the total voting power,that international economic conditions permit the introduction of a widespread system of exchange arrangements based on stable but adjustable par values.The Fund shall make the determination on the basis of the underlying stability of the world economy,and for this purpose shall take into account price movements and rates of expansion in the economies of members.The determination shall be made in light of the evolution of the international monetary system,with particular reference to sources of liquidity,and,in order to ensure the effective operation of a system of par values,to arrangements under which both members in surplus and members in deficit in their balances of payments take prompt,effective,and symmetrical action to achieve adjustment,as well as to arrangements for intervention and the treatment of imbalances.Upon making such determination,the Fund shall notify members that the provisions of Schedule C apply. 在国际经济条件允许的情况下,基金得以总投票权85%的多数票作出决定,实行一个在稳定但可调整的平价的基础上普遍的外汇安排制度。基金应在世界经济基本稳定的基础上作出决定,并为此目的应考虑价格变动和会员国的经济增长率。这项决定应根据国际货币制度的演变,特别是要考虑流动资金的来源,而且为了保证平价制度的有效实施,还要考虑使国际收支顺差国和逆差国都能采取迅速、有效和对称的调整行动的安排,以及对国际收支不平衡的干预和处理的安排。在作此决定时,基金应通知会员国附录的规定。
Section 5 Separate currencies within a member's territories 第五节 会员国领土内的个别货币
(a)Action by a member with respect to its currency under this Article shall be deemed to apply to the separate currencies of all territories in respect of which the member has accepted this Agreement under Article ⅩⅩⅪ,Section 2 (g)unless the member declares that its action relates either to the metropolitan currency alone,or only to one or more specified separate currencies,or to the metropolitan currency and one or more specified separate currencies. 一、会员国根据本条对本国货币采取的行动应该被认为适用于该会员国根据第三十一条第二节第七款的规定接受本协定的所有领土的个别货币,除非会员国宣布,它的行动或者是仅仅针对宗主国的货币,或者仅仅针对一种或几种特定的个别货币,或者针对宗主国的货币和一种或几种特定的个别货币。
(b)Action by the Fund under this Article shall be deemed tc relate to all currencies of a member referred to in (a)above unless the Fund declares otherwise. 二、基金根据本条采取的行动应该被认为是针对上述第一款里所提到的一个会员国的所有货币,除非基金另有具体宣布。
Article Ⅴ Operations and Transactions of the Fund   第五条 基金的业务交易
Section 1 Agencies dealing with the Fund 第一节 与基金往来的机构
Each member shall deal with the Fund only through its Treasury,central bank,stabilization fund,or other similar fiscal agency,and the Fund shall deal only with or through the same agencies. 各会员国应由基金财政部、中央银行、平准基金会或其它类似的财政机关与基金往来,基金也只经由这些机关与会员国往来。
Section 2 Limitation on the Fund's operations and transactions 第二节 基金的业务范围
(a)Except as otherwise provided in this Agreement,transactions on the account of the Fund shall be limited to transactions for the purpose of supplying a member,on the initiative of such member,with special drawing rights or the currencies of other members from the general resources of the Fund,which shall be held in the General Resources Account,in exchange for the currency of the member desiring to make the purchase. 一、除本协定另有规定外,基金的业务限于经会员国请求,以该国货币向基金普通资金帐户上的普通资金中购买特别提款权或其它会员国货币。
(b)If requested,the Fund may decide to perform financial and technical services,including the administration of resources contributed by members,that are consistent with the purposes of the Fund.Operations involved in the performance of such financial services shall not be on the account of the Fund.Services under this subsection shall not impose any obligation on a member without its consent. 二、如经请求,基金可决定提供符合于基金宗旨的金融和技术服务,包括对会员国所缴资金的管理。在提供此项金融服务所涉及的业务不属基金业务。在此分节项下的服务未经会员国同意不能加给其任何义务。
Section 3 Conditions governing use of the Fund's general resources 第三节 使用基金普通资金的条件
(a)The Fund shall adopt policies on the use of its general resources,including policies on stand—by or similar arrangements,and may adopt special policies for special balance of payments problems,that will assist members to solve their balance of payments problems in a manner consistent with the provisions of this Agreement and that will establish adequate safeguards for the temporary use of the general resources of the Fund. 一、基金应对使用其普通资金,包括对备用安排或类似的安排制定出政策,也可对特殊的国际收支问题制定特殊的政策,以便协助会员国按照符合于基金宗旨的一定方式来解决其国际收支问题,并对暂时使用基金资金作出充分保障。
(b)A member shall be entitled to purchase the currencies of other members from the Fund in exchange for an equivalent amount of its own currency subject to the following conditions: 二、在下列条件下会员国得以本国相当数额的货币向基金购买其它会员国货币。
(i)the member's use of the general resources of the Fund would be in accordance with the provisions of this Agreement and the policies adopted under them; (一)会员国应根据本协定的规定及依该规定所制定的政策使用基金的普通资金。
(ii)the member represents that it has a need to make the purchase because of its balance of payments or its reserve position or developments in its reserves; (二)会员国应以其国际收支,储备状况或其储备变化等为理由提出购买的需要。
(iii)the proposed purchase would be a reserve tranche purchase,or would not cause the Fund's holdings of the purchasing member's currency to exceed two hundred percent of its quota; (三)请购的数额系指在储备部分额度内的购买,或不致使基金所持有的购买国的货币超过其份额的200%。
(iv)the Fund has not previously declared under Section 5 of this Article,Article Ⅵ,Section 1,or Article ⅩⅩⅥ,Section 2 (a)that the member desiring to purchase is ineligible to use the general resources of the Fund. (四)基金在以前并未根据本条第五节、第六条第一节以及第二十六条第二节第一款宣布过,该请购会员国已无资格使用基金的普通资金。
(c)The Fund shall examine a request for a purchase to determine whether the proposed purchase would be consistent with the provisions of this Agreement and the policies adopted under them,provided that requests for reserve tranche purchases shall not be subject to challenge. 三、基金应审查此项请购是否符合本协定的规定以及根据该规定所制定的政策。但会员国申请在储备部分额度的购买不须受审查。
(d)The Fund shall adopt policies and procedures on the selection of currencies to be sold that take into account,in consultation with members,the balance of payments and reserve position of members and developments in the exchange markets,as well as the desirability of promoting over time balanced positions in the Fund,provided that if a member represents that it is proposing to purchase the currency of another member because the purchasing member wishes to obtain an equivalent amount of its own currency offered by the other member,it shall be entitled to purchase the currency of the other member unless the Fund has given notice under Article Ⅶ,Section 3 that its holdings of the currency have become scarce. 四、基金应制定有关选择所出售货币的政策和程序,要同会员国磋商,考虑到会员国的国际收支、储备状况、外汇市场的变化,以及在一段时间内改进在基金中的平衡地位的要求。假如一个会员国提出购买另一会员国的货币是因为希望获得其它会员国提供的相等数量的本国货币,该会员国应有权购买其它会员国的货币,除非基金按第七条第三节已通知其持有的货币已经稀少。
