(Issued by the Ministry of Transport on January 27, 2003; and amended in accordance with the Decision of the Ministry of Transport on Amending the Provisions on the Administration of Highways by the Order No. 81 [2016] of the Ministry of Transport on December 10, 2016) (2003年1月27日交通部发布 根据2016年12月10日交通运输部令2016年第81号交通运输部《关于修改〈路政管理规定〉的决定》修正)

Chapter I General Provisions 

第一章 总 则

Article 1 For purposes of strengthening the administration of highways, improving the administration of highways, and ensuring the integrity, security and clearness of highways, these Provisions are enacted under the Highway Law of the People's Republic of China (hereinafter referred to as "Highway Law") and other laws and administrative regulations.   第一条 为加强公路管理,提高路政管理水平,保障公路的完好、安全和畅通,根据《中华人民共和国公路法》(以下简称《公路法》)及其他有关法律、行政法规,制定本规定。
Article 2 These Provisions shall apply to the administration of the state, provincial, county and township highways within the territory of the People's Republic of China.   第二条 本规定适用于中华人民共和国境内的国道、省道、县道、乡道的路政管理。
For the purpose of these Provisions, "administration of highways" means the public administration whereby the transport department of the people's governments at or above the county level or the highway administrative departments established by them protect highways, highway land or auxiliary highway facilities (hereinafter collectively referred to as "highway property") in order to protect the lawful rights and interests of managers, operators and users of highways, and under the Highway Law and other relevant laws, regulations and rules. 本规定所称路政管理,是指县级以上人民政府交通主管部门或者其设置的公路管理机构,为维护公路管理者、经营者、使用者的合法权益,根据《公路法》及其他有关法律、法规和规章的规定,实施保护公路、公路用地及公路附属设施(以下统称“路产”)的行政管理。
Article 3 The administration of highways shall conform to the principles of "unified administration, hierarchical responsibility, and administration by law."   第三条 路政管理工作应当遵循“统一管理、分级负责、依法行政”的原则。
Article 4 The Ministry of Transport shall, under the Highway Law and other relevant laws and administrative regulations, take primary charge of the administration of highways across the country.   第四条 交通部根据《公路法》及其他有关法律、行政法规的规定主管全国路政管理工作。
The transport departments of the local people's governments at or above the county level shall, under the Highway Law and other relevant laws, regulations and rules, take primary charge of the administration of highways within their respective administrative regions. 县级以上地方人民政府交通主管部门根据《公路法》及其他有关法律、法规、规章的规定主管本行政区域内路政管理工作。
The highway administrative departments established by the transport departments of the local people's governments at or above the county level shall, under the Highway Law or in accordance with the entrustment of the latter, be responsible for the specific work of the administration of highways. 县级以上地方人民政府交通主管部门设置的公路管理机构根据《公路法》的规定或者根据县级以上地方人民政府交通主管部门的委托负责路政管理的具体工作。
Article 5 The transport departments of the local people's governments at or above the county level or the highway administrative departments established by them shall have the following duties of the administration of highways:   第五条 县级以上地方人民政府交通主管部门或者其设置的公路管理机构的路政管理职责如下:
(1) Publicizing and implementing the laws, regulations and rules in respect of the administration of highways. (一)宣传、贯彻执行公路管理的法律、法规和规章;
(2) Protecting highway property. (二)保护路产;
(3) Patrolling highway property. (三)实施路政巡查;
(4) Managing the building control area on either side of highways. (四)管理公路两侧建筑控制区;
(5) Maintaining the order of the highway maintenance operating sites. (五)维持公路养护作业现场秩序;
(6) Participating in the handover and acceptance check of highway projects. (六)参与公路工程交工、竣工验收;
(7) Investigating and dealing with all cases of violations of the laws, regulations and rules in respect of the administration of highways in accordance with the law. (七)依法查处各种违反路政管理法律、法规、规章的案件;
(8) Other duties prescribed by the laws and regulations. (八)法律、法规规定的其他职责。
Article 6 The dispatched agencies and personnel of the transport departments of the local people's governments at or above the county level or the highway administrative departments established by them shall, in accordance with the relevant provisions of the Highway Law, be responsible for the administration of the transferred entitlement to the collection of highway toll and toll highways established and invested in by economic organizations from home and abroad.   第六条 依照《公路法》的有关规定,受让公路收费权或者由国内外经济组织投资建成的收费公路的路政管理工作,由县级以上地方人民政府交通主管部门或者其设置的公路管理机构的派出机构、人员负责。
Article 7 No entity or individual shall destroy, damage or illegally occupy highway property.   第七条 任何单位和个人不得破坏、损坏或者非法占用路产。
An entity or individual shall be obliged to care about highway property and entitled to report any act destroying or damaging highway property or prejudicing highway security. 任何单位和个人都有爱护路产的义务,有检举破坏、损坏路产和影响公路安全行为的权利。
Chapter II Licensing in Administration of Highways 

