Preamble
The Contracting States to the European Patent Convention,
 欧洲专利公约各缔约国,
Considering that the co—operation of the countries of Europe on the basis of the European Patent Convention and the single procedure for the grant of patents thereby established renders a significant contribution to the legal and economic integration of Europe, 考虑到欧洲各国在欧洲专利公约基础上的合作以及按照该公约建立的授予专利的单一程序,对欧洲法律和经济的一体化作出了重要的贡献,
Wishing to promote innovation and economic growth in Europe still more effectively by laying foundations for the further development of the European patent system, 希望为进一步发展欧洲专利制度奠定基础,以更有效地促进欧洲的创新和经济增长,
Desiring,in the light of the increasingly international character of the patent system,to adapt the European Patent Convention to the technological and legal developments which have occurred since it was concluded, 渴望按照专利制度日益国际化的性质,使欧洲专利公约适应自缔结以来所发生的技术和法律的发展,
 Have Agreed As Follows: 兹议定如下:
Article 1 nbsp;Amendment of the European Patent Convention 

第一条 对欧洲专利公约的修订

The European Patent Convention shall be amended as follows: 欧洲专利公约修订如下:
 1.The following new Article 4a shall be inserted after Article 4: 1.在第4条之后增加新的第4a条:
Article 4a Conference of ministers of the Contracting States 

第4a条 缔约国部长会议

A conference of ministers of the Contracting States responsible for patent matters shall meet at least every five years to discuss issues pertaining to the Organisation and to the European patent system. 各缔约国负责专利事务的部长至少应当每5年集会一次,讨论有关本组织和有关欧洲专利制度的问题。
 2.Article 11 shall be amended to read as follows: 2.第11条修改如下:
Article 11 nbsp;Appointment of senior employees 

第11条 高级职员的任命

 (1)The President of the European Patent Office shall be appointed by the Administrative Council. (1)欧洲专利局局长由行政委员会任命。
 (2)The Vice—Presidents shall be appointed by the Administrative Council after the President of the European Patent Office has been consulted. (2)各副局长应当由行政委员会在与欧洲专利局局长商议后任命。
 (3)The members,including the Chairmen,of the Boards of Appeal and of the Enlarged Board of Appeal shall be appointed by the Administrative Council on a proposal from the President of the European Patent Office.They may be re—appointed by the Administrative Council after the President of the European Patent Office has been consulted. (3)各申诉委员会和扩大申诉委员会的成员,包括主席在内,由行政委员会根据欧洲专利局局长的建议任命。上述人员可以由行政委员会在与欧洲专利局局长商议后再次任命。
 (4)The Administrative Council shall exercise disciplinary authority over the employees referred to in paragraphs 1 to 3. (4)行政委员会应当对第1款至第3款所述的职员行使纪律处分权。
 (5)The Administrative Council,after consulting the President of the European Patent Office,may also appoint as members of the Enlarged Board of Appeal legally qualified members of the national courts or quasi—judicial authorities of the Contracting States,who may continue their judicial activities at the national level.They shall be appointed for a term of three years and may be reappointed. (5)行政委员会在与欧洲专利局局长磋商后,也可以任命缔约国国家法院或者准司法机关的具有法律资格的成员为扩大申诉委员会的成员;他们可以继续在国家一级的司法活动。他们的任期为3年,可以再次任命。
 3.Article 14 shall be amended to read as follows: 3.第14条修改如下:
Article 14 nbsp;Languages of the European Patent Office,European patent applications and other documents 

第14条 欧洲专利局、欧洲专利申请和其他文件的语言

 (1)The official languages of the European Patent Office shall be English,French and German. (1)欧洲专利局的正式语言为英语、法语和德语。
 (2)A European patent application shall be filed in one of the official languages or,if filed in any other language,translated into one of the official languages in accordance with the Implementing Regulations.Throughout the proceedings before the European Patent Office,such translation may be brought into conformity with the application as filed.If a required translation is not filed in due time,the application shall be deemed to be withdrawn. (2)提出欧洲专利申请应当使用正式语言之一,或者,如果是使用任何其他语言提出的,应当根据实施细则译为正式语言之一。在欧洲专利局的全部程序中,此种译文可以修改,使其与原提交的申请保持一致。如果要求的译文没有在规定的期间内提交,该申请视为撤回。
 (3)The official language of the European Patent Office in which the European patent application is filed or into which it is translated shall be used as the language of the proceedings in all proceedings before the European Patent Office,unless otherwise provided in the Implementing Regulations. (3)提出欧洲专利申请所使用的或者其译文所使用的欧洲专利局正式语言,除实施细则另有规定外,应当在欧洲专利局的各种程序中作为程序语言使用。
 (4)Natural or legal persons having their residence or principal place of business within a Contracting State having a language other than English,French or German as an official language,and nationals of that State who are resident abroad,may file documents which have to be med within a time limit in an official language of that State.They shall however file a translation in an official language of the European Patent Office in accordance with the Implementing Regulations.If any document,other than those documents making up the European patent application,is not filed in the prescribed language,or if any required translation is not filed in due time,the document shall be deemed not to have been filed. (4)自然人或者法人的居所或者主营业所是在以英语、法语、德语以外的语言作为正式语言的缔约国内的,以及缔约国国民居住于国外的,可以使用该国的正式语言提交必须在一定期限内提交的文件。然而,他们应当根据实施细则提交使用欧洲专利局一种正式语言的译文。如果构成欧洲专利申请文件以外的任何文件没有使用规定的语言提交,,或者如果本公约所要求的任何译文没有在规定的期间内提交,该文件视为没有提交。
 (5)European patent applications shall be published in the language of the proceedings. (5)欧洲专利申请应当以程序语言公布。
 (6)Specifications of European patents shall be published in the language of the proceedings and shall include a translation of the claims in the two other official languages of the European Patent Office. (6)欧洲专利说明书应当以程序语言公布,并包括以欧洲专利局其他两种正式语言对权利要求书的译文。
 (7)There shall be published in the three official languages of the European Patent Office: (7)下列刊物以欧洲专利局的三种正式语言出版:
 (a)the European Patent Bulletin; (a)欧洲专利公报;
 (b)the Official Journal of the European Patent Office. (b)欧洲专利局官方公报。
 (8)Entries in the European Patent Register shall be made in the three official languages of the European Patent Office.In cases of doubt,the entry in the language of the proceedings shall be authentic. (8)欧洲专利登记簿的登记项目应当使用欧洲专利局的三种正式语言。遇有疑义时,以程序语言的登记作准。
 4.Article 16 shall be amended to read as follows: 4.第16条修改如下:

