The Measures for the Supervision and Administration of the Table Salt Quality and Safety, as deliberated and adopted at the 18th executive meeting of the State Administration for Market Regulation on December 23, 2019, are hereby issued, and shall come into force on March 1, 2020. 《食盐质量安全监督管理办法》已于2019年12月23日经国家市场监督管理总局2019年第18次局务会议审议通过,现予公布,自2020年3月1日起施行。

Measures for the Supervision and Administration of the Table Salt Quality and Safety 食盐质量安全监督管理办法

Article 1 These Measures are developed in accordance with the Food Safety Law of the People's Republic of China, the Regulation on the Implementation of the Food Safety Law of the People's Republic of China, the Measures for Monopoly of Table Salt, and other laws and regulations for the purposes of strengthening the supervision and administration of the table salt quality and safety and protecting the public health and life safety.   第一条 为加强食盐质量安全监督管理,保障公众身体健康和生命安全,根据《中华人民共和国食品安全法》、《中华人民共和国食品安全法实施条例》、《食盐专营办法》等法律法规,制定本办法。
Article 2 These Measures shall apply to the table salt production and distribution activities in the territory of the People's Republic of China and the supervision and administration of the table salt quality and safety.   第二条 在中华人民共和国境内从事食盐生产经营活动,开展食盐质量安全监督管理,适用本办法。
Article 3 The State Administration for Market Regulation (“SAMR”) shall be responsible for the supervision and administration of the table salt quality and safety across the country.   第三条 国家市场监督管理总局负责全国食盐质量安全监督管理。
The local market regulatory departments at or above the county level shall be responsible for the supervision and administration of the table salt quality and safety in their respective administrative regions on the basis of their legal duties. 县级以上地方市场监督管理部门依据法定职责负责本行政区域内的食盐质量安全监督管理。
Article 4 Table salt producers and distributors shall, according to the laws, regulations and rules, and the standards for food safety, carry out production and distribution activities and be responsible for the table salt quality and safety.   第四条 食盐生产经营者应当依照法律、法规、规章和食品安全标准从事生产经营活动,对食盐的质量安全负责。
Article 5 The table salt industry association established according to the law shall intensify industry self-regulation, direct and urge table salt producers and distributors to conduct production and distribution according to the law, promote the honesty construction of the industry, and publicize and popularize knowledge on table salt quality and safety.   第五条 依法成立的食盐行业组织应当加强行业自律,引导和督促食盐生产经营者依法生产经营,推动行业诚信建设,宣传、普及食盐质量安全知识。
Article 6 To carry out table salt production activities, a food production license shall be obtained in accordance with the provisions of the Measures for the Administration of Food Production License. The food production license for table salt shall be in the charge of the market regulatory departments of the provinces, autonomous regions and municipalities directly under the Central Government.   第六条 从事食盐生产活动,应当依照《食品生产许可管理办法》的规定,取得食品生产许可。食盐的食品生产许可由省、自治区、直辖市市场监督管理部门负责。
To carry out wholesale and retail activities of table salt, a food business license shall be obtained in accordance with the Measures for the Administration of Food Business License. 从事食盐批发、零售活动,应当依照《食品经营许可管理办法》的规定,取得食品经营许可。
Article 7 Table salt producers and distributors shall ensure that the table salt produced and distributed by them comply with the provisions of the laws, regulations, rules and food safety standards.   第七条 食盐生产经营者应当保证其生产经营的食盐符合法律、法规、规章和食品安全标准的规定。
Table salt production enterprises shall use food additives in accordance with national food safety standards and shall not exceed the scope or limit of use prescribed in the national food safety standards. 食盐生产企业应当按照食品安全国家标准使用食品添加剂,不得超过食品安全国家标准规定的使用范围和限量。
The storage and transportation of table salt shall satisfy the requirements of food safety. 食盐的贮存、运输,应当符合食品安全的要求。
Article 8 In the production and distribution of table salt, the following acts shall be prohibited:   第八条 食盐生产经营禁止下列行为:
(1) Selling liquid salt (including natural brine) as table salt. (一)将液体盐(含天然卤水)作为食盐销售;
(2) Selling industrial salt and other non-edible salt as table salt. (二)将工业用盐和其他非食用盐作为食盐销售;
(3) Selling salt made from saline soil, nitrate or industrial waste residue and liquid as table salt. (三)将利用盐土、硝土或者工业废渣、废液制作的盐作为食盐销售;
(4) Boiling well and rock salt brines down or selling salt made by boiling well and rock salt brines down as table salt. (四)利用井矿盐卤水熬制食盐,或者将利用井矿盐卤水熬制的盐作为食盐销售;
(5) Production and distribution of table salt that is mixed with strange objects, adulterated or impure. (五)生产经营掺假掺杂、混有异物的食盐;
(6) Production and distribution of other table salt that does not comply with the laws, regulations, rules and food safety standards.
