| Article 1 This Regulation is developed for the purposes of strengthening the protection of Olympic symbols, safeguarding the lawful rights and interests of the right holders of Olympic symbols and promoting the development of the Olympic Movement. | | 第一条 为了加强对奥林匹克标志的保护，保障奥林匹克标志权利人的合法权益，促进奥林匹克运动发展，制定本条例。 |
| Article 2 For the purposes of this Regulation, “Olympic symbols” means the following: | | 第二条 本条例所称奥林匹克标志，是指： |
| (1) The Olympic symbol of five interlaced rings, the Olympic flag, the Olympic motto, the Olympic emblem and the Olympic anthem of the International Olympic Committee. | | （一）国际奥林匹克委员会的奥林匹克五环图案标志、奥林匹克旗、奥林匹克格言、奥林匹克徽记、奥林匹克会歌； |
| (2) The exclusive expressions such as “Olympic,” “Olympia,” and “Olympic Games” and the abbreviations thereof. | | （二）奥林匹克、奥林匹亚、奥林匹克运动会及其简称等专有名称； |
| (3) The name, emblem and symbol of the Chinese Olympic Committee. | | （三）中国奥林匹克委员会的名称、徽记、标志； |
| (4) The name, emblem and symbol of the institution that applies for hosting the Olympic Games inside China. | | （四）中国境内申请承办奥林匹克运动会的机构的名称、徽记、标志； |
| (5) The name, abbreviation, mascots, anthem, torch modeling, slogan, “Name of the Host City + Year of the Olympic Games” and other symbols of the Olympic Games hosted inside China, and the name and emblem of the organizer thereof. | | （五）在中国境内举办的奥林匹克运动会的名称及其简称、吉祥物、会歌、火炬造型、口号、“主办城市名称＋举办年份”等标志，以及其组织机构的名称、徽记； |
| (6) Other symbols related to the Olympic Games hosted inside China laid down in the Olympic Charter and the Host City Contract for the relevant Olympic Games. | | （六）《奥林匹克宪章》和相关奥林匹克运动会主办城市合同中规定的其他与在中国境内举办的奥林匹克运动会有关的标志。 |
| Article 3 For the purpose of this Regulation, “right holders of Olympic symbols” means the International Olympic Committee, the Chinese Olympic Committee and the organization that applies for hosting the Olympic Games inside China, and the organizer of the Olympic Games hosted inside China. | | 第三条 本条例所称奥林匹克标志权利人，是指国际奥林匹克委员会、中国奥林匹克委员会和中国境内申请承办奥林匹克运动会的机构、在中国境内举办的奥林匹克运动会的组织机构。 |
| The rights of the International Olympic Committee, the Chinese Olympic Committee, the organization that applies for hosting the Olympic Games inside China, and the organizer of the Olympic Games hosted inside China, respectively, shall be determined in accordance with the Olympic Charter and the Host City Contract for the relevant Olympic Games. | | 国际奥林匹克委员会、中国奥林匹克委员会和中国境内申请承办奥林匹克运动会的机构、在中国境内举办的奥林匹克运动会的组织机构之间的权利划分，依照《奥林匹克宪章》和相关奥林匹克运动会主办城市合同确定。 |
| Article 4 The right holders of Olympic symbols shall enjoy the exclusive rights to the Olympic symbols in accordance with this Regulation. | | 第四条 奥林匹克标志权利人依照本条例对奥林匹克标志享有专有权。 |
| No one may use Olympic symbols for commercial purposes without the authorization of the right holders of the Olympic symbols. | | 未经奥林匹克标志权利人许可，任何人不得为商业目的使用奥林匹克标志。 |
| Article 5 For the purpose of this Regulation, “use for commercial purposes” means the use of Olympic symbols for profit-making purposes in the following ways: | | 第五条 本条例所称为商业目的使用，是指以营利为目的，以下列方式利用奥林匹克标志： |
| (1) Using Olympic symbols on commodities, commodity packages or containers, or commodity trading documents. | | （一）将奥林匹克标志用于商品、商品包装或者容器以及商品交易文书上； |
| (2) Using Olympic symbols in services. | | （二）将奥林匹克标志用于服务项目中； |
| (3) Using Olympic symbols in advertising and publicity, commercial exhibitions, for-profit performances and other commercial activities. | | （三）将奥林匹克标志用于广告宣传、商业展览、营业性演出以及其他商业活动中； |
| (4) Selling, importing or exporting commodities bearing Olympic symbols. | | （四）销售、进口、出口含有奥林匹克标志的商品； |
| (5) Producing or selling Olympic symbols. | | （五）制造或者销售奥林匹克标志； |
| (6) Other acts of using Olympic symbols for profits. | | （六）其他以营利为目的利用奥林匹克标志的行为。 |
| Article 6 Unless otherwise provided for in Article 5 of this Regulation, the utilization of elements related to the Olympic Movement which might mislead people into believingthat there are sponsorship or other support relations between the users and the right holders of the Olympic Symbols or constitutes unfair competition shall be handled in accordance with the Anti-Unfair Competition Law of the People's Republic of China. | | 第六条 除本条例第五条规定外，利用与奥林匹克运动有关的元素开展活动，足以引人误认为与奥林匹克标志权利人之间有赞助或者其他支持关系，构成不正当竞争行为的，依照《中华人民共和国反不正当竞争法》处理。 |
Article 7 The market regulatory department and the intellectual property department of the State Council shall, in accordance with the provisions of this Regulation, be responsible for the protection of Olympic symbols throughout the country.