 (1)The Examining Divisions shall be responsible for the examination of European patent applications. (1)各审查部负责欧洲专利申请的审查。
 (2)An Examining Division shall consist of three technical examiners.However,the examination of a European patent application prior to a decision on it shall,as a general rule,be entrusted to one member of the Division.Oral proceedings shall be before the Examining Division itself.If the Examining Division considers that the nature of the decision so requires,it shall be enlarged by the addition of a legally qualified examiner.In the event of parity of votes,the vote of the China man of the Division shall be decisive. (2)一个审查部由三名技术审查员组成。然而,在作出决定前,欧洲专利申请的审查通常应当委托该部的一名成员进行。口头程序在审查部本身进行。如果审查部认为决定的性质需要,该部应当扩大,增加一名具有法律资格的审查员。遇有票数相等时,审查部主席的投票是决定性的。
 7.Article 21 shall be amended to read as follows: 7.第21条修改如下:

 (1)The Boards of Appeal shall be responsible for the examination of appeals from the decisions of the Receiving Section,Examining Divisions,Opposition Divisions and of the Legal Division. (1)各申诉委员会负责对受理处、各审查部、各异议部和法律部所作决定的申诉的审查。
 (2)For appeals from a decision of the Receiving Section or the Legal Division,a Board of Appeal shall consist of three legally qualified members. (2)对于受理处或者法律部所作决定的申诉,申诉委员会由三名具有法律资格的成员组成。
 (3)For appeals from a decision of an Examining Division.a Board of Appeal shall consist of: (3)对于审查部所作决定的申诉,申诉委员会的组成如下:
 (a)two technically qualified members and one legally qualified member,when the decision concerns the refusal of a European patent application or the grant,limitation or revocation of a European patent and was taken by an Examining Division consisting of less than four members; (a)在该决定涉及一项欧洲专利申请的拒绝,或者一项欧洲专利的授予、限制或者撤销,并且作出该决定的审查部的成员少于四名时,申诉委员会由两名具有技术资格的成员和一名具有法律资格的成员组成;
 (b)three technically qualified members and two legally qualified members,when the decision was taken by an Examining Division consisting of four members or when the Board of Appeal considers that the nature of the appeal so requires; (b)在该决定是由四名成员组成的审查部所作出,或者申诉委员会认为申诉的性质需要时,申诉委员会由三名具有技术资格的成员和两名具有法律资格的成员组成;

 (4)For appeals from a decision of an Opposition Division.a Board of Appeal shall consist of: (4)对于异议部所作决定的申诉,申诉委员会的组成如下:
 (a)two technically qualified members and one legally qualified member,when the decision was taken by an Opposition Division consisting of three members; (a)在该决定是由三名成员组成的异议部作出时,申诉委员会由两名具有技术资格的成员和一名具有法律资格的成员组成;
 (b)three technically qualified members and two legally qualified members,when the decision was taken by an Opposition Division consisting of four members or when the Board of Appeal considers that the nature of the appeal so requires. (b)在该决定是由四名成员组成的异议部所作出,或者申诉委员会认为申诉的性质需要时,申诉委员会由三名具有技术资格的成员和两名具有法律资格的成员组成。
 8.Article 22 shall be amended to read as follows: 8.第22条修改如下:
Article 22 nbsp;Enlarged Board of Appeal 

