| For purposes of regulating the selection and appointment of technical investigators, strengthening the trial of intellectual property right cases in the technology category, these Opinions are developed under the Civil Servant Law of the People's Republic of China and the relevant provisions on the administration of contractual civil servants, based on the actual circumstances of intellectual property right trials. | | 为规范技术调查官选任工作，加强技术类知识产权案件审理，根据《中华人民共和国公务员法》和聘任制公务员管理有关规定，结合知识产权审判工作实际，制定本意见。 |
| I. Technical investigators are trial-supporting personnel responsible for investigation, examination, analysis and judgment of technical issues involved in trial of intellectual property right cases and providing professional technical opinions for judges to decide cases. | | 一、技术调查官是审判辅助人员，负责对知识产权案件审理中涉及的技术问题进行调查、询问、分析、判断等，为法官裁判案件提供专业技术意见。 |
| II. An intellectual property court may, with the approval of the provincial civil servant department, employ technical investigators by contract according to the provisions pertaining to the administration of contractual civil servants. | | 二、经省级公务员主管部门批准，知识产权法院可以按照聘任制公务员管理有关规定，以合同形式聘任技术调查官。 |
| To satisfy the need of trial, qualified professional technical personnel of patent administration and other departments may work at intellectual property courts for one to two years in the form of exchange, during which they are technical investigators. Such personnel shall be examiners in office. | | 根据审判工作需要，符合资格条件的专利行政管理等部门的专业技术人员，可到知识产权法院挂职交流1至2年，在交流期间担任技术调查官。担任技术调查官的专利行政管理部门交流人员应为现职审查员。 |
| Other professional technical personnel qualified as technical investigators may, as recommended by industry associations or relevant entities and reviewed by intellectual property courts, be part-time technical investigators. | | 其他符合技术调查官资格条件的专业技术人员，经行业协会、有关单位推荐和知识产权法院审核，可兼职担任技术调查官。 |
III. In selecting and appointing technical investigators, the principle of administration of officials by the party, equal stress on integrity and ability, integrity as top priority, focus on actual performance, industry recognition, use as orientation, and the principles of openness, equality, competition, and selection of the best shall be adhered to, and the statutory power, conditions, standards and procedures shall be the bases, and the professional characteristics of intellectual property right trial shall be highlighted.
