| The European Atomic Energy Community (hereinafter 'Euratom'), the Government of the People's Republic of China, the Government of the Republic of India, the Government of Japan, the Government of the Republic of Korea and the Government of the Russian Federation (hereinafter 'the Parties'), | | 欧洲原子能共同体、中华人民共和国政府、印度共和国政府、日本政府、大韩民国政府和俄罗斯联邦政府（以下称缔约方） |
| WHEREAS Article 12 of the Agreement on the Establishment of the ITER International Fusion Energy Organization for the Joint Implementation of the ITER Project (hereinafter 'the ITER Agreement') requires the parties to that Agreement to give effect to privileges and immunities; | | 鉴于《联合实施国际热核聚变实验堆计划建立国际聚变能组织的协定》（以下简称《组织协定》）第十二条要求缔约各方给予特权和豁免； |
| WHEREAS it is the purpose of this Agreement to define for the Parties to this Agreement the content and scope of such privileges and immunities in accordance with Article 12 of the ITER Agreement; | | 鉴于本协定的目的系为本协定缔约方根据《组织协定》第十二条的规定就上述特权和豁免的含义和范围做出界定； |
| WHEREAS the Parties have confirmed their intention to conclude this Agreement on the occasion of the Ministerial Meeting for ITER in Brussels on 24 May 2006, | | 鉴于缔约方已确认他们将在2006年5月24日在布鲁塞尔举行的ITER部长级会议上签署本协定的意愿； |
| HAVE AGREED AS FOLLOWS: | | 兹协议如下： |
| Article 1 | | 第一条 |
| 1. In accordance with Article 5 of the ITER Agreement, the ITER International Fusion Energy Organization (hereinafter 'the ITER Organization') shall have international legal personality, including the capacity to conclude agreements with States and/or international organizations. | | 一、根据《组织协定》第五条，ITER国际聚变能组织（以下简称ITER组织）应当具有国际法主体资格，有权与国家和（或）国际组织缔结协定。 |
| 2. The ITER Organization shall have legal personality and enjoy, in the territories of the Members, the legal capacity it requires, including to: | | 二、ITER组织应当具有法人资格，并在成员方境内享有所需的法律能力，包括： |
| (a) conclude contracts; | | （一）签订合同。 |
| (b) acquire, hold and dispose of property; | | （二）取得、持有和处置财产。 |
| (c) obtain licenses; and | | （三）获得许可证。 |
| (d) institute legal proceedings. | | （四）提起诉讼。 |
| Article 2 nbsp; The buildings and premises of the ITER Organization shall be inviolable. | | 第二条 ITER组织的房舍不得侵犯。 |
| Article 3 nbsp; The archives and documents of the ITER Organization shall be inviolable. | | 第三条 ITER组织的档案和文件不得侵犯。 |
| Article 4 | | 第四条 |
| 1. The ITER Organization shall enjoy immunity from jurisdiction and execution except: | | 一、ITER组织享有管辖和执行豁免，但以下情况除外： |
| (a) to the extent that it has expressly waived such immunity in a particular case; | | （一）在特定案件中ITER组织明示放弃此种豁免。 |
| (b) in respect of a civil action by a third party for damage arising from an accident caused by a motor vehicle belonging to, or operated on behalf of, the ITER Organization, or in respect of a motor traffic offence involving such a vehicle; | | （二）在ITER组织所有或以ITER组织名义使用的机动车辆造成的交通事故中，第三方当事人提出的民事索赔诉讼，或涉及上述车辆的交通违规。 |
| (c) in respect of an enforcement of an arbitration award made under Article 23; and | | （三）执行根据本协定第二十三条做出的仲裁裁决。 |
| (d) in the event of an attachment of salary, enforced for a debt of a staff member of the ITER Organization, provided that such attachment results from a final and enforceable legal decision in accordance with the rules in force on the territory of enforcement. | | （四）因ITER组织职员的债务而采取扣押其薪金的强制措施，但扣押依据必须是按照执行地现行法律做出的终局和可执行的法律决定。 |
| 2. The ITER Organization's property and assets, wherever situated, shall be immune from any form of requisition, confiscation, expropriation and sequestration except: | | 二、ITER组织的财产和资产不论位于何处，都免于任何形式征用、充公、征收和扣押，但以下情况除外： |
| (a) to the extent that it has expressly waived such immunity in a particular case; | | （一）ITER组织在特定案件中明示放弃了该项豁免。 |
| (b) in respect of a civil action provided for in paragraph 1(b); and | | （二）在前款第（二）项规定的民事诉讼中。 |
| (c) in respect of the enforcement of an arbitration award made under Article 23. | | （三）执行根据本协定第二十三条做出的仲裁裁决。 |