(e)(i)Each member shall ensure that balances of its currency purchased from the Fund are balances of a freely usable currency or can be exchanged at the time of purchase for a freely usable currency of its choice at an exchange rate between the two currencies equivalent to the exchange rate between them on the basis of Article ⅩⅨ,Section7 (a). 五、(一)每个会员国应保证,从基金购买的其货币额是可以自由使用货币额或在购买时可以兑换成其选择的一种自由使用货币。两种货币间兑换使用的汇率等于按第十九条第七节第一款两者间的汇率。
(ii)Each member whose currency is purchased from the Fund or is obtained in exchange for currency purchased from the Fund shall collaborate with the Fund and other members to enable such balances of its currency to be exchanged,at the time of purchase,for the freely usable currencies of other members. (二)每个会员国,其货币被从基金所购买,或者货币是被从基金购买的货币所换得,应和基金及其它会员国工作,从而使它的这些货币额在购买时能够兑换成其它会员国的可自由使用的货币。
(iii)An exchange under (i)above of a currency that is not freely usable shall be made by the member whose currency is purchased unless that member and the purchasing member agree on another procedure. (三)如按照上述第(一)项所购的是一种不能自由使用货币,应由其货币被购买的会员国进行兑换,除非该会员国和购买会员国同意采用另一种办法。
(iv)A member purchasing from the Fund the freely usable currency of another member and wishing to exchange it at the time of purchase for another freely usable currency shall make the exchange with the other member if requested by that member.The exchange shall be made for a freely usable currency selected by the other member at the rate of exchange referred to in (i)above. (四)如一会员国从基金购买另一会员国的可自由使用货币,并希望在购买时兑换成另一种可自由使用货币,在该会员国的要求下应与另一会员国作出兑换。应按另一会员国选择的可自由使用货币进行兑换,汇率按照上述第(一)项的规定。
(f)Under policies and procedures which it shall adopt,the Fund may agree to provide a participant making a purchase in accordance with this Section with special drawing rights instead of the currencies of other members. 六、基金应按制定的政策和程序,可同意按照本节规定提供给请购的参与国以特别提款权,而不是其它会员国货币。
Section 4 Waiver of conditions 第四节 放弃条件的办法
The Fund may in its discretion,and on terms which safeguard its interests,waive any of the conditions prescribed in Section 3 (b)(iii)and (iv)of this Article,especially in the case of members with a record of avoiding large or continuous use of the Fund's general resources.In making a waiver it shall take into consideration periodic or exceptional requirements of the member requesting the waiver.The Fund shall also take into consideration a member's willingness to pledge as collateral security acceptable assets having a value sufficient in the opinion of the Fund to protect its interests and may require as a condition of waiver the pledge of such collateral security. 基金得在保障本身利益的条件下,酌情放弃本条第三节第二款第(三)和(四)款所列的任何条件,特别是对过去一向不多用或不经常用基金普通资金的会员国。在放弃此项条件时,基金应考虑该申请国的周期性的或特殊的需要。基金并应考虑该国愿否提供基金认为是以保障其利益的可接受的资产作为担保,基金得要求提供此种担保作为放弃上述条件的交换条件。
Section 5 Ineligibility to use the Fund's general resources 第五节 使用基金普通资金资格的丧失
Whenever the Fund is of the opinion that any member is using the general resources of the Fund in a manner contrary to the purposes of the Fund,it shall present to the member a report setting forth the views of the Fund and prescribing a suitable time for reply.After presenting such a report to a member,the Fund may limit the use of its general resources by the member.If no reply to the report is received from the member within the prescribed time,or if the reply received is unsatisfactory,the Fund may continue to limit the member's use of the general resources of the Fund or may,after giving reasonable notice to the member,declare it ineligible to use the general resources of the Fund. 当基金认为任何会员国使用基金普通资金的方式违反基金的宗旨时,即应向该国提出报告,阐明基金的意见,并规定一答复的适当期限。在提出报告后,基金可限制该国使用基金的普通资金。如在规定期限内该会员国对于基金的执行不予答复,或者答复不能令人满意,基金得继续限制其使用基金的普通资金,或者在给予该会员国适当的通知后,宣告该会员国丧失使用基金普通资金的资格。
Section 6 Other purchases and sales of special drawing rights by the Fund 第六节 基金对特别提款权的其它购买和出售
(a)The Fund may accept special drawing rights offered by a participant in exchange for an equivalent amount of the currencies of other members. 一、基金可接受参与国提供的特别提款权,兑换给相等金额的其它会员国货币。
(b)The Fund may provide a participant,at its request,with special drawing rights for an equivalent amount of the currencies of other members.The Fund's holdings of a member's currency shall not be increased as a result of these transactions above the level at which the holdings would be subject to charges under Section 8 (b)(ii)of this Article. 二、在参与国的要求下,基金可提供给该国的特别提款权换回相等金额的其它会员国货币基金持有的会员国货币不能由于这些交易的结果而增加到超过本条第八节第二款第(二)项所规定要征收手续费的水平。
(c)The currencies provided or accepted by the Fund under this Section shall be selected in accordance with policies that take into account the principles of Section 3 (d)or 7 (i)of this Article.The Fund may enter into transactions under this Section only if a member whose currency is provided or accepted by the Fund concurs in that use of its currency. 三、基金按本节所提供或接受的货币应按照政策,考虑到本条第三节第四款或第七节第九款的原则,进行选择。只有在基金提供或接受的会员国货币,得到该会员国同意使用时,基金才能按此节进行交易。
Section 7 Repurchase by a member of its currency held by the Fund 第七节 会员国向基金购回本国货币的办法
(a)A member shall be entitled to repurchase at any time the Fund's holdings of its currency that are subject to Charges under Section 8 (b)of this Article. 一、会员国在任何时候有权购回基金所持有的该国货币额中按本条第八节第二款的规定要征收手续费的部分。
(b)A member that has made a purchase under Section 3 of this Article will be expected normally,as its balance of payments and reserve position improves,to repurchase the Fund's holdings of its currency that result from the purchase and are subject to charges under Section 8 (b)of this Article.A member shall repurchase these holdings if,in accordance with policies on repurchase that the Fund shall adopt and after consultation with the member,the Fund represents to the member that it should repurchase because of an improvement in its balance of payments and reserve position. 二、按本条第三节已进行购买的会员国,由于其国际收支和储备状况有所改善时,一般情况应购回因购买而被基金所持有的该国货币额中按本条第八节第二款规定要征收手续费的部分。假如根据基金制定的购回政策并在与会员国磋商后,基金向该会员国提出,由于其国际收支和储备状况有所改善而应该购回时,会员国应购回基金持有的这些货币。
(c)A member that has made a purchase under Section 3 of this Article shall repurchase the Fund' s holdings of its currency that result from the purchase and are subject to charges under Section 8 (b)of this Article not later than five years after the date on which the purchase was made.The Fund may prescribe that repurchase shall be made by a member in installments during the period beginning three years and ending five years after the date of a purchase.The Fund,by an eighty—five percent majority of the total voting power,may change the periods for repurchase under this subsection,and any period so adopted shall apply to all members. 三、按本条第三节已进行购买的会员国,应在不超过自购买之日后的五年内,购回因购买而被基金所持有的该国货币额中按本条第八节第二款的规定要征收手续费的部分。基金可以规定会员国应从购买之日后三年起到五年止的期限内分期作出购回。基金可以总投票权85%的多数票改变本分节定的购回期限。由此而规定的期限将适用于所有会员国。
