The Interim Measures for the Participation in Social Insurance of Foreigners Employed in China, as deliberated and adopted at the 67th executive meeting of the Ministry of Human Resources and Social Security and approved by the State Council, are hereby issued and shall come into force on October 15, 2011. | |
《在中国境内就业的外国人参加社会保险暂行办法》已经人力资源和社会保障部第67次部务会审议通过，并经国务院同意，现予公布，自2011年10月15日起施行。 |

| Article 1 To protect the legal rights and interests of foreigners employed in China in participating in social insurance and enjoying social insurance benefits according to law and strengthen the administration of social insurance, these Measures are formulated in accordance with the Social Insurance Law of the People's Republic of China (hereinafter the “Social Insurance Law”). | | 第一条 为了维护在中国境内就业的外国人依法参加社会保险和享受社会保险待遇的合法权益，加强社会保险管理，根据《中华人民共和国社会保险法》（以下简称社会保险法），制定本办法。 |

| Article 2 The “Foreigners employed in China” refer to the persons without Chinese nationality who have legally obtained the employment certificates, such as the Employment Certificate for Foreigners, the Foreign Expert Certificate and the Certificate of Resident Foreign Correspondents, and residence certificates for foreigners or are holding the Permanent Resident Permit for Foreigners and are legally employed within the territory of China. | | 第二条 在中国境内就业的外国人，是指依法获得《外国人就业证》、《外国专家证》、《外国常驻记者证》等就业证件和外国人居留证件，以及持有《外国人永久居留证》，在中国境内合法就业的非中国国籍的人员。 |

| Article 3 Foreigners legally employed by enterprises, public institutions, social organizations, private non-enterprise entities, foundations, law firms, accounting firms and other organizations which are legally registered in China (hereinafter the “employers”) shall participate in the basic endowment insurance for employees, basic medical insurance for employees, work-related injury insurance, unemployment insurance and maternity insurance according to law, and the social insurance premiums shall be paid by the employers and foreigners according to the relevant provisions. | | 第三条 在中国境内依法注册或者登记的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织（以下称用人单位）依法招用的外国人，应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险，由用人单位和本人按照规定缴纳社会保险费。 |
A foreigner who, after entering into an employment contract with an overseas employer, is dispatched to a branch or representative office registered in China (hereinafter referred to as the “domestic entity”) shall participate in the basic endowment insurance for employees, basic medical insurance for employees, work-related injury insurance, unemployment insurance and maternity insurance according to law, and the social insurance premiums shall be paid by the domestic entity and the foreigner in accordance with the relevant provisions. | |
与境外雇主订立雇用合同后，被派遣到在中国境内注册或者登记的分支机构、代表机构（以下称境内工作单位）工作的外国人，应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险，由境内工作单位和本人按照规定缴纳社会保险费。 |

| Article 4 Where a foreigner is employed, the employer shall, within 30 days from the date on which the employment certificate is handled, handle the social insurance registration for the foreigner. | | 第四条 用人单位招用外国人的，应当自办理就业证件之日起30日内为其办理社会保险登记。 |
For a foreigner who is dispatched by an overseas employer to a domestic entity, the domestic entity shall handle the social insurance registration for the foreigner according to the provision of the preceding paragraph. | |
受境外雇主派遣到境内工作单位工作的外国人，应当由境内工作单位按照前款规定为其办理社会保险登记。 |
Institutions issuing employment certificates to foreigners according to law shall timely notify the local social insurance agencies of information about foreigners employed in China. Social insurance agencies shall check information about issuance of employment certificates to foreigners with the relevant institutions on a regular basis. | |
依法办理外国人就业证件的机构，应当及时将外国人来华就业的相关信息通报当地社会保险经办机构。社会保险经办机构应当定期向相关机构查询外国人办理就业证件的情况。 |

Article 5 Where a foreigner participating in social insurance meets the relevant conditions, he or she shall enjoy social insurance benefits in accordance with law.
