| The market regulatory bureaus (departments and commissions) of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps; and relevant entities: | | 各省、自治区、直辖市及新疆生产建设兵团市场监管局（厅、委），有关单位： |
| According to the Announcement of the State Administration for Market Regulation on Matters Concerning the Administrative Licensing of Special Equipment (No. 3 [2019]) and the Announcement of the State Administration for Market Regulation on Issuing the Rules of Licensing for Special Equipment Producers and Filling Entities (No. 22 [2019]), the List of Licensing for Special Equipment Producers, the Classification and Items of the Qualification of Special Equipment Operators, the Items of the Qualification of Special Equipment Inspectors and Testers, the Rules of Licensing for Special Equipment Producers and Filling Entities, and other licensing requirements (hereinafter referred to as the "new licensing requirements") will come into force on June 1, 2019. With the approval of the State Administration for Market Regulation ("SAMR"), the following opinions are hereby offered on related matters. | | 根据《市场监管总局关于特种设备行政许可有关事项的公告》（2019第3号）、《市场监管总局关于发布〈特种设备生产和充装单位许可规则〉的公告》（2019年第22号），《特种设备生产单位许可目录》《特种设备作业人员资格认定分类与项目》《特种设备检验检测人员资格认定项目》《特种设备生产和充装单位许可规则》等许可要求（以下称新许可要求）将于2019年6月1日起实施。经市场监管总局同意，现就有关事项提出以下意见。 |
| I. Transition from the implementation of old production licensing to that of new production licensing | | 一、关于新旧生产许可实施的过渡 |
| 1. Licensing for producers. A license for a special equipment production or filling entity issued before May 31, 2019 (including May 31, the same below) shall remain valid within the original licensing scope and before its expiration date, and the license shall be replaced according to the new licensing requirements before the license expires. | | 1.生产单位许可。2019年5月31日前（含5月31日，下同）发放的特种设备生产和充装单位许可证书继续在原许可范围和有效期内有效，许可到期前按新许可要求进行换证。 |
| 2. Licensing matters that have been accepted. For licensing matters (including license obtainment, replacement, addition, and modification, the same below) with respect to which on-site authentication review has been completed (including awaiting a report or being under rectification after review is completed) before May 31, 2019, licenses shall be issued according to the new licensing requirements after June 1, and if an accepted item conforms to the item at original licensing level specified in the Comparison Table between New and Old Licensing Items for Producers (Annex 1), a license may be issued according to the item at new licensing level in the Table, otherwise the issuing authority shall limit the scope of licensing based on the specific circumstances. For a licensing item which respect to which the issuing authority changes, the original accepting authority shall notify the new license implementing authority in writing of the review report and the conclusion of the licensing recommendations, and notify the applicant that it should retroactively submit an application to the new license implementing authority in accordance with the new licensing requirements. | | 2.已经受理的许可事项。2019年5月31日前已经完成现场鉴定评审（包括完成评审工作尚未出具报告或已在整改中）的许可事项（包括取证、换证、增项、变更下同），6月1日后应当按新许可要求进行许可，对于受理项目符合《新旧生产单位许可项目对应表》（见附件1）中规定的原许可级别项目，可按表中新许可级别项目进行发证，否则发证机关应当根据具体情况对许可范围进行限制。对发证机关发生变动的许可项目，原受理机关应当将评审报告和许可建议结论书面通知变动后的许可实施机关，并通知申请单位向变动后的许可实施机关按新的许可要求补交申请。 |
| For a licensing item accepted with respect to which on-site authentication review has not been conducted, and which, according to the relevant provisions, shall continue to be implemented by the original licensing authority after June 1, 2019, the review and issuance of licenses shall be conducted according to the new licensing requirements, and the requirements for issuing licenses shall be the same as above. If the license implementing authority changes, the applicant shall apply to the new license implementing authority, and the original licensing procedure shall be terminated. | | 对已经受理但未开展现场鉴定评审的且2019年6月1日后按规定仍由原许可实施机关实施的许可项目，应当按新许可要求进行评审和发证，发证要求同上。许可实施机关发生变化的，申请单位应当向变动后的许可实施机关重新申请，原许可程序终止。 |
| 3. Licensing matters that have not been accepted. For a licensing matter with respect to which an application has been submitted but not accepted before May 31, 2019, the applicant shall re-apply according to the new licensing requirements after June 1. If a licensee meets the items specified in Annex 1, the licensee may apply for a replacement, otherwise the licensee shall apply for a new license (or addition). | | 3.未受理的许可事项。对2019年5月31日前已经递交申请但未受理的许可事项，在6月1日后申请单位应当按新许可要求重新申请。其中，符合附件1规定项目的持证单位，可按换证申请，否则应当按新取证（或增项）申请。 |
