| In order to implement the relevant requirements of the Several Opinions on Accelerating the Building of a Powerful Intellectual Property Nation under the New Situation (No. 71 [2015], State Council) issued by the State Council, better support the development of China's patent cause and relieve the burden of enterprises and individuals on patent application and maintenance, in accordance with the relevant provisions of the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China (Order No. 569, State Council), we have developed the Measures for the Reduced Payment of Patent Fees (see Annex), which are hereby issued to you for your compliance and implementation. | | 为贯彻落实国务院《关于新形势下加快知识产权强国建设的若干意见》(国发[2015]71号)有关要求，更好的支持我国专利事业发展，减轻企业和个人专利申请和维护负担，根据《中华人民共和国专利法实施细则》(国务院令第569号)有关规定，我们制定了《专利收费减缴办法》(见附件)，现印发给你们，请遵照执行。 |

| Article 1 In order to implement the relevant requirements of the Several Opinions on Accelerating the Building of a Powerful Intellectual Property Nation under the New Situation (No. 71 [2015], State Council) issued by the State Council, these Measures are developed in accordance with the relevant provisions of the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China. | | 第一条 为贯彻落实国务院《关于新形势下加快知识产权强国建设的若干意见》(国发[2015]71号)要求，根据《中华人民共和国专利法实施细则》有关规定，制定本办法。 |
| Article 2 A patent applicant or patentee may request to reduce the payment of the following patent fees: | | 第二条 专利申请人或者专利权人可以请求减缴下列专利收费： |
| (1) Application fee (excluding the printing fee for publication and the additional fee for filing an application). | | (一)申请费(不包括公布印刷费、申请附加费)； |
| (2) The substantive examination fee of a patent application for invention. | | (二)发明专利申请实质审查费； |
| (3) Patent annuities (within six years from the year of granting of a patent right). | | (三)年费(自授予专利权当年起六年内的年费)； |
| (4) Review fee. | | (四)复审费。 |
| Article 3 Where a patent applicant or patentee meets any of the following conditions, he or it may apply to the SIPO for reducing the payment of the aforesaid fees: | | 第三条 专利申请人或者专利权人符合下列条件之一的，可以向国家知识产权局请求减缴上述收费： |
(1) The patent applicant or patentee is an individual with the average monthly income of less than CNY 3,500 (or the average annual income of less than CNY 42,000) in the previous year.
