| Opinions on Further Strengthening the Trial Supervision and Administration Work of the Supreme People's Court (for Trial Implementation) | | 进一步加强最高人民法院审判监督管理工作的意见（试行） |
For the purposes of further regulating and improving the trial supervision and administration mechanism of the Supreme People's Court (“SPC”), promoting strict administration of justice, and building honest administration of justice, these Opinions are developed according to the Organic Law of the People's Courts, the Criminal Procedure Law, the Civil Procedure Law | | 为进一步规范和完善最高人民法院审判监督管理机制，推进严格司法，建设廉洁司法，根据人民法院组织法、刑事诉讼法、民事诉讼法、行政诉讼法等法律及相关司法解释规定，结合本院工作实际，制定本意见。 |
| I. Basic Principles. | | 一、基本原则 |
| 1. The Party's absolute leadership over the work of the people's courts shall be insisted on, the Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era shall be regarded as the guidance, “four consciousnesses” shall be strengthened and “four self-confidences” shall be insisted on, “two maintenance” shall be achieved, and the path of rule of law with Chinese characteristics shall be unswervingly taken, to ensure that the Party's paths, guidelines, and policies are strictly implemented in the trial and enforcement of the people's courts. | | 1.坚持党对人民法院工作的绝对领导，以习近平新时代中国特色社会主义思想为指导，增强“四个意识”坚定“四个自信”，做到“两个维护”，坚定不移走中国特色社会主义法治道路，确保党的路线、方针、政策在人民法院审判执行工作中得到严格贯彻落实。 |
| 2. Various work arrangements of the CPC Central Committee for deepening the comprehensive and supporting reform of the judicial system and comprehensively implementing the judicial responsibility system shall be diligently implemented, the reform requirements of “allowing triers to adjudicate, and requiring adjudicators to be responsible” shall be strictly implemented, joint efforts shall be made for establishing a trial supervision and administration system characterized by comprehensive coverage, scientific norms, and effective supervision and administration, and the unity of orderly delegating powers to lower levels and effective supervision shall be realized. | | 2.认真贯彻党中央关于深化司法体制综合配套改革、全面落实司法责任制的各项工作部署，严格落实“让审理者裁判，由裁判者负责”的改革要求，着力构建全面覆盖、科学规范、监管有效的审判监督管理制度体系，实现有序放权与有效监督相统一。 |
| 3. Problem and target orientation shall be insisted on, prominent problems and vulnerable respects in the trial supervision and administration shall be brought into focus, the division of responsibilities, standardized business processes, and refined work requirements shall be specified in a targeted manner, and the judicial supervision and administration entities at all levels shall be comprehensively urged to fully perform the functions of trial supervision and administration. | | 3.坚持问题导向和目标导向，聚焦当前在审判监督管理方面存在的突出问题和薄弱环节，有针对性地明确职责分工、规范业务流程、细化工作要求，全面推动各级审判管理主体充分履行审判监督管理职责。 |
| II. Trial Process Administration | | 二、审判流程管理 |
| 4. The case distribution rules dominated by random distribution of cases and supplemented by appointed distribution of cases shall be implemented. | | 4.实行以随机分案为主、指定分案为辅的分案规则。 |
| The following cases shall be subject to appointed distribution: | | 下列案件实行指定分案： |
| (1) a case to which one party is the same and that has objective relevance in facts, legal relationships, causes of action, procedures, and other respects; | | （1）一方当事人相同，且在事实、法律关系、案由、程序等方面存在客观关联性的案件； |
| (2) a case handled by the president and divisional chief; and | | （2）院庭长承办的案件； |
| (3) cases included in the scope of trial supervision and administration by presidents and divisional chiefs. | | （3）纳入院庭长审判监督管理范围的案件。 |
| For a case subject to appointed distribution, the specific reasons shall be specified in the case handling system. | | 指定分案的，应当在办案系统内注明具体原因。 |
| 5. After distribution of cases, the judges handling the case and other members of the collegial benches shall not be changed as a general rule. | | 5.分案后，一般不得变更承办法官及其他合议庭成员。 |
| Under one of the following circumstances, the divisional chief may change the judge handling the case and other members of the collegial bench: | | 有下列情形之一的，院庭长可以变更承办法官及其他合议庭成员： |
| (1) The judge handling the case and other members of the collegial bench need to be disqualified. | | （1）承办法官及其他合议庭成员需要回避的； |
| (2) The judge handling the case and other members of the collegial bench need to be disengaged from work for not less than one month due to objective reasons. | | （2）承办法官及其他合议庭成员因客观原因需要脱产一个月以上的； |
| (3) Change needs to be conducted due to the trial supervision and administration work. | | （3）因审判监督管理工作需要变更的。 |
| To change a judge handling the case and other members of the collegial bench, the specific reasons shall be indicated in the case handling system. | | 变更承办法官及其他合议庭成员的，应当在办案系统中注明具体理由。 |
| 6. According to the needs of the trial supervision and administration work, a president or divisional chief may determine that the following cases shall be heard by a five-person collegial bench: | | 6. 根据审判监督管理工作需要，院庭长可以确定由五人组成合议庭审理下列案件： |
| (1) criminal cases under trial on appeal, civil cases under trial on appeal, and administrative cases under trial on appeal; | | （1）刑事二审、民事二审、行政二审案件； |
| (2) criminal cases under trial on retrial, civil cases under trial on retrial, and administrative cases under trial on retrial; | | （2）刑事再审、民事再审、行政再审案件； |
| (3) difficult and complicated enforcement reconsideration and enforcement supervision cases; and | | （3）疑难、复杂的执行复议、执行监督案件； |
| (4) other major, difficult, complicated and new-type cases. | | （4）其他重大、疑难、复杂、新类型案件。 |
| 7. The presiding judge of a case shall generally be a senior judge at or above level 2, and may also be designated by the president or divisional chief according to the work needs. | | 7.案件审判长一般由二级以上高级法官担任，也可由院庭长根据工作需要指定。 |
| The case handling system shall, according to the rules of random distribution of cases, automatically match the presiding judge, the judge handling the case and other members of the collegial bench for each case; and after the divisional chief conducts confirmation or adjustment within 3 working days, distribution of cases is completed. The case distribution process shall be completely recorded in the case handling system. | | 办案系统根据随机分案规则为每个案件自动匹配审判长、承办法官以及合议庭其他成员；庭长在三个工作日内进行确认或调整后，分案完成。分案过程在办案系统全程留痕。 |
| 8. In the trial of a case, a judge handling the case shall, through www.wenshu.court.gov.cn/, the case handling system, the file system, www.faxin.cn, and other relevant search tools, comprehensively retrieve similar cases and correlated cases closed or under trial and develop a research report. | | 8.承办法官在审理案件时，应当依托中国裁判文书网、办案系统、档案系统、法信等相关检索工具，对本院已审结或正在审理的类案与关联案件进行全面检索，并制作检索报告。 |
