(Issued by the Ministry of Transport on December 21, 2004; amended for the first time in accordance with the Decision of the Ministry of Transport on Amending the Measures for the Administration of the Highway Construction Market on November 30, 2011; and amended for the second time in accordance with the Decision of the Ministry of Transport on Amending the Measures for the Administration of the Highway Construction Market by the Order No. 11 [2015] of the Ministry of Transport on June 26, 2015) (2004年12月21日交通部发布 根据2011年11月30日交通运输部《关于修改〈公路建设市场管理办法〉的决定》第一次修正 根据2015年6月26日交通运输部令2015年第11号交通运输部《关于修改〈公路建设市场管理办法〉的决定》第二次修正)

Chapter I General Provisions 

第一章 总 则

Article 1 The present Measures are formulated in accordance with the Highway Law of the People's Republic of China, Law of the People's Republic of China on Bid Invitation and Bid Tendering, and the Regulation on Quality Control of Construction Projects, for the purpose of strengthening administration on highway construction market, regulating the market order of highway construction, ensuring the quality of highway projects, and promoting the healthy development of the highway construction market.   第一条 为加强公路建设市场管理,规范公路建设市场秩序,保证公路工程质量,促进公路建设市场健康发展,根据《中华人民共和国公路法》、《中华人民共和国招标投标法》、《建设工程质量管理条例》,制定本办法。
Article 2 The present Measures shall be applicable to the supervision over and administration of highway construction market by the competent departments of communications at all levels.   第二条 本办法适用于各级交通运输主管部门对公路建设市场的监督管理活动。
Article 3 The principle of fairness, justness, openness, and good faith shall be followed in the highway construction market.   第三条 公路建设市场遵循公平、公正、公开、诚信的原则。
Article 4 The state shall establish and perfect a unified, open, competitive, and orderly highway construction market, and prohibit any forms of regional blockage.   第四条 国家建立和完善统一、开放、竞争、有序的公路建设市场,禁止任何形式的地区封锁。
Article 5 Definitions of the terms used in the present Measures:   第五条 本办法中下列用语的含义是指:
The subject of highway construction market shall refer to highway construction practicing entities and practicing personnel. 公路建设市场主体是指公路建设的从业单位和从业人员。
The practicing entities shall refer to the project legal persons that undertake highway construction, project construction management entities, entities of consulting, survey, design, construction, supervision, experiment and testing, and public intermediary institutions that provide relevant services, as well as equipment and material supply entities. 从业单位是指从事公路建设的项目法人,项目建设管理单位,咨询、勘察、设计、施工、监理、试验检测单位,提供相关服务的社会中介机构以及设备和材料的供应单位。
The practicing personnel shall refer to the personnel undertaking highway construction activities. 从业人员是指从事公路建设活动的人员。
Chapter II Administration Functions 

