Ecology and environment departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, Xinjiang Production and Construction Corps, and sub-provincial cities: 各省、自治区、直辖市、新疆生产建设兵团、副省级城市生态环境厅(局):
For the purposes of profoundly implementing Xi Jinping Thought on Ecological Civilization, complying with the spirit of the Central Economic Work Conference and the relevant requirements of the National Videoconference on Deepening the Reform of “Simplifying Procedures, Decentralizing Powers, Combining Decentralization with Appropriate Control, and Optimizing Services” and Optimizing the Business Environment, putting the work to serve the “stabilization of employment, finance, foreign trade, foreign investment, and expectation” in a more prominent position, being oriented to releasing vitality, exercising administration fairly, and serving facilitation, deepening the reform of “simplifying procedures, decentralizing powers, combining decentralization with appropriate control, and optimizing services,” further optimizing the business environment, voluntarily serving the green development of enterprises, and collaboratively advancing high-quality economic development and high-level ecological and environmental protection, the following opinions are hereby offered on further deepening the ecological and environmental regulatory services and promoting high-quality economic development. 为深入贯彻习近平生态文明思想,贯彻落实中央经济工作会议精神、全国深化“放管服”改革优化营商环境电视电话会议有关要求,把服务“六稳”工作放在更加突出位置,以放出活力、管出公平、服出便利为导向,深化“放管服”改革,进一步优化营商环境,主动服务企业绿色发展,协同推进经济高质量发展和生态环境高水平保护,现就进一步深化生态环境监管服务推动经济高质量发展,提出以下意见。
I. Increasing decentralization efforts and stimulating the vitality of market participants   一、加大“放”的力度,激发市场主体活力
1. Improving the market access mechanism (一)完善市场准入机制
The market access list in the ecological and environmental field shall be further reorganized, and neither separate threshold nor implicit restrictions shall be imposed, unless on the list. The market access negative list shall be fully implemented, the advancement of the preparation and implementation of the ecological protection red line, environmental quality bottom line, ceiling on resource utilization, and ecological and environmental access list shall be accelerated, and the optimization of industry layout and the relocation of heavily polluting enterprises shall be guided. Market access policy measures against fair competition in the ecological and environmental field shall be amended or repealed. The reserving and construction of public-private partnership (“PPP”) projects in the ecological and environmental field shall be further regulated, the support for the tasks of the pollution prevention and control endeavor shall be strengthened with a focus on projects in the pool of central environmental protection investment projects, regional barriers shall be removed, unreasonable restrictions in tendering and other links shall be removed, all types of enterprises shall be fairly treated and uniformly required, and the acceptance of a tender at an unreasonably low price shall be prevented. 进一步梳理生态环境领域市场准入清单,清单之外不得另设门槛和隐性限制。全面实施市场准入负面清单,加快推进“三线一单”(生态保护红线、环境质量底线、资源利用上线和生态环境准入清单)编制和落地,引导产业布局优化和重污染企业搬迁。修改、废止生态环境领域不利于公平竞争的市场准入政策措施。进一步规范生态环境领域政府和社会资本合作(PPP)项目的储备和建设,以中央环保投资项目储备库入库项目为重点强化对污染防治攻坚战任务的支撑,打破地域壁垒,清理招投标等环节设置的不合理限制,对各类企业主体公平对待、统一要求,防止不合理低价中标。
2. Simplifying and regulating license approval items (二)精简规范许可审批事项
The lists of administrative licensing items in the ecological and environmental field developed by the central authorities shall be consolidated, the scope, conditions, and links of administrative license shall be specified, and various disguised approval shall be addressed. The standardization of ecological and environmental administrative license shall be advanced at a faster pace, the links of approval shall be further simplified, the efficiency of approval shall be raised, and the basis, acceptance, approval, and other circumstances of administrative licensing items shall be promptly disclosed to the public. The “reduction of certificates for the public” action shall continue to be advanced, and administrative application materials shall be further reduced. The integration of annual review and annual inspection of land transport vehicles and the emission inspection of motor vehicles into one shall be advanced. The implementation of the review and administrative license of the construction, conversion, or expansion of effluent outfalls at rivers and lakes, environmental administration and registration of new chemical substances, administration of hazardous waste business licenses, dumping of arisings at sea licenses, approval and license of temporary marine dumping areas, and other items shall be regulated. 整合中央层面设定的生态环境领域行政许可事项清单,明确行政许可范围、条件和环节,整治各类变相审批。加快推进生态环境行政许可标准化,进一步精简审批环节,提高审批效率,及时公开行政许可事项依据、受理、批复等情况。持续推进“减证便民”行动,进一步减少行政申请材料。推进道路运输车辆年审、年检和机动车排放检验“三检合一”。规范实施江河、湖泊新建、改建或者扩大排污口审核行政许可,新化学物质环境管理登记,危险废物经营许可证管理,废弃物海洋倾倒许可,临时性海洋倾倒区审批许可等事项。