第二章 路政管理许可

Article 8 Except for the protection and maintenance of highways, the occupation, use or excavation of a highway, highway land or the building control area on either side of a highway, or replacement or logging of the trees on highway land, shall, under the Highway Law and these Provisions, be filed in advance with the transport department or the highway administrative department established by it for approval or consent.   第八条 除公路防护、养护外,占用、利用或者挖掘公路、公路用地、公路两侧建筑控制区,以及更新、砍伐公路用地上的树木,应当根据《公路法》和本规定,事先报经交通主管部门或者其设置的公路管理机构批准、同意。
Article 9 Where it is necessary to occupy, excavate or relocate a highway arising out of the need of the construction of a railway, an airport, a power station, a telecommunications facility, a water conservancy project or any other construction project, the project owner shall, under paragraph 2, Article 44 of the Highway Law, file an application and blueprint in advance with the transport department or the highway administrative department established by it.   第九条 因修建铁路、机场、电站、通信设施、水利工程和进行其他建设工程需要占用、挖掘公路或者使公路改线的,建设单位应当按照《公路法》四十四条第二款的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书和设计图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name, driver location sign number and the distance to the periphery of highway slope or to the highway boundary mark). (二)地点(公路名称、桩号及与公路边坡外缘或者公路界桩的距离);
(3) Security guarantee measures. (三)安全保障措施;
(4) Construction period. (四)施工期限;
(5) Measures for the recovery or reconstruction of the highway or the amount of compensation. (五)修复、改建公路的措施或者补偿数额。
Article 10 In the case of the construction of a bridge or aqueduct, or erection or burial of a pipeline or any other facility, over or across a highway, or the erection or burial of a pipeline (rod line), cable or any other facility within the scope of highway land, an application and blueprint shall, under Article 45 of the Highway Law, be filed in advance with the transport department or the highway administrative department established by it.   第十条 跨越、穿越公路,修建桥梁、渡槽或者架设、埋设管线等设施,以及在公路用地范围内架设、埋设管(杆)线、电缆等设施,应当按照《公路法》四十五条的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书和设计图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name, driver location sign number and the distance to the periphery of highway slope or to the highway boundary mark). (二)地点(公路名称、桩号及与公路边坡外缘或者公路界桩的距离);
(3) Security guarantee measures. (三)安全保障措施;
(4) Construction period. (四)施工期限;
(5) Measures for the recovery or reconstruction of the highway or the amount of compensation. (五)修复、改建公路的措施或者补偿数额。
Article 11 In the case of the construction of a dyke, or narrowing or expansion of a riverbed, within 200 meters around a medium or large-sized bridge or ferry arising out of the need of emergency response or flood control, an application and blueprint shall, under paragraph 2, Article 47 of the Highway Law, be filed in advance with the transport department.   第十一条 因抢险、防汛需要在大中型公路桥梁和渡口周围二百米范围内修筑堤坝、压缩或者拓宽河床,应当按照《公路法》四十七条第二款的规定,事先向交通主管部门提交申请书和设计图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name, driver location sign number and the distance to the periphery of highway slope or to the highway boundary marker). (二)地点(公路名称、桩号及与公路边坡外缘或者公路界桩的距离);
(3) Security guarantee measures. (三)安全保障措施;
(4) Construction period. (四)施工期限。
Article 12 An iron-wheeled or caterpillars vehicle or any other vehicular machinery that may damage the highway pavement shall not run on a highway without authorization.   第十二条 铁轮车、履带车和其他可能损害公路路面的机具,不得在公路上行驶。
Where agricultural machinery needs to run a short distance on a highway or a military vehicle needs to run on a highway arising out of carrying out missions, it shall not be governed by the preceding paragraph provided that safety and protection measures are adopted. If damage is caused to the highway, compensation shall be made according to the extent of the damage. 农业机械因当地田间作业需要在公路上短距离行驶或者军用车辆执行任务需要在公路上行驶的,可以不受前款限制,但是应当采取安全保护措施。对公路造成损坏的,应当按照损坏程度给予补偿。
Article 13 Where a vehicle exceeding the loading, height, width or length limit of a highway, highway bridge or highway tunnel, or automobile ferry needs to run on a highway, handling shall be conducted under Article 50 of the Highway Law and the Provisions on the Administration of Transport Vehicles Exceeding Limit Running on the Highway.   第十三条 超过公路、公路桥梁、公路隧道或者汽车渡船的限载、限高、限宽、限长标准的车辆,确需在公路上行驶的,按照《公路法》五十条和交通部制定的《超限运输车辆行驶公路管理规定》的规定办理。
Article 14 In the case of the establishment of a sign other than highway signs within the scope of highway land, an application and blueprint shall, under Article 54 of the Highway Law, be filed in advance with the transport department or the highway administrative department established by it.   第十四条 在公路用地范围内设置公路标志以外的其他标志,应当按照《公路法》五十四条的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书和设计图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Content of the sign. (二)标志的内容;
