The “Regulation on Religious Affairs”, which was adopted at the 57th executive meeting of the State Council on July 7, 2004, is hereby promulgated and shall come into force on March 1, 2005. | |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 This Regulation is formulated in accordance with the Constitution and the relevant laws so as to guarantee the citizens' freedom of religious belief, maintain religious and social harmony, and regulate the administration of religious affairs. | | 第一条 为了保障公民宗教信仰自由，维护宗教和睦与社会和谐，规范宗教事务管理，根据宪法和有关法律，制定本条例。 |

| Article 2 Citizens shall have the freedom of religious belief. | | 第二条 公民有宗教信仰自由。 |
No organization or individual shall compel citizens to believe in or not to believe in any religion; nor may they discriminate against citizens who believe in any religion (hereinafter referred to as citizens believing in religion) or citizens who do not believe in any religion (hereinafter referred to as citizens not believing in religion). | |
任何组织或者个人不得强制公民信仰宗教或者不信仰宗教，不得歧视信仰宗教的公民（以下称信教公民）或者不信仰宗教的公民（以下称不信教公民）。 |
The citizens believing in religion, the citizens not believing in religion, and the citizens believing in different religions shall respect each other and live in harmony. | |
信教公民和不信教公民、信仰不同宗教的公民应当相互尊重、和睦相处。 |

| Article 3 The State lawfully protects the normal religious activities, maintain the religious bodies and religious activity sites, as well as the lawful rights and interests of the citizens believing in religion. | | 第三条 国家依法保护正常的宗教活动，维护宗教团体、宗教活动场所和信教公民的合法权益。 |
The religious bodies, religious activity sites, and citizens believing in religion shall abide by the Constitution, laws, regulations and rules, as well as maintain the unity of the State, the solidarity of the nations, and social stability. | |
宗教团体、宗教活动场所和信教公民应当遵守宪法、法律、法规和规章，维护国家统一、民族团结和社会稳定。 |
No organization or individual may make use of religion to destroy the social order, harm the health of citizens, obstruct the educational system of the State, or carry out other activities that harm the benefits of the State, public benefits, or lawful rights and interests of citizens. | |
任何组织或者个人不得利用宗教进行破坏社会秩序、损害公民身体健康、妨碍国家教育制度，以及其他损害国家利益、社会公共利益和公民合法权益的活动。 |

| Article 4 All religions shall adhere to the principles of maintaining their independence, relying on themselves respectively, and holding their respective religions on their own. No religious body, religious activity site or religious affair shall be dominated by foreign force. | | 第四条 各宗教坚持独立自主自办的原则，宗教团体、宗教活动场所和宗教事务不受外国势力的支配。 |
Religious bodies, religious activity sites and religion undertaking personnel shall interact with foreign parties on the basis of friendliness and equality. Other organizations or individuals may not accept additional religious conditions in economic or cultural cooperation or communications with foreign parties. | |
宗教团体、宗教活动场所、宗教教职人员在友好、平等的基础上开展对外交往；其他组织或者个人在对外经济、文化等合作、交流活动中不得接受附加的宗教条件。 |

| Article 5 The department for religious affairs under the people's government at the county level or above shall lawfully administer the religious affairs involving the benefits of the State or of the public, while other relevant departments under the people's government at the county level or above shall lawfully administer the relevant affairs within the scope of their respective duties. | | 第五条 县级以上人民政府宗教事务部门依法对涉及国家利益和社会公共利益的宗教事务进行行政管理，县级以上人民政府其他有关部门在各自职责范围内依法负责有关的行政管理工作。 |
The people's government at each level shall listen to the opinions of religious bodies, of religious activity sites, and of citizens believing in religion, as well as coordinate the administration of religious affairs. | |
各级人民政府应当听取宗教团体、宗教活动场所和信教公民的意见，协调宗教事务管理工作。 |
| | 第二章 宗教团体 |
| Chapter II Religious Bodies | |
|
| | 第六条 宗教团体的成立、变更和注销，应当依照《社会团体登记管理条例》的规定办理登记。 |
| Article 6 For the sake of establishing, modifying or canceling a religious body, the party concerned shall go through the registration procedures in accordance with the Regulations on Registration Administration of Associations. | |
宗教团体章程应当符合《社会团体登记管理条例》的有关规定。 |
The articles of association of a religious body shall conform to the relevant provisions in the Regulations on Registration Administration of Associations. | |
宗教团体按照章程开展活动，受法律保护。 |
A religious body shall be protected by law when carrying out activities in accordance with its articles of association. | |

