The Regulation of the Shenzhen Special Economic Zone on the Administration of Use of Sea Areas, as deliberated and adopted at the 37th session of the Standing Committee of the Sixth People's Congress of Shenzhen City on December 31, 2019, is hereby issued and shall come into force on May 1, 2020. 《深圳经济特区海域使用管理条例》经深圳市第六届人民代表大会常务委员会第三十七次会议于2019年12月31日审议通过,现予公布,自2020年5月1日起施行。

Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of regulating the administration of use of sea areas, protecting the marine ecology and environment, and promoting the reasonable development and sustainable utilization of sea areas, this Regulation is developed in accordance with the basic principles of the laws and administrative regulations, based on the actual circumstances of the Shenzhen Special Economic Zone.   第一条 为了规范海域使用管理,保护海洋生态环境,促进海域合理开发和可持续利用,根据法律、行政法规的基本原则,结合深圳经济特区实际,制定本条例。
Article 2 This Regulation shall apply to the exclusive use of sea areas within the Shenzhen Special Economic Zone and its supervision and administration.   第二条 在深圳经济特区范围内排他性使用海域及其监督管理,适用本条例。
For the purpose of this Regulation, "sea areas" means the surface, water body, sea floor, and subsoil of internal waters within the jurisdiction of Shenzhen City. 本条例所称海域,是指深圳市管辖范围内的内水水面、水体、海床和底土。
Article 3 Sea areas shall be used in adherence to the principles of giving priority to protection, reasonable development, coordination between land and the sea, unified planning, and economical and intensive use, so as to achieve the seamless integration of ecological, economic, and social benefits.   第三条 海域使用坚持保护优先、合理开发、陆海统筹、统一规划和节约集约利用原则,实现生态效益、经济效益和社会效益有机统一。
Article 4 A survey, monitoring, and assessment system for marine resources shall be established to conduct a comprehensive assessment of marine resources and ecological conditions.   第四条 建立海洋资源调查、监测和评估制度,对海洋资源和生态状况进行综合评价。
Article 5 Except for major projects constructed with the approval of the state, reclamation shall be completely prohibited.   第五条 除国家批准建设的重大项目外,全面禁止围填海。
Article 6 The construction of a global marine central city shall be comprehensively advanced. The spatial layout of sea areas shall be optimized, the protection of the marine ecology and environment and the prevention and reduction of disasters shall be strengthened, marine economy shall be vigorously developed, the development and utilization level of marine resources shall be raised, and the marine culture shall be propagated.   第六条 全面推进全球海洋中心城市建设。优化海域空间布局,加强海洋生态环境保护和防灾减灾,大力发展海洋经济,提升海洋资源开发利用水平,弘扬海洋文化。
Article 7 The coastline shall be strictly protected, the ecology shall be vigorously restored, a marine ecological security shield shall be formed, and the administration of coastline protection and utilization shall be integrated into the administration of use of sea areas.   第七条 严格保护海岸线,大力开展生态修复,构筑海洋生态安全屏障,将海岸线保护和利用管理纳入海域使用管理。
Article 8 The marine department of the municipal people's government (hereinafter referred to as the "municipal marine authority") shall be responsible for the supervision and administration of use of citywide sea areas, and its representative offices shall be responsible for the specific work related to the supervision and administration of use of sea areas.   第八条 市人民政府海洋主管部门(以下简称市海洋主管部门)负责全市海域使用监督管理工作,其下设各派出机构承担海域使用监督管理有关具体工作。
The relevant competent departments of the people's governments of all coastal districts and the municipal people's government shall perform their functions related to the administration of sea areas in accordance with the law and cooperate with the municipal marine authority in strengthening the supervision and administration of use of sea areas. 沿海各区人民政府和市人民政府有关主管部门依法履行海域管理相关职责,并协同市海洋主管部门加强海域使用监督管理。
Chapter II Planning and Administration of Use of Sea Areas 

第二章 海域使用规划管理

