The Provisions on the Archival Filing of Film Scripts (Abstracts) and the Administration of Films, which were adopted at the executive meeting of the State Administration of Radio, Film and Television (SARFT) on April 3, 2006, are hereby promulgated, and shall come into force as of June 22, 2006. | |

| Chapter I General Provisions | | 第一章 总则 |

| Article 1 These Provisions are formulated in accordance with the Regulation on the Administration of Films for the purpose of regulating and improving the archival filing of film scripts (abstracts) and the administration of films, improving the quality of films, prospering the film production, satisfying the spiritual and cultural needs of the general public, and propelling the sound development of the film industry. | | 第一条 为规范和改进电影剧本（梗概）备案和电影片管理制度，提高电影质量，繁荣电影创作，满足广大群众的精神文化需求，推进电影业健康发展，根据《电影管理条例》，制定本规定。 |

| Article 2 The State implements a system of archival filing of film scripts (abstracts) and examination of films. The film scripts (abstracts) that have not been put in the archival files shall not be shot into films, and the films that have not passed the examination shall not be issued, projected, imported or exported. | | 第二条 国家实行电影剧本（梗概）备案和电影片审查制度。未经备案的电影剧本（梗概）不得拍摄，未经审查通过的电影片不得发行、放映、进口、出口。 |

| Article 3 These Provisions shall apply to the archival filing of the scripts (abstracts) of such films as feature films, documentary films, science and education films, cartoons, and special topic films, etc. (including all above-mentioned types of films produced through Chinese-foreign cooperation) that are projected to the public within the territory of the People's Republic of China, the examination of such films, as well as the examination of the imported films. | | 第三条 本规定适用于在中华人民共和国境内公映的各类故事片、纪录片、科教片、动画片、专题片（含以上各类型的中外合拍片）等的电影剧本（梗概）备案、电影片审查和进口片审查。 |

| Article 4 The State Administration of Radio, Film and Television (hereinafter referred to as the SARFT) shall take charge of the administration regarding the archival filing of film scripts (abstracts) and the examination of films. | | 第四条 国家广播电影电视总局（以下简称广电总局）负责电影剧本（梗概）备案和电影片审查的管理工作。 |
The Film Examination Committee and the Film Review Committee of the SARFT shall take charge of the examination of films. | |
广电总局电影审查委员会和电影复审委员会负责电影片的审查。 |
The administrative department of radio, film and television at the provincial level (hereinafter referred to as the provincial administrative department of radio, film and television) may, after filing an application, be entrusted by the SARFT and establish a film examination institution to take charge of the examination of some films produced by the film production entities holding a Permit for Film Production within its own jurisdiction (hereinafter referred to as the territorial censorship). | |
省级广播影视行政部门（以下简称省级广电部门），经申请可以受广电总局委托，成立电影审查机构，负责本行政区域内持有《摄制电影许可证》的制片单位摄制的部分电影片的审查工作（以下简称属地审查）。 |

| Chapter II Archival Filing of Film Scripts (Abstracts) | | 第二章 电影剧本（梗概）备案 |

| Article 5 Where any film production entity holding a Permit for Film Production or any other film and television culture entity that is registered at the industrial and commercial administrative department at or above the municipal level (hereinafter referred to as the film and television culture entity) shoots any film, it shall, before shooting the film, submit the film script (abstract) to the SARFT or the corresponding provincial administrative department of radio, film and television that implements the territorial censorship for archival filing. | | 第五条 持有《摄制电影许可证》的电影制片单位和在地市级以上工商部门注册登记的各类影视文化单位（以下简称影视文化单位）摄制电影片，应在拍摄前将电影剧本（梗概）送广电总局或相应的实行属地审查的省级广电部门备案。 |
In the case of joint production of a film, the archival filing formalities shall be gone through in advance by any cooperative entity. | |
联合摄制电影片的，应当由其中的一个单位提前办理备案手续。 |

| Article 6 To go through the formalities for archival filing of a film script (abstract), an applicant shall provide the following materials: | | 第六条 办理电影剧本（梗概）备案手续，应当提供下列材料： |

