The First Session of the Twelfth National People's Congress has listened to the explanations on the plan for restructuring the State Council and transforming functions made by Ma Kai, state councilor and secretary general of the State Council, deliberated on the plan for restructuring the State Council and transforming functions, and decided to approve the plan. According to the requirements of this session, the State Council shall make elaborate arrangements and organization and guarantee the smooth implementation of the plan. Where the implementation of the plan for restructuring the State Council and transforming functions needs revising a law, the State Council shall timely submit a request to the Standing Committee of the National People's Congress for deliberation according to law in a timely manner. | |

| 1. Separation of government functions from enterprise management shall be implemented in the railway sector. For purposes of promoting the sound and sustainable development of railway construction and operation, guaranteeing the railway operation order and safety, and enhancing the linkup of various transport means, separation of government functions from enterprise management shall be implemented so as to improve the comprehensive transport system. The administrative functions of the Ministry of Railways, including making railway development plans and policies, shall be transferred to the Ministry of Transport. The Ministry of Transport shall make overall plans for the development of railways, highways, waterways, and civil aviation, and accelerate the building of the comprehensive transportation system. The State Railway Administration shall be established under the administration of the Ministry of Transport, assuming other administrative duties of the Ministry of Railways, and being responsible for making technical standards for railways, supervising and administrating the railway work safety, transport service quality and railway engineering quality. For purposes of better sticking to the basic state policy of family planning, strengthening the work of medical care and health, deepening the reform of medical care and health system, optimizing the distribution of medical care and family planning service resources, and improving the quality of newborn population and people's health, the Ministry of Health's functions and duties and the National Population and Family Planning Commission's duties of family planning administration and services shall be integrated and the National Health and Family Planning Commission shall be established. For purposes of strengthening the supervision and administration of food and drugs and improving the safety and quality level of food and drugs, the functions and duties of the Office of the Food Safety Committee of the State Council, the functions and duties of the State Food and Drug Administration, the duties and functions of the General Administration of Quality Supervision, Inspection and Quarantine on supervising and administrating food safety in the process of production, and the duties and functions of the State Administration for Industry and Commerce on supervising and administrating food safety in the process of circulation shall be integrated and the China Food and Drug Administration shall be established. The main functions and duties of the China Food and Drug Administration include: uniformly supervising and administrating food safety and drug safety and effectiveness in the processes of production, circulation, and consumption thereof. For purposes of further promoting the cultural system's reform and making overall arrangements for resources of press and publication, radio, film and television, the functions and duties of the General Administration of Press and Publication and the State Administration of Radio, Film and Television shall be integrated and the General Administration of Press and Publication, Radio, Film and Television shall be established. The main functions and duties of the General Administration of Press and Publication, Radio, Film and Television include: making overall plans for the development of the press and publication industry, radio, film and television undertakings, supervising and administrating institutions of press and publication, radio, film and television and the business thereof as well as the content and quality of publications and broadcasting, film and television programs, and being responsible for copyright administration. 5. The State Oceanic Administration shall be reorganized. For purposes of promoting uniform marine law enforcement and improving efficacy of law enforcement, the contingents and functions and duties of the State Oceanic Administration, the China Marine Surveillance Force, the coast guard for frontier defense under the Ministry of Public Security, the China Fishery Management Commanding Center under the Ministry of Agriculture, and the smuggle-suppressing police under the General Administration of Customs shall be integrated, and the State Oceanic Administration shall be reorganized, which is administrated by the Ministry of Land and Resources. The main functions and duties of the new State Oceanic Administration include: making ocean development planning, implementing marine right safeguarding and law enforcement, supervising and administrating the use of sea areas and the protection of marine environment. The State Oceanic Administration shall carry out marine right safeguarding and law enforcement in the name of the China Coast Guard, and accept business guidance of the Ministry of Public Security.
