The Measures for the Classified Administration of Enterprises Exporting Industrial Products, which were deliberated and adopted at the executive meeting of the General Administration of Quality Supervision, Inspection and Quarantine on May 26, 2009, are hereby promulgated and shall come into force as of August 1, 2009. | |
《出口工业产品企业分类管理办法》已经2009年5月26日国家质量监督检验检疫总局局务会议审议通过，现予公布，自2009年8月1日起施行。 |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 For purposes of regulating the inspection, supervision and administration of enterprises manufacturing industrial products for export, enhancing the effectiveness of inspection, supervision and administration, encouraging the good faith of enterprises manufacturing industrial products for export, enhancing the awareness of accountability and promoting the improvement of the quality of export products, these Measures are formulated in accordance with the Law of the People's Republic of China on Import and Export Commodity Inspection and the regulation on the implementation thereof. | | 第一条 为规范对出口工业产品生产企业的检验监管工作，提高检验监管有效性，鼓励出口工业产品生产企业诚实守信，增强责任意识，促进出口产品质量提高，根据《中华人民共和国进出口商品检验法》及其实施条例，制定本办法。 |

| Article 2 These Measures shall apply to the inspection, supervision and administration of enterprises manufacturing export-oriented industrial products as listed in the Catalogue of Import and Export Commodities Subject to the Inspection and Quarantine of Entry-Exit Inspection and Quarantine Institutions. | | 第二条 本办法适用于对列入《出入境检验检疫机构实施检验检疫的进出境商品目录》的出口工业产品生产企业的检验监督管理。 |

| Article 3 The term “classified administration” as mentioned in these Measures refers to the inspection, supervision and administration by which the enterprises manufacturing export-oriented industrial products are classified into different categories on the basis of their credit, quality guarantee capacity and product quality status, and shall apply different ways of inspection, supervision and administration to the different categories of manufacturing enterprises in light of the risk levels of products. | | 第三条 本办法所称分类管理，是指根据企业信用、质量保证能力和产品质量状况，对出口工业产品生产企业进行分类，并结合产品的风险分级对不同类别的生产企业采取不同检验监管方式的检验监督管理。 |

| Article 4 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the GAQSIQ) shall adopt classified administration to the enterprises manufacturing export-oriented industrial products throughout the country. | | 第四条 国家质量监督检验检疫总局（以下简称国家质检总局）主管全国出口工业产品生产企业分类管理工作。 |
The entry & exit inspection and quarantine bureaus directly under the GAQSIQ at all places shall be responsible for organizing, supervising and administering the classified administration of enterprises manufacturing export-oriented industrial products within their respective jurisdiction. | |
国家质检总局设在各地的直属出入境检验检疫局（以下简称直属检验检疫局）负责所辖地区出口工业产品生产企业分类管理工作的组织和监督管理。 |
The entry & exit inspection and quarantine institutions established by the GAQSIQ at all places shall be responsible for the evaluation and classification as well as the routine inspection, supervision and administration of the enterprises manufacturing export-oriented industrial products within their respective jurisdiction. | |
国家质检总局设在各地的出入境检验检疫机构（以下简称检验检疫机构） 负责所辖地区出口工业产品生产企业分类评定以及日常检验监管工作。 |

| Article 5 The GAQSIQ shall formulate a Guide for the Classification of Enterprises Manufacturing Export-Oriented Industrial Products (hereinafter referred to the Guide) and regulate the evaluation and classification standards and the evaluation procedures for enterprises manufacturing export-oriented industrial products. | | 第五条 国家质检总局制定《出口工业产品生产企业分类指南》（以下简称《分类指南》），规范出口工业产品生产企业分类评定标准和评定程序。 |
An entry & exit inspection and quarantine bureau directly under the GAQSIQ shall formulate corresponding norms on the evaluation work by taking the local actualities into account, and shall implement them upon approval of the GAQSIQ. | |
直属检验检疫局根据《分类指南》，结合各地实际情况制定相应的评定工作规范，并报国家质检总局批准后实施。 |