Article 9 The use of sea areas and its supervision and administration shall strictly conform to the relevant requirements of national land spatial plans for the protection of the marine ecology and environment and the administration of use of sea areas.   第九条 海域使用及其监督管理应当严格遵守国土空间规划关于海洋生态环境保护和海域使用管理的相关要求。
When a plan concerning the use of sea areas is formulated or revised, the basic national policies for resource conservation and environmental protection shall be strictly observed, and the most stringent ecological and environmental protection system shall be implemented; and the principles of giving priority to conservation, giving priority to protection, and focusing on natural restoration shall be observed, and sea use projects that change the natural attributes of sea areas or seriously affect the marine ecology and environment shall be strictly controlled, so as to effectively protect the marine ecology and environment and secure the sustainable utilization of sea area resources. 编制和修改涉及海域使用的有关规划,应当严格遵守节约资源和保护环境的基本国策,实行最严格的生态环境保护制度;坚持节约优先、保护优先、自然恢复为主的方针,严格控制改变海域自然属性或者严重影响海洋生态环境的用海项目,有效保护海洋生态环境,保障海域资源可持续利用。
Article 10 When the general national land spatial plan of Shenzhen City is prepared or revised, the effective protection and reasonable utilization of sea areas shall be coordinated, the ecological, residential, and production zones of sea areas shall be scientifically laid out, and the following contents shall be specified:   第十条 编制和修改深圳市国土空间总体规划,应当统筹海域空间的有效保护和合理利用,科学布局海域生态空间、生活空间和生产空间,并重点明确以下内容:
(1) The spatial layout of sea areas and the spatial layout of the coastline. (一)海域空间布局和海岸线空间布局;
(2) The key fields of use of sea areas and key sea areas. (二)海域使用重点领域和重点海域;
(3) The scope of marine ecological protection red line areas and marine nature reserves at all levels. (三)海洋生态保护红线区和各级海洋自然保护区范围;
(4) The natural concentration areas for rare and endangered marine life. (四)珍稀、濒危海洋生物天然集中分布区;
(5) Marine life habitats of great economic value, marine natural history remains and natural landscape protection areas of great scientific and cultural value, and areas otherwise requiring special protection. (五)其他具有重要经济价值的海洋生物生存区域、有重大科学文化价值的海洋自然历史遗迹和自然景观保护区域以及其他需要予以特殊保护的区域。
Article 11 The municipal ecology and environment authority shall, in conjunction with the municipal planning and resources, construction, water, and other authorities and the people's governments of all coastal districts, prepare a marine ecological and environmental protection plan and implement the plan with the concurrence of the municipal people's government, as approved by the Standing Committee of the Municipal People's Congress.   第十一条 市生态环境主管部门应当会同市规划资源、建设、水务等主管部门和沿海各区人民政府,编制海洋生态环境保护规划,经市人民政府同意并提请市人民代表大会常务委员会批准后实施。
The marine ecological and environmental protection plan shall determine the objectives of protection of the marine ecology and environment, main protection measures, and prevention and control of marine environmental pollution, among others, and specify the requirements for environmental protection and ecological restoration in relevant areas. 海洋生态环境保护规划应当确定海洋生态环境保护目标、主要保护措施和海洋环境污染防治等内容,并明确相关区域的环境保护要求和生态修复要求。
Article 12 A special plan related to the use of sea areas and the protection and utilization of the coastline shall be connected with and in no conflict with the marine ecological and environmental protection plan.   第十二条 涉及海域使用和海岸线保护利用的有关专项规划,应当与海洋生态环境保护规划相衔接,并不得与其相冲突。
Article 13 The municipal marine authority shall, in conjunction with the relevant competent authorities, organize the preparation of a coastal zone protection and utilization plan and organize its implementation with the approval of the municipal people's government.   第十三条 市海洋主管部门应当会同有关主管部门组织编制海岸带保护与利用规划,经市人民政府批准后组织实施。