第22条 扩大申诉委员会

 (1)The Enlarged Board of Appeal shall be responsible for: (1)扩大申诉委员会负责下列事项:
 (a)deciding points of law referred to it by Boards of Appeal; (a)对申诉委员会提交的法律问题作出决定;
 (b)giving opinions on points of law referred to it by the President of the European Patent Office under Article 112; (b)对欧洲专利局局长根据第112条提交的法律问题提出意见。
 (c)deciding on petitions for review of decisions of the Boards of Appeal under Article 112a. (c)对根据第112a条提出的对于申诉委员会决定的复审请求作出决定。
 (2)In proceedings under paragraph 1(a)and(b),the Enlarged Board of Appeal shall consist of five legally qualified and two technically qualified members.In proceedings under paragraph 1(C),the Enlarged Board of Appeal shall consist of three or five members as laid down in the Implementing Regulations.In all proceedings a legally qualified member shall be the Chairman. (2)在根据第1款(a)项和(b)项的程序中,扩大申诉委员会由五名具有法律资格和两名具有技术资格的成员组成。在根据第1款(c)项的程序中,扩大申诉委员会按照实施细则规定由三名或五名成员组成。在所有程序中,主席一职由具有法律资格的成员担任。
 9.Article 23 shall be amended to read as follows: 9.第23条修改如下:
Article 23 nbsp;Independence of the members of the Boards 

第23条 委员会成员的独立性

 (1)The members of the Enlarged Board of Appeal and of the Boards of Appeal shall be appointed for a term of five years and may not be removed from office during this term,except if there are serious grounds for such removal and if the Administrative Council,on a proposal from the Enlarged Board of Appeal,takes a decision to this effect.Notwithstanding sentence 1,the term of office of members of the Boards shall end if they resign or are retired in accordance with the Service Regulations for permanent employees of the European Patent Office. (1)扩大申诉委员会的成员和各申诉委员会的成员的任期各为5年,在这任期内不得免除其职务,但是如果有重大理由需要予以免职,而且行政委员会根据扩大申诉委员会的提议作出免职的决定的,则属例外。尽管有第一句的规定,如果委员会的成员辞职,或者根据欧洲专利局长期职员的服务条例退休,其任期应即终止。
 (2)The members of the Boards may not be members of the Receiving Section,Examining Divisions,Opposition Divisions or of the Legal Division. (2)各委员会的成员不得同时担任受理处、各审查部、各异议部或者法律部的成员。
 (3)In their decisions the members of the Boards shall not be bound by any instructions and shall comply only with the provisions of this Convention. (3)各委员会的成员在作出决定时应当只遵守本公约的规定,不应受任何命令的拘束。
 (4)The Rules of Procedure of the Boards of Appeal and the Enlarged Board of Appeal shall be adopted in accordance with the Implementing Regulations.They shall be subject to the approval of the Administrative Council. (4)各申诉委员会和扩大申诉委员会的程序规则应当根据实施细则的规定予以制定。程序规则应当经行政委员会批准。
 10.Article 33 shall be amended to read as follows: 10.第33条修改如下:
Article 33 nbsp;Competence of the Administrative Council in certain cases 

第33条 行政委员会在某些情况下的权限

 (1)The Administrative Council shall be competent to amend the following provisions: (1)行政委员会有权修改本公约的下列规定:
 (a)the time limits laid down in this Convention: (a)本公约规定的期限;
 (b)Parts Ⅱ to Ⅷ and Part Ⅹ of this Convention.to bring them into line with an international treaty relating to patents or European Community legislation relating to patents; (b)本公约第Ⅱ部分至第Ⅷ部分和第Ⅹ部分,使它们与有关专利的国际条约或者有关专利的欧洲共同体立法保持一致;
 (C)the Implementing Regulations. (c)实施细则。
 (2)The Administrative Council shall be competent,in conformity with this Convention,to adopt or amend the following provisions: (2)为了与本公约保持一致,行政委员会有权通过或者修改下列规定:
 (a)the Financial Regulations; (a)财务条例;
 (b)the Service Regulations for permanent employees and the conditions of employment of other employees of the European Patent of fice,the salary scales of the said permanent and other employees,and also the nature and rules for the grant of any supplementary benefits; (b)欧洲专利局长期职员的服务条例和其他职员的任用条件,上述长期职员和其他职员的工资表,以及任何补贴的性质和授予补贴的规则;
 (c)the Pension Scheme Regulations and any appropriate increases in existing pensions to correspond to increases in salaries; (c)退休金条例以及为与工资的增加相适应,现有退休金的适当增加;
 (d)the Rules relating to Fees; (d)有关费用的规则;
 (e)its Rules of Procedure. (e)行政委员会的议事规则。
 (3)Notwithstanding Article 18,paragraph 2,the Administrative Council shall be competent to decide,in the light of experience,that in certain categories of cases Examining Divisions shall consist of one technical examiner.Such decision may be rescinded. (3)尽管有第18条第2款的规定,行政委员会根据经验有权决定,在某几类案件,审查部由一名技术审查员组成。这种决定可以废除。
 (4)The Administrative Council shall be competent to authorise the President of the European Patent Office to negotiate and,with its approval,to conclude agreements on behalf of the European Patent Organisation with States,with intergovernmental organisations and with documentation centres set up by virtue of agreements with such organisations. (4)行政委员会有权授权欧洲专利局局长代表欧洲专利组织与国家、与政府间组织以及与根据与这种组织的协定而建立的文献中心进行谈判,经行政委员会批准后,缔结协定。
 (5)The Administrative Council may not take a decision under paragraph 1(b):
 —concerning an international treaty,before the entry into force of that treaty;
 —concerning European Community legislation,before its entry into force or,where that legislation provides for a period for its implementation,before the expiry of that period.
 (5)行政委员会不得根据第1款(b)项作出下列决定:一在一项国际条约生效以前,关于该条约的决定;一在欧洲共同体立法生效以前,或者如果该立法订有实施期,在该期间届满以前,关于该立法的决定。
 11.Article 35 shall be amended to read as follows: 11.第35条修改如下:
Article 35 nbsp;Voting rules 

