| Decision of the Ministry of Commerce to Repeal and Amend Some Rules | | 商务部关于废止和修改部分规章的决定 |
| For the purpose of further deepening the reform of “simplifying procedures, decentralizing powers, combining decentralization with appropriate control, and optimizing services,” the Ministry of Commerce has reviewed relevant rules in accordance with the requirements of the State Council for review of certification items and other matters. With the approval of the relevant departments jointly issuing these rules, it is hereby decided that: | | 为继续深化简政放权、放管结合、优化服务改革，根据国务院关于清理证明事项等工作要求，商务部对相关规章进行了清理。经相关联发部门同意，现决定： |
| I. Two rules are repealed. | | 一、废止2部规章 |
| 1. With the approval of the State Administration for Market Regulation through consultation, the Ministry of Commerce has decided to repeal the Measures for the Administration of Business Qualifications for Foreign Labor Service Cooperation (Order No. 3 [2004], Ministry of Commerce and State Administration for Industry and Commerce). | | （一）经商市场监督管理总局同意，决定废止《对外劳务合作经营资格管理办法》（商务部、工商行政管理总局令2004年第3号）。 |
| 2. The Ministry of Commerce has decided to repeal the Measures for the Administration of Foreign-Funded International Freight Forwarding Enterprises (Order No. 19 [2005], Ministry of Commerce). | | （二）决定废止《外商投资国际货物运输代理企业管理办法》（商务部令2005年第19号）。 |
| II. Ten rules are amended. | | 二、修改10部规章 |
| 1. The Ministry of Commerce has decided to delete “(4) The resume and valid identification of the legal representative” in Article 8 and “(4) The resume and valid identification of the person in charge of the branch” in Article 11 of the Measures for the Administration of Auctions (Order No. 24 [2004], Ministry of Commerce). | | （一）决定删除《拍卖管理办法》（商务部令2004年第24号）第八条的“（四）法定代表人简历和有效身份证明；”和第十一条的“（四）分公司负责人简历及有效身份证明；”。 |
| The Ministry of Commerce has decided to replace “(6) The title to or the lease contract for a permanent office” in Article 8 and “(6) The title to or the lease contract for a permanent office” in Article 11 with “A written commitment that the enterprise has purchased or rented a permanent office”. | | 决定修改第八条的“（六）固定办公场所产权证明或租用合同”和第十一条的“（六）固定办公场所产权证明或租用合同”为“企业已购买或租用固定办公场所的书面承诺”。 |
| “Chapter III Foreign-Funded Enterprises' Applications for Licenses of Auction Business and the Change and Termination of the Licensing” is deleted. | | 删除第三章“外商投资企业申请取得拍卖业务的许可、变更和终止”。 |
| 2. With the approval of the General Administration of Customs and the State Administration for Market Regulation through consultation, the Ministry of Commerce has decided to amend Article 9 of the Measures for the Administration of the Import of Key Used Mechanical and Electrical Products (Order No. 5 [2008], Ministry of Commerce, GACC and AQSIQ) to read: “An entity that imports key used mechanical and electrical products to engage in the renovation thereof shall also submit a written commitment that it has obtained relevant qualification certificate if there are requirements for qualifications as provided for by the state.” | | （二）经商海关总署、国家市场监督管理总局同意，决定将《重点旧机电产品进口管理办法》（商务部、海关总署、国家质检总局令2008年第5号）第九条修改为：“从事翻新业务进口重点旧机电产品的单位，国家规定有资质要求的，还须提供已取得相关资质证明的书面承诺。” |
| 3. With the approval of the General Administration of Customs through consultation, the Ministry of Commerce has decided to add the following statement to paragraph 1(4) of Article 6 of the Measures for the Implementation of Automatic Licensing for Import of Mechanical and Electrical Products (Order No. 6 [2008], Ministry of Commerce and GACC, amended by Order No. 7 [2018], Ministry of Commerce) as subparagraph (8): “The materials as prescribed above that may be consulted online through the national government service system are not required to be submitted.” Subparagraphs (3) and (4) are deleted, and subparagraph (7) is amended to read: “(7) Whoever imports mechanical and electrical products purchased through international bidding shall provide the notification of winning an international bid for mechanical and electrical products.” | | （三）经商海关总署同意，决定在《机电产品自动进口许可实施办法》（商务部海关总署令2008年第6号 商务部令2018年第7号修改）第六条第一款第四项增加如下表述作为第8项：“上述规定的材料可通过国家政务服务系统联网查询的，可不再提交。”删除第3、4项，并修改第7项为：“7．进口采用国际招标方式采购的机电产品，应提供机电产品国际招标中标通知书。” |
4. The Ministry of Commerce has decided to delete Paragraph 2(3)(e) of Article 5 of the Measures for the Recordation and Registration of Foreign Trade Dealers (No. 14 [2004], Ministry of Commerce): “(e) The individual industrial and commercial household (sole proprietor) that has undergone the industry and commerce registration formalities according to the law shall submit the certificate of property notarization issued by a legal notary institution. A foreign (regional) enterprise that has undergone the industry and commerce registration formalities according to the law shall submit the documents of certificate of capital credit issued by a legal notary organ.”
