Measures for the Protection of Foreign Geographical Indication Products 

国外地理标志产品保护办法

Chapter I General Provisions 

第一章 总 则

Article 1 These Measures are enacted by the General Administration of Quality Supervision, Inspection and Quarantine under Article 26 of the Provisions on the Protection of Geographical Indication Products for purposes of effectively protecting the foreign geographical indication products on sale in China, and regulating the use of names of and special marks on foreign geographical indication products in China.   第一条 为了有效保护在中国销售的国外地理标志产品,规范国外地理标志产品名称和专用标志在华使用,依据《地理标志产品保护规定》第二十六条,制定本办法。
Article 2 For the purpose of these Measures, “foreign geographical indication products” means products made outside China, already granted registration and protection by the country or region of origin, and comply with the provisions of Article 2 of the Provisions on the Protection of Geographical Indication Products.   第二条 本办法所称国外地理标志产品,是指在中国以外生产、已受原产国或地区注册保护并符合《地理标志产品保护规定》第二条规定的产品。
Article 3 In accordance with these Measures, a foreign geographical indication product shall apply for protection in China under the agreement concluded between the country which the product is from and the People's Republic of China, or the international treaty acceded to by China and the country, or in accordance with the principle of reciprocity.   第三条 依照本办法,申请在华保护的国外地理标志产品,应当按其所属国和中华人民共和国签订的协议或者共同参加的国际条约办理,或者按对等原则办理。
Article 4 These Measures shall apply to the application, acceptance, examination, and approval, and the use of special marks, supervision, management, modification and revocation of foreign geographical indication products protected in China.   第四条 在中国保护(简称“在华保护”)的国外地理标志产品的申请、受理、审查、批准、专用标志使用、监督管理和变更撤销等适用本办法。
Article 5 The name of a foreign geographical indication product protected in China shall include the name in Chinese language and the name in source language.   第五条 国外地理标志产品在华保护名称包括中文名称和原文名称。
(1) The “name in Chinese language” shall consist of the name with graphically indicating functions and the generic name reflecting the truthful properties; or may also mean the name “established by usage.” (一)中文名称,由具有地理指示功能的名称和反映产品真实属性的通用名称构成,也可是“约定俗成”的名称;
(2) The “name in source language” means the name granted registration and protection as geographical indication in the country or region of origin. (二)原文名称,是指在原产国或地区获得地理标志注册保护的名称;
(3) The aforesaid names are not generic names in China or do not conflict with the names of China's geographical indication products or other prior rights. (三)上述名称在中国不属于通用名称,且未与中国的地理标志产品名称等其他在先权利相冲突。
Article 6 The China National Intellectual Property Administration (“CNIPA”) shall uniformly administer the protection of foreign geographical indication products in China. The administrative departments of intellectual property at all levels shall implement protection of foreign geographical indication products in accordance with their respective functions and duties.   第六条 中国国家知识产权局(以下简称“国家知识产权局”)统一管理国外地理标志产品在华保护工作。各级知识产权管理部门依据职能对国外地理标志产品实施保护。
Chapter II Application and Acceptance 

第二章 申请与受理

Article 7 The protection of a foreign geographical indication product in China shall be applied for to the CNIPA by the same applicant for the geographical indication protection in its country or region of origin, upon the recommendation of the geographical indication competent authority of the country or region of origin.   第七条 国外地理标志产品在华保护,由该产品所在原产国或地区地理标志保护的原申请人申请,经原产国或地区地理标志主管部门推荐,向国家知识产权局提出。
Article 8 The applicant for protection of a foreign geographical indication product may designate its institution in China as the contact person for the protection in China, or may consult with and ask any staff member of the embassy of the country or region of origin in China as the contact person or designated representative for the protection in China.   第八条 国外地理标志产品在华保护申请人可以指定其在华机构作为在华保护工作的联系人,也可商请原产国或地区官方驻华代表机构工作人员作为在华保护工作的联系人,或指定代理人。
Article 9 To apply for the protection of a foreign geographical indication product, the following documents in writing in Chinese language shall be submitted:   第九条 国外地理标志产品在华保护申请需提供以下中文书面材料:
(1) Application for the protection of the foreign geographical indication product; (一)国外地理标志产品在华保护申请书;
(2) the name, address, telephone number of the applicant, and address and telephone number of the contact person in China; (二)申请人名称和地址、联系电话,在华联系人、地址和联系电话;
(3) the original of the official certification document granting the protection of geographical indication in the country or region of origin and its notarized Chinese translation; (三)在原产国或地区获准地理标志保护的官方证明文件原件及其经过公证的中文译本;
(4) range of production place issued by the geographical indication competent agency of the country or region of origin and its notarized Chinese translation; (四)原产国或地区地理标志主管机构出具的产地范围及其经过公证的中文译本;
(5) quality and technical requirements of such product; (五)该产品的质量技术要求;
(6) the testing report: the testing report proving the sensory characteristics and physiochemical indicators of the product under application as issued by the country or region of origin and its notarized Chinese translation; and (六)检测报告:原产国或地区出具的,证明申请产品感官特色、理化指标的检测报告及其经过公证的中文译本;
(7) other supporting proof and documents, etc. (七)其他辅助证明资料等。
Article 10 The quality and technical requirements of a foreign geographical indication product protected in China shall include:   第十条 在华保护的国外地理标志产品质量技术要求包括:
(1) Name of the product in Chinese language and in source language; (一)产品的中文名称和原文名称;
(2) protected range of production place; (二)保护的产地范围;
(3) product properties and production technique procedures; (三)产品属性及其生产工艺过程;
(4) quality features, including the sensory characteristics and physiochemical indicator, among others; (四)质量特色,包括产品的感官特色、理化指标等;
(5) popularity, popularity, trade and sale of the product in country (region) of origin, China and other countries and regions in the world; and
......
 (五)知名度,产品在原产国(地区)、中国以及世界其他国家和地区的知名度与贸易销售情况;
......