| | 第七条 宗教团体按照国家有关规定可以编印宗教内部资料性出版物。出版公开发行的宗教出版物，按照国家出版管理的规定办理。 |
| Article 7 A religious body may, in accordance with the relevant provisions of the State, compile and print its internal documental religious publications. When the religious body publishes publicly distributed religious publications, it shall comply with the provisions of the State on the administration of publication. | |
涉及宗教内容的出版物，应当符合《出版管理条例》的规定，并不得含有下列内容： |
A publication involving religious contents shall conform to the Regulation on the Administration of Publication, and may not contain any of the following contents: | |
|
| | （一）破坏信教公民与不信教公民和睦相处的； |
| (1) that which destroys the peace and harmony between the citizens believing in religion and those not believing in religion; | |
|
| | （二）破坏不同宗教之间和睦以及宗教内部和睦的； |
| (2) that which destroys the peace and harmony between different religions or the internal peace and harmony within one religion; | |
|
| | （三）歧视、侮辱信教公民或者不信教公民的； |
| (3) that which discriminates against or insults the citizens believing in religion or the citizens not believing in religion; | |
|
| | （四）宣扬宗教极端主义的； |
| (4) that which propagates religion extremism; and | |
|
| | （五）违背宗教的独立自主自办原则的。 |
| (5) that which violates such principles for religions as maintaining their independence, relying on themselves respectively, and holding their respective religions on their own. | |
|
| | 第八条 设立宗教院校，应当由全国性宗教团体向国务院宗教事务部门提出申请，或者由省、自治区、直辖市宗教团体向拟设立的宗教院校所在地的省、自治区、直辖市人民政府宗教事务部门提出申请。省、自治区、直辖市人民政府宗教事务部门应当自收到申请之日起30日内提出意见，对拟同意的，报国务院宗教事务部门审批。 |
| Article 8 For the sake of establishing a religious institution or college, a national religious body shall file an application to the department for religious affairs under the State Council, or the religious body of the province, autonomous region, or municipality directly under the Central Government shall file an application to the department for religious affairs under the people's government of the province, autonomous region, or municipality directly under the Central Government where the religious institution or college under planned establishment will be located. The department for religious affairs under the people's government of the province, autonomous region, or municipality directly under the Central Government shall provide its opinions within 30 days as of receipt of the application. If it intents to consent to the application, it shall report the said application to the department for religious affairs under the State Council for approval. | |
国务院宗教事务部门应当自收到全国性宗教团体的申请或者省、自治区、直辖市人民政府宗教事务部门设立宗教院校的报告之日起60日内，作出批准或者不予批准的决定。 |
The department for religious affairs under the State Council shall, within 60 days as of receipt of the application of the national religious body, or as of receipt of the report from the department for religious affairs under the people's government of the province, autonomous region, or municipality directly under the Central Government on establishing the religious institution or college, make a decision on whether to grant the approval or not. | |

