The Provisions on the Simplified Procedures for International Filing of Satellite Networks (For Trial Implementation), as adopted at the 9th minister's executive meeting of the Ministry of Industry and Information Technology in 2019, is hereby issued to you for your earnest implementation. 《卫星网络国际申报简易程序规定(试行)》已经2019年第9次部长办公会议审议通过,现印发给你们,请认真贯彻执行。

Provisions on the Simplified Procedures for International Filing of Satellite Networks (For Trial Implementation) 卫星网络国际申报简易程序规定(试行)
Article 1 For the purposes of accelerating the international filing of satellite networks, simplifying the filing procedures, and improving the filing efficiency, the Provisions are developed in accordance with the Radio Regulation of the People's Republic of China.   第一条 为加快卫星网络国际申报,简化申报程序,提升申报效率,根据《中华人民共和国无线电管理条例》,制定本规定。
Article 2 “Simplified procedures” means the process in which Chinese satellite operators submit their satellite network filings to the International Telecommunication Union (“ITU”) through the Ministry of Industry and Information Technology (“MIIT”) and coordinate with other satellite operators in China under the principle of “filing first and then coordination”.   第二条 简易程序是指,境内卫星操作单位按照先申报后协调的原则,通过工业和信息化部向国际电信联盟(以下简称国际电联)报送卫星网络资料,并开展国内协调等相应工作的流程。
Simplified procedures shall apply to the filing of Advance Publication Information (“API”) and coordination materials of satellite networks in non-planned frequency bands or PART A information of satellite networks in planned frequency bands under any of the following conditions: 拟申报非规划频段卫星网络的提前公布资料、协调资料或规划频段的PART A资料,且符合下列条件之一的,适用简易程序:
1. filing of a geostationary satellite network, which has two degrees of spatial separation from any geostationary satellite network filed by China; (一)拟申报静止轨道卫星网络且与我国已申报的静止轨道卫星网络间隔超过2度(不含2度);
2. filing of a remote-sensing and aerospace non-geostationary satellite networks; (二)拟申报遥感和空间科学非静止轨道卫星网络;
3. filing of a small communication and navigation satellite demonstration system, with less than ten satellites in principle which have operated on-orbit for less than three years; or (三)拟申报小型通信和导航试验星座系统,原则上卫星数量应少于10颗(不含10颗)且在轨工作时间少于3年(不含3年);
4. major satellite projects approved by the State Council and the Central Military Commission. (四)国务院、中央军委批准的重大卫星工程。
The filing of other satellite networks shall be carried out in accordance with the Measures for the Management of Filing, Coordination, Registration and Maintenance of Satellite Networks (For Trial Implementation)

 其他卫星网络的申报按照《卫星网络申报协调与登记维护管理办法(试行)》(工信部无〔2017〕3号)规定的程序开展。
The matters involving the filing of military system satellite networks shall be handled by the electromagnetic spectrum regulatory authority of the Army. 涉及军事系统卫星网络申报事宜,由军队电磁频谱管理机构归口办理。
The matters involving the filing of satellite networks by Hong Kong or Macao shall be handled in accordance with the relevant provisions of the Chinese Mainland, Hong Kong Special Administrative Region and Macao Special Administrative Region. 涉及香港、澳门的卫星网络申报事宜,按照内地与香港、澳门特别行政区有关规定办理。
Article 3 A satellite network filed with the ITU shall meet the relevant provisions and requirements on radio management as prescribed in the ITU's Radio Regulations and the Provisions of the People's Republic of China on Radio Spectrum Allocations. A satellite network involving amateur-satellite services shall also meet the technical and use requirements of the International Amateur Radio Union.   第三条 向国际电联申报的卫星网络应当符合国际电联《无线电规则》以及《中华人民共和国无线电频率划分规定》等无线电管理相关规定和要求。涉及使用卫星业余无线电业务的,还应当符合国际业余无线电联盟有关技术和使用要求。
A satellite operator shall self-check the technical parameters in the filing materials of a satellite network so as to ensure that the parameter characteristics meet the above-mentioned provisions and requirements. 卫星操作单位应开展对拟申报卫星网络资料技术参数的自查,确保卫星网络资料参数特性符合上述规定和要求。