3. Deepening the reform of the approval of environmental impact assessment (“EIA”) (三)深化环评审批改革
The classification of EIA shall be optimized, and the filing system for EIA registration forms shall continue to be advanced. The linkage between plan EIA and project EIA shall be strengthened, and the contents of project EIA shall be simplified according to the law for the construction projects that conform to the conclusions and review opinions of the plan EIA. The requirements for multi-track approval shall be implemented, the technical assessment and evaluation of EIA reports (forms) shall be regulated, and the EIA approval process shall be optimized. A list of major national projects, major local projects, and major foreign capital utilization projects shall be developed, the linkage between departments and local governments shall be strengthened, major infrastructure, people's livelihood projects, and major industry layout projects shall be voluntarily served and intervened in in advance, the efficiency of EIA approval shall be raised, and the time for project EIA approval shall be further reduced, so as to effectively stabilize investment and foreign investment. The inclusion of the main content related to pollutant discharge in EIA in the pollutant discharge permit shall be advanced. The amendment of relevant laws shall be vigorously advanced, and the cancellation of the approval of environmental protection final inspection of construction projects, the final inspection of environmental protection facilities for marine engineering construction projects, and other administrative licensing items shall be completed. 优化环境影响评价分类,持续推进环评登记表备案制。加强规划环评与项目环评联动,对符合规划环评结论和审查意见的建设项目,依法简化项目环评内容。落实并联审批要求,规范环境影响报告书(表)技术评估评审,优化环评审批流程。建立国家重大项目、地方重大项目、外资利用重大项目清单,加强与部门和地方联动,主动服务、提前介入重大基础设施、民生工程和重大产业布局项目,加快环评审批速度,进一步压缩项目环评审批时间,切实做好稳投资、稳外资工作。推进将环评中与污染物排放相关的主要内容载入排污许可证。积极推进相关法律修改,完成建设项目竣工环境保护验收审批、海洋工程建设项目环境保护设施竣工验收等行政许可事项取消。
II. Optimizing the manners for “control” and creating a fair market environment   二、优化“管”的方式,营造公平市场环境
4. Strengthening interim and ex-post regulation (四)强化事中事后监管
The issuance of guiding opinions on the full implementation of environmental protection credit assessment shall be promoted, the environmental protection credit regulatory mechanism in fields such as EIA, pollutant discharge licensing, hazardous waste business, ecological and environmental monitoring, and the construction, operation, and maintenance of environmental protection facilities shall be improved, and the mutual recognition of environmental protection credit reports in different regions shall be promoted. The EIA intermediary market shall be strictly regulated, measures for the supervision and administration of the preparation of construction project EIA reports (forms) and their supporting documents shall be issued, and the quality management of EIA documents shall be strengthened. The implementation of government procurement of services in the links of assessment and evaluation shall be promoted, and ecology and environment departments at all levels or other relevant approval departments may not pass on assessment and evaluation fees to enterprises. Enterprises shall be supervised promptly filing final self-inspection reports on the National Environmental Protection Final Inspection Information System for Construction Projects. The issuance quality of pollutant discharge permits shall be continuously improved, enterprises shall be supervised and guided fully implementing pollutant discharge licensing items and management requirements, and enterprises shall be supervised submitting the pollutant discharge permit implementation reports in a high-quality manner, as scheduled. The main responsibility of enterprises shall be fully implemented, the regulation and enforcement action after the pollutant discharge permit shall be tightened, pollutant discharge without a permit and pollutant discharge not by permit shall be seriously investigated and punished, and compulsory disclosure of information, severe punishment, and other systems shall be improved. 