关于制止非法劫持航空器的公约*

 (注*:该公约于1970年12月16日订于海牙,1971年10月14日生效。我国于1980年9月10日交存加入书,同时声明:对本公约第十二条第一款持有保留;台湾当局用中国名义对该公约的签署和批准是非法和无效的 该公约于1980年10月10日对我生效。)

Preamble 前言
 THE STATES PARTIES to this Convention. 本公约各缔约国
 CONSIDERING that unlawful acts of seizure or exercise of control of aircraft in flight jeopardize the safety of persons and property,seriously affect the operation of air services,and undermine the confidence of the peoples of the world in the safety of civil aviation; 考虑到非法劫持或控制飞行中的航空器的行为危及人身和财产的安全,严重影响航班的经营,并损害世界人民对民用航空安全的信任;
 CONSIDERING that the occurrence of such acts is a matter of grave concern; 考虑到发生这些行为是令人严重关切的事情;
 CONSIDERING that for the purpose of deterring such acts,there is an urgent need to provide appropriate measures for punishment of offenders; 考虑到为了防止这类行为,迫切需要规定适当的措施以惩罚罪犯;
 HAVE AGREED AS FOLLOWS: 协议如下:
Article 1 Any person who on board an aircraft in flight:   第一条 凡在飞行中的航空器内的任何人:
 a.unlawfully,by force or threat thereof,or by any other form of intimidation,seizes,or exercises control of,that aircraft,or attempts to perform any such act,or (甲)用暴力或用暴力威胁,或用任何其他恐吓方式,非法劫持或控制该航空器,或企图从事任何这种行为,或
 b.is an accomplice of a person who performs or attempts to perform any such act commits an offence(hereinafter referred to as“the offence”). (乙)是从事或企图从事任何这种行为的人的同犯,即是犯有罪行(以下称为“罪行”)。
Article 2 Each Contracting State undertakes to make the offence punishable by severe penalties.   第二条 各缔约国承允对上述罪行给予严厉惩罚。
Article 3   第三条
 1.For the purposes of this Convention,an aircraft is considered to be in flight at any time from the moment when all its external doors are closed following embarkation until the moment when any such door is opened for disembarkation.In the case of a forced landing,the flight shall be deemed to continue until the competent authorities take over the responsibility for the aircraft and for persons and property on board. 一、在本公约中,航空器从装载完毕、机仓外部各门均已关闭时起,直至打开任一机仓门以便卸载时为止,应被认为是在飞行中。航空器强迫降落时,在主管当局接管对该航空器及其所载人员和财产的责任前,应被认为仍在飞行中。
 2.This Convention shall not apply to aircraft used in military,customs or police services. 二、本公约不适用于供军事、海关或警察用的航空器。
 3.This Convention shall apply only if the place of take—off or the place of actual landing of the aircraft on board which the offence is committed is situated outside the territory of the State of registration of that aircraft;it shall be immaterial whether the aircraft is engaged in an international or domestic flight. 三、本公约仅适用于在其内发生罪行的航空器的起飞地点或实际降落地点是在该航空器登记国领土以外,不论该航空器是从事国际飞行或国内飞行。
 4.In the cases mentioned in Article 5,this Convention shall not apply if the place of take—off and the place of actual landing of the aircraft on board which the offence is committed are situated within the territory of the same State where that State is one of those referred to in that Article. 四、对于第五条所指的情况,如在其内发生罪行的航空器的起飞地点或实际降落地点是在同一个国家的领土内,而这一国家又是该条所指国家之一,则本公约不适用。
 5.Notwithstanding paragraphs 3 and 4 of this Article,Articles 6,7,8,and 10 shall apply whatever the place of take—off or the place of actual landing of the aircraft,if the offender or the alleged offender is found in the territory of a State other than the State of registration of that aircraft. 五、尽管有本条第三、第四款的规定,如罪犯或被指称的罪犯在该航空器登记国以外的一国领土内被发现,则不论该航空器的起飞地点或实际降落地点在何处,均应适用第六、七、八条和第十条。
Article 4   第四条
 1.Each Contracting State shall take such measures as may be necessary to establish its iurisdiction over the offence and any other act of violence against passengers or crew committed by the alleged offender in connection with the offence,in the following cases: 一、在下列情况下,各缔约国应采取必要措施,对罪行和对被指称的罪犯对旅客或机组所犯的同该罪行有关的任何其他暴力行为,实施管辖权:
 a.when the offence is committed on board an aircraft registered in that State; (甲)罪行是在该国登记的航空器内发生的;
 b.when the aircraft on board which the offence is committed lands in its territory with the alleged offender still on board; (乙)在其内发生罪行的航空器在该国降落时被指称的罪犯仍在该航空器内;
 c.when the offence is committed on board an aircraft leased without crew to a lessee who has his principal place of business or,if the lessee has no such place of business,his permanent residence,in that State. (丙)罪行是在租来时不带机组的航空器内发生的,而承租人的主要营业地,或如承租人没有这种营业地,则其永久居所,是在该国。
 2.Each Contracting State shall likewise take such measures as may be necessary to establish its iurisdiction over the offence in the case where the alleged offender is present in its territory and it does not extradite him pursuant to Article 8 to any of the States mentioned in paragraph 1 of this Article. 二、当被指称的罪犯在缔约国领土内,而该国未按第八条的规定将此人引渡给本条第一款所指的任一国家时,该缔约国应同样采取必要措施,对这种罪行实施管辖权。
 3.This Convention does not exclude any criminal jurisdiction exercised in accordance with national law. 三、本公约不排斥根据本国法行使任何刑事管辖权。
Article 5 The Contracting States which establish joint air transport operating organizations or international operating agencies,which operate aircraft which are subject to joint or international registration shall,by appropriate means,designate for each aircraft the State among them which shall exercise the jurisdiction and have the attributes of the State of registration for the purpose of this Convention and shall give notice thereof to the International Civil Aviation Organization which shall communicate the notice to all States Parties to this Convention.

   第五条 如缔约各国成立航空运输联营组织或国际经营机构,而其使用的航空器需进行联合登记或国际登记时,则这些缔约国应通过适当方法在它们之间为每一航空器指定一个国家,该国为本公约的目的,应行使管辖权并具有登记国的性质,并应将此项指定通知国际民用航空组织,由该组织将上述通知转告本公约所有缔约国。