第35条 表决规则

 (1)The Administrative Council shall take its decisions other than those referred to in paragraphs 2 and 3 by a simple majority of the Contracting States represented and voting. (1)除第2款和第3款所述的决定以外,行政委员会作出决定应当有派代表出席和参加表决的缔约国的简单多数票。
 (2)A majority of three quarters of the votes of the Contracting States represented and voting shall be required for the decisions which the Administrative Council is empowered to take under Article 7.Article 11,paragraph 1,Article 33,paragraphs 1(a)and(C),and 2 to 4,Article 39,paragraph 1,Article 40,paragraphs 2 and 4,Article 46,Article 134a,Article 149a,paragraph 2,Article 152,Article 153,paragraph 7,Article 166 and Article 172. (2)行政委员会根据第7条、第11条第1款、第33条第1款(a)项和(c)项、同条第2款至第4款、第39条第1款、第40条第2款和第4款、第46条、第134a条、第149a条第2款、第152条、第153条第7款、第166条和第172条有权作出的决定,需要有派代表出席和参加表决的缔约国的四分之三的多数票。
 (3)Unanimity of the Contracting States voting shall be required for the decisions which the Administrative Couneil is empowered to take under Article 33,paragraph,1(b).The Administrative Council shall take such decisions only if all the Contracting States are represented.A decision taken on the basis of Article 33,paragraph 1(b),shall not take effect if a Contracting State declares,within twelve months of the date of the decision,that it does not wish to be bound by that decision. (3)行政委员会根据第33条第1款(b)项授权作出的决定要求缔约国投票的全体一致。只在所有缔约国都有代表出席的情况下,行政委员会才能作出这样的决定。如果有一个缔约国在作出决定之日起12个月内声明,它不愿受该决定的拘束,则根据第33条第1款(b)项作出的决定就不发生效力。
 (4)Abstentions shall not be considered as votes. (4)弃权不应认为是投票。
 12.Article 37 shall be amended to read as follows: 12.第37条修改如下:
Article 37 nbsp;Budgetary funding 

第37条 预算筹资

 The budget of the Organisation shall be financed: 本组织预算资金的来源:
 (a)by the Organisation's own resources; (a)本组织自己的资源;
 (b)by payments made by the Contracting States in respect of renewal fees for European patents levied in these States; (b)各缔约国就其在本国收取的欧洲专利续展费缴纳的款项;
 (C)where necessary,by special financial contributions made by the Contracting States; (c)必要时各缔约国所作的特别财政捐款;
 (d)where appropriate,by the revenue provided for in Article 146; (d)在适用的情况下,第146条所规定的收入:
 (e)where appropriate,and for tangible assets only,by third—party borrowings secured on la nd or buildings; (e)在适用的情况下,只就有形资产而言,以土地或者建筑物为担保向第三方的借贷;
 (f)where appropriate,by third—party funding for specific projects. (f)在适用的情况下,由第三方为特定项目提供的资金。
 13.Article 38 shall be amended to read as follows: 13.第38条修改如下:
Article 38 nbsp;The Organisation's own resources 

第38条 本组织自己的资源

 The Organisation's own resources shall comprise: 本组织自己的资源包括下列各项:
 (a)all income from fees and other sources and also the reserves of the Organisation; (a)来自费用和其他来源以及本组织储备金的一切收入;
 (b)the resources of the Pension Reserve Fund,which shall be treated as a special class of asset of the Organisation designed to lend support to the Organisation's pension scheme by providing the appropriate reserves. (b)退休费公积金的资源,这种公积金作为本组织的特种资产,提供适当的储备金以支持本组织的退休金办法。
 14.Article 42 shall be amended to read as follows: 14.第42条修改如下:
Article 42 nbsp;Budget 

第42条 预算

 (1)The budget of the Organisation shall be balanced.It shall be drawn up in accordance with the generally accepted accounting principles laid down in the Financial Regulations.If necessary,there may be amending or supplementary budgets. (1)本组织的预算应当保持平衡。预算应当根据财务条例规定的一般会计原则予以编制。必要时,可以有修改预算或者补充预算。
 (2)The budget shall be drawn up in the unit of account fixed in the Financial Regulations. (2)预算应当以财务条例规定的记账单位制定。
 15.Article 50 shall be amended to read as follows: 15.第50条修改如下:
Article 50 nbsp;Financial Regulations 