推动出台关于全面实施环保信用评价的指导意见,完善环评、排污许可、危险废物经营、生态环境监测、环保设施建设运维等领域环保信用监管机制,推动环保信用报告结果异地互认。严格环评中介市场监管,出台建设项目环境影响报告书(表)编制监督管理办法及其配套文件,加强环评文件质量管理。推动在评估评审环节中实施政府购买服务,各级生态环境部门或其他有关审批部门不得向企业转嫁评估评审费用。督促企业及时在全国建设项目竣工环境保护验收信息系统上备案自验收报告。不断提升排污许可证核发质量,督促和指导企业全面落实排污许可事项和管理要求,督促企业高质量如期提交排污许可证执行报告。全面落实企业主体责任,强化排污许可证后监管和执法,严肃查处无证排污、不按证排污行为,健全信息强制性披露、严惩重罚等制度。
5. Implementing “random selection of inspectees and inspectors and public disclosure” (五)推行“双随机、一公开”
A guiding catalog of comprehensive administrative enforcement action items for ecological and environmental protection shall be released, and administrative inspections, administrative punishment, and administrative compulsion shall be further regulated. According to the degree of environmental impact, the random inspection proportion for “random selection of inspectees and inspectors” shall be reasonably fixed, and information on random inspection and the results of random inspection shall be disclosed to the public in a timely manner. Before the end of 2020, ecology and environment departments at all levels will have achieved regular inspection by the mode of “random selection of inspectees and inspectors and public disclosure” and comprehensively advanced the administrative enforcement action publication system, the whole-process enforcement action recording system, and the legal review system for major enforcement action decisions. The building of the “Internet plus regulation” system for the ecological and environmental system shall be advanced at a faster pace, and the establishment of inter-government department and inter-regional assisted investigation, joint investigation, and information sharing mechanisms shall be promoted. In reliance on online monitoring, satellite remote sensing, drones, mobile enforcement action, and other scientific and technological means, off-site inspection methods shall be optimized, the model for early warning of risks shall be established and improved, a hot spot grid-based early warning mechanism shall be implemented, and the precision of supervision and enforcement action shall be improved. 发布生态环境保护综合行政执法事项指导目录,进一步规范行政检查、行政处罚、行政强制行为。根据环境影响程度,合理设置“双随机”抽查比例,及时公开抽查情况和抽查结果。2020年年底前,各级生态环境部门实现“双随机、一公开”监管常态化,全面推进行政执法公示制度、执法全过程记录制度、重大执法决定法制审核制度。加快推进生态环境系统“互联网+监管”系统建设,推动建立政府部门间、跨区域间协查、联查和信息共享机制。依托在线监控、卫星遥感、无人机、移动执法等科技手段,优化非现场检查方式,建立完善风险预警模型,推行热点网格预警机制,提高监督执法的精准性。
6. Improving the enforcement action system tempering justice with mercy (六)健全宽严相济执法机制
Opinions on effectively guiding environmental compliance of enterprises shall be issued, so as to permit law-abiding enterprises to gain market competitive advantages and enable law-breaking enterprises to pay high prices. A list of ecologically and environmentally law-abiding “model enterprises” shall be regularly developed and released, and the frequency of regulation shall be significantly reduced for enterprises with good law-abiding records, so as not to disturb law-abiding ones. The frequency of regulatory enforcement action against enterprises about which the public strongly complain, or which violate the laws and regulations at a high frequency, shall be increased; cases with serious circumstances and bad effects shall be handled in cooperation with the public authorities under public supervision; and the connection between ecological and environmental administrative enforcement actions and criminal justice shall be advanced, and environmental crimes shall be severely combated according to the law. Environmental protection credit information shall be incorporated into the National Credit Information Sharing Platform, and joint disciplinary action shall be taken against environmentally dishonest enterprises and natural persons.

 出台关于做好引导企业环境守法工作的意见,让守法企业获得市场竞争优势,让违法企业付出高昂代价。定期评定并发布生态环境守法“标杆企业”名单,对守法记录良好的企业大幅减少监管频次,做到对守法者无事不扰。对群众投诉反映强烈、违法违规频次高的企业加密执法监管频次;对案情重大、影响恶劣的案件,联合公安机关挂牌督办;推进生态环境行政执法与刑事司法衔接,依法严厉打击环境犯罪。将环保信用信息纳入全国信用信息共享平台,针对环境失信企业和自然人,实施联合惩戒。