The coastal zone protection and utilization plan shall specify the following: 海岸带保护与利用规划应当明确下列事项:
(1) The scope and development goals of coastal zone. (一)海岸带地区范围、发展目标;
(2) Spatial layout, coordination between land and marine construction, and planning and control units. (二)空间格局、陆海建设协调、规划管控单元;
(3) Important coastal urban infrastructure and public service facilities. (三)重要滨海城市基础设施以及公共服务设施;
(4) Measures for ecological and environmental protection and natural disaster prevention. (四)生态环境保护和自然灾害防御措施;
(5) Matters otherwise required to be specified. (五)其他需要明确的事项。
Article 14 The municipal marine authority shall, in conjunction with the relevant competent authorities, organize the preparation of detailed plans for key sea areas as the planning basis for the approval of specific projects in key sea areas and organize their implementation with the approval of the municipal people's government.   第十四条 市海洋主管部门应当会同有关主管部门组织编制重点海域详细规划,作为重点海域具体项目审批的规划依据,经市人民政府批准后组织实施。
The scope of key sea areas may be delineated according to the planning and control units determined by the coastal zone protection and utilization plan, or according to the sea areas related to linear works such as sea dikes, bridges, electrical conduit, and undersea tunnels. 重点海域范围按照海岸带保护与利用规划确定的规划管控单位划分,也可以按照海堤、桥梁、电缆管道、海底隧道等线性工程所涉海域划分。
A detailed plan for key sea areas shall specify the following: 重点海域详细规划应当明确下列事项:
(1) The nature and type of sea use in each key sea area. (一)各重点海域用海性质和类型;
(2) Measures for the control of marine works and coastal works. (二)海洋工程和海岸工程管控措施;
(3) Land and sea connection requirements for construction projects. (三)建设项目陆海衔接要求;
(4) Requirements for environmental protection and ecological restoration. (四)环境保护和生态修复要求;
(5) Matters otherwise required to be specified. (五)其他需要明确的事项。
Chapter III Protection and Administration of Coastlines 

第三章 海岸线保护管理

Article 15 A classification-based coastline protection system shall be implemented. Coastlines shall be classified according to natural resource conditions and development degree into three categories: strict protection, restricted development, and optimal utilization.   第十五条 实行海岸线分类保护制度。根据海岸线自然资源条件和开发程度,分为严格保护、限制开发和优化利用三个类别。
Natural coastlines having a well-preserved natural shape and significant ecological functions and resource value shall be classified under strict protection; coastlines having a natural shape of basic integrity and relatively good ecological functions and resource value, at a relatively low level of development and utilization, shall be classified under restricted development; and coastlines at a highly artificial level, with relatively good coast defense, development, and utilization conditions, may be classified under optimal utilization. 自然形态保持完好、生态功能与资源价值显著的自然岸线应当划为严格保护岸线;自然形态保持基本完整、生态功能与资源价值较好、开发利用程度较低的海岸线应当划为限制开发岸线;人工化程度较高、海岸防护与开发利用条件较好的海岸线可以划为优化利用岸线。
Article 16 Around coastlines classified under strict protection, the construction of permanent buildings and structures shall be prohibited, except as needed for national defense security; and reclamation, mining of sea sand, the establishment of sewage outfalls, and other activities that cause damage to the coastal terrain, landforms, ecology, and environment shall be prohibited.   第十六条 划定为严格保护的海岸线,除国防安全需要外,禁止建设永久性建筑物、构筑物;禁止围填海、开采海砂、设置排污口等损害海岸地形地貌和生态环境的活动。
The coastlines where high-quality beaches, typical geological landforms and landscape, and mangroves, among others, are located shall be classified under strict protection. 优质沙滩、典型地质地貌景观、红树林等所在岸线应当列入严格保护岸线。
Article 17 Around coastlines classified under restricted development, development and utilization activities that change the natural shape of the coast and affect the ecological functions of the coast shall be strictly controlled, space shall be reserved for future development, and the use of sea areas shall be strictly approved.   第十七条 划定为限制开发的海岸线,应当严格控制改变海岸自然形态和影响海岸生态功能的开发利用活动,预留未来发展空间,严格海域使用审批。