| 4. Applications after June 1, 2019. As from June 1, all license applications, acceptance, and issuance of licenses shall be governed by the new licensing requirements. For a replacement, if the new license after replacement is at a level higher than the original licensing level, or the scope of licensing becomes wider, the licensee shall apply for a new license (or addition). If an entity is to apply for the licensing of different product categories (or different links), the entity shall apply to the corresponding license implementing authorities respectively. If an entity is to apply for multiple sub-items under the licensing items, implemented by different licensing authorities, for manufacturing boilers, fixed pressure vessels, pipes and valves, safety valves and emergency shutdown valves, and elevators and (bridge, portal, mobile, and gantry) cranes, it may submit a consolidated application to a higher license implementing authority. | | 4.2019年6月1日后的申请。6月1日起，所有许可的申请、受理及许可证书的发放均应当按新许可要求执行。换证时如改换比原许可级别参数高的或许可范围变宽的，应当按新取证（或增项）进行申请。同一单位申请不同产品类别（或不同环节）的许可，应当分别向对应的许可实施机关提出申请。申请不同许可机关实施的锅炉、固定式压力容器、管子和阀门、安全阀和紧急切断阀、电梯和起重机械（桥式、门式、流动式、门座式）制造许可项目中的多个子项目时，可一并向层级高的许可实施机关提出申请。 |
| 5. License modification. If an addition is needed for the same product category or the same license item before the original license expires (including applications after June 1, 2019, and applications for which authentication review has not been completed before June 1), the new licensing requirements shall apply, and the original license shall be replaced at the same time. In the case of a licensing item implemented by the SAMR, the applicant that meets the requirements of the above paragraph shall submit a consolidated application to the SAMR; or in the case of a licensing item which was formerly implemented by the SAMR and shall be implemented by the provincial market regulatory authority according to the new licensing requirements, the applicant shall apply to the provincial market regulatory authority for addition and replacement of license and after receiving a new license, apply to the SAMR for cancellation of the original license that has not expired. | | 5.许可变更。原许可有效期内的同一产品类别、同一许可项目需增项的（含2019年6月1日后申请和6月1日前未完成鉴定评审的），应当按新许可要求办理，原许可证应当一并换证。其中如有总局实施的，符合上款要求的申请单位应当向总局一并提出申请；对原由总局实施、按新许可要求由省级市场监管部门实施的许可项目，申请单位应当向省级市场监管部门提交增项与换证申请，并在取得证书后向总局提出注销有效期内的原证书。 |
| For a new type of products not covered by the type test filing of outsize cranes and special types of completely built elevators, or the relevant entity license, which has passed the type test, the producer may apply to the license implementing authority for the consolidated modification of the original license (including the certificate of filing) and type test information. The license implementing authority shall modify the original license based on the correspondence between the new and old license catalogs. | | 对超大型起重机械、特殊类型电梯整机型式试验备案以及单位许可证中没有涵盖新的产品品种，且已经通过型式试验的，生产单位可将原许可证（包括备案证书）和型式试验资料一并向许可实施机关提出变更申请。许可实施机关依据新旧许可目录对应关系，对原许可证书进行变更。 |
| 6. Pressure vessel design licensing. When a pressure vessel manufacturer submits an application for the obtainment (replacement, or addition) of a manufacturing license after June 1, 2019, it shall specify in the application whether to design pressure vessels. For a manufacturer that is not engaged in the design of pressure vessels and only designs its own pressure vessel products, the authentication review institution shall confirm or review the design capability of the applicant during the manufacturing review and, if the requirements of the new licensing rules are met, issue a manufacturing license; if the applicant has the capability to design the products manufactured, it is not required to be stated in the manufacturing license; if the applicant has no capability to design the product manufactured, the manufacturing license shall be marked with "design outsourcing"; and if the applicant has no full capability to design the product manufactured, the manufacturing license shall indicate the limits by product. The design capability review of a manufacturer shall be conducted at the time of obtainment (replacement, or addition) of the manufacturing license, instead of being accepted as addition separately. | | 6.压力容器设计许可。2019年6月1日后，压力容器制造单位提交制造许可取证（换证、增项）申请时，应当在申请书中明确是否设计压力容器。对不从事压力容器设计和仅设计本单位压力容器产品的制造单位，制造评审时鉴定评审机构应当对申请单位设计能力进行确认或评审，满足新许可规则要求的，颁发制造许可证书；具备所制造产品设计能力的，制造证书上无需注明；不具备所制造产品设计能力的，制造证书上注明“设计外委”；不完全具备所制造产品设计能力的，制造证书上按产品注明限制范围。制造单位的设计能力审查在制造许可取证（换证、增项）时进行，不单独按增项受理。 |
A pressure vessel design entity, or a manufacturer that needs to provide pressure vessel design services, which applies for the obtainment (replacement or addition) of a license after June 1, 2019, shall separately apply for a pressure vessel design license to the SAMR. A pressure vessel manufacturer that applies for a design license separately shall be treated as a design entity, irrelevant to the item of the manufacturing license, and the manufacturing license it obtains shall be marked with "separate obtainment of design license."