第二章 管理职责

Article 6 The administration of highway construction market shall be based on uniform administration with each level assuming responsibility for its own work.   第六条 公路建设市场管理实行统一管理、分级负责。
Article 7 The competent department of communications of the State Council shall be responsible for the work of supervision over and administration of highway construction market nationwide, with major functions as follows:   第七条 国务院交通运输主管部门负责全国公路建设市场的监督管理工作,主要职责是:
1. Implementing the relevant state laws and regulations, formulating regulations for the administration of highway construction market all over the country; (一)贯彻执行国家有关法律、法规,制定全国公路建设市场管理的规章制度;
2. Organizing the formulation of and supervising over the implementation of technical standards, specifications, and rules for highway construction; (二)组织制定和监督执行公路建设的技术标准、规范和规程;
3. Implementing the administration of access to the highway construction market, market dynamic administration, and making supervision over and inspection on the highway construction market all over the country; (三)依法实施公路建设市场准入管理、市场动态管理,并依法对全国公路建设市场进行监督检查;
4. Setting up bid evaluation expert database for highway construction industry, and strengthening administration on bid evaluation experts; (四)建立公路建设行业评标专家库,加强评标专家管理;
5. Publishing information on the highway construction market all over the country; (五)发布全国公路建设市场信息;
6. Guiding and supervising over the work of the competent departments of communications of the local people's governments at the provincial level for their administration of highway construction market; (六)指导和监督省级地方人民政府交通运输主管部门的公路建设市场管理工作;
7. Accepting reports and complaints according to law and investigating and punishing illegal acts in the highway construction market; and (七)依法受理举报和投诉,依法查处公路建设市场违法行为;
8. Other functions as prescribed by laws and administrative regulations. (八)法律、行政法规规定的其他职责。
Article 8 The competent departments of communications of the people's governments at the provincial level shall be responsible for the work of supervision over and administration of the highway construction market within their own administrative regions, and their main functions shall be:   第八条 省级人民政府交通运输主管部门负责本行政区域内公路建设市场的监督管理工作,主要职责是:
1. Implementing the relevant state laws, regulations and rules, and the technical standards, specifications and rules for highway construction, and formulating concrete management rules in light of the reality of their own administrative regions; (一)贯彻执行国家有关法律、法规、规章和公路建设技术标准、规范和规程,结合本行政区域内的实际情况,制定具体的管理制度;
2. Regulating the market access of highway construction, and implementing dynamic administration and supervision over and inspection on the highway construction market within their own administrative regions; (二)依法实施公路建设市场准入管理,对本行政区域内公路建设市场实施动态管理和监督检查;
3. Setting up a bid evaluation expert database for highway construction of their own administrative regions, and strengthening administration on bid evaluation experts; (三)建立本地区公路建设招标评标专家库,加强评标专家管理;
4. Publishing information on highway construction market of their own administrative regions, and report the information on highway construction market to the competent department of communications of the State Council as required; (四)发布本行政区域公路建设市场信息,并按规定向国务院交通运输主管部门报送本行政区域公路建设市场的信息;
5. Guiding and supervising over the work of lower-level competent departments of communications in their administration of the highway construction market; (五)指导和监督下级交通运输主管部门的公路建设市场管理工作;
6. Accepting reports and complaints according to law, investigating and punishing illegal acts in the highway construction market within their own administrative regions; and (六)依法受理举报和投诉,依法查处本行政区域内公路建设市场违法行为;
7. Other functions as prescribed by laws, regulations and rules. (七)法律、法规、规章规定的其他职责。
Article 9 The competent departments of communications of the local people's governments at the level below the province shall be responsible for the work of supervision over and administration of the highway construction market within their own administrative regions, their main functions shall be:   第九条 省级以下地方人民政府交通运输主管部门负责本行政区域内公路建设市场的监督管理工作,主要职责是:
1. Implementing the relevant state laws, regulations and rules, and the technical standards, specifications and rules for highway construction; (一)贯彻执行国家有关法律、法规、规章和公路建设技术标准、规范和规程;
2. Cooperating with the competent department of communications of the local people's government at the provincial level to conduct administration on the market access of highway construction and dynamic administration; (二)配合省级地方人民政府交通运输主管部门进行公路建设市场准入管理和动态管理;
3. Making supervision over and inspection on the highway construction market within their own administrative regions; (三)对本行政区域内公路建设市场进行监督检查;
4. Accepting reports and complaints according to law and investigating and punishing illegal acts in the highway construction market of their own administrative regions; and (四)依法受理举报和投诉,依法查处本行政区域内公路建设市场违法行为;
5. Other functions as prescribed by laws, regulations and rules. (五)法律、法规、规章规定的其他职责。
Chapter III Administration on Market Access 