Article 18 Around coastlines classified under optimal utilization, construction projects that compelling need to occupy the coastline shall be laid out in a concentrated manner, the length of the occupied coastline shall be strictly controlled, and the development and utilization pattern of the coastline shall be optimized.   第十八条 划定为优化利用的海岸线,应当集中布局确需占用海岸线的建设项目,严格控制占用海岸线长度,优化海岸线开发利用格局。
Article 19 A construction project shall be strictly restricted from occupying the natural coastline. A construction project that compellingly needs to occupy the natural coastline shall be justified and approved in strict accordance with the provisions issued by the state and the relevant provisions of this Regulation, consolidate and restore the natural coastline by the principle of a balance between occupation and supplementing, and maintain the morphological characteristics and ecological functions of the coastline.   第十九条 严格限制建设项目占用自然岸线。确需占用自然岸线的建设项目,应当严格依照国家规定和本条例有关规定进行论证和审批,并按照占补平衡原则,对自然岸线进行整治修复,保持岸线的形态特征和生态功能。
Article 20 The control target of retention rates of the natural coastlines in Shenzhen shall be not less than 40%. An application for sea use from a construction project unable to meet the requirements for a balance between the occupation and supplementing of natural coastlines shall be rejected.   第二十条 深圳市自然岸线保有率控制目标为不低于百分之四十。不能满足自然岸线占补平衡要求的建设项目用海申请不予批准。
The consolidation and restoration of coastlines shall be strengthened so as to increase the retention rate of natural coastlines. Coastlines as consolidated and restored having the morphological characteristics and ecological functions of natural coasts shall be placed under natural coastline administration. 加强海岸线整治修复,提升自然岸线保有率。整治修复后具有自然海岸形态特征和生态功能的海岸线纳入自然岸线管理。
Article 21 Coast defense works built by utilizing the coastline shall be connected with the special plans related to land and sea areas and take into account disaster prevention, ecology, landscape, and other functions.   第二十一条 利用海岸线建设海岸防护工程的,应当与陆地以及海域相关专项规划相衔接,兼顾防灾、生态和景观等功能。
Chapter IV Acquisition of Rights to Use Sea Areas 

第四章 海域使用权的取得

Article 22 Subject to Article 41 of this Regulation, the right to use sea areas shall be acquired in accordance with the law for exclusive sea use activities that continue in a specific sea area for more than three months. A right to use a sea area may be created on the water surface, water body, sea floor, or subsoil of the sea area.   第二十二条 除本条例第四十一条规定的情形之外,其他持续使用特定海域三个月以上的排他性用海活动,应当依法取得海域使用权。海域使用权可以在海域的水面、水体、海床或者底土分别设立。
If the exclusive use of a specific sea area is to continue for less than three months, but may have a major impact on national defense security, maritime traffic safety, and other public interest, or other legal sea use activities, the procedures for temporary use of a sea area shall be performed. The temporary use of a sea area may not be renewed. 排他性使用特定海域不足三个月,但是可能对国防安全和海上交通安全等公共利益,或者对其他合法用海活动造成重大影响的,应当办理临时海域使用手续。临时海域使用期限届满,不得续期。
For sea use in an emergency repair, rescue, or disaster relief project, construction may be commenced in advance, and an application for the use of the sea area shall be filed within ten days from the commencement date. 因紧急维修、抢险救灾工程用海,可以先行施工,并自施工之日起十日内申请补办海域使用手续。
Article 23 A right to use a sea area may be assigned by applying for approval or by means of bidding, auction, or listing.   第二十三条 海域使用权可以通过申请批准或者采取招标、拍卖、挂牌方式出让。
If the right to use a sea area is assigned by means of bidding, auction, or listing, the assignment shall be performed publicly on a public resource trading platform under supervision in accordance with the law. 采取招标、拍卖、挂牌方式出让海域使用权的,应当在公共资源交易平台公开进行,依法接受监督。