第50条 财务条例

 The Financial Regulations shall in particular establish: 财务条例尤其应当规定下列各项:
 (a)the procedure relating to the establishment and implementation of the budget and for the rendering and audit i ng of accounts; (a)关于预算的编制和实施的程序以及账目的记录和审计程序;
 (b)the method and procedure whereby the payments and contributions provided for in Article 37 and the advances provided for in Article 41 are to be made available to the Organisation by the Contracting States; (b)各缔约国向本组织提供第37条规定的缴款和捐款以及第41条规定的预付款的方法和程序;
 (c)the rules concerning the responsibilities of authorising and accounting officers and the arrangements for their supervision; (c)关于授权官员和会计官员职责的规则以及对这些官员监督的办法;
 (d)the rates of interest provided for in Articles 39,40 and 47; (d)第39条、第40条和第47条规定的利息的率;
 (e)the method of calculating the contributions payable by virtue of Article 146; (e)依据第146条应缴纳捐款的计算方法;
 (f)the composition vf and duties to be assigned to a Budget and Finance Committee which should be set up by the Administrative Council; (f)行政委员会应当设立的预算和财务委员会的组成和赋予的职责;
 (g)the generally accepted accounting principles on which the budget and the annual financial statements shall be based. (g)预算和年度财务报表所根据的一般会计原则。
 16.Article 51 shall be amended to read as follows: 16.第51条修改如下:
Article 51 nbsp;Fees 

第51条 费用

 (1)The European Patent Office may levy fees for any official task or procedure carried out ruder this Convention. (1)欧洲专利局对于其根据本公约所履行的任何官方任务或者程序可以收取费用。
 (2)Time limits for the payment of fees other than those fixed by this Convention shall be laid down in the Implementing Regulations. (2)缴纳本公约规定费用以外的其他费用的期限,应当在实施细则中予以规定。
 (3)Where the Implementing Regulations provide that a fee shall be paid.they shall also lay down the consequences of failure to pay such fee in due time. (3)实施细则规定应缴纳某种费用的,应同时规定不在规定期限内缴纳该费用的后果。
 (4)The Rules relating to Fees shall determine in particular the amounts of the fees and 1 he ways in which they are to be paid. (4)关于费用的规则尤其应确定费用的数额及其缴纳的方法。
 17.Article 52 shall be amended to read as follows: 17.第52条修改如下:
Article 52 nbsp;Patentable inventions 

第52条 可享专利的发明

 (1)European patents shall be granted for any inventions,in all fields of technology,provided that they are new,involve an inventive step and are susceptible of industrial application. (1)对于所有技术领域的任何发明,只要是新的,包含创造性并且能在产业上应用的,应当授予欧洲专利。
 (2)The following in particular shall not be regarded as inventions within the meaning of paragraph 1: (2)下列各项尤其不应认为是第1款所述的发明:
 (a)discoveries,scientific theories and mathematical methods; (a)发现、科学理论和数学方法;
 (b)aesthetic creations; (b)美学创作;
 (c)schemes,rules and methods for performing mental acts,playing games or doing business,and programs for computers; (c)进行智力行为、进行运动、游戏或者经营业务的计划、规则和方法,以及计算机程序;
 (d)presentations of information. (d)信息的提示。
 (3)Paragraph 2 shall exclude the patentability of the subject—matter or activities referred to therein only to the extent to which a European patent application or European patent relates to such subject—matter or activities as such. (3)第2款的规定,只有在欧洲专利申请或者欧洲专利涉及该规定所述的主题或者活动本身的限度内,才排除该主题或活动的可享专利性。
 18.Article 53 shall be amended to read as follows: 18.第53条修改如下:

第53条 可享专利性的例外

European patents shall not be granted in respect of: 对下列各项不授予欧洲专利:
 (a)inventions the commercial exploitation of which would be contrary to“ordre public”or morality,provided that such exploitation shall not he deemed to be so contrary merely because it is prohibited by law or regulation in some or all of the Contracting States; (a)凡是其商业实施会违反公共秩序或者道德的发明,但条件是,不能仅仅因为这种实施被某些或者全部缔约国的法律或者条例所禁止而即认为其实施违反公共秩序或者道德;
 (b)plant or animal varieties or essentially biological processes for the production of plants or animals;this provision shall not apply to microbiological processes or the products thereof; (b)植物、动物品种或者生产植物、动物的主要是生物学的方法;本规定不适用于微生物学方法或者该方法的产品。
 (C)methods for treatment of the human or animal body by surgery or therapy and diagnostic methods practised on the human or animal body;this provision shall not apply to products,in particular substances or compositions,for use in any of these methods. (c)对人体或者动物体的外科或者疗法的治疗方法,以及在人体或者动物体上施行的诊断方法;本规定不适用于在这些方法中所使用的产品,尤其是物质或者组合物。
 19.Article 54 shall be amended to read as follows: 19.第54条修改如下:
Article 54 nbsp;Novelty 