(d)The Fund,by an eighty—five percent majority of the total voting power,may adopt periods other than those that apply in accordance with (c)above,which shall be the same for all members,for the repurchase of holdings of currency acquired by the Fund pursuant to a special policy on the use of its general resources. 四、基金可以总投票权85%的多数票规定一个不同于上述第三款而适用于所有会员国的购回期限,购回依据使用基金普通资金的特殊政策而使基金持有的货币。
(e)A member shall repurchase,in accordance with policies that the Fund shall adopt by a seventy percent majority of the total voting power,the Fund's holdings of its currency that are not acquired as a result of purchases and are subject to charges under Section 8 (b)(ii)of this Article. 五、会员国应根据基金以总投票权70%多数票通过的政策,购回基金所持有的该国货币,基金持有的这些货币不是因购买的结果,但按本条第八节第二款第(二)项的规定属于要征收手续费的部分。
(f)A decision prescribing that under a policy on the use of the general resources of the Fund the period for repurchase under(c)or(d)above shall be shorter than the one in effect under the policy shall apply only to holdings acquired by the Fund subsequent to the effective date of the decision. 六、如果作出决定,规定按使用基金普通资金的政策,在上述第三或第四款项下购回期限应比按政策执行中的期限减短,则该决定应仅适用于该决定生效之日后基金所得的持有额。
(g)The Fund,on the request of a member,may postpone the date of discharge of a repurchase obligation,but not beyond the maximum period under (c)or (d)above or under policies adopted by the Fund under (e)above,unless the Fund determines,by a seventy percent majority of the total voting power,that a longer period for repurchase which is consistent with the temporary use of the general resources of the Fund is justified because discharge on the due date would result in exceptional hardship for the member. 七、在会员国的要求下,基金可以延缓购回义务的日期,但不能超过上述第三或第四款项下的或依上述第五款基金规定政策下的最长期限。除非经基金以总投票权70%的多数票决定,由于在规定日期偿还会给会员国造成额外的困难,因而延长购回(该项购回符合于暂时性使用基金普通资金)的期限是合理的。
(h)The Fund's policies under Section 3 (d)of this Article may be supplemented by policies under which the Fund may decide after consultation with a member to sell under Section 3 (b)of this Article its holdings of the member' s currency that have not been repurchased in accordance with this Section 7,without prejudice to any action that the Fund may be authorized to take under any other provision of this Agreement. 八、本条第三节第四款的基金政策,可以通过政策加以补充,即基金在和会员国磋商后,可以决定按本条第三节第二款出售基金所持有的、尚未根据第七节购回的该会员国货币不妨碍基金按本协定其它规定所允许基金采取的任何行动。
(i)All repurchases under this Section shall be made with special drawing rights or with the currencies of other members specified by the Fund.The Fund shall adopt policies and procedures with regard to the currencies to be used by members in making repurchases that take into account the principles in Section 3 (d)of this Article.The Fund' holdings of a member's currency that is used in repurchase shall not be increased by the repurchase above the level at which they would be subject to charges under Section 8 (b)(ii)of this Article. 九、所有依本节所作的购回,应使用特别提款权或基金指定的其它会员国货币。基金在制定会员国进行购回所需使用货币的政策和程序时,应考虑本条第三节第四款的原则。基金所持有的被用于购回的会员国货币,不能由于购回而增加到高出依本条第八节第二款第(二)项规定要征收手续费的水平。
(j)(i)If a member's currency specified by the Fund under (i)above is not a freely usable currency,the member shall ensure that the repurchasing member can obtain it at the time of the repurchase in exchange for a freely usable currency selected by the member whose currency has been specified.An exchange of currency under this provision shall take place at an exchange rate between the two currencies equivalent to the exchange rate between them on the basis of Article ⅪⅩ,Section 7 (a). 十、(一)假如按上述第(一)项基金所指定的会员国货币不是自由使用货币,该会员国应保证进行购回的会员国在进行购回时可以它兑换成被指定货币的会员国所选择的自由使用货币。在此规定下的两种货币间兑换的汇率应等于按第十九条第七节第一款两者间的汇率。
(ii)Each member whose currency is specified by the Fund for repurchase shall collaborate with the Fund and other members to enable repurchasing members,at the time of the repurchase,to obtain the specified currency in exchange for the freely usable currencies of other members. (二)每个会员国,其货币被基金指定用作购回的,应和基金及其它会员国合作,从而使进行购回的会员国在购回时,能用获得的指定货币,兑换成其它会员国的自由使用货币。
(iii)An exchange under (j)(i)above shall be made with the member whose currency is specified unless that member and the repurchasing member agree on another procedure. (三)上述第十款第(一)项下的兑换,应与被指定货币的会员国进行,除非该会员国和购回国间同意按另外的程序进行。
(iv)If a repurchasing member wishes to obtain,at the time of the repurchase,the freely usable currency of another member specified by the Fund under (i)above,it shall,if requested by the other member,obtain the currency from the other member in exchange for a freely usable currency at the rate of exchange referred to in(j) (i)above.The Fund may adopt regulations on the freely usable currency to be provided in an exchange. (四)假如进行购回的会员国在购回时,希望获得基金按上述第一项所指定的其它会员国的自由使用货币,如其它会员国要求,它应按上述第十款第(一)项所提到的汇率,以可自由使用的货币,从其它会员国换得货币。基金可以在兑换时提供自由使用货币问题制定规章。
Section 8 Charges 第八节 手续费
(a)(i)The Fund shall levy a service charge on the purchase by a member of special drawing rights or the currency of another member held in the General Resources Account in exchange for its own currency,provided that the Fund may levy a lower service charge on reserve tranche purchases than on other purchases.The service charge on reserve tranche purchases shall not exceed one—half of one percent. 一、(一)基金对会员国用本国货币换购特别提款权或其它会员国货币应征收手续费,对储备部分额度的购买可比其它部分的购买征收较低的手续费,购买储备部分的手续费不能超过0.5%。
(ii)The Fund may levy a charge for stand—by or similar arrangements.The Fund may decide that the charge for an arrangement shall be offset against the service charge levied under (i)above on purchases under the arrangement. (二)基金对备用安排或类似的安排征收手续费。基金可以决定,安排的手续费应抵销按上述第(一)项对该安排项下的购买所征收的手续费。
(b)The Fund shall levy charges on its average daily balances of a member's currency held in the General Resources Account to the extent that they 二、基金对在普通资金帐户持有的每一会员国货币的每日平均余额在以下情况下征收手续费,该货币是:
(i)have been acquired under a policy that has been the subject of an exclusion under Article ⅩⅩⅩ (c),or (一)属按第三十条第三款项下列作不包括项目的某项政策所获得者:
(ii)exceed the amount of the member's quota after excluding any balances referred to in (i)above. (二)在除去上述第(一)项所提及的任何余额后超过了会员国持有份额的数额。
The rates of charge normally shall rise at intervals during the period in which the balances are held. 在持有余额期间,手续费率应每隔一定时间而增高。
