The Decision of the Ministry of Construction on Amending the Measures for the Administration of Advance Sale of Urban Commodity Houses, which was discussed and adopted at the 41st executive meeting of the Ministry of Construction on July 13, 2004, is hereby promulgated, and shall come into force on the date of promulgation.
 
建设部关于修改<城市商品房预售管理办法>的决定》已于2004年7月13日经建设部第41次常务会议讨论通过,现予发布,自发布之日起施行。

Decision of the Ministry of Construction on Amending the Measures for the Administration of Advance Sale of Urban Commodity Houses
 

建设部关于修改《城市商品房预售管理办法》的决定


The Ministry of Construction decides to make the following amendments to the Measures for the Administration of Advance Sale of Urban Commodity Houses (Order No. 95 of the Ministry of Construction):
 
建设部决定对《城市商品房预售管理办法》(建设部令第95号)作如下修改:

 
I. The phrase “the city or county people's government” in Paragraph 3 of Article 4 is amended as “the municipal or county people's government”.   一、将第四条第三款中的“城市、县人民政府”改为“市、县人民政府”。

 
II. Article 6 is amended as: “A permission system shall be adopted for the advance sale of commodity houses. A development enterprise shall, if selling commodity houses in advance, apply to the real estate administrative department for the permission for advance sale, and obtain the Permit for Advance Sale of Commodity Houses.   二、第六条修改为:“商品房预售实行许可制度。开发企业进行商品房预售,应当向房地产管理部门申请预售许可,取得《商品房预售许可证》。

No development enterprise may sell commodity houses in advance without obtaining a Permit for Advance Sale of Commodity Houses.
 
未取得《商品房预售许可证》的,不得进行商品房预售。”

 
III. Article 7 is amended as: “When a development enterprise applies for the permit for advance sale, it shall submit the following certificates (photocopies) and materials:   三、第七条修改为:“开发企业申请预售许可,应当提交下列证件(复印件)及资料:

 
(1) an application form for advance sale of commodity houses; (一)商品房预售许可申请表;

 
(2) the Business License and eligibility certificate of the development enterprise; (二)开发企业的《营业执照》和资质证书;

 
(3) the land use right certificate, the construction project planning permit, and the permit for undertaking construction; (三)土地使用权证、建设工程规划许可证、施工许可证;

 
(4) a testimonial on that the ratio between the funds put into development and construction and the total investments in the project construction meets the prescribed conditions; (四)投入开发建设的资金占工程建设总投资的比例符合规定条件的证明;

 
(5) the contract on undertaking project construction and a statement on the construction progress; and (五)工程施工合同及关于施工进度的说明;

 
(6) the plan on the advance sale of commodity houses, which shall state the location, area and completion delivery date of the commodity houses to be sold in advance, and shall be accompanied by the ichnographies based on the floors of the commodity houses to be sold in advance.

 (六)商品房预售方案。预售方案应当说明预售商品房的位置、面积、竣工交付日期等内容,并应当附预售商品房分层平面图。”