第54条 新颖性

 (1)An invention shall be considered to be new if it does not form part of the state of the art. (1)如果一项发明不属于现有技术,该发明应当认为是新颖的。
 (2)The state of the art shall be held to comprise everything made available to the public by means of a written or oral description,by use,or in any other way,before the date of filing of the European patent application. (2)现有技术应当认为包括在欧洲专利申请日以前,依书面或者口头描述的方法,依使用,或者依任何其他方法,公众可以得到的一切东西。
 (3)Additionally,tile content of European patent applications as filed.of which the dates of filing are prior to the date referred to in paragraph 2 and which、vere published on or after that date,shall be considered as comprised in the state of the art. (3)此外,已经提交的欧洲专利申请的内容,如果该申请的申请日是在第2款所述的日期以前,并且该申请在该日或该日以后公布的,应当认为包括在现有技术以内。
 (4)Paragraphs 2 an d 3 shall not exclude the patentability of any substance or composition,comprised in the state of the art,for use in a method referred to in Article 53(c),provided that its use for any such method is not comprised in the state of the art. (4)第2款和第3款的规定,不应排除属于现有技术中的任何物质或者组合物在第53条(c)项所述方法中的用途的可享专利性,但以该物质或者组合物在任何这种方法中的用途没有包括在现有技术内为限。
 (5)Paragraphs 2 an d 3 shall also not exclude the patentability of any substance or composition referred to in paragraph 4 for any specific use in any method referred to in Article 53(c),provided that such use is not comprised in the state of the art. (5)第2款和第3款的规定,还不应排除第4款所述的任何物质或者组合物在第53条(c)项所述的任何方法中的任何特定用途的可享专利性,但以这种用途没有包括在现有技术内为限。
 20.Article 60 shall be amended to read as follows: 20.第60条修改如下:
Article 60 nbsp;Right to a European patent 

第60条 取得欧洲专利的权利

 (1)The right to a European patent shall belong to the inventor or his successor in title.If the inventor is an employee,the right to a European patent shall be determined in accordance with the law of the State in which the employee is mainly employed;if the State in which the employee is mainly employed cannot be determined,the law to be applied shall be that of the State in which the employer has his place of business to which the employee is attached. (1)取得欧洲专利的权利应当属于发明人或者其权利继受人。如果发明人为雇员,取得欧洲专利的权利应当根据该雇员主要受雇地国家的法律予以确定;如果该雇员主要受雇地国家不能确定,适用的法律应当是该雇员所属雇主的营业所地国家的法律。
 (2)If two or more persons have made an invention independently of each other,the right to a European patent therefor shall being to the person whose European patent application has the earliest date of filing,provided this first application has been published. (2)如果两人或者两人以上各自独立地作出了一项发明,取得该发明的欧洲专利的权利属于提出具有最早申请日的欧洲专利申请的人;但以该第一个申请已经公布为限。
 (3)For the purposes of proceedings before the European Patent Office,the applicant shall be deemed to be entitled to exercise the right to a European patent. (3)为了在欧洲专利局程序的目的,申请人视为有权行使取得欧洲专利的权利。
 21.Article 61 shall be amended to read as follows: 21.第61条修改如下:
Article 61 nbsp;European patent applications filed by non—entitled persons 

第61条 无权的人提出的欧洲专利申请

 (1)If by a final decision it is adjudged that a person other than the applicant is entitled to the grant of the European patent,that person may,in accordance with the Implementing Regulations, (1)如果根据最终决定,申请人以外的人被确认为有权取得欧洲专利的人,此人可以根据实施细则进行下列行为之一:
 (a)prosecute the European patent application as his own application in place of the applicant, (a)代替原申请人,作为自己的申请处理欧洲专利申请,
 (b)file a new European patent application in respect of the same invention,or (b)就同一发明提出新的欧洲专利申请,或者
 (C)request that the European patent application be refused. (c)请求将该欧洲专利申请予以拒绝。
 (2)Article 76,paragraph 1,shall apply mutatis mutandis to a new European patent application filed under paragraph 1(b). (2)第76条第1款应当比照适用于根据第1款(b)项提交的新的欧洲专利申请。
 22.Article 65 shall be amended to read as follows: 22.第65条修改如下:
Article 65 nbsp;Translation of the European patent 

第65条 欧洲专利的译文

 (1)Any Contracting State may,if the European patent as granted,amended or limited by the European Patent Office is not drawn up in one of its official languages,prescribe that the proprietor of the patent shall supply to its central industrial property office a translation of the patent as granted,amended or limited in one of its official languages at his option or,where that State has prescribed the use of one specific official language,in that language.The period for supplying the translation shall end three months after the date on which the mention of the grant,maintenance in amended form or limitation of the European patent is published in the European Patent Bulletin,unless the State concerned prescribes a longer period. (1)任何缔约国可以规定,如果欧洲专利局授予的、修正的或者限制的欧洲专利不是以其官方语言之一撰写的,专利所有人应当向该国中央工业产权局提供该授予的、修正的或者限制的专利文本的以其本人选择的该国正式语言之一的译文,或者,如果该国规定使用某一特定正式语言的,提交该文本的以该语言的译文。提供译文的期间,自该欧洲专利的授予、以修正形式的维持或者限制在欧洲专利公报上公布之日以后三个月终止,除非有关国家规定更长的期间。
 (2)Any Contracting State which has adopted provisions pursuant to paragraph 1 may prescribe that the proprietor of the patent must pay all or part of the costs of publication of such translation within a period laid down by that State. (2)按照第1款作出规定的缔约国可以规定,专利所有人必须在该国规定的期间内缴纳此种译文的全部或者部分出版费。
 (3)Any Contracting State may prescribe that in the event of failure to observe the provisions adopted in accordance with paragraphs 1 and 2,the European patent shall be deemed to be void ab initio in that State. (3)任何缔约国可以规定,倘不遵守根据第1款和第2款所制定的规定的,欧洲专利视为在该国自始无效。
 23.Article 67 shall be amended to read as follows: 23.第67条修改如下:
Article 67 nbsp;Rights conferred by a European patent application after publication 