(c)If a member fails to make a repurchase required under Section 7 of this Article,the Fund,after consultation with the member on the reduction of the Fund's holdings of its currency,may impose such charges as the Fund deems appropriate on its holdings of the member's currency that should have been repurchased. 三、假如会员国不能按本条第七节所要求的进行购回,基金在和会员国就减少基金所持有的其货币进行磋商后,可对其所持有的、应当购回的该会员国货币征收基金认为合适的手续费。
(d)A seventy percent majority of the total voting power shall be required for the determination of the rates of charge under (a)and (b)above,which shall be uniform for all members,and under (c)above. 四、应有总投票权70%的多数票来决定上述第一和第二款项下的手续费率,它应对所有会员国一致,上述第三款亦同。
(e)A member shall pay all charges in special drawing rights,provided that in exceptional circumstances the Fund may permit a member to pay charges in the currencies of other members specified by the Fund,after consultation with them,or in its own currency.The Fund's holdings of a member's currency shall not be increased as a result of payments by other members under this provision above the level at which they would be subject to charges under(b)(ii)above. 五、会员国应以特别提款权支付所有的手续费,只有在特殊情况下,在基金与其它会员国磋商后,基金可允许该会员国以基金指定的其它会员国货币支付手续费,或者用本国货币。基金所持有的会员国的货币,不能因在此规定下其它会员国的支付结果而增加到超过依上述第二款第(二)项规定要征收手续费的水平。
Section 9 Remuneration 第九节 酬金
(a)The Fund shall pay remuneration on the amount by which the percentage of quota prescribed under (b)or (c)below exceeds the Fund's average daily balances of a member's currency held in the General Resources Account other than balances acquired under a policy that has been the subject of an exclusion under Article ⅩⅩⅩ (c).The rate of remuneration,which shall be determined by the Fund by a seventy percent majority of the total voting power,shall be the same for all members and shall be not more than,nor less than four—fifths of,the rate of interest under Article ⅩⅩ,Section 3.In establishing the rate of remuneration,the Fund shall take into account the rates of charge under Article V,Section 8 (b). 一、当下述第二或第三款所规定的份额比例超过基金普通资金帐户所持有的会员国货币的每日平均余额(不包括按第三十条第三款项下列作不包括项目的政策所获得的余额),基金应付给酬金。酬金率应由基金按总投票权70%的多数票决定。对所有会员国均相同,并应不高于或低于第二十条第三节所定利率的4/5。在制定酬金率时,基金应考虑到第五条第八节第二款项下的手续费率。
(b)The percentage of quota applying for the purposes of (a)above shall be: 二、适用于上述第一款的目的的份额比例如下:
(i)for each member that became a member before the second amendment of this Agreement,a percentage of quota corresponding to seventy—five percent of its quota on the date of the second amendment of this Agreement,and for each member that became a member after the date of the second amendment of this Agreement,a percentage of quota calculated by dividing the total of the amounts corresponding to the percentages of quota that apply to the other members on the date on which the member became a member by the total of the quotas of the other members on the same date;plus (一)对第二次修改协定前成为会员国的国家,此项份额比例应相当于第二次修改协定之日其份额的75%,对第二次修改协定后成为会员国的,其份额比例的计算是:用相当于该国成为会员国当日适用于其它会员国的份额比例的总金额除以同日其它会员国的总份额;加上:
(ii)the amounts it has paid to the Fund in currency or special drawing rights under Article Ⅲ,Section 3 (a)since the date applicable under (b)(i)above;and minus (二)会员国自上述第二款第(一)项中适用的日期起,按第三条第三节第一款以货币或特别提款权支付给基金的数额,减去:
(iii)the amounts it has received from the Fund in currency or special drawing rights under Article Ⅲ,Section 3(c)since the date applicable under (b)(i)above. (三)会员国自上述第二款第(一)项中适用的日期起,按第三条第三节第三款从基金所得到的货币或特别提款权的数额。
(c)The Fund,by a seventy percent majority of the total voting power,may raise the latest percentage of quota applying for the purposes of (a)above to each member to: 三、经总投票权70%的多数票通过,基金可以对每个会员国将适用于上述第一款的最新份额比例提高到:
(i)a percentage,not in excess of one hundred percent,that shall be determined for each member on the basis of the same criteria for all members,or (一)不超过100%的某一比例,对每个会员国应根据对所有会员国同样的准则来决定,或
(ii)one hundred percent for all members. (二)所有会员国均为100%。
(d)Remuneration shall be paid in special drawing rights,provided that either the Fund or the member may decide that the payment to the member shall be made in its own currency. 四、酬金应以特别提款权支付,除非基金或会员国决定以本国货币支付给会员国。
Section 10 Computations 第十节 计算
(a)The value of the Fund's assets held in the accounts of the General Department shall be expressed in terms of the special drawing right. 一、基金在普通帐户所持有的资产价值以特别提款权表示。
(b)All computations relating to currencies of members for the purpose of applying the provisions of this Agreement,except Article Ⅳ and Schedule C,shall be at the rates at which the Fund accounts for these currencies in accordance with Section 11 of this Article. 二、适用于本协定规定的有关会员国货币的计算,除第四条和附录三外,均应按照本条第十一节基金计算这些货币的汇率。
(c)Computations for the determination of amounts of currency in relation to quota for the purpose of applying the provisions of this Agreement shall not include currency held in the Special Disbursement Account or in the Investment Account. 三、为实行本协定规定,确定有关份额的货币金额计算,不应将特别支付帐户或投资帐户的货币包括在内。
Section 11 Maintenance of value 第十一节 价值的维持
(a)The value of the currencies of members held in the General Resources Account shall be maintained in terms of the special drawing right in accordance with exchange rates under Article ⅪⅩ,Section 7 (a). 一、在普通资金帐户的会员国货币的价值,应依第十九条第七节第一款汇率折成特别提款权表示。
(b)An adjustment in the Fund's holdings of a member's currency pursuant to this Section shall be made on the occasion of the use of that currency in an operation or transaction between the Fund and another member and at such other times as the Fund may decide or the member may request.Payments to or by the Fund in respect of an adjustment shall be made within a reasonable time,as determined by the Fund,after the date of adjustment,and at any other time requested by the member. 二、基金按照本节变更其所持有的某会员国的货币额,应在基金和其它会员国进行业务活动中使用那种货币时进行,也可在基金决定的或会员国要求的其它时候进行。因变更而须向基金的支付,或基金向会员国的支付,应在变更之日后由基金决定的一个合理期限内进行,或在会员国要求的任何其它时候进行。
Section 12 Other operations and transactions 第十二节 其它业务交易
(a)The Fund shall be guided in all its policies and decisions under this Section by the objectives set forth in Article Ⅷ,Section 7 and by the objective of avoiding the management of the price,or the establishment of a fixed price,in the gold market. 一、基金在此节下的所有政策和决定,应遵守第八条第七节所规定的目标,和避免在黄金市场上管理价格或制订固定价格的目标。
(b)Decisions of the Fund to engage in operations or transactions under (c),(d),and (e)below shall be made by an eighty—five percent majority of the total voting power. 二、基金按下述第三、四款和第五款进行业务活动的决定,应经总投票权85%的多数票同意。