|
| (1)a report on archival filing of the film to be shot; | | （一）拟拍摄影片的备案报告； |
| |
|
| (2)a plot abstract composed of no less than one thousand Chinese characters. If the main characters or scenario of any film involve the contents in foreign affairs, nationality affairs, religion, military affairs, public security, justice, historical celebrity or cultural celebrity, etc. (hereinafter referred to as special topic films), a film literature script in triplet shall to be provided, and the opinions of the relevant provincial administrative departments at the provincial or national level shall be obtained; | | （二）不少于一千字的电影剧情梗概一份。凡影片主要人物和情节涉及外交、民族、宗教、军事、公安、司法、历史名人和文化名人等方面内容的（以下简称特殊题材影片），需提供电影文学剧本一式三份，并要征求省级或中央、国家机关相关主管部门的意见； |

|
| (3)the agreement (letter of authorization) on the copyright of the film script (abstract); and | | （三）电影剧本（梗概）版权的协议（授权）书； |
| |
|
| (4)the duplicate of its business license and a completed application form for the Permit for Film Production (Single Film) shall be submitted to the SARFT if the film and television culture entity applies for obtaining a Permit for Film Production (Single Film). | | （四）影视文化单位申请领取《摄制电影片许可证（单片）》，需向广电总局提供本单位营业执照副本及填报《摄制电影片许可证（单片）》申请书。 |

| Article 7 The procedures for archival filing of a film script (abstract): | | 第七条 电影剧本（梗概）备案的程序： |
| |
|
| (1)The film production entity puts forward an application for archival filing to the SARFT or the provincial administrative department of radio, film and television that implements the territorial censorship; and | | （一）制片单位向广电总局或实行属地审查的省级广电部门提出备案； |
| |
|
| (2)The SARFT or the provincial administrative department of radio, film and television that implements the territorial censorship issues a Return Receipt on Archival Filing of Film Script (Abstract) within the time limit prescribed in the Administrative License Law (see the attachment for the format). | | （二）广电总局或实行属地审查的省级广电部门按照《行政许可法》规定的期限，发给《电影剧本（梗概）备案回执单》（式样附后）。 |
If the administrative department of radio, film and television has not put forward opinions within 20 working days, the film production entity can shoot the film on the basis of the film script (abstract) that is put on archives. | |
如在二十个工作日内没有提出意见的，制片单位可按备案的电影剧本（梗概）进行拍摄； |
If the administrative department of radio, film and television has the opinions for alteration of the film script (abstract) that is put on archives or does not agree to shoot the film, it shall notify the film production entity in written form within 20 working days. | |
如对备案的电影剧本（梗概）有修改意见或不同意拍摄的，应在二十个工作日内书面通知制片单位； |
If it is necessary to invite other relevant administrative departments and experts to appraise the film script, 20 working days shall be prolonged, and the administrative department of radio, film and television shall notify it to the film production entity in written form. | |
如电影剧本需另请相关主管部门和专家评审的，需延长二十个工作日，并书面告知制片单位。 |

| Article 8 The provincial administrative department of radio, film and television that implements the territorial censorship shall submit a copy of the conditions on archival filing of the film script (abstract) to the SARFT; and the SARFT shall regularly publicize the conditions on archival filing of the film script (abstract) on the relevant media. | | 第八条 实行属地审查的省级广电部门，应将电影剧本（梗概）备案情况抄报广电总局；广电总局将定期在相关媒体公布电影剧本（梗概）备案情况。 |

| Article 9 Where it is necessary to submit the script for project initiation examination in order to shoot a film involving any significant revolutionary or historical event, the film production entity shall handle it according to the provision of the SARFT on the administration of the project initiation of film scripts involving significant revolutionary or historical events and the completed films thereof. | | 第九条 拍摄重大革命和重大历史题材影片，需报送剧本立项审查，按照广电总局关于重大革命和重大历史题材电影剧本立项及完成片的管理规定办理。 |

| Article 10 Where it is necessary to submit the script for project initiation examination in order to shoot a major theoretical documentary, the film production entity shall handle it according to the provision of the SARFT on the administration of major theoretical documentaries. | | 第十条 拍摄重大文献纪录影片，需报送剧本立项审查，按照广电总局关于重大文献纪录影片的管理规定办理。 |

| Article 11 Where it is necessary to submit the script for project initiation examination in order to shoot a film produced through Sino-foreign cooperation, the film production entity shall handle it according to the provision of the SARFT on the administration of films produced through Chinese-foreign cooperation. | | 第十一条 中外合作摄制影片，需报送剧本立项审查，按照广电总局关于中外合作摄制电影片的管理规定办理。 |
