现金管理暂行条例

(Issued by the Order No. 12 of the State Council of the People's Republic of China on September 8, 1988, and revised in accordance with the Decision of the State Council on Abolishing and Amending Some Administrative Regulations by the Order No. 588 of the State Council on January 8, 2011) (1988年9月8日中华人民共和国国务院令第12号发布 根据2011年1月8日国务院令第588号《国务院关于废止和修改部分行政法规的决定》修订)

Chapter I General Provisions 

第一章 总  则

Article 1 These Regulations are formulated for the purpose of improving cash control, promoting commodity production and circulation, strengthening supervision in social economic activities.   第一条 为改善现金管理,促进商品生产和流通,加强对社会经济活动的监督,制定本条例。
Article 2 Any government organ, group, armed force unit, enterprise, institution or any other unit (hereinafter referred to as the account holding institution) that holds an account in bank or any other financial agency (hereinafter referred to as the account holding bank) shall make receipt and disbursement and use of cash in accordance with the provisions in the Regulations and be subject to supervision by the account holding bank.   第二条 凡在银行和其他金融机构(以下简称开户银行)开立账户的机关、团体、部队、企业、事业单位和其他单位(以下简称开户单位),必须依照本条例的规定收支和使用现金,接受开户银行的监督。
The State encourages account holding institutions and individuals to make settlement in the form of transfer of account so as to reduce cash flow. 国家鼓励开户单位和个人在经济活动中,采取转账方式进行结算,减少使用现金。
Article 3 The account holding institutions shall make transfer account settlement through account holding banks for business transaction except that the use of cash falls within the scope as provided for in the Regulations.   第三条 开户单位之间的经济往来,除按本条例规定的范围可以使用现金外,应当通过开户银行进行转账结算。
Article 4 People's banks at various levels shall fulfill their duty as competent authorities of finance in supervising and auditing cash control of account holding banks.   第四条 各级人民银行应当严格履行金融主管机关的职责,负责对开户银行的现金管理进行监督和稽核。
Account holding banks shall be responsible for concrete supervision of cash control, supervising the receipt and disbursement and use of cash of account holding institutions in accordance with the Regulations and the stipulations of the People's Republic of China. 开户银行依照本条例和中国人民银行的规定,负责现金管理的具体实施,对开户单位收支、使用现金进行监督管理。
Chapter II Cash Control and Supervision 

第二章 现金管理和监督

Article 5 Account holding institutions may use cash in the following scope:   第五条 开户单位可以在下列范围内使用现金:
(1) salary and allowance; (一)职工工资、津贴;
(2) payment of labour service for individuals; (二)个人劳务报酬;
(3) bounds awards to individuals for scientific, technological, cultural, artistic, sports and other achievements according to State regulations; (三)根据国家规定颁发给个人的科学技术、文化艺术、体育等各种奖金;
(4) cost of labour insurance and welfare and other payments to individuals provided for by the State; (四)各种劳保,福利费用以及国家规定的对个人的其他支出;
(5) money used to purchase agricultural and sideline products and other materials from individuals; (五)向个人收购农副产品和其他物资的价款;
(6) travel and miscellaneous expenses that should be carried by personnel on official errand; (六)出差人员必须随身携带的差旅费;
(7) scrap disbursements under the minimum settlement point; (七)结算起点以下的零星支出;
(8) other disbursements which the People's Bank of China deems necessary to be paid in cash. (八)中国人民银行确定需要支付现金的其他支出。
The minimum settlement point as mentioned in the previous clause is 1,000 yuan. The People's Bank of China shall have the right to adjust the minimum settlement point and file a report with the State Council for the record. 前款结算起点定为1000元。结算起点的调整,由中国人民银行确定,报国务院备案。
Article 6 Except (E) and (F) of Article 5 of the Regulations, if payment to individual exceeds the limit of cash control, the account holding institution shall make disbursement of the part beyond the limit in the form of check or cashier's check; if total disbursement in the form of cash is necessary, such a disbursement may be made upon the examination and approval of the account holding bank.   第六条 除本条例第五条第(五)、(六)项外,开户单位支付给个人的款项,超过使用现金限额的部分,应当以支票或者银行本票支付;确需全额支付现金的,经开户银行审核后,予以支付现金。
Limit of cash disbursement as mentioned in the previous clause shall be implemented pursuant to Clause 2, Article 5. 前款使用现金限额,按本条例第五条第二款的规定执行。
Article 7 Vouchers of transfer account settlement shall bear the same disbursement capability as cash in business transaction.   第七条 转账结算凭证在经济往来中,具有同现金相同的支付能力。
Account holding institutions shall not offer cash settlement more preferential treatment than transfer account settlement in purchase and sale; nor shall they refuse to accept checks, bank drafts or cashier's checks. 开户单位在销售活动中,不得对现金结算给予比转账结算优惠待遇;不得拒收支票、银行汇票和银行本票。
Article 8 Government institution, groups, armed force units, state-owned and collective owned enterprises and institutions shall apply transfer account settlement instead of cash settlement to purchase specially controlled commodities stipulated by the State.   第八条 机关、团体、部队、全民所有制和集体所有制企业事业单位购置国家规定的专项控制商品,必须采取转账结算方式,不得使用现金。
Article 9 Account holding banks shall according to the actual situation determine the limit of cash on hand necessary for three to five days of minor disbursements of the account holding institutions.