(c)The Fund may sell gold for the currency of any member after consulting the member for whose currency the gold is sold,provided that the Fund's holdings of a member's currency held in the General Resources Account shall not be increased by the sale above the level at which they would be subject to charges under Section 8(b)(ii)of this Article without the concurrence of the member,and provided that,at the request of the member,the Fund at the time of sale shall exchange for the currency of another member such part of the currency received as:would prevent such an increase.The exchange of a currency for the currency of another member shall be made after consultation with that member,and shall not increase the Fund's holdings of that member's currency above the level at which they would be subject to charges under Section 8 (b)(ii)of this Article.The Fund shall adopt policies and procedures with regard to exchanges that take into account the principles applied under Section 7 (i)of this Article.Sales under this provision to a member shall be at a price agreed for each transaction on the basis of prices in the market. 三、基金在经该会员国磋商后,可以出售黄金换取该会员国的货币,但未经该会员国同意,不能因此项出售而使在普通资金帐户里基金所持有的该会员国的货币增加到超过本条第八节第二款第(二)项所规定要征收手续费的水平;但经会员国的要求,基金在出售时,将一部分兑换另一会员国的货币,所换的这部分可以防止这种增加。以一种货币兑换成另一会员国的货币,须经和该会员国协商后进行,并不得使基金持有的该会员国的货币增加到超过本条第八节第二款第(二)项规定要征收手续费的水平。基金在制定有关兑换的政策和程序时应考虑到本条第七节第九款所用的原则。依本协定向一会员国的出售,应按照每笔交易双方根据市场价格所协议的价格。
(d)The Fund may accept payments from a member in gold instead of special drawing rights or currency in any operations or transactions under this Agreement.Payments to the Fund under this provision shall be at a price agreed for each operation or transaction on the basis of prices in the market. 四、在基金按本协定进行的任何业务活动中,可以从会员国接受黄金,以代替特别提款权或货币。依本规定向基金的支付,应按照每笔业务交易双方根据在市场价格所协议的价格。
(e)The Fund may sell gold held by it on the date of the second amendment of this Agreement to those members that were members on August 31,1975 and that agree to buy it,in proportion to their quotas on that date.If the Fund intends to sell gold under (c)above for the purpose of (f)(ii)below,it may sell to each developing member that agrees to buy it that portion of the gold which,if sold under (c)above,would have produced the excess that could have been distributed to it under(f)(iii)below.The gold that would be sold under this provision to a member that has been declared ineligible to use the general resources of the Fund under Section 5 of this Article shall be sold to it when the ineligibility ceases,unless the Fund decides to make the sale sooner.The sale of gold to a member under this subsection (e)shall be made in exchange for its currency and at a price equivalent at the time of sale to one special drawing right per 0.888 671 gram of fine gold. 五、基金可将在本协定第二次修改之日持有的黄金出售给在1975年8月31日已经参加并且同意购买的会员国,并按这一天会员国份额所定的比例售给。假如基金打算为上述第六款第(二)项的目的而依据上述第三款出售黄金,可出售该部分黄金给同意购买的各发展中会员国,该部分黄金如依上述第三款出售会造成有多余,可按下述第六款第(三)项分配给会员国。按此规定出售黄金给按本条第五节宣布为无资格使用基金普通资金会员国,应在其恢复资格时再售给,除非基金决定提前售给。依本分节第五款出售给会员国的黄金应收取该会员国的货币,并按出售时以一特别提款权合0.888671克纯黄金等值的价格。
(f)Whenever under (c)above the Fund sells gold held by it on the date of the second amendment of this Agreement,an amount of the proceeds equivalent at the time of sale to one special drawing fight per 0.888 671 gram of fine gold shall be placed in the General Resources Account and,except as the Fund may decide otherwise under (g)below,any excess shall be held in the Special Disbursement Account.The assets held in the Special Disbursement Account shall be held separately from the other accounts of the General Department,and may be used at any time: 六、黄金依上述第三款在任何时候出售其在第二次协定修改之日所持有的黄金时,应把出售收入按出售时以一特别提款权合0.888671克纯黄金等值存入普通资金帐户。除非基金按下述第七款决定用另外办法,任何多余部分应存于特别支付帐户。在特别支付帐户所持有的资产应和普通帐户的其它帐户分开,并可在任何时候使用于:
(i)to make transfers to the General Resources Account for immediate use in operations and transactions authorized by provisions of this Agreement other than this Section; (一)转入普通资金帐户,作本协定规定认可的、除本节以外的业务活动中立即使用。
(ii)for operations and transactions that are not authorized by other provisions of this Agreement but are consistent with the purposes of the Fund.Under this subsection(f)(ii)balance of payments assistance may be made available on special terms to developing members in difficult circumstances,and for this purpose the'Fund shall take into account the level of per capita income; (二)虽非本协定其它规定认可但符合基金宗旨的业务活动。在本分节第六款第(二)项下,对处于困境的发展中会员国可按特别的条件提供给国际收支上的援助。为此目的,基金应考虑到平均国民收入的水平。
(iii)for distribution to those developing members that were members on August 31,1975,in proportion to their quotas on that date,of such part of the assets that the Fund decides to use for the purposes of(ii)above as corresponds to the proportion of the quotas of these members on the date of distribution to the total of the quotas of all members on the same date,provided that the distribution under this provision to a member that has been declared ineligible to use the general resources of the Fund under Section 5 of this Article shall be made when the ineligibility ceases,unless the Fund decides to make the distribution sooner.Decisions to use assets pursuant to (i)above shall be taken by a seventy percent majority of the total voting power,and decisions pursuant to (ii)and (iii)above shall be taken by an eighty—five percent majority of the total voting power. (三)对1975年8月31日为会员国的发展中会员国按其在这一天的份额的比例进行分配。基金按上述第(二)项的目的决定使用的资产部分,相当于这些会员国在分配之日的份额与同日所有会员国份额总数的比例。但依本规定对于按本条第五节宣布为无资格使用普通资金的会员国的分配,应在其资格恢复后才能进行,除非基金决定提前给予分配。按上述第(一)项使用资产的决定须经总投票权70%的多数通过,按上述第(二)项、第(三)项所作的决定须经总投票权的85%多数票通过。
(g)The Fund may decide,by an eighty—five percent majority of the total voting power,to transfer a part of the excess referred to in (f)above to the Investment Account for use pursuant to the provisions of Article Ⅻ,Section 6 (f). 七、基金可经总投票权85%的多数票决定,将上述第六款提及的部分剩余额转入投资帐户,按第十二条第六节第六款的规定使用。
(h)Pending uses specified under (f)above,the Fund may invest a member's currency held in the Special Disbursement Account in marketable obligations of that member or in marketable obligations of international financial organizations.The income of investment and interest received under(f)(ii)above shall be placed in the Special Disbursement Account.No investment shall be made without the concurrence of the member whose currency is used to make the investment.The Fund shall invest only in obligations denominated in special drawing fights or in the currency used for investment. 八、在按上述第六款规定未使用期间,基金可将在特别支付帐户持有的会员国货币投资于该会员国的可销售的债务,或国际金融机构的可销售债务,按上述第六款第(二)项所得到的投资和利息收入应存入特别支付帐户。未经其货币被用于投资的会员国同意,不得进行该项投资。基金只能对以特别提款权或用作投资的货币为单位的债务进行投资。
