最高人民法院关于周龙潭申请确认财产保全和执行程序违法一案的答复

辽宁省高级人民法院：
你院关于周龙潭申请确认财产保全和执行违法案的请示收悉，经研究，答复如下：
你省盘锦市双台子区人民法院在审理周龙潭诉张海军个人合伙纠纷一案的诉讼过程中，未依照最高人民法院《关于适用＜中华人民共和国民事诉讼法＞若干问题的意见》第101条的规定履行财产保全措施；在执行程序中，亦违反了最高人民法院《执行规定》第41条第2款关于向有关管理机关发出协助执行通知书的规定，且在对土地证的丢失、补办及收回中又存在严重的过失行为。又由于被执行人已无财产可供执行，已经给确认申请人造成了损失。因此，同意你院审判委员会第一种意见，对盘锦市双台子区人民法院的执行行为应当确认违法。
