| The higher people's courts, people's procuratorates, public security departments (bureaus), state security departments (bureaus) and judicial departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government; the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region, and the People's Procuratorate, the Public Security Bureau and the Judicial Bureau of Xinjiang Production and Construction Corps; all military regions, corps and headquarters; the Academy of Military Science; the National Defense University; the National University of Defense Technology; and the Political Department of the Armed Police Forces: | | 各省、自治区、直辖市高级人民法院、人民检察院、公安厅（局）、国家安全厅（局）、司法厅（局），新疆维吾尔自治区高级人民法院生产建设兵团分院、新疆生产建设兵团人民检察院、公安局、司法局，各军区、各军兵种、各总部、军事科学院、国防大学、国防科学技术大学、武警部队政治部： |
| In order to further regulate the handling of criminal cases involving both servicemen and local civilians, legally, timely and effectively crack down on crimes, protect the military interests of the state, and maintain the stability of the army and the society, the Provisions on the Handling of Criminal Cases Involving Both Servicemen and Local Civilians are hereby issued to you for your compliance and implementation. | | 为进一步规范办理军队和地方互涉刑事案件工作，依法及时有效打击犯罪，保护国家军事利益，维护军队和社会稳定，现将《办理军队和地方互涉刑事案件规定》印发你们，请遵照执行。 |
| These Provisions come into force on August 1, 2009. For any discrepancy between any previously issued provisions in this regard and these Provisions, the latter shall prevail. | | 本规定自2009年8月1日起施行。以往相关规定与本规定不一致的，以本规定为准。 |

| Provisions on the Handling of Criminal Cases Involving Both Servicemen and Local Civilians | | 办理军队和地方互涉刑事案件规定 |
| Article 1 In order to further regulate the handling of criminal cases involving both servicemen and local civilians, legally, timely and effectively crack down on crimes, protect the military interests of the state, and maintain the stability of the army and the society, these Provisions are made pursuant to the Criminal Law, the Criminal Procedure Law and other relevant provisions. | | 第一条 为了规范办理军队和地方互涉刑事案件（以下简称军地互涉案件）工作，依法及时有效打击犯罪，保护国家军事利益，维护军队和社会稳定，根据刑法、刑事诉讼法和其他有关规定，制定本规定。 |
| Article 2 These Provisions apply to: | | 第二条 本规定适用于下列案件： |
| (1) cases of crimes jointly committed by servicemen and local civilians; | | （一）军人与地方人员共同犯罪的； |
| (2) cases of crimes committed by servicemen outside military camps; | | （二）军人在营区外犯罪的； |
| (3) cases of crimes committed by servicemen inside military camps which infringe upon non-military interests; | | （三）军人在营区侵害非军事利益犯罪的； |
| (4) cases of crimes committed by local civilians inside military camps; | | （四）地方人员在营区犯罪的； |
| (5) cases of crimes committed by local civilians outside military camps which infringe upon military interests; and | | （五）地方人员在营区外侵害军事利益犯罪的； |
| (6) other cases the handling of which requires collaboration between the army and the local authorities. | | （六）其他需要军队和地方协作办理的案件。 |
| Article 3 In the handling of cases involving both servicemen and local civilians, the principles of division of work with individual responsibility, mutual cooperation, timeliness, compliance, and legality shall be followed. | | 第三条 办理军地互涉案件，应当坚持分工负责、相互配合、及时规范、依法处理的原则。 |
| Article 4 The jurisdiction over the investigation, prosecution and trial of servicemen falls upon military security departments, military procuratorates and military courts. The jurisdiction over civilian staff, office attendants of non-active duty, employees on the payroll of the army, honorary and normal retirees under the management of the army, and reserve forces and other personnel carrying out military tasks shall be determined according to provisions governing servicemen. | | 第四条 对军人的侦查、起诉、审判，由军队保卫部门、军事检察院、军事法院管辖。军队文职人员、非现役公勤人员、在编职工、由军队管理的离退休人员，以及执行军事任务的预备役人员和其他人员，按照军人确定管辖。 |
| The jurisdiction over the investigation, prosecution and trial of local civilians falls upon local public security organs, state security organs, people's procuratorates and people's courts. The jurisdiction over public security frontier defense forces, firefighting forces and guard forces included in the Chinese People's Armed Police Force shall be determined according to provisions governing local civilians. | | 对地方人员的侦查、起诉、审判，由地方公安机关、国家安全机关、人民检察院、人民法院管辖。列入中国人民武装警察部队序列的公安边防、消防、警卫部队人员，按照地方人员确定管辖。 |
| Article 5 A case which occurred inside military camps shall be opened for investigation by a military security department or a military procuratorate. If the criminal suspect is uncertain and the interests infringed upon are non-military, the military security department or the military procuratorate shall, together with the local public security organ, state security organ or people's procuratorate, jointly organize investigation according to the division of jurisdictions between them. If it has been ascertained that the criminal suspect is subject to jurisdiction described in Paragraph 2, Article 4 of these Provisions, the case shall be transferred to the local public security organ, state security organ or people's procuratorate for handling. | | 第五条 发生在营区的案件，由军队保卫部门或者军事检察院立案侦查；其中犯罪嫌疑人不明确且侵害非军事利益的，由军队保卫部门或者军事检察院与地方公安机关或者国家安全机关、人民检察院，按照管辖分工共同组织侦查，查明犯罪嫌疑人属于本规定第四条第二款规定管辖的，移交地方公安机关或者国家安全机关、人民检察院处理。 |
| A case which occurred outside military camps shall be opened for investigation by the local public security organ, state security organ or people's procuratorate. If it has been ascertained that the criminal suspect is subject to jurisdiction described in Paragraph 1, Article 4 of these Provisions, the case shall be transferred to the military security department or military procuratorate for handling. | | 发生在营区外的案件，由地方公安机关或者国家安全机关、人民检察院立案侦查；查明犯罪嫌疑人属于本规定第四条第一款规定管辖的，移交军队保卫部门或者军事检察院处理。 |
Article 6 For a case which occurred at a barrack, yard, airport, dock or any other area jointly used by servicemen and local civilians, if it occurred in an area under the management of the army, it shall be handled under Paragraph 1, Article 5 of these Provisions; if it occurred in an area under the management of local authorities, it shall be handled under Paragraph 2, Article 5 of these Provisions. If it is hard to determine whether it is a military or local management area, the army and the local competent authority shall handle it upon negotiation.