(i)The General Resources Account shall be reimbursed from time to time in respect of the expenses of administration of the Special Disbursement Account paid from the General Resources Account by transfers from the Special Disbursement Account on the basis of a reasonable estimate of such expenses. 九、从普通资金帐户支付的,有关特别支付帐户的行政管理费用,应不时地得到偿还,根据对此项费用合理的估计数,从特别支付帐户转拨到普通资金帐户内。
(j)The Special Disbursement Account shall be terminated in the event of the liquidation of the Fund and may be terminated prior to liquidation of the Fund by a seventy percent majority of the total voting power.Upon termination of the account because of the liquidation of the Fund,any assets in this account shall be distributed in accordance with the provisions of Schedule K.Upon termination prior to liquidation of the Fund,any assets in this account shall be transferred to the General Resources Account for immediate use in operations and transactions.The Fund,by a seventy percent majority of the total voting power,shall adopt rules and regulations for the administration of the Special Disbursement Account. 十、特别支付帐户应在基金清理时终止,并可经总投票权70%多数票在基金清理前终止。由于基金清理该帐户终止时,对该帐户内的任何资产应根据附录十一的规定予以分配。在基金清理前该帐户终止时,该帐户内的任何资产应转到普通资产帐户,在业务活动中立即使用。经总投票权70%的多数票通过,基金可对特别支付帐户的管理制定出规章和条例。
Article Ⅵ Capital Transfers   第六条 资本转移
Section 1 Use of the Fund's general resources for capital transfers 第一节 使用基金资金作资本转移的规定
(a)A member may not use the Fund's general resources to meet a large or sustained outflow of capital except as provided in Section 2 of this Article,and the Fund may request a member to exercise controls to prevent such use of the general resources of the Fund.If,after receiving such a request,a member fails to exercise appropriate controls,the Fund may declare the member ineligible to use the general resources of the Fund. 一、除本条第二节规定的情况外,会员国不得使用基金普通资金作为大量或长期的资金输出之用。基金可以要求会员国实行管制,以防止对基金普通资金作如此使用。如会员国接到此项要求后不采取适当管制,基金可以宣布该会员国无资格使用基金资金。
(b)Nothing in this Section shall be deemed: 二、本节规定不限制下列情况:
(i)to prevent the use of the general resources of the Fund for capital transactions of reasonable amount required for the expansion of exports or in the ordinary course of trade,banking,or other business;or (一)会员国为了扩大出口或进行正常贸易,金融业或其它业务使用基金普通资金作必需的合理数额资本交易。
(ii)to affect capital movements which are met out of a member's own resources,but members undertake that such capital movements will be in accordance with the purposes of the Fund. (二)会员国使用其自有资金作符合基金宗旨的资本移动。
Section 2 Special provisions for capital transfers 第二节 资本转移的特殊规定
A member shall be entitled to make reserve tranche purchases to meet capital transfers. 会员国可以在储备部分额度内购买货币,作为资本转移之用。
Section 3 Controls of capital transfers 第三节 资本转移的管制
Members may exercise such controls as are necessary to regulate international capital movements,but no member may exercise these controls in a manner which will restrict payments for current transactions or which will unduly delay transfers of funds in settlement of commitments,except as provided in Article Ⅶ,Section 3 (b)and in Article ⅪⅤ,Section 2. 会员国对国际资本转移得采取必要的管制,但这种管制,除第七条第三节第二款及第十四条第二节规定者外,不得限制日常交易的支付或者不适当地阻滞清偿债务的资金转移。
Article Ⅶ Replenishment and Scarce Currencies   第七条 补充货币和稀少货币
Section 1 Measures to replenish the Fund's holdings of currencies 第一节 基金补进货币的办法
The Fund may,if it deems such action appropriate to replenish its holdings of any member's currency in the General Resources Account needed in connection with its transactions,take either or both of the following steps: 基金认为有补进普通资金帐户中有关业务所需某种会员国货币的需要时,得采取下列措施之一,或两者同时采取:
(i)propose to the member that,on terms and conditions agreed between the Fund and the member,the latter lend its currency to the Fund or that,with the concurrence of the member,the Fund borrow such currency from some other source either within or outside the territories of the member,but no member shall be under any obligation to make such loans to the Fund or to concur in the borrowing of its currency by the Fund from any other source; (一)在基金与该会员国协议的期限和条件下,向该会员国提议借入稀少货币,或经该国同意,向境内或境外的其他来源借入稀少货币。但该会员国并无出借货币给基金或同意基金向其他来源借入的任何义务。
(ii)require the member,if it is a participant,to sell its currency to the Fund for special drawing rights held in the General Resources Account,subject to Article ⅪⅩ,Section 4.In replenishing with special drawing rights,the Fund shall pay due regard to the principles of designation under Article ⅪⅩ,Section 5. (二)要求会员国(如该会员国是参与国)将其货币出售给基金,换回在普通资金帐户持有的特别提款权,并遵守第十九条第四节的规定。在以特别提款权补充时,基金应适当注意第十九条第五节指定参与国的原则。
Section 2 General scarcity of currency 第二节 货币的普遍稀少
If the Fund finds that a general scarcity of a particular currency is developing,the Fund may so inform members and may issue a report setting forth the causes of the scarcity :rod containing recommendations designed to bring it to an end.A representative of the member whose currency is involved shall participate in the preparation of the report. 基金如发现某种货币发生普遍稀少情形在发展时,应即通告各会员国,并提出报告,阐明稀少的原因,并建议解决的办法。当准备此项执行时,稀少货币的当事国应派代表参加。
Section 3 Scarcity of the Fund's holdings 第三节 基金持有的某种货币的稀少
(a)If it becomes evident to the Fund that the demand for a member's currency seriously threatens the Fund's ability to supply that currency,the Fund,whether or not it has issued a report under Section 2 of this Article,shall formally declare such currency scarce and shall thenceforth apportion its existing and accruing supply of the scarce currency with due regard to the relative needs of members,the general international economic situation,and any other pertinent considerations.The Fund shall also issue a report concerning its action. 一、如基金认为对于某会员国货币的需求明显地严重威胁基金供应该项货币的能力时,不论其已否按本条第二节规定发出报告,应即正式宣告该货币已经稀少。此后,对所存有和可收的该项稀少货币,应参酌各会员国的相对需要,总的国际经济形势及其它有关的考虑,进行分配。基金并应发出关于此项措施的执行。
(b)A formal declaration under (a)above shall operate as an authorization to any member,after consultation with the Fund,temporarily to impose limitations on the freedom of exchange operations in the scarce currency.Subject to the provisions of Article Ⅳ and Schedule C,the member shall have complete jurisdiction in determining the nature of such limitations,but they shall be no more restrictive than is necessary to limit the demand for the scarce currency to the supply held by,or accruing to,the member in question,and they shall be relaxed and removed as rapidly as conditions permit. 二、根据上述第一款所作的正式宣告,亦即是授权任何会员国,在与基金协商后,暂时限制稀少货币的自由汇兑。依照第四条和附录三,该会员国应有全权决定比项限制的性质。但此项限制,仅以使对稀少货币的需求能与该国已有或应有的供给相适应为限。一俟情况许可,应即尽速放宽或解除限制。
Section 4 Administration of restrictions 第四节 限制的执行
