为落实国务院国发（１９９６）２号文件精神，加强和规范边境贸易外汇管理，我局在广泛调查及征求意见的基础上，制订了《边境贸易外汇管理暂行办法》（以下简称《暂行办法》），现发给你局，请遵照执行。现就有关问题通知如下： |
Provisional Rules on Foreign Exchange Management in Border Trade | |

(Promulgated by the State Administration of Foreign Exchange Control on January 23, 1997) | | 一、关于核定限额问题。根据《暂行办法》第二章第八条规定，边贸企业经常项目下外汇收入，在外汇局核定的最高限额内保留外汇。该限额由各有关分局根据当地情况具体核定并报我局备案，原则上最高限额不得超过边贸企业上一年进出口总额的５０％。 |

| CHAPTER I GENERAL PROVISIONS | | 二、“边境贸易企业外汇登记证”由有关分局自行印制（规格见样本）。该登记证可代替“外汇帐户使用证”使用，但仅限于边贸公司开立现汇帐户之用。 |

| Article 1 These Rules are formulated hereby in accordance with Article 54 of the Regulations of the People's Republic of China on Foreign Exchange Control to promote border trade and economic cooperation between Chinese border regions and the neighboring countries (hereinafter referred to as "border trade") and to standardize foreign exchange settlement, sale, payment and clearance in border trade. | | 三、各有关分局须结合当地实际情况，根据《暂行办法》，制订《边境贸易外汇管理暂行办法实施细则》，并报我局备案。 |

各有关分局今后在边境贸易外汇管理中如遇新的问题，请及时上报我局。 |
| Article 2 "Border trade" referred to in these Rules includes exchange trade between border residents, cross-border trade in small amount, and foreign economic and technological cooperation in border regions. | |
附件：一、边境贸易外汇管理暂行办法 |
Exchange trade between border residents refers to commodity exchange activities with the amount or quantity under the set limit in the open area approved by the government or in the designated market within 20 kilometres along the border line. | |

Small-amount border trade refers to trade activities between enterprises in Chinese border regions who have been granted the right to handle border trade in small amount and enterprises or other trading agencies in foreign border regions at state-designated land ports. | | 二、边境贸易企业外汇登记证（略） |
Foreign economic and technological cooperation in border regions refers to project contracting and labor cooperation between enterprises in Chinese border regions which have been granted the right to conduct foreign economic and technological cooperation by the Chinese Ministry of Foreign Trade and Economic Cooperation and their counterparts from neighboring countries. | |

Enterprises engaged in small-amount border trade refer to enterprises in the border regions with the right to conduct small-amount border trade with approval from the Chinese Ministry of Foreign Trade an Economic Cooperation or its authorized department. | |
边境贸易外汇管理暂行办法 |
Foreign economic and technological cooperation enterprises refer to enterprises in the border regions with the foreign economic and technological cooperation right granted by the Chinese Ministry of Foreign Trade and Economic Cooperation to conduct project contracting and labor cooperation with border regions of neighboring countries. | |

| | 第一章 总则 |
| Article 4 Border residents shall be able to use convertible currency, Renminbi or the currency of the neighboring country for quoting prices and settling accounts under exchange trade in exchange trade areas. | |

| | 第一条 为了促进我国边境地区发展与毗邻国家之间的边境贸易与经济合作（以下简称“边境贸易”），规范边境贸易中的结汇、售汇、付汇及结算行为，根据《中华人民共和国外汇管理条例》第五十四条，特制定本办法。 |
| Article 5 Border trade enterprises shall be able to use convertible currency or Renminbi for quoting prices and settling accounts in border trade with enterprises or other trading agencies from neighboring countries. | |

| | 第二条 本办法所称“边境贸易”包括边民互市贸易、边境小额贸易和边境地区对外经济技术合作。 |
| Article 6 In border trade, border trade enterprises shall go through import and export account cancellation procedures in accordance with relevant administrative measures on import foreign exchange payment cancellation and export foreign exchange receiving cancellation. | |
边民互市贸易，系指边境地区边民在边境线２０公里以内、经政府批准的开放点或指定的集市上，在不超过规定的金额或者数量范围内进行的商品交换活动。 |

边境小额贸易，系指我国边境地区经批准有边境小额贸易经营权的企业，通过国家指定的陆地边境口岸，与毗邻国家边境地区的企业或者其他贸易机构之间进行的贸易活动。 |
| Article 7 Border trade enterprises shall register for the record in the Foreign Exchange Bureau and get the Foreign Exchange Registration Certificate for Border Trade Enterprises with the business license issued by an industrial and commercial bureau and the Approval Certificate issued by the Ministry of Foreign Trade and Economic Cooperation with in 30 days after getting the right to conduct small- amount border trade and foreign economic and technological cooperation from the Ministry of Foreign Trade and Economic Cooperation. | |
边境地区对外经济技术合作，系指我国边境地区经对外贸易经济合作部批准有对外经济技术合作经营权的企业，与我国毗邻国家边境地区开展的承包工程和劳务合作项目。 |

| CHAPTER II MANAGEMENT OF FOREIGN EXCHANGE SETTLEMENT, SALE, PAYMENT AND FOREIGN EXCHANGE ACCOUNT | | 第三条 本办法所称“边贸企业”包括边境小额贸易企业和对外经济技术合作企业。 |
| |
边境小额贸易企业，系指我国边境地区经对外贸易经济合作部或者其授权部门批准，有边境小额贸易经营权的企业。
