| Chapter I General Provisions | | 第一章 总则 |

| Article 1 For the purpose of strengthening the administration of the work on issuing the licenses of import and export commodities, realizing the systematic, normalized and technical administration of the issuance of licenses, and maintaining the normal order of foreign trade and economic cooperation, these Measures are formulated according to the Foreign Trade Law of the People's Republic of China and the relevant provisions of the State on the administration of licenses. | | 第一条 为加强进出口商品许可证签发工作的管理，使签发管理工作实现制度化、规范化、技术化，维护正常的外经贸经营秩序，依据《中华人民共和国对外贸易法》及国家许可证管理有关规定，特制定本办法。 |

| Article 2 The Quota and License Office (hereinafter referred to as the License Office) shall uniformly manage the national work on the issuance of licenses upon authorization of the Ministry of Commerce, and be responsible to the Ministry of Commerce. | | 第二条 配额许可证事务局（以下简称许可证局）经商务部授权统一管理全国的许可证签发工作，向商务部负责。 |

| Article 3 The License Office shall be responsible for supervising, inspecting and administrating the work of the license issuing organs of the local accredited representatives' offices under the Ministry of Commerce at all localities (hereinafter referred to as all the accredited representatives' offices) as well as the commissions (departments or bureaus) of foreign trade and economic cooperation of all the provinces, autonomous regions, municipalities directly under the Central Government, cities under separate state planning and some provincial capital cities (hereinafter referred to as all the local license issuing authorities) for issuing the licenses of import and export commodities, and shall conduct relevant professional guidance. | | 第三条 许可证局负责监督、检查、管理商务部驻各地特派员办事处（以下简称各特办）、各省、自治区、直辖市、计划单列市及部分省会城市外经贸委（厅、局）所属发证机构（以下简称各地方发证机构）的进出口商品许可证签发工作，并进行业务指导。 |

| Article 4 The License Office shall be responsible for issuing the licenses for the commodities subject to key administration of the State according to these Measures. All the accredited representatives' offices and all the local license issuing authorities (hereinafter referred to as all the license issuing authorities) shall, upon authorization of the License Office, be responsible for issuing the licenses for some import and export commodities within the authorized scope. Their work on issuing licenses shall be subject to the administration and guidance of the License Office, and they shall be responsible to the License Office. | | 第四条 许可证局负责按本办法的规定签发国家重点管理商品的许可证。各特办、各地方发证机构（以下简称各发证机构）受许可证局委托负责签发授权范围内部分进出口商品许可证。其发证业务接受许可证局的管理和指导，对许可证局负责。 |

| Chapter II Establishment of License Issuing Authorities | | 第二章 发证机构设置 |

| Article 5 The License Office shall, according to the macro requirements of the Ministry of Commerce for the administration of licenses as well as the principles of offering convenience to the enterprises and reducing the repetition of authorities, study and formulate the scheme on establishment and adjustment of license issuing authorities. | | 第五条 许可证局根据商务部对许可证管理的宏观要求，按照方便企业、减少机构重叠的原则，研究制定发证机构设置和调整方案。 |

| Article 6 As a general rule, the local license issuing authorities shall be separated from the local quota administrative department in the aspects of framework or personnel. The establishment of the license issuing authorities and its staff may be adjusted or separated by the local commission (department or bureau) of foreign trade and economic cooperation) according to the local situation. | | 第六条 地方发证机构原则上应与地方配额管理部门在机构或人员上实行分离。发证机构设置及其工作人员配备由地方外经贸委（厅、局）负责根据地方实际情况调整或分离。 |

| Article 7 Principles and conditions for a region to establish a license issuing authorities: | | 第七条 地方设立发证机构的原则及条件： |
As a general rule, one provincial administrative area may establish one license issuing authorities. A region shall meet the following requirements for establishing the license issuing authorities: | |
原则上一个省级行政区设立一个发证机构。地方设立发证机构应具备以下条件： |