Any member imposing restrictions in respect of the currency of any other member pursuant to the provisions of Section 3 (b)of this Article shall give sympathetic consideration to any representations by the other member regarding the administration of such restrictions. 任何会员国依据本条第三节第二款的规定,对任何其它会员国货币施行限制时,应对其他会员国就此项限制措施所提的任何意见,尽量予以考虑。
Section 5 Effect of other international agreements on restrictions 第五节 其它国际协定对此项限制的效力
Members agree not to invoke the obligations of any engagements entered into with other members prior to this Agreement in such manner as will prevent the operation of the provisions of this Article. 各会员国同意不引用本协定未签订前与其他会员国所订任何协定内的义务,以免妨碍本条文规定的施行。
Article Ⅷ General Obligations of Members   第八条 会员国的一般义务
Section 1 Introduction 第一节 引言
In addition to the obligations assumed under other articles of this Agreement,each member undertakes the obligations set out in this Article. 各会员国除承担本协定其他各条下的义务外,尚须履行本条规定的义务。
Section 2 Avoidance of restrictions on current payments 第二节 避免限制经常性支付
(a)Subject to the provisions of Article Ⅶ,Section 3 (b)and Article ⅪⅤ,Section 2,no member shall,without the approval of the Fund,impose restrictions on the making of payments and transfers for current international transactions. 一、除第七条第三节第二款及第十四条第二节的规定外,各会员国未经基金同意,不得对国际经常往来的付款和资金转移施加限制。
(b)Exchange contracts which involve the currency of any member and which are contrary to the exchange control regulations of that member maintained or imposed consistently with this Agreement shall be unenforceable in the territories of any member.In addition,members may,by mutual accord,cooperate in measures for the purpose of making the exchange control regulations of either member more effective,provided that such measures and regulations are consistent with this Agreement. 二、有关任何会员国货币的汇兑契约,如与该国按本协定所施行的外汇管理条例相抵触时,在任何会员国境内均属无效。此外,各会员国得相互合作采取措施,使彼此的外汇管理条例更为有效,但此项措施与条例,应符合于本协定。
Section 3 Avoidance of discriminatory currency practices 第三节 避免施行歧视性货币措施
No member shall engage in,or permit any of its fiscal agencies referred to in Article Ⅴ,Section 1 to engage in,any discriminatory currency arrangements or multiple currency practices,whether within or outside margins under Article Ⅳ or prescribed by or under Schedule C,except as authorized under this Agreement or approved by the Fund.ff such arrangements and practices are engaged in at the date when this Agreement enters into force,the member concerned shall consult with the Fund as to their progressive removal unless they are maintained or imposed under Article ⅪⅤ,Section 2,in which case the provisions of Section 3 of that Article shall apply. 除本协定规定或基金准许者外,无论是在第四条或附录三规定的幅度之内或之外,任何会员国或第五条第一节所述之财政机关不得施行歧视性货币措施或多种货币汇率制。如在本协定生效前已经施行此项安排与措施,该有关会员国应与基金磋商逐步解除的办法,但其根据第十四条第二节规定而施行者不在此限。在该情况下得适用该条第三节的规定。
Section 4 Convertibility of foreign—held balances 第四节 兑付外国持有的本国货币
(a)Each member shall buy balances of its currency held by another member if the latter,in requesting the purchase,represents: 一、任何会员国对其它会员国所持有的本国货币结存,如其它会员国提出申请,应予购回,但申请国应说明:
(i)that the balances to be bought have been recently acquired as a result of current transactions;or (一)此项货币结存系最近经常性往来中所获得,或
(ii)that their conversion is needed for making payments for current transactions.The buying member shall have the option to pay either in special drawing rights,subject to Article ⅪⅩ,Section 4,or in the currency of the member making the request. (二)此项兑换系为支付经常性往来所必需。购买国得自行选用特别提款权支付(须遵守第十九条第四节规定)或者用该申请国的货币支付。
(b)The obligation in (a)above shall not apply when: 二、上述第一款所规定的义务,不适用下列情况:
(i)the convertibility of the balances has been restricted consistently with Section 2 of this Article or Article Ⅵ,Section 3; (一)按本条第二节或第六条第三节规定,已限制此项货币结存的兑换;
(ii)the balances have accumulated as a result of transactions effected before the removal by a member of restrictions maintained or imposed under Article ⅪⅤ,Section 2; (二)此项货币结存系一会员国在撤销依照第十四条第二节所施行的限制前的交易所得;
(iii)the balances have been acquired contrary to the exchange regulations of the member which is asked to buy them; (三)此项货币结存之获得违反被要求购买的会员国的外汇条例;
(iv)the currency of the member requesting the purchase has been declared scarce under Article Ⅶ,Section 3 (a);or (四)申请国的货币,依照第七条第三节第一款的规定,已经被宣告为稀少货币;
(v)the member requested to make the purchase is for any reason not entitled to buy currencies of other members from the Fund for its own currency. (五)被要求购买的会员国由于其它原因,已经无资格用本国货币向基金购买其它国家的货币。
Section 5 Furnishing of information 第五节 供给资料
(a)The Fund may require members to furnish it with such information as it deems necessary for its activities,including,as the minimum necessary for the effective discharge of the Fund's duties,national data on the following matters: 一、基金得要求各会员国提供基金认为其进行活动所需的各种资料,为了有效地实现基金的任务,至少应包括以下全国性的资料:
(i)official holdings at home and abroad of (1)gold,(2)foreign exchange; (一)官方在国内外持有的1.黄金,2.外汇;
(ii)holdings at home and abroad by banking and financial agencies,other than official agencies,of (1)gold,(2)foreign exchange; (二)官方机构以外的银行和金融机构在国内外持有的1.黄金,2.外汇;
(iii)production of gold; (三)黄金生产量;
(iv)gold exports and imports according to countries of destination and origin; (四)黄金输出入量,及输出入国别;
(v)total exports and imports of merchandise,in terms of local currency values,according to countries of destination and origin; (五)商品进出口量(价值用本国货币表示),及进出口国别;
(vi)international balance of payments,including (1)trade in goods and services,(2)gold transactions,(3)known capital transactions,and (4)other items; (六)国际收支状况,包括1.商品与劳务的交易,2.黄金交易,3.可知的资本往来,4.其它项目;
(vii)international investment position,i.e.,investments within the territories of the member owned abroad and investments abroad owned by persons in its territories so far as it is possible to furnish this information; (七)国际投资状况,即外人在本国境内的投资,及本国人在国外的投资,就可能范围内提供此项资料;
(viii)national income; (八)国民收入;
(ix)price indices,i.e.,indices of commodity prices in wholesale and retail markets and of export and import prices; (九)物价指数,即批发和零售市场的商品价格指数,及进出口价格指数;
(x)buying and selling rates for foreign currencies; (十)买卖外币的汇率;
(xi)exchange controls,i.e.,a comprehensive statement of exchange controls in effect at the time of assuming membership in the Fund and details of subsequent changes as they occur;and (十一)外汇管理情况,即加入基金时外汇管理的全面情况,以及后来变更的详情;
(xii)where official clearing arrangements exist,details of amounts awaiting clearance in respect of commercial and financial transactions,and of the length of time during which such arrears have been outstanding. (十二)如有官方的清算安排,关于商业及金融交易待清算的数额,及此项未清算款项拖欠的时间。