第67条 欧洲专利申请公布后授予的权利

 (1)A European patent application shall,from the date of its publication,provisionally confer,aport the applicant such protection as is conferred by Article 64,in the Contracting States designated in the application. (1)欧洲专利申请自其公布之日起,在该申请指定的缔约国内,对申请人临时地授予第64条所授予的保护。
 (2)Any Contracting State may prescribe that a European patent application shall not confer such protection as is conferred by Article 64.However,the protection attached to the publication of the European patent application may not be less than that which the laws of the State concerned attach to the compulsory publication of unexamined national patent applications.In any event,every State shall ensure at least that,from the date of publication of a European patent application,the applicant can claim compensation reasonable in the circumstances from any person who has used the invention in the said State in circumstances where that person would be liable under national law for infringement of a national patent. (2)任何缔约国可以规定,欧洲专利申请不授予第64条所授予的保护。然而,公布的欧洲专利申请所给予的保护不得少于有关国家法律对未审查的国家专利申请强制公布后所授予的保护。无论如何,每一缔约国至少应当保证,自欧洲专利申请公布之日起,按照在该国任何人因侵犯国家专利根据国家法律应负责任的情况,申请人能要求使用其发明的任何人给予根据情况是合理的赔偿。
 (3)Any Contracting State which does not have as an official language the language of the proceedings may prescribe that provisionalprotection in accordance with paragraphs 1 and 2 above shall not be effective until such time as a translation of the claims in one of its official languages at the option of the applicant or,where that State has prescribed the use of one specific official language,in that language: (3)任何缔约国并没有以程序语言作为其正式语言的,可以规定,只有到申请人以其选择该国正式语言之一提交权利要求的译文,或者,如果该国规定使用某一特定正式语言的,以该语言提交权利要求的译文,并有下列情况之一时,根据上述第1款和第2款的临时保护才发生效力:
 (a)has been made available to the public in the manner prescribed by national law,or (a)按照该国法律规定的方式公众已经可以得到该译文;或者
 (b)has been communicated to the person using the invention in the said State. (b)该译文已经送达该国使用发明的人。
 (4)The European patent application shall be deemed never to have had the effects set out in paragraphs 1 and 2 above when it has been withdrawn,deemed to be withdrawn or finally refused.The same shall apply in respect of the effects of the European patent application in a Contracting State the designation of which is withdrawn or deemed to be withdrawn. (4)欧洲专利申请被撤回,视为撤回,或者最终已被拒绝时,上述第1款和第2款所规定的欧洲专利申请的效力视为自始即不存在。本规定在欧洲专利申请对某一缔约国的指定被撤回或者视为撤回时,也同样适用。
 24.Article 68 shall be amended to read as follows: 24.第68条修改如下:
Article 68 nbsp;Effect of revocation or limitation of the European patent 

第68条 欧洲专利撤销或限制的效力

 The European patent application and the resulting patent shall be deemed not to have had,from the outset,the effects specified in Articles 64 and 67,to the ex tent that the patent has been revoked or limited in opposition,limitation or revocation proceedings. 欧洲专利申请和根据该申请授予的欧洲专利,在该专利于异议、限制或者撤销程序中被撤销或者被限制的限度内,视为自始即不具有第64条和第67条规定的效力。
 25.Article 69 shall be amended to read as follows: 25.第69条修改如下:
Article 69 nbsp;Extent of protection 

第69条 保护范围

 (1)The extent of the protection conferred by a European patent or a European patent application shall be determined by the claims.Nevertheless,the description and drawings shall be used to interpret the claims. (1)欧洲专利或者欧洲专利申请所授予的保护范围取决于权利要求的内容。然而,说明书和附图应当用以解释权利要求。
 (2)For the period up to grant of the European patent,the extent of the protection conferred by the European patent application shall be determined by the claims contained in the application as published.However,the European patent as granted or as amended in opposition,limitation or revocation proceedings shall determine retroactively the protection conferred by the European patent application,in so far as such protection is not thereby extended. (2)在直到授予欧洲专利之前的期间内,欧洲专利申请授予的保护范围取决于公布的申请中所包含的权利要求。但是,授予的欧洲专利或者在异议、限制或者撤销程序中修改过的欧洲专利,在这种保护没有因此而扩大的限度内,应当追溯地决定欧洲专利申请所授予的保护。
 26.Article 70 shall be amended to read as follows: 26.第70条修改如下:
Article 70 nbsp;Authentic text of a European patent application or European patent 