| (1) having a certain amount of licenses to be issued according to the actual demands of the work; | | （一）根据工作实际需要，确有一定的发证工作量。 |
| |
|
| (2) having computers and other special facilities for issuing licenses, and having conducted the uniform network management; and | | （二）配置计算机等发证专用设备，并实行了统一的网络化管理。 |
| |
|
| (3) having full-time functionaries and managerial personnel who have political and professional qualities, and are familiar with the guidelines and polices for foreign trade and economic cooperation, the rules and systems for the administration of licenses as well as the criteria for issuing licenses. | | （三）配备有一定的政治、业务素质，熟悉外经贸方针、政策、许可证管理规章制度、签证规范的专职工作人员及管理人员。 |

| Article 8 Each local license issuing authorities shall determine the personnel scheme according to the amount of licenses to be issued, and the personnel scheme shall be reported to the License Office for archival filing. | | 第八条 各地方发证机构根据发证工作量制定人员配置方案，人员配置方案须报许可证局备案。 |
| |
|
| Article 9 The License Office shall, together with the competent departments of the Ministry of Commerce, carry out the completion-based check of the functionary offices of all the accredited representatives' offices and all the local license issuing organs, and the said license issuing organs shall not issue the licenses until they are found to be qualified upon the completion-based check. | | 第九条 许可证局会同商务部主管业务司对各特办发证业务处、各地方发证机构进行验收。经验收合格方能从事发证工作。 |

| Chapter III Responsibilities of Each License Issuing Authorities | | 第三章 各发证机构职责 |

| Article 10 Each license issuing authorities shall accept the authorization of the License Office, and issue the licenses for some import and export commodities according to the licensing catalogue of commodities subject to license administration. | | 第十条 接受许可证局委托按照许可证管理商品发证目录签发部分进出口商品许可证。 |
| |
|
| Article 11 Each license issuing authorities shall, in strict accordance with the rules, systems and criteria for the administration of licenses, accept the applications for issuing the licenses of import and export commodities and shall not issue licenses by exceeding the power or scope, and it is strictly prohibited to issue licenses without quotas or by exceeding quotas. | | 第十一条 严格按照许可证管理规章制度、签证规范受理签发进出口商品许可证，不得越权或超范围发证，严禁无配额或超配额发证。 |

| Article 12 Each license issuing authorities shall, in strict accordance with the provisions, timely and correctly report the data on issuance of import and export licenses via China International Electronic Commerce Center. | | 第十二条 严格按规定及时准确通过中国国际电子商务网上报进出口商品许可证签发数据。 |
| |
|
| Article 13 Each license issuing authorities shall be responsible for making statistics of and analyzing the conditions on the issuance of the licenses for various import and export commodities and the use of quotas of its own region or contact area, and report the comprehensive conditions to the License Office, and the License Office shall collect and analyze the conditions of all the regions, and feed back the conditions on issuance of licenses and use of quotas to the Ministry of Commerce on a monthly basis. | | 第十三条 负责本地区或联系地区各类进出口商品许可证签发及配额使用情况的统计分析工作，并将情况综合上报许可证局，由许可证局将各地情况汇总分析，按月向商务部反馈发证情况及配额使用情况。 |

| Article 14 Each license issuing authorities shall, according to the provisions of the Ministry of Commerce, establish and improve all the following internal management systems: | | 第十四条 各发证机构须根据商务部规定，建立健全下列各项内部管理制度： |

| (1) the system for internal examination and issuance of licenses; | | （一）许可证内部审核签发工作制度 |
| |
|
| (2) the system for use and keeping of seals; | | （二）印章使用保管制度 |
| |
|
| (3) the system for issuance and registration of licenses; | | （三）许可证发放登记制度 |
| |
|
| (4) the system for management of license issuing procedures; | | （四）发证程序管理制度 |
| |
|
| (5) the system for management of the equipment special for issuing licenses; | | （五）发证专用设备管理制度 |
| |
|
| (6) the system for keeping and use of blank certificates; | | （六）空白证书保管、使用登记制度 |
| |
|
| (7) the system for management of archives; and | | （七）档案管理制度 |
| |
|
| (8) the system for financial management of the charges for licenses. | | （八）许可证收费财务管理制度 |

Article 15 Each license issuing authorities shall establish the post responsibility system for acceptance, examination and approval, printing, examination (re-examination), hand-over and data transmission, etc. of the licenses of import and export commodities. The licenses of import and export commodities shall be issued upon the work procedures of two or more persons.