(b)In requesting information the Fund shall take into consideration the varying ability of members to furnish the data requested.Members shall be under no obligation to furnish information in such detail that the affairs of individuals or corporations are disclosed.Members undertake,however,to furnish the desired information in as detailed and accurate a manner as is practicable and,so far as possible,to avoid mere estimates. 二、基金在要求此项资料时,应考虑到各会员国提供资料能力的不同。会员国并无义务提供资料详细到这样地步以致泄露了私人和公司的事务。但会员国应提供尽可能详细而准确的必要资料,避免单纯的估计。
(c)The Fund may arrange to obtain further information by agreement with members.It shall act as a centre for the collection and exchange of information on monetary and financial problems,thus facilitating the preparation of studies designed to assist members in developing policies which further the purposes of the Fund. 三、基金得与会员国协商下,获取更多的资料。基金应成为收集和交换货币金融情报的中心,以便进行研究协助会员国拟定政策,促进基金目的的实现。
Section 6 Consultation between members regarding existing international agreements 第六节 会员国间对现行国际协定的协商
Where under this Agreement a member is authorized in the special or temporary circumstances specified in the Agreement to maintain or establish restrictions on exchange transactions,and there are other engagements between members entered into prior to this Agreement which conflict with the application of such restrictions,the parties to such engagements shall consult with one another with a view to making such mutually acceptable adjustments as may be necessary.The provisions of this Article shall be without prejudice to the operation of Article Ⅶ,Section 5. 如根据本协定,某会员国被准许在本协定规定的特殊或临时情形下维持或施行外汇交易限制,而在本协定以前已与其它会员国签订的协议与此项外汇限制的实施相抵触时,有关会员国应互相协商,以达成双方可以接受的必要调整。本条规定不应影响第七条第五节的施行。
Section 7 Obligation to collaborate regarding policies on reserve assets 第七节 在储备资产政策上合作的义务
Each member undertakes to collaborate with the Fund and with other members in order to ensure that the policies of the member with respect to reserve assets shall be consistent with the objectives of promoting better international surveillance of international liquidity and making the special drawing right the principal reserve asset in the international monetary system. 每个会员国应和基金或其它会员国进行合作,以保证会员国有关储备资产的政策应与促进对国际流动资金较好的国际监督,以及使特别提款权作为国际货币制度的主要储备资产的目标相一致。
Article Ⅸ Status,Immunities,and Privileges   第九条 法律地位,豁免与特权
Section 1 Purposes of Article 第一节 本条的目的
To enable the Fund to fulfill the functions with which it is entrusted,the status,immunities,and privileges set forth in this Article shall be accorded to the Fund in the territories of each member. 为使基金能履行其受托的职能,基金在各会员国境内得享有本条所规定的法律地位、豁免与特权。
Section 2 Status of the Fund 第二节 基金的法律地位
The Fund shall possess full juridical personality,and in particular,the capacity: 基金应有完整的法人权力,特别是有权:
(i)to contract; 一、签订契约;
(ii)to acquire and dispose of immovable and movable property;and 二、取得与处置动产与不动产;
(iii)to institute legal proceedings. 三、进行法律诉讼。
Section 3 Immunity from judicial process 第三节 司法程序的豁免
The Fund,its property and its assets,wherever located and by whomsoever held,shall enjoy immunity from every form of judicial process except to the extent that it expressly waives its immunity for the purpose of any proceedings or by the terms of any contract. 基金的财产和资产,不论在何地和为何人所保管,均应享受任何形式司法程序的豁免,除为起诉或因履行契约,得自动声明放弃此项豁免权益。
Section 4 Immunity from other action 第四节 其它豁免事项
Property and assets of the Fund,wherever located and by whomsoever held,shall be immune from search,requisition,confiscation,expropriation,or any other form of seizure by executive or legislative action. 基金的财产和资产,不论在何地和为何人所保管,均应免受搜查、征用、没收、征收及其他行政或立法行为上的任何形式的扣押。
Section 5 Immunity of archives 第五节 档案的豁免
The archives of the Fund shall be inviolable. 基金的档案不受侵犯。
Section 6 Freedom of assets from restrictions 第六节 资产免受限制
To the extent necessary to carry out the activities provided for in this Agreement,all property and assets of the Fund shall be free from restrictions,regulations,controls,and moratoria of any nature. 基金的一切财产和资产,在执行本协定现定业务所必需的范围内,应免受各种限制、管制、统制以及任何性质的延缓付款。
Section 7 Privilege for communications 第七节 通讯的特权
The official communications of the Fund shall be accorded by members the same treatment as the official communications of other members. 各会员国对基金的公文邮电应与其它会员国的公文邮电同等对待。
Section 8 Immunities and privileges of officers and employees 第八节 官员和雇员的豁免事项与特权
All Governors,Executive Directors,Alternates,members of committees,representatives appointed under Article Ⅻ,Section 3 (j),advisors of any of the foregoing persons,officers,and employees of the Fund: 基金的理事、执行董事及其副职、委员会的成员、按第十二条第三节第十款所任命的代表,以上人员的顾问以及官员和雇员皆享有以下权益:
(i)shall be immune from legal process with respect to acts performed by them in their official capacity except when the Fund waives this immunity; (一)在执行公务中,应豁免法律程序。但基金放弃比项豁免权益时,不在此限。
(ii)not being local nationals,shall be granted the same immunities from immigration restrictions,alien registration requirements,and national service obligations and the same facilities as regards exchange restrictions as are accorded by members to the representatives,officials,and employees of comparable rank of other members;and (二)倘非当地本国人民,应豁免当地的移民限制、外国人登记办法和兵役义务,其在外汇限制方面享有的便利,应与其它会员国同等级的代表、官员及雇员同样待遇。
(iii)shall be granted the same treatment in respect of traveling facilities as is accorded by members to representatives,officials,and employees of comparable rank of other members. (三)在施行方面的便利,应与其它会员国同等级的代表、官员及雇员同样待遇。
Section 9 Immunities from taxation 第九节 豁免捐税
(a)The Fund,its assets,property,income,and its operations and transactions authorized by this Agreement shall be immune from all taxation and from all customs duties.The Fund shall also be immune from liability for the collection or payment of any tax or duty. 一、基金的资产、财产、收益以及本协定授权的业务活动和交易,应豁免一切捐税和关税。基金对于任何捐税关税的征收或交纳,也均豁免承担任何责任。
(b)No tax shall be levied on or in respect of salaries and emoluments paid by the Fund to Executive Directors,Alternates,officers,or employees of the Fund who are not local citizens,local subjects,or other local nationals. 二、基金的执行董事、副董事、官员和雇员非当地本国公民、属民或国民,对其自基金所得的薪金的报酬,不得征税。
(c)No taxation of any kind shall be levied on any obligation or security issued by the Fund,including any dividend or interest thereon,by whomsoever held: 三、对于基金发行的债务凭证或证券,包括红利和利息在内,不论为何人所持有,不得征税:
(i)which discriminates against such obligation or security solely because of its origin;or (一)仅因该项负责凭证或证券的来源不同而发生的歧视性捐税;或
(ii)if the sole jurisdictional basis for such taxation is the place or currency in which it is issued,made payable or paid,or the location of any office or place of business maintained by the Fund. (二)仅以其发行及付款的地点和货币或基金办事处或进行业务的地点为法律根据而征收的捐税。