Article 24 The municipal marine authority shall develop a catalog for application for the approval of use of sea areas, include sea use projects such as public facility projects and major construction projects in the catalog, and implement the catalog with the approval of the municipal people's government.   第二十四条 市海洋主管部门应当制定申请批准使用海域目录,将公共设施项目、重大建设项目等用海项目纳入目录内,经市人民政府批准后实施。
If a sea use project has the circumstances set forth in the catalog in the preceding paragraph, the right to use a sea area may be assigned by means of applying for approval; and for any other sea use project that meets the requirements of this Regulation, the right to use a sea area shall be assigned by means of bidding, auction, or listing in accordance with the law. 用海项目属于前款目录所列情形的,可以通过申请批准方式出让海域使用权;其他符合本条例要求的用海项目,应当依法采取招标、拍卖、挂牌方式出让海域使用权。
Article 25 Under any of the following circumstances, the right to use a sea area may not be assigned by applying for approval or by means of bidding, auction, or listing:   第二十五条 有下列情形之一的,不得批准海域使用申请或者采取招标、拍卖、挂牌方式出让海域使用权:
(1) There lacks conformity with the requirements of the general national land spatial plan, the marine ecological and environmental protection plan, the coastal zone protection and utilization plan, and the detailed plan for key sea areas. (一)不符合国土空间总体规划、海洋生态环境保护规划、海岸带保护与利用规划和重点海域详细规划要求;
(2) Damage may be caused to the resources, environment, natural landscape, and ecological balance in the sea area, and it is impossible to take adequate and effective prevention or remedial measures. (二)可能破坏海域资源、环境、自然景观和生态平衡且无法采取充分有效预防或者补救措施;
(3) The siltation of navigable waterways and port areas may be caused, the production operations at an anchorage and a port may be affected, or port safety may be affected by using a sea area in the vicinity of a port area, and it is impossible to take adequate and effective prevention or remedial measures. (三)可能导致航道、港区淤积,影响锚地、港口生产作业,或者临近港区使用海域影响港口安全且无法采取充分有效预防或者补救措施;
(4) Coastal erosion may be caused, or the safety of coastal works such as sea dike may be affected, and it is impossible to take adequate and effective prevention or remedial measures. (四)可能导致岸滩侵蚀或者危害海堤等海岸工程安全且无法采取充分有效预防或者补救措施;
(5) Navigation, firefighting, rescue, and flood drainage may be impeded, and it is impossible to take adequate and effective prevention or remedial measures. (五)可能妨碍航行、消防、救护、行洪排涝且无法采取充分有效预防或者补救措施;
(6) The safety of a military management zone and a national defense facility may be affected, and it is impossible to take adequate and effective prevention or remedial measures. (六)可能影响军事管理区、国防设施安全且无法采取充分有效预防或者补救措施;
(7) The use of the sea area is otherwise prohibited by the laws and regulations. (七)法律、法规规定禁止使用海域的其他情形。
The preceding paragraph shall apply mutatis mutandis to the application for temporary use of a sea area. 办理临时海域使用手续的,参照前款规定执行。
Article 26 The term of the right to use a sea area under an application or determined shall conform to the provisions on maximum terms in the Law of the People's Republic of China on the Use of Sea Areas. For non-commercial sea use, approval may be granted in accordance with the maximum terms as set forth by the law, and the terms of commercial sea use shall be determined by the municipal people's government to the extent of the maximum terms as set forth by the law, in accordance with the relevant plans, taking into account the industry development cycle and the designed useful life of sea use projects, among others.   第二十六条 申请和确定海域使用权的期限应当符合《中华人民共和国海域使用管理法快醒醒开学了》关于最高年限的规定。其中非经营性用海可以依照该法规定的最高年限审批,经营性用海期限由市人民政府根据相关规划,结合产业发展周期、用海项目工程设计年限等在该法规定的最高年限内确定。
