The Provisions of the Supreme People's Court on Recognition and Enforcement of the Civil Judgments of Courts of the Taiwan Region, as adopted at the 1,653rd meeting of the Judicial Committee of the Supreme People's Court on June 2, 2015, are hereby issued and shall come into force on July 1, 2015. 《最高人民法院关于认可和执行台湾地区法院民事判决的规定》已于2015年6月2日由最高人民法院审判委员会第1653次会议通过,现予公布,自2015年7月1日起施行。

Provisions of the Supreme People's Court on Recognition and Enforcement of the Civil Judgments of Courts of the Taiwan Region 最高人民法院关于认可和执行台湾地区法院民事判决的规定
(Interpretation No. 13 [2015] of the Supreme People's Court, adopted at the 1,653rd meeting of the Judicial Committee of the Supreme People's Court on June 2, 2015) (2015年6月2日最高人民法院审判委员会第1653次会议通过 法释〔2015〕13号)
For purposes of safeguarding the legitimate rights and interests of parties across the Taiwan Strait and better adapting to the new situations in the peaceful development of cross-strait relations, these Provisions on the recognition and enforcement of the civil judgments of courts of the Taiwan Region are hereby developed in accordance with the Civil Procedure Law and other relevant laws, and by summarizing the experience of the people's courts in trials involving Taiwan. 为保障海峡两岸当事人的合法权益,更好地适应海峡两岸关系和平发展的新形势,根据民事诉讼法等有关法律,总结人民法院涉台审判工作经验,就认可和执行台湾地区法院民事判决,制定本规定。
Article 1 A party to the civil judgment of a court of the Taiwan Region may, in accordance with these Provisions, apply to the people's court for recognition and enforcement of the civil judgment of the relevant court of the Taiwan Region as an applicant.   第一条 台湾地区法院民事判决的当事人可以根据本规定,作为申请人向人民法院申请认可和执行台湾地区有关法院民事判决。
Article 2 For the purpose of these Provisions, the term “civil judgments of courts of the Taiwan Region” includes the effective civil judgments, rulings, settlement transcripts, mediation transcripts and payment orders issued by courts of the Taiwan Region, among others.   第二条 本规定所称台湾地区法院民事判决,包括台湾地区法院作出的生效民事判决、裁定、和解笔录、调解笔录、支付命令等。
These Provisions shall apply to applications for recognition of the effective judgments, rulings and settlement transcripts on civil damages issued by courts of the Taiwan Region in criminal cases. 申请认可台湾地区法院在刑事案件中作出的有关民事损害赔偿的生效判决、裁定、和解笔录的,适用本规定。
These Provisions shall apply, mutatis mutandis, to applications for recognition of the mediation papers that are issued by the mediation committees of townships, towns or cities in the Taiwan Region, among others, ratified by courts of the Taiwan Region, and of legal effect equal to the effective civil judgments of courts of the Taiwan Region. 申请认可由台湾地区乡镇市调解委员会等出具并经台湾地区法院核定,与台湾地区法院生效民事判决具有同等效力的调解文书的,参照适用本规定。
Article 3 Where an applicant applies for recognition and enforcement of the civil judgment of a court of the Taiwan Region at the same time, the people's court shall first examine the application in accordance with the recognition procedures. After the people's court issues a ruling to recognize the civil judgment, it shall be enforced by the enforcement institution of the people's court.   第三条 申请人同时提出认可和执行台湾地区法院民事判决申请的,人民法院先按照认可程序进行审查, 裁定认可后,由人民法院执行机构执行。
Where an applicant applies for enforcement directly, the people's court shall notify the applicant that a recognition application shall also be filed. If the applicant refuses to apply for recognition, the people's court shall issue a ruling to dismiss the application. 申请人直接申请执行的,人民法院应当告知其一并提交认可申请;坚持不申请认可的,裁定驳回其申请。
Article 4 A case involving an application for recognition of the civil judgment of a court of the Taiwan Region shall be accepted by the intermediate people's court or a special people's court at the place where the applicant is domiciled or habitually resides, the respondent is domiciled or habitually resides, or the relevant property is located.   第四条 申请认可台湾地区法院民事判决的案件,由申请人住所地、经常居住地或者被申请人住所地、经常居住地、财产所在地中级人民法院或者专门人民法院受理。
Where the applicant applies for recognition to two or more people's courts having jurisdiction, the case shall be under the jurisdiction of the people's court which dockets the case first. 申请人向两个以上有管辖权的人民法院申请认可的,由最先立案的人民法院管辖。
Where the applicant applies for recognition to the people's court at the place where the respondent's property is located, the relevant evidence on existence of such property shall be provided. 申请人向被申请人财产所在地人民法院申请认可的,应当提供财产存在的相关证据。
Article 5 The people's court shall form a collegial panel to examine any case involving an application for recognition of the civil judgment of a court of the Taiwan Region.   第五条 对申请认可台湾地区法院民事判决的案件,人民法院应当组成合议庭进行审查。
Article 6 Where an applicant authorizes another person to apply for recognition of the civil judgment of a court of the Taiwan Region on behalf of the applicant, a power of attorney to which the applicant affixes a signature or seal shall be submitted to the people's court.   第六条 申请人委托他人代理申请认可台湾地区法院民事判决的,应当向人民法院提交由委托人签名或者盖章的授权委托书。
A power of attorney to which a party from the Taiwan Region, the Hong Kong Special Administrative Region, the Macao Special Administrative Region or a foreign country affixes a signature or seal shall undergo the relevant notarization, legalization or other certification formalities, unless the signing of the power of attorney was witnessed by a judge of the people's court, or a notarization authority of the Chinese Mainland certifies that the power of attorney was signed in the Chinese Mainland. 台湾地区、香港特别行政区、澳门特别行政区或者外国当事人签名或者盖章的授权委托书应当履行相关的公证、认证或者其他证明手续,但授权委托书在人民法院法官的见证下签署或者经中国大陆公证机关公证证明是在中国大陆签署的除外。
Article 7 When an applicant applies for recognition of the civil judgment of a court of the Taiwan Region, a written application shall be submitted, with the original written civil judgment of the relevant court of the Taiwan Region and the original certificate confirming the civil judgment, or the certified true duplicates thereof attached. Where the civil judgment of the court of the Taiwan Region is a default judgment, the applicant shall, at the same time, submit certification documents showing that the party has been legally summoned by the court of the Taiwan Region, unless the judgment expressly states the fact.   第七条 申请人申请认可台湾地区法院民事判决,应当提交申请书,并附有台湾地区有关法院民事判决文书和民事判决确定证明书的正本或者经证明无误的副本。台湾地区法院民事判决为缺席判决的,申请人应当同时提交台湾地区法院已经合法传唤当事人的证明文件,但判决已经对此予以明确说明的除外。
The written application shall indicate the following items: 申请书应当记明以下事项:
(1) The applicant and respondent's names, gender, ages, occupations, identity certificate numbers, addresses (where the applicant or the respondent is a legal person or any other organization, the name and address of the legal person or any other organization and the name and job title of the legal representative or primary person in charge thereof shall be indicated) and contact information. (一)申请人和被申请人姓名、性别、年龄、职业、身份证件号码、住址(申请人或者被申请人为法人或者其他组织的,应当记明法人或者其他组织的名称、地址、法定代表人或者主要负责人姓名、职务)和通讯方式;
(2) Claims and reasons. (二)请求和理由;
(3) Information on the enforcement of the judgment involved in the recognition application. (三)申请认可的判决的执行情况;
(4) Other information which needs to be explained.