Article 4 A satellite operator that files a satellite network with the ITU according to Article 2 of the Provisions shall submit the following materials to the MIIT:   第四条 卫星操作单位依据本规定第二条向国际电联申报卫星网络的,应向工业和信息化部提交下列材料:
1. filing documents, a feasibility study report on radio frequencies and orbital resources, instructions on self-check of parameter characteristics, and a letter of commitment for the filing of a satellite network, as well as an authorization document if authorization is required (see Annex 1 for a list of the materials and templates); (一)申报文件、卫星频率和轨道资源可行性论证报告、卫星网络参数特性自查说明、卫星网络申报承诺书,涉及委托关系的,还应提供相关委托文件(有关材料清单及模板见附件1);
2. electronic documents listed in Appendix 4 of the Radio Regulations and the relevant resolutions and generated by using software designated by the ITU; and (二)使用国际电联指定软件填报生成的《无线电规则》附录4和相关决议所列的电子版文件;
3. other materials required by the MIIT. (三)工业和信息化部要求的其他材料。
If any major change occurs to the above materials, the satellite operator concerned shall submit the modified materials to the MIIT in a timely manner. 上述信息如发生重大变化,卫星操作单位应当及时向工业和信息化部报送变更后的材料。
If the filing materials submitted by a satellite operator are returned or deleted due to its own reasons, such as incomplete filing materials, noncompliant parameter characteristics, or timeout for filing, the satellite operator shall bear the consequences on its own. 对于卫星操作单位因申报材料不齐全、参数特性不符合规定、申报时间超过时限等自身原因造成卫星网络资料被退回、删除的,有关后果由卫星操作单位自行承担。
Article 5 After receiving the filing materials and database documents, the MIIT shall accept and handle it properly. The satellite network filings that meet the requirements of the Provisions shall be submitted to the ITU by the MIIT.   第五条 工业和信息化部收妥申报材料和数据库文件后,予以受理。对于符合本规定要求的卫星网络资料,由工业和信息化部报送国际电联。
Article 6 After submitting the filing materials of a satellite network to the ITU, the MIIT shall solicit the opinions of the relevant departments and authorities in China on coordination by email, an information-based system or other electronic means. If coordination is required, the relevant departments and authorities shall, within ten working days, send their feedbacks to the MIIT by electronic means and copy them to the operator filing the satellite network.   第六条 卫星网络资料报送国际电联后,工业和信息化部通过电子邮件或信息系统等电子方式征求国内相关部门和单位的协调意见。需开展相应国内协调的,相关部门和单位应通过电子方式在10个工作日内反馈意见,并抄送申报单位。
Article 7 The MIIT shall determine the coordination relations among different departments and authorities for a satellite network in accordance with the ITU's Radio Regulations and the Provisions of the People's Republic of China on Radio Spectrum Allocations哎哟不错哦 and the feedbacks of the relevant departments and authorities, and create a table of domestic coordination for satellite networks (see Annex 2 for a template of the table). The list shall in principle be released by electronic means once every month.   第七条 工业和信息化部按照国际电联《无线电规则》和《中华人民共和国无线电频率划分规定》等无线电管理相关规定,根据相关部门和单位反馈的协调意见,确定卫星网络的国内协调关系,形成卫星网络国内协调清单(清单模板见附件2)。国内协调清单通过电子方式原则上每月公布一次。
Article 8 The coordination positions of different departments and authorities for a satellite network shall be determined according to the time of accepting the filing materials of the satellite network and, if necessary, by comprehensively considering such factors as satellite project planning and demonstration. The coordination shall be carried out according to the positions of different departments and authorities, and follow the principle of “secondary services yielding to primary ones, late uses yielding to early ones, and non-planned assignments yielding to planned ones”.   第八条 卫星网络的国内协调地位依据卫星网络资料受理时间的先后确定,必要时还应统筹考虑卫星工程规划和论证等因素。卫星网络的国内协调根据其协调地位开展,并遵循次要业务让主要业务、后用让先用、无规划让有规划的原则。
