To accurately apply laws, and pursuant to the State Compensation Law of the People's Republic of China (hereinafter referred to as the “State Compensation Law”) and in consideration of the actual situation regarding state compensation work, we formulate the causes of action for state compensation cases as follows: | |
为正确适用法律，根据《中华人民共和国国家赔偿法》，结合国家赔偿工作实际，对国家赔偿案件案由规定如下： |

| 1. Compensation for illegal criminal detention (item (1) of Article 17 of the State Compensation Law): The measure of detention is taken against a citizen in violation of the Criminal Procedure Law, or the measure of detention is taken in accordance with the conditions and procedures as prescribed in the Criminal Procedure Law but the term of detention exceeds the time limit as prescribed in the Criminal Procedure Law, and a decision to withdraw the case, not to prosecute, or a judgment of acquittal is later made, terminating the pursuit of criminal liability. | | 一、违法刑事拘留赔偿（国家赔偿法第十七条第（一）项）。违反刑事诉讼法的规定对公民采取拘留措施的，或者依照刑事诉讼法规定的条件和程序对公民采取拘留措施，但是拘留时间超过刑事诉讼法规定的时限，其后决定撤销案件、不起诉或者判决宣告无罪终止追究刑事责任的赔偿案件。 |

| 2. Compensation for arrest of an innocent person (item (2) of Article 17 of the State Compensation Law): After the measure of arrest is taken against a citizen, a decision is made to withdraw the case, not to prosecute, or a judgment of acquittal by the court of first instance is made, terminating the pursuit of criminal liability. | | 二、无罪逮捕赔偿（国家赔偿法第十七条第（二）项）。对公民采取逮捕措施后，决定撤销案件、不起诉或者一审判决宣告无罪终止追究刑事责任的赔偿案件。 |

3. Compensation for acquittal in the judgment of second instance (paragraph 4 of Article 21 of the State Compensation Law): A judgment of acquittal is made by the court of second instance.