| 3. The ITER Organization shall also be immune from any form of administrative or provisional judicial constraint, except to the extent that it has expressly waived such immunity in a particular case and insofar as may be necessary in connection with or in respect of: | | 三、ITER组织还应免于任何形式的行政和临时司法强制措施，除非组织在特定案件中明确放弃了该项豁免，或在因下述情况或与下述情况相关而必须采取的限度内： |
| (a) the prevention and investigation of accidents involving motor vehicles belonging to, or operated on behalf of, the ITER Organization; and | | （一）防止或调查交通事故，事故涉及ITER组织所有或以ITER组织名义使用的机动车辆。 |
| (b) the enforcement of an arbitration award made under Article 23. | | （二）执行根据本协定第二十三条做出的仲裁裁决。 |
| Article 5 | | 第五条 |
| 1. Within the scope of its official activities, the ITER Organization, its property and income shall be exempt from direct taxes. | | 一、ITER组织及其财产和收入在公务活动范围内，免征直接税。 |
| 2. When goods or services, strictly necessary for the exercise of the official activities of the ITER Organization, are purchased or used by or on behalf of the ITER Organization, and when the price of such goods or services includes taxes or duties, appropriate measures shall, whenever possible, be taken by the Party to grant exemption from such taxes or duties or to provide for their reimbursement. | | 二、在ITER组织采购物品或服务，或此等物品或服务为ITER组织所用或代表ITER组织使用的情况下，如果购买物品或服务的价款中包含税金，缔约方应尽可能采取措施，免除此类税赋，或提供补偿，但以物品或服务系ITER组织从事公务活动绝对必需为限。 |
| Article 6 | | 第六条 |
| 1. Goods imported or exported by the ITER Organization, or on its behalf, for its official activities shall be exempt from all duties and taxes. Goods imported or exported by the ITER Organization for its official activities shall be exempt from prohibitions and restrictions on imports and exports except where such prohibitions or restrictions are consistent with the laws, regulations and policies referred to in Articles 14 and 20 of the ITER Agreement. | | 一、ITER组织或代表ITER组织，为公务活动进口或出口的物品应免征一切关税和其他税款。ITER组织为公务活动进口或出口的物品免受进出口的禁止和限制，除非上述禁止或限制与《组织协定》第十四条和第二十条所述的法律、法规和政策一致。 |
| 2. Goods which have benefited from the exemption provided for in Article 5 or imported under paragraph 1 shall not be sold or given away except in accordance with conditions laid down by the Parties which have granted exemptions. | | 二、根据本协定第五条免税的物品或根据本条第一款进口的物品不得出售或转赠，除非符合已经给予豁免的缔约方规定的条件。 |
| Article 7 | | 第七条 |
| 1. For the purposes of Articles 5 and 6, the official activities of the ITER Organization shall include its administrative activities, including its operations in connection with any social security scheme it establishes, and activities undertaken in pursuance of the purpose of the ITER Organization as defined in the ITER Agreement. | | 一、就第五条和第六条而言，ITER组织的公务活动应包括管理活动，如与组织设立的任何社会保障制度有关的行为，和与《组织协定》规定的ITER组织宗旨相符的活动。 |
| 2. The provisions of Articles 5 and 6 shall not apply to taxes and duties that are no more than charges for public utility services. | | 二、第五条和第六条不适用于纯为公用事业服务费用的捐税。 |
| Article 8 nbsp; No exemption shall be granted under Articles 5 or 6 in respect of goods purchased or imported, or services provided for the personal benefit of the staff of the ITER Organization. | | 第八条 为ITER组织职员个人使用购买或进口的物品，或提供的服务，不应根据第五条和第六条享有豁免。 |
| Article 9 nbsp; Without prejudice to the laws, regulations and policies referred to in Articles 14 and 20 of the ITER Agreement, the circulation of publications and other information material sent by or to the ITER Organization shall not be restricted in any way. | | 第九条 在不违反《组织协定》第十四条和第二十条提及的法律、法规和政策的情况下，ITER组织发出或接收的出版物和其他信息资料不得受到任何限制。 |
| Article 10 | | 第十条 |
1. The ITER Organization may receive and hold any kind of funds, currency, cash or securities; it may dispose of them freely for any purpose provided for in the ITER Agreement and hold accounts in any currency to the extent required to meet its obligations.