(3) Color, dimensions and structure of the sign. (三)标志的颜色、外廓尺寸及结构;
(4) Location for the sign to be established (highway name and driver location sign number). (四)标志设置地点(公路名称、桩号);
(5) Time of establishment and maintenance period of the sign. (五)标志设置时间及保持期限。
Article 15 In the case of the establishment of a ground crossing on the highway, an application and blueprint or layout chart shall, under Article 55 of the Highway Law, be filed in advance with the transport department or the highway administrative department established by it.   第十五条 在公路上增设平面交叉道口,应当按照《公路法》五十五条的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书和设计图或者平面布置图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name and driver location sign number). (二)地点(公路名称、桩号);
(3) Construction period. (三)施工期限;
(4) Security guarantee measures. (四)安全保障措施。
Article 16 In the case of the burial of a pipeline (rod line), an application and blueprint shall, under paragraph 1, Article 56 of the Highway Law, be filed in advance with the transport department or the highway administrative department established by it.   第十六条 在公路两侧的建筑控制区内埋设管(杆)线、电缆等设施,应当按照《公路法》五十六条第一款的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书和设计图。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name, driver location sign number and the distance to the periphery of highway slope or to the highway boundary marker). (二)地点(公路名称、桩号及与公路边坡外缘或公路界桩的距离);
(3) Security guarantee measures. (三)安全保障措施;
(4) Construction period. (四)施工期限。
Article 17 In the case of the replacement or logging of trees on highway land, an application shall, under paragraph 2, Article 42 of the Highway Law, be filed in advance with the transport department or the highway administrative department established by it.   第十七条 更新砍伐公路用地上的树木,应当依照《公路法》四十二条第二款的规定,事先向交通主管部门或者其设置的公路管理机构提交申请书。
An application as set out in the preceding paragraph of this Article shall include the following main content: 本条前款规定的申请书包括以下主要内容:
(1) Main reasons. (一)主要理由;
(2) Location (highway name and driver location sign number). (二)地点(公路名称、桩号);
(3) Variety and number of trees. (三)树木的种类和数量;
(4) Security guarantee measures. (四)安全保障措施;
(5) Time. (五)时间;
(6) Replanting measures. (六)补种措施。
Article 18 Save where the provincial-level people's governments make decisions in respect of the duties of the administration and supervision of state and provincial highways under paragraph 2, Article 8 of the Highway Law, the licensing powers in the administration of highways shall be as follows:   第十八条 除省级人民政府根据《公路法》八条第二款就国道、省道管理、监督职责作出决定外,路政管理许可的权限如下:
(1) In the case of a state or provincial highway, the license shall be handled by the transport department of the provincial-level people's government or the highway administrative department established by it. (一)属于国道、省道的,由省级人民政府交通主管部门或者其设置的公路管理机构办理;
(2) In the case of a county highway, the license shall be handled by the transport department of the people's government at the level of cities (cities divided into districts) or the highway administrative department established by it. (二)属于县道的,由市(设区的市)级人民政府交通主管部门或者其设置的公路管理机构办理;
(3) In the case of a township highway, the license shall be handled by the transport department of the county-level people's government or the highway administrative department established by it. (三)属于乡道的,由县级人民政府交通主管部门或者其设置的公路管理机构办理。
Where a licensing matter in the administration of highways involves any duties of relevant departments, relevant formalities shall be undergone upon the approval or consent of the transport department or the highway administrative department established by it according to the relevant laws and regulations. In particular, the matters as provided for in Article 11 of these Provisions shall be handled by the transport department of the provincial-level people's governments in conjunction with provincial-level water departments. 路政管理许可事项涉及有关部门职责的,应当经交通主管部门或者其设置的公路管理机构批准或者同意后,依照有关法律、法规的规定,办理相关手续。其中,本规定第十一条规定的事项,由省级人民政府交通主管部门会同省级水行政主管部门办理。
Article 19 A transport department or the highway administrative department established by it shall, within 15 days following the date of the receipt of the application, make a decision. Where it makes a decision of approval or consent, it shall issue a corresponding license; otherwise it shall give a written notice and make an explanation on the reasons.   第十九条 交通主管部门或者其设置的公路管理机构自接到申请书之日起15日内应当作出决定。作出批准或者同意的决定的,应当签发相应的许可证;作出不批准或者不同意的决定的,应当书面告知,并说明理由。