| | 第九条 设立宗教院校，应当具备下列条件： |
| Article 9 For the establishment of a religious institution or college, the establisher shall meet the following conditions: | |
|
| | （一）有明确的培养目标、办学章程和课程设置计划； |
| (1) Having clear educational targets, the articles of association for running the institution or college, and scheme of courses; | |
|
| | （二）有符合培养条件的生源； |
| (2) Having the sources of students who meet the conditions for education; | |
|
| | （三）有必要的办学资金和稳定的经费来源； |
| (3) Having the necessary funds for running the institution or college, and stable sources of funds; | |
|
| | （四）有教学任务和办学规模所必需的教学场所、设施设备； |
| (4) Having the indispensable teaching sites, facilities and equipment suitable for the teaching tasks and scale; | |
|
| | （五）有专职的院校负责人、合格的专职教师和内部管理组织； |
| (5) Having a full-time principal, qualified full-time teachers, and an internal management structure; and | |
|
| | （六）布局合理。 |
| (6) The layout being reasonable. | |
|
| | 第十条 全国性宗教团体可以根据本宗教的需要按照规定选派和接收宗教留学人员。 |
| Article 10 A national religious body may, upon the needs in this religion and in accordance with the provisions, select religious students or scholars and send them to study abroad, or accept foreign religious students or scholars. | |
|
| | 第十一条 信仰伊斯兰教的中国公民前往国外朝觐，由伊斯兰教全国性宗教团体负责组织。 |
| Article 11 The responsibility to organize Chinese citizens believing in Islam to go abroad for Hajj shall remain with the national Islamic body. | |
|
| | 第三章 宗教活动场所 |
| Chapter III Religious Activity Sites | |
|
| | 第十二条 信教公民的集体宗教活动，一般应当在经登记的宗教活动场所（寺院、宫观、清真寺、教堂以及其他固定宗教活动处所）内举行，由宗教活动场所或者宗教团体组织，由宗教教职人员或者符合本宗教规定的其他人员主持，按照教义教规进行。 |
| Article 12 A collective religious activity of citizens believing in religion shall usually be held in a registered religious activity site (Buddhist temple, Daoist temple, mosque, church or any other fixed religious activity place). Such an activity shall be organized by the religious activity site or religious body, presided over by religion undertaking personnel or other personnel conforming to the rules of this religion, and carried on pursuant to the religious doctrines and rules. | |
|
| | 第十三条 筹备设立宗教活动场所，由宗教团体向拟设立的宗教活动场所所在地的县级人民政府宗教事务部门提出申请。县级人民政府宗教事务部门应当自收到申请之日起30日内，对拟同意的，报设区的市级人民政府宗教事务部门审批。 |
| Article 13 In the case of preparation for the establishment of a religious activity site, the relevant religious body shall file an application to the department for religious affairs under the people's government at the county level where the religious activity site is planned to be established. The department for religious affairs under the people's government at the county level shall, if it intends to consent to the application, report within 30 days as of receipt of the application to the department for religious affairs under the people's government at the level of city divided into districts for approval. | |
设区的市级人民政府宗教事务部门应当自收到县级人民政府宗教事务部门的报告之日起30日内，对拟同意设立寺院、宫观、清真寺、教堂的，提出审核意见，报省、自治区、直辖市人民政府宗教事务部门审批；对设立其他固定宗教活动处所的，作出批准或者不予批准的决定。 |
The department for religious affairs under the people's government at the level of city divided into districts shall, within 30 days as of receipt of the report from the department for religious affairs under the people's government at the county level, propose its opinions on examination if it intends to consent to the establishment of the Buddhist temple, Daoist temple, mosque or church, and report to the department for religious affairs under the people's government of the province, autonomous region, or municipality directly under the Central Government for approval; or, in the case of establishment of a fixed religious activity place of any other kind, make a decision on whether to grant the approval or not. | |
省、自治区、直辖市人民政府宗教事务部门应当自收到设区的市级人民政府宗教事务部门拟同意设立寺院、宫观、清真寺、教堂的报告之日起30日内，作出批准或者不予批准的决定。 |
The department for religious affairs under the people's government of the province, autonomous region, or municipality directly under the Central Government shall, within 30 days as of receipt of the report from the department for religious affairs under the people's government at the level of city divided into districts on its planned consent to the establishment of the Buddhist temple, Daoist temple, mosque or church, make a decision on whether to grant the approval or not. | |
宗教团体在宗教活动场所的设立申请获批准后，方可办理该宗教活动场所的筹建事项。 |
A religious body may not handle the matters for preparatory establishment of a religious activity site until the application for the establishment of such religious activity site has been approved. | |

| | 第十四条 设立宗教活动场所，应当具备下列条件： |
| Article 14 For the establishment of a religious activity site, the applicant shall meet the following conditions: | |

| | （一）设立宗旨不违背本条例第三条、第四条的规定； |
| (1) The tenet of establishment does not violate Article 3、Article 4 of this Regulation; | |