Article 9 The coordination among satellite networks in China shall be properly planned in advance and actively promoted, and be completed one month before the ex-factory evaluation of the satellite and the review of approving the satellite launch. Only after the domestic coordination and necessary international coordination are completed can a satellite operator apply for submitting the notification information of a satellite network, and launch and put the satellite into use. If a satellite fails to be launched, the notification information fails to be submitted, or the satellite system fails to be normally used due to uncompleted domestic coordination, the satellite operator concerned shall bear the consequences on its own.   第九条 卫星网络的国内协调应当提前谋划、积极推进,最迟应在卫星出厂评审或卫星发射许可评审前一个月完成。完成国内协调及必要的国际协调后,方可申请报送卫星网络的通知资料,以及发射并投入使用卫星。对于因国内协调未完成造成卫星无法发射、通知资料无法报送、卫星系统无法正常投入使用等后果的,由卫星操作单位自行承担。
Article 10 When the operator filing a satellite network is conducting domestic coordination, other satellite operators shall cooperate and provide the data required for the coordination. Those that refuse to cooperate on the coordination, fail to offer substantial coordination opinions within a specified time limit after the MIIT urges it to do so, or whose opinions lack the support of reasonable data analysis shall be deemed as having no opinion. If two parties feel it hard to reach a consensus due to significant technical differences, or the conclusion after coordination is apparently unreasonable, the operator filing the satellite network shall request the MIIT to arrange for experts to review it and promote the domestic coordination.   第十条 申报单位开展国内协调工作时,其他卫星操作单位应予配合,并提供协调所需的相关数据。拒不配合开展协调、经工业和信息化部催办后在规定时限内仍未提出实质性协调意见,或相关协调意见无合理数据分析支撑的,视同无协调意见。对于双方技术分歧较大、难以达成共识,或相关协调结论明显不合理的,申报单位可提请工业和信息化部组织开展专家评审,推进国内协调工作。
Article 11 Other matters involving the international coordination, registration and maintenance of a satellite network and those not prescribed in the Provisions shall be implemented in accordance with the Measures for the Management of Filing, Coordination, Registration and Maintenance of Satellite Networks (For Trial Implementation).   第十一条 涉及卫星网络的国际协调、登记和维护以及本规定未规定的其他事项,按照《卫星网络申报协调与登记维护管理办法(试行)

Article 12 The Provisions shall come into force on August 1, 2019.   第十二条 本规定自2019年8月1日起施行。

 卫星网络申报需提交的有关材料清单及模板
   一、卫星网络申报文件
 (一)卫星网络的基本情况,包括:
 1.项目背景;
 2.卫星系统概况,如使用用途、应用范围、实施计划以及卫星系统架构、卫星工作模式等;
 3.项目联系人及电话。
 (二)卫星网络资料的主要参数(应与拟提交国际电联的数据库数据保持一致),其中:
 1.静止轨道卫星网络主要参数包括:
 1)轨道位置;
 2)波束名称、频率指配范围、最大天线增益、发射方向、业务类型、业务区等;
 3)特殊地球站的位置、典型地球站的计划部署位置。
 2.非静止轨道卫星网络主要参数包括:
 1)星座构型,包括轨道类型、轨道倾角、轨道高度、运行周期等;
 2)波束名称、频率指配范围、最大天线增益、发射方向、业务类型、业务区等;
 3)特殊地球站的位置、典型地球站的计划部署位置;
 4)天线方向图;
 5)卫星预计质量和寿命。
 3.涉及卫星业余业务的,还应提供符合卫星业余业务用途的说明。
   二、卫星频率和轨道资源可行性论证报告(作为申报文件的附件提供)
 主要包括与相关空间和地面业务协调情况以及电磁兼容情况分析,国内国际协调是否存在潜在风险,是否有相应的对策等(有关可行性论证的规定另行制定)。
   三、卫星网络资料参数特性的自查说明(作为申报文件的附件提供)
 (一)卫星网络特性是否符合国际电联《无线电规则》和《中华人民共和国无线电频率划分规定》等相关规定。
 (二)Space Validation软件验证结果:
 1.软件验证截图,包括Fatal Error和Warning Error两张截图;
 2.如验证中存在Fatal Error,需附上英文说明。
 (三)对于静止轨道卫星网络,提交GIBC软件验证结果:
 1.验证结果截图;
 2.如验证中存在可移动波束的超限结果,需附上英文说明。
 (四)对于非静止轨道卫星网络,提交下行波束到地功率通量密度(PFD)验证结果,其中有限值的需与《无线电规则》第21条的限值进行比较,无限值的需提供计算结果:
 1.对于《无线电规则》表21-4中同一组频段,仅需验证最大PFD值的载波是否符合限值;
 2.验证结果应以表格方式提供。
 (五)对于非静止轨道卫星网络,如果频率指配涉及卫星固定业务且这些频率指配在《无线电规则》第22.5款中有限值,需提交相关波束EPFD相关数据和验证结果:
 1.国际电联CA/414通函中要求的电子格式数据;
 2.如需在未生成RESULTS.MDB文件的情况下提交EPFD相关数据,应附上相关说明。
   四、卫星网络申报承诺书(文本如下,作为申报文件的附件提供)
 根据《中华人民共和国无线电管理条例》以及国际电信联盟(以下简称国际电联)《无线电规则》等规定,我单位对本次申报及今后的申报协调等工作承诺如下:
 一、严格遵守国家无线电管理及国际电联相关规定,履行工业和信息化部及国际电联规定的有关规则义务,根据国家卫星频率和轨道资源管理工作需要,服从工业和信息化部对资源使用权进行必要的统筹调配。
 二、积极开展国内国际协调,认真处理国际电联频率信息通报,减少和避免与其他卫星网络以及地面无线电业务之间的干扰,遵守内地与香港、澳门间有关协定。
 三、认识到卫星频率和轨道资源的获取存在一定的不确定因素,有可能导致卫星工程项目规划和建设进行适应性调整,并同意承担上述情况可能带来的风险。
 四、按照国际电联规定,如期足额缴纳所申报的卫星网络成本回收费用。