| Article 6 An inspection and quarantine institution shall classify the enterprises manufacturing export-oriented industrial products into 4 categories, namely, Category I, Category II, Category III and Category IV. | | 第六条 检验检疫机构对出口工业产品的生产企业按照一类、二类、三类、四类企业四个类别进行分类。 |
An inspection and quarantine institution shall classify the export-oriented industrial products into 3 risk levels, namely, high risk, relatively high risk and ordinary risk. | |
检验检疫机构对出口工业产品按照高风险、较高风险和一般风险三个级别进行分级。 |

| Chapter II Classification of Enterprises | | 第二章 企业分类 |

| Article 7 An inspection and quarantine institution shall, under the relevant requirements in the evaluation norms, make a comprehensive evaluation of the classification of the enterprises manufacturing export-oriented industrial products within its jurisdiction, and inform the manufacturing enterprises of the evaluation results. | | 第七条 检验检疫机构按照评定工作规范的有关要求对本辖区内出口工业产品生产企业进行分类综合评定，并将评定结果告知生产企业。 |

| Article 8 The standards on the classification and evaluation of enterprises manufacturing export-oriented industrial products shall include the following elements: | | 第八条 出口工业产品生产企业分类评定标准应当包括以下要素： |
| |
|
| 1. the credit standing of enterprises; | | （一）企业信用情况； |
| |
|
| 2. the work conditions of the enterprises; | | （二）企业生产条件； |
| |
|
| 3. the testing capacity of enterprises; | | （三）企业检测能力； |
| |
|
| 4. the quality of employees of enterprises; | | （四）企业人员素质； |
| |
|
| 5. the management capabilities of suppliers of raw materials; | | （五）原材料供应方管理能力； |
| |
|
| 6. the information about the pre-warning, compensation claims, return of goods and complaints about the products exported by the enterprise; | | （六）企业出口产品被预警、索赔、退货及投诉情况； |
| |
|
| 7. the retroactivity of products of enterprises; | | （七）企业产品追溯能力； |
| |
|
| 8. the information about the establishment of the quality management system of enterprises; and | | （八）企业质量管理体系建立情况； |
| |
|
| 9. other information which may affect the quality guarantee capacity of enterprises. | | （九）其他影响企业质量保证能力情况。 |
| |
|
| Article 9 The enterprises manufacturing export-oriented industrial products shall be classified into 4 categories on the basis of the comprehensive evaluation results: | | 第九条 根据综合评定结果将出口工业产品生产企业分为以下四种类别： |
| |
|
| 1. Those with excellent results of comprehensive evaluation shall fall into Category I; | | （一）综合评定结果优秀的为一类企业； |
| |
|
| 2. Those with good results of comprehensive evaluation shall fall into Category II; | | （二）综合评定结果良好的为二类企业； |
| |
|
| 3. Those with ordinary results of comprehensive evaluation shall fall into Category III; and | | （三）综合评定结果一般的为三类企业； |
| |
|
| 4. Those with bad results of comprehensive evaluation shall fall into Category IV. | | （四）综合评定结果差的为四类企业。 |
| |
|
| Article 10 The inspection and quarantine institution of the place where enterprises are located shall form an evaluation team, which shall be responsible for the comprehensive evaluation of the classification of export enterprises. | | 第十条 企业所在地检验检疫机构应当组成评定工作组，负责出口企业分类的综合评定工作。 |
| |
|
| Article 11 The results of comprehensive evaluation of enterprises in Category I and Category IV shall be subject to the examination of the inspection and quarantine bureaus directly under the GAQSIQ. | | 第十一条 评定为一类、四类企业的综合评定结果应当经直属检验检疫局审核。 |
| |
|
Article 12 Generally, the term of classified administration of enterprises shall be 3 years, which may be dynamically adjusted by the inspection and quarantine institution in light of the actualities of the enterprises.