第70条 欧洲专利申请或欧洲专利的作准文本

 (1)The text of a European patent application or a European patent in the language of the proceedings shall be the authentic text in any proceedings before the European Patent Office and in any Contracting State. (1)以程序语言撰写的欧洲专利申请或者欧洲专利文本,应当是在欧洲专利局的任何程序中和在任何缔约国的作准文本。
 (2)If,however,the European patent application has been filed in a language which is not an official language of the European Patent Office,that text shall be the application as filed within the meaning of this Convention. (2)然而,如果提交的欧洲专利申请不是以欧洲专利局的正式语言撰写的,该文本为本公约所称的原提交的申请。
 (3)Any Contracting State may prescribe that a translation,as provided for in this Convention,in an official language of that State,shall in that State be regarded as authentic,except for revocation proceedings,in the event of the European patent application or European patent in the language of the translation conferring protection which is narrower than that conferred by it in the language of the proceedings. (3)任何缔约国可以规定,以该国正式语言所作的译文,正如本公约所规定的,在该国应当认为是作准文本,但是对于撤销程序,倘若以译文语言撰写的欧洲专利申请或者欧洲专利所授予的保护,比以程序语言撰写的该申请或该专利所授予的保护更为狭小,则应除外。
 (4)Any Contracting State which adopts a provision under paragraph 3: (4)任何缔约国根据第3款作出规定的,
 (a)must allow the applicant for or proprietor of the patent to file a corrected translation of the European patent application or European patent.Such corrected translation shall not have any legal effect until any conditions established by the Contracting State under Article 65,paragraph 2,and Article 67,paragraph 3,have been complied with mutatis mutandis; (a)必须允许专利的申请人或者所有人提交欧洲专利申请或者欧洲专利的改正译文。这种改正译文在申请人或者所有人比照履行缔约国根据第65条第2款和第67条第3款所制订的条件以前,没有任何法律效力;
 (b)may prescribe that any person who,in that State,in good faith is using or has made effective and serious preparations for using an invention the use of which would not constitute infringement of the application or patent in the original translation may,after the corrected translation takes effect,continue such use in the course of his business or for the needs thereof without payment. (b)可以规定,任何人正在该国善意使用一项发明或者已经为使用该发明进行有效和认真的准备,而这种使用不会构成对原译文的专利申请或者专利的侵权的,在改正译文生效后,可以继续在其业务中或者为该业务的需要使用该发明而无需付款。
 27.Article 75 shall be amended to read aS follows: 27.第75条修改如下:
Article 75 nbsp;Filing of a European patent application 

第75条 欧洲专利申请的提交

 (1)A European patent application may be filed: (1)欧洲专利申请可以向下列机构提交:
 (a)at the European Patent Office,or (a)向欧洲专利局提交,或者
 (b)if the law of a Contracting State so permits,and subject to Article 76,paragraph 1,at the central industrial property office or other competent authority of that State.Any application filed in this way shall have the same effect as if it had been filed on the same date at the European Patent Office. (b)如果缔约国的法律允许,并且在符合第76条第1款规定的前提下,向该国中央工业产权局或者其他主管机构提交。按此种方法提交的任何申请,与假如该申请在同一日向欧洲专利局提交具有同样的效力。
 (2)Paragraph 1 shall not preclude the application of legislative or regulatory provisions which,in any Contracting State: (2)第1款不排除缔约国下列法律或者条例规定的适用:
 (a)govern inventions which,owing to the nature of their subject—matter,may 1101 be communicated abroad without the prior authorisation of the competent authorities of that State,or(b)prescribe that any application is to be filed initially with a national authority or make direct filing with another authority subject to prior authorisation. (a)关于发明因为其主题的性质事先未经该国主管机构批准不得向国外传播的规定;或者(b)关于任何申请应当首先向本国机构提交,或者须经事先批准才能直接向另一机构提交的规定。
 28.Article 76 shall be amended to read as follows: 28.第76条修改如下:
Article 76 nbsp;European divisional applications 

第76条 欧洲分案申请

 (1)Any European divisional application shall be filed directly with the European Patent of lice in accordance with the Implementing Regulations.It may be filed only in respect of subject—matter which does not extend beyond the content of the earlier application as filed;in so far as this requirement is complied with,the divisional application shall be deemed to have been filed on the date of filing of the earlier application and shall enjoy any right of priority. (1)任何欧洲分案申请应当根据实施细则直接提交欧洲专利局。分案申请只可以就不超出在先提交的申请内容的主题提交;在遵守这一要求的限度内,分案申请应当视为在初次申请的申请日提交,并享有优先权。
 (2)All the Contracting States designated in the earlier application at the time of filing of a European divisional application shall be deemed to be designated in the divisional application. (2)在提交欧洲分案申请时,在先申请中指定的所有缔约国视为分案申请中的指定国。
 29.Article 77 shall be amended to read as follows: 29.第77条修改如下:
Article 77 nbsp;Forwarding of European patent applications 

第77条 欧洲专利申请的转送

 (1)The central industrial property office of a Contracting State shall forward to the European Patent Office any European patent application filed with it or ally other competent authority in that State,in accordance with the Implementing Regulations. (1)缔约国中央工业产权局应根据实施细则将向该局或者向该国任何其他主管机构提交的任何欧洲专利申请转送欧洲专利局。
 (2)Any European patent application the subject of which has been made secret shall not be forwarded to the European Patent Office. (2)任何欧洲专利申请,其主题已经认为应当保密的,不应转送给欧洲专利局。
 (3)Any European patent application not forwarded to the European Patent Office in due time shall be deemed to be withdrawn. (3)任何欧洲专利申请不在规定期间内转送给欧洲专利局的,应当视为撤回。
 30.Article 78 shall be amended to read its follows: 30.第78条修改如下:
