Notice by the Ministry of Finance of Promoting Fair Competition in Public Procurement and Optimizing Business Environment 

财政部关于促进政府采购公平竞争优化营商环境的通知

All central budget entities, the finance departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning, and the Finance Bureau of Xinjiang Production and Construction Corps: 各中央预算单位,各省、自治区、直辖市、计划单列市财政厅(局),新疆生产建设兵团财政局:
For the purposes of implementing the relevant requirements prescribed in the Plan of Deepening the Reform of Government Procurement System, and the Notice by the General Office of the State Council of Focusing on Enterprises' Concerns and Further Promoting Implementation of Business Environment Optimization Policies (No. 104 [2018] of the General Office of the State Council), and building an integrated and open public procurement market system with orderly competition, the relevant matters of promoting fair competition in public procurement and optimizing business environment are hereby notified as follows: 为贯彻落实中央深改委审议通过的《深化政府采购制度改革方案》和《国务院办公厅关于聚焦企业关切进一步推动优化营商环境政策落实的通知》(国办发〔2018〕104号)有关要求,构建统一开放、竞争有序的政府采购市场体系,现就促进政府采购领域公平竞争、优化营商环境相关事项通知如下:
I. Thoroughly eliminating the regulations and practices that inhibit fair competition in public procurement   一、全面清理政府采购领域妨碍公平竞争的规定和做法
All regions and all departments shall strictly follow the requirements prescribed in the Government Procurement Law of the People's Republic of China and other relevant laws and regulations, and protect the rights of various market players to participate in government procurement activities on an equal footing. To thoroughly eliminate the regulations and practices inhibiting fair competition in public procurement, the focus shall be put on eliminating and correcting the following problems: 各地区、各部门应当严格落实《中华人民共和国政府采购法》等相关法律法规的要求,依法保障各类市场主体平等参与政府采购活动的权利。要全面清理政府采购领域妨碍公平竞争的规定和做法,重点清理和纠正以下问题:
1. giving differential or discriminatory treatment to suppliers based on their ownership forms, organizational forms or ownership structure, setting up imparity clauses for private enterprises, and discriminating between products produced and services provided by domestic enterprises and those provided by foreign-funded enterprises in China; (一)以供应商的所有制形式、组织形式或者股权结构,对供应商实施差别待遇或者歧视待遇,对民营企业设置不平等条款,对内资企业和外资企业在中国境内生产的产品、提供的服务区别对待;
2. preventing a supplier from entering the public procurement market by shortlisting a pool of backup suppliers, a directory of suppliers, and a database of qualified suppliers for government procurement activities, except for contractual suppliers and designated suppliers of small-sum and sporadic goods or services as well as the circumstances prescribed otherwise by the Ministry of Finance; (二)除小额零星采购适用的协议供货、定点采购以及财政部另有规定的情形外,通过入围方式设置备选库、名录库、资格库作为参与政府采购活动的资格条件,妨碍供应商进入政府采购市场;
3. requiring a supplier to undergo unnecessary registration formalities before government procurement, or requiring a supplier to establish subsidiaries so as to create barriers or create barriers in disguise for the supplier to enter the public procurement market; (三)要求供应商在政府采购活动前进行不必要的登记、注册,或者要求设立分支机构,设置或者变相设置进入政府采购市场的障碍;
4. setting a threshold or setting a threshold in disguise for the business scale and years of incorporation of a supplier, and restricting the supplier's participation in government procurement activities; (四)设置或者变相设置供应商规模、成立年限等门槛,限制供应商参与政府采购活动;
5. requiring suppliers to purchase designated software as a condition for them to participate in government procurement activities through an electronic bidding system; (五)要求供应商购买指定软件,作为参加电子化政府采购活动的条件;
6. failing to release or provide the information of procurement projects in a timely, effective and complete manner according to law, and preventing a supplier from participating in government procurement activities; (六)不依法及时、有效、完整发布或者提供采购项目信息,妨碍供应商参与政府采购活动;
7. forcing a purchaser to select a procurement agency in a random way (such as lucky draw, lottery ticket) or through simple comparisons, and interfering in the purchaser's selection of a procurement agency; (七)强制要求采购人采用抓阄、摇号等随机方式或者比选方式选择采购代理机构,干预采购人自主选择采购代理机构;
8. setting up requirements for approval, filing, supervision, punishment, or charging without legal grounds; (八)设置没有法律法规依据的审批、备案、监管、处罚、收费等事项;
9. requiring the purchaser to determine the winning supplier in a random way, except for the circumstances as prescribed in Article 68 of the Measures for the Administration of Bidding for the Government Procurement of Goods and Services; and (九)除《政府采购货物和服务招标投标管理办法》第六十八条规定的情形外,要求采购人采用随机方式确定中标、成交供应商;
10. other violations of the relevant laws and regulations that impede fair competition. (十)违反法律法规相关规定的其他妨碍公平竞争的情形。
All regions and all departments shall spare no effort in eliminating the regulations and practices that inhibit fair competition in government procurement; and the elimination results shall be released to the public in a timely manner, and be reported to the Ministry of Finance before October 31, 2019.

 各地区、各部门要抓紧清理政府采购领域妨碍公平竞争的规定和做法,有关清理结果要及时向社会公开,并于2019年10月31日前报送财政部。