第三章 市场准入管理

Article 10 All the practicing entities and practicing personnel that comply with the conditions for market access as prescribed by laws and regulations may enter into the highway construction market. No entity or individual may implement regional protection on the highway construction market, or discriminate against any practicing entity or practicing personnel that complies with market access conditions.   第十条 凡符合法律、法规规定的市场准入条件的从业单位和从业人员均可进入公路建设市场,任何单位和个人不得对公路建设市场实行地方保护,不得对符合市场准入条件的从业单位和从业人员实行歧视待遇。
Article 11 The system of holding the legal person responsible for projects shall be implemented on highway construction projects. A project legal person may manage a highway construction project by itself or entrust a project construction management entity with legal person status to effect the project management.   第十一条 公路建设项目依法实行项目法人负责制。项目法人可自行管理公路建设项目,也可委托具备法人资格的项目建设管理单位进行项目管理。
The technical and management ability of any project legal person or the organization, major person-in-charge of the project construction management entity under its entrustment shall satisfy the need for the management of the project to be constructed, and comply with the requirements of the relevant provisions of the competent department of communications of the State Council. 项目法人或者其委托的项目建设管理单位的组织机构、主要负责人的技术和管理能力应当满足拟建项目的管理需要,符合国务院交通运输主管部门有关规定的要求。
Article 12 The registration and recording system shall be implemented on any legal person of toll road construction project and project construction management entity for their entering into the highway construction market.   第十二条 收费公路建设项目法人和项目建设管理单位进入公路建设市场实行备案制度。
After the feasibility study report on any toll road construction project is lawfully ratified or verified, the project investment subject shall establish or clarify the project legal person, who shall report the relevant conditions of its project construction management entity or the project construction management entity entrusted by it to the competent department of communications for archival filing in light of the relationship of administrative subordination of project management. 收费公路建设项目可行性研究报告批准或依法核准后,项目投资主体应当成立或者明确项目法人。项目法人应当按照项目管理的隶属关系将其或者其委托的项目建设管理单位的有关情况报交通运输主管部门备案。
For any project legal person or project construction management entity that does not meet the prescribed requirements, the competent department of communications shall demand them to correct and rectify. 对不符合规定要求的项目法人或者项目建设管理单位,交通运输主管部门应当提出整改要求。
Article 13 No highway project survey, design, construction, supervision, experiment and testing entity or other practicing entity may enter into the highway construction market until it has obtained the corresponding qualifications as issued by the relevant administrative departments in accordance with the provisions of laws and regulations.   第十三条 公路工程勘察、设计、施工、监理、试验检测等从业单位应当按照法律、法规的规定,取得有关管理部门颁发的相应资质后,方可进入公路建设市场。
Article 14 In case any law or regulation has provisions on the practicing qualification of the highway construction practicing personnel, such personnel shall obtain the corresponding practicing qualification according to law before entering into the highway construction market.   第十四条 法律、法规对公路建设从业人员的执业资格作出规定的,从业人员应当依法取得相应的执业资格后,方可进入公路建设市场。
Chapter IV Administration on Conducts of Market Subjects 

第四章 市场主体行为管理

Article 15 Any and all highway construction practicing entities and practicing personnel shall strictly abide by the relevant state laws and regulations concerning the highway construction market, and strictly implement the compulsory standards, various technical specifications and rules for highway construction industry.   第十五条 公路建设从业单位和从业人员在公路建设市场中必须严格遵守国家有关法律、法规和规章,严格执行公路建设行业的强制性标准、各类技术规范及规程的要求。
Article 16 Any and all legal persons of a highway construction project shall strictly implement the capital construction procedures prescribed by the state, and shall not violate or simplify the capital construction procedures without authorization.   第十六条 公路建设项目法人必须严格执行国家规定的基本建设程序,不得违反或者擅自简化基本建设程序。
Article 17 A legal person of a highway construction project shall be responsible for organizing the relevant experts or entrusting any entity that has the corresponding qualification of engineering consultation or design to examine the detail design documents. The examination on the detail design documents shall mainly include:   第十七条 公路建设项目法人负责组织有关专家或者委托有相应工程咨询或者设计资质的单位,对施工图设计文件进行审查。施工图设计文件审查的主要内容包括:
1. Whether it has adopted the feasibility study report of the project and the reply opinions on the preliminary design; (一)是否采纳工程可行性研究报告、初步设计批复意见;
2. Whether it complies with the compulsory standards, the relevant technical specifications and rules for highway projects; (二)是否符合公路工程强制性标准、有关技术规范和规程要求;
3. Whether the detail design documents are complete and meet the prescribed technical depth requirements; and (三)施工图设计文件是否齐全,是否达到规定的技术深度要求;
4. Whether the structural design of the project complies with the requirements for safety and stability. (四)工程结构设计是否符合安全和稳定性要求。
Article 18 A legal person of a highway construction project shall submit the detail design documents to the competent department of communications according to the relationship of administrative subordination of the project. No detail design documents may be used without examination and approval.   第十八条 公路建设项目法人应当按照项目管理隶属关系将施工图设计文件报交通运输主管部门审批。施工图设计文件未经审批的,不得使用。
Article 19 The following documents shall be submitted to the competent department of communications when applying for the examination and approval of detail design documents:   第十九条 申请施工图设计文件审批应当向相关的交通运输主管部门提交以下材料:
1. The whole set of detail design documents;