Article 27 For sea use in a project subject to the approval of the municipal people's government in accordance with the law, the municipal marine authority shall conduct a site survey, propose an examination opinion, and submit it to the municipal people's government for approval; and for any other application for sea use, the municipal marine authority shall conduct a site survey, propose an examination opinion, and submit it to the higher people's government for approval in accordance with the approval authority, with the concurrence of the municipal people's government.   第二十七条 依法由市人民政府审批的项目用海,由市海洋主管部门实地勘察、提出审查意见后报请市人民政府审批;其他用海申请由市海洋主管部门实地勘察、提出审查意见,并经市人民政府同意后,按照审批权限报请上级人民政府审批。
Article 28 Where a specific sea area is to be exclusively used for more than three months, the use shall be justified in accordance with the law.   第二十八条 持续使用特定海域三个月以上的排他性用海,应当依法进行海域使用论证。
Article 29 Where the right to use a sea area is to be assigned by means of applying for approval, an applicant shall justify the use of the sea area according to the law before application; and if the right to use a sea area is to be assigned by means of bidding, auction, and listing, the municipal marine authority shall organize a justification of the use of the sea area according to the law before bidding, auction, and listing.   第二十九条 通过申请批准方式出让海域使用权的,由申请人在申请使用海域之前依法进行海域使用论证;采取招标、拍卖、挂牌方式出让海域使用权的,由市海洋主管部门在招标、拍卖、挂牌之前依法组织进行海域使用论证。
The justification of use of the sea area shall focus on the following, a sea area use justification report shall be prepared, and a conclusion on the justification of sea use shall be drawn: 海域使用论证应当重点论证以下内容,并编制海域使用论证报告,作出用海论证结论:
(1) The necessity of sea use. (一)用海的必要性;
(2) The reasonableness of the selection, method, area, and term of the site for the sea use project. (二)用海项目选址、方式、面积、期限的合理性;
(3) Whether the sea use project meets the requirements of relevant plans. (三)用海项目是否符合有关规划要求;
(4) The reasonableness of coordinated solutions to the conflict of interest which the sea use project is in. (四)用海项目利益冲突协调解决方案的合理性;
(5) Possible impacts on the ecology and environment of the sea area and corresponding countermeasures and recommendations. (五)对海域生态环境可能造成的影响以及相应的对策和建议。
A sea area use justification report as approved shall be used as the basis for preparing the design plan for the sea-related part of marine works and coastal works. 经评审通过的海域使用论证报告应当作为海洋工程和海岸工程涉海部分设计方案的编制依据。
Article 30 A government-invested sea use project that assigns the right to use a sea area by means of applying for approval shall, before the municipal development and reform authority grants approval and confirmation, request comments on the necessity, location, scope, planning conditions, and public ancillaries of sea use from the municipal marine authority and comments on measures for ecological and environmental protection from the municipal ecology and environment authority .   第三十条 通过申请批准方式出让海域使用权的政府投资用海项目,市发展改革部门审批、核准前,应当就用海必要性、位置、范围、规划条件和公共配套等事项征求市海洋主管部门的意见,并就生态环境保护措施征求市生态环境主管部门的意见。
Article 31 Where the right to use a sea area is assigned by means of bidding, auction or listing, the municipal marine authority shall formulate an assignment plan after requesting comments from relevant authorities and implement it with the approval of the municipal people's government. The assignment plan shall specify the location, scope, current status, purpose, sea use method, sea use type, planning conditions, term of use, assignment method, requirements for ecological and environmental protection, coordinated solutions to conflicts of interest, and other content related to the sea area under assignment.   第三十一条 采取招标、拍卖、挂牌方式出让海域使用权的,市海洋主管部门应当在征求有关部门意见后制定出让方案,经市人民政府批准后实施。出让方案应当明确出让海域的位置、范围、现状、用途、用海方式、用海类型、规划条件、使用年限、出让方式、生态环境保护要求和利益冲突协调解决方案等内容。
When developing an assignment plan, the municipal marine authority shall organize a valuation of the right use to the sea area to be assigned and fix a reserve price for assignment. 制定出让方案时,市海洋主管部门应当组织对拟出让的海域使用权进行价值评估,确定出让底价。
