| Your Request for Instructions on Whether an “Order on Dismantlement within a Prescribed Time Limit Is an Administrative Punishment (No. 49 [2012], Legislative Affairs Office of the People's Government of Shaanxi Province) has been received. Upon deliberation and consultation with the Legislative Affairs Commission of the Standing Committee of the National People's Congress, the following reply is hereby made: | | 你办《关于“责令限期拆除”是否属于行政处罚行为的请示》（陕府法字〔2012〕49号）收悉。经研究并商全国人大常委会法工委，现函复如下： |
In accordance with Article 23 of the Administrative Punishment Law of the People's Republic of China that “when enforcing an administrative punishment, the administrative organ shall order the taking of corrective actions against violations or to do so within a prescribed time limit,” ordering the taking of corrective actions against violations or do so within a prescribed time limit is an administrative act different from an administrative punishment. Therefore, “to dismantle within a prescribed time limit” as set out in Article 64 and “to order to dismantle within a prescribed time limit” as set out in Article 68 in the Urban and Rural Planning Law of the People's Republic of China should not be interpreted as an administrative punishment.
