The Several Provisions of the Supreme People's Court on the Service of Civil Process by Post in the Manner of Special Delivery for Court, as adopted at the 1324th Meeting of the Judicial Committee of the Supreme People's Court on September 7, 2004, are hereby issued and shall come into force on January 1, 2005.
 
《最高人民法院关于以法院专递方式邮寄送达民事诉讼文书的若干规定》已于2004年9月7日由最高人民法院审判委员会第1324次会议通过,现予公布,自2005年1月1日起施行。

最高人民法院关于以法院专递方式邮寄送达民事诉讼文书的若干规定


(Adopted at the 1324th Meeting of the Judicial Committee of the Supreme People's Court on September 7, 2004; Interpretation No. 13 [2004] of the Supreme People's Court)

These Provisions are developed in accordance with the relevant provisions of the Civil Procedure Law of the People's Republic of China and in consideration of civil trial experience and actual circumstances of different regions for the purposes of protecting and facilitating the lawful exercise of procedural rights by the parties.
 

为保障和方便双方当事人依法行使诉讼权利,根据《中华人民共和国民事诉讼法》的有关规定,结合民事审判经验和各地的实际情况,制定本规定。

 
Article 1 Where it is difficult for a people's court to directly serve process, process may be served by a postal institution of the state (hereinafter referred to as the “postal institution”) in the manner of special delivery for court, except under any of the following circumstances:   第一条 人民法院直接送达诉讼文书有困难的,可以交由国家邮政机构(以下简称邮政机构)以法院专递方式邮寄送达,但有下列情形之一的除外:

 
(1) The person to be served, a litigation representative of the person to be served, or a process agent designated by the person to be served agrees to go to the people's court to accept service of process within a specified time limit. (一)受送达人或者其诉讼代理人、受送达人指定的代收人同意在指定的期间内到人民法院接受送达的;

 
(2)The whereabouts of the person to be served are unknown. (二)受送达人下落不明的;

 
(3) Process shall be served otherwise as required by law or agreed upon under an international treaty concluded or acceded to by China. (三)法律规定或者我国缔结或者参加的国际条约中约定有特别送达方式的。

 
Article 2 Service of civil process in the manner of special delivery for court shall have equal legal effects as service by a people's court.   第二条 以法院专递方式邮寄送达民事诉讼文书的,其送达与人民法院送达具有同等法律效力。

 
Article 3 When instituting an action or submitting a statement of defense, a party shall provide the people's court with or confirm to the people's court an accurate address of the party for service of process and fill out an address confirmation letter for service of process. If the party refuses to provide the address, the people's court shall inform the party of the adverse effects of a refusal to provide the address and record the refusal.

   第三条 当事人起诉或者答辩时应当向人民法院提供或者确认自己准确的送达地址,并填写送达地址确认书。当事人拒绝提供的,人民法院应当告知其拒不提供送达地址的不利后果,并记入笔录。
