| Chapter I General Provisions | | 第一章 总则 |
| Article 1 These measures are developed according to the Decision of the Standing Committee of the National People's Congress on the Administration of Judicial Authentication and other applicable laws and regulations, in light of the actual work of public security authorities, for the purposes of regulating the administration of the registration of the qualification of authenticators of public security authorities and meeting the needs for cracking down on crimes, protecting the people, and maintaining social security and stability and equitable administration of justice. | | 第一条 为规范公安机关鉴定人资格登记管理工作，适应打击犯罪、保护人民、维护社会治安稳定和司法公正的需要，根据《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》和有关法律、法规，结合公安机关工作实际，制定本办法。 |
| Article 2 For the purpose of these Measures, “authenticator of a public security authority” (hereinafter referred to as the “authenticator”) means a professional technician who, with the confirmation by and registration with the registration administration department of the public security authority, holds an authenticator qualification and engages in authentication work. | | 第二条 本办法所称的公安机关鉴定人（以下简称鉴定人），是指经公安机关登记管理部门核准登记，取得鉴定人资格证书并从事鉴定工作的专业技术人员。 |
| Article 3 For the purpose of these Measures, “authentication” means empirical activities that the authenticators of the authentication institutions of public security authorities use the theoretical results and technical methods of natural sciences and social sciences to inspect, identify, analyze, and judge the person, corpses, biological samples, traces, documents, certificates, audiovisual recordings, electronic data, and other related items and substances, in order to solve certain specialized problems in the investigation of cases (events) and legal proceedings, and issue authentication opinions or inspection results. | | 第三条 本办法所称的鉴定，是指为解决案（事）件调查和诉讼活动中某些专门性问题，公安机关鉴定机构的鉴定人运用自然科学和社会科学的理论成果与技术方法，对人身、尸体、生物检材、痕迹、文件、证件、视听资料、电子数据及其它相关物品、物质等进行检验、鉴别、分析、判断，并出具鉴定意见或者检验结果的科学实证活动。 |
| Article 4 The administration of the registration of authenticators shall comply with the relevant national laws and regulations and these Measures and follow the principles of legality, equity, and timeliness, so as to ensure well-regulated, orderly, and efficient administration of registration. | | 第四条 鉴定人的登记管理工作应当根据国家有关法律法规和本办法的规定，遵循依法、公正、及时的原则，保证登记管理工作规范、有序、高效。 |
| Chapter II Registration Administration Departments | | 第二章 登记管理部门 |
| Article 5 The Ministry of Public Security and the public security departments and bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government shall establish or designate a unified registration administration department to be responsible for the review and registration of authenticator qualifications, annual inspection, modification, disqualification, reconsideration, compilation and filing of registers, and supervision and punishment, among others. | | 第五条 公安部和各省、自治区、直辖市公安厅、局设立或者指定统一的登记管理部门，负责鉴定人资格的审核登记、年度审验、变更、注销、复议、名册编制与备案、监督管理与处罚等。 |
| Article 6 The registration administration department of the Ministry of Public Security shall be responsible for the administration of the registration of the authenticators of the public security departments and bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government, the research institutes, education institutions, and professional technician associations affiliated with the Ministry, and the National Immigration Administration and the entities affiliated with it. | | 第六条 公安部登记管理部门负责各省、自治区、直辖市公安厅、局，部属科研机构、院校和专业技术协会，国家移民管理局及其所属单位鉴定人的登记管理工作。 |
| The registration administration departments of the public security departments and bureaus of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the administration of the registration of the authenticators of public security authorities at prefecture, municipal and county levels and the education institutions, hospitals, and professional technician associations affiliated with provincial public security authorities. | | 省、自治区、直辖市公安厅、局登记管理部门负责所属地市级、县级公安机关，以及省级公安机关所属院校、医院和专业技术协会的鉴定人的登记管理工作。 |
| Article 7 A registration administration department shall not charge any applicant for the registration of authentication qualification or any authenticator a fee for registration administration. | | 第七条 登记管理部门不得收取鉴定资格登记申请人和鉴定人的任何登记管理费用。 |
| The relevant business cost of registration administration departments shall be included respectively in the annual budgets of the Ministry of Public Security and the public security departments and bureaus of all provinces, autonomous regions and municipalities directly under the Central Government. | | 登记管理部门的有关业务经费分别列入公安部和各省、自治区、直辖市公安厅、局的年度经费预算。 |
| Chapter III Qualification Registration | | 第三章 资格登记 |
| Article 8 An authenticator may engage in authentication only after he has obtained the Authenticator Qualification with the confirmation by and registration with a registration administration department. The Authenticator Qualification shall be uniformly managed by the authentication institution with which the authenticator works. | | 第八条 鉴定人经登记管理部门核准登记，取得《鉴定人资格证书》，方可从事鉴定工作。《鉴定人资格证书》由所在鉴定机构统一管理。 |
| Authenticator Qualifications shall be made under the supervision of the Ministry of Public Security. | | 《鉴定人资格证书》由公安部统一监制。 |
| Article 9 An individual applying for qualification as an authenticator shall meet the following requirements: | | 第九条 个人申请鉴定人资格，应当具备下列条件： |
| (1) An active or retired people's police officer with technical expertise and skills; or a professional technician employed by any public security authority holding a permanent administrative position or public institution position. | | （一）在职或者退休的具有专门技术知识和技能的人民警察；公安机关聘用的具有行政编制或者事业编制的专业技术人员； |
| (2) Complying with the national laws and regulations and the professional ethics of the people's police. | | （二）遵守国家法律、法规，具有人民警察职业道德； |
(3) Holding qualification for a senior technical police position or a senior professional technical title related to the authentication item with respect to his or her application, or a bachelor degree or above in a related discipline awarded by a higher education institution, and having engaged in the related work or research for more than five years, or having more than ten years' experience in the work related to the authentication item with respect to his or her application and relatively considerable professional skills.
