| Chapter I General provisions | | 第一章 总则 |
| Article 1 In order to evaluate the implementation effects and impacts of loan and grant projects of international financial institutions and foreign governments in an objective, impartial and scientific way, further regulate and strengthen the management of loans and grants by international financial institutions and foreign governments, and improve the system of performance evaluation management, the Measures are developed in accordance with the Budget Law of the People's Republic of China, the Measures for the Management of Loans and Grants by International Financial Institutions and foreign governments (No. 85, MoF), and other regulations. | | 第一条 为了客观、公正、科学地评价国际金融组织和外国政府贷款赠款项目的实施效果与影响，进一步规范加强国际金融组织和外国政府贷款赠款管理工作，完善绩效评价管理体系，根据《中华人民共和国预算法》、《国际金融组织和外国政府贷款赠款管理办法》 (财政部令第85号)等有关规定，制定本办法。 |
| Article 2 The Measures shall apply to performance evaluation conducted by the public finance departments at all levels, central project implementation entities or coordination institutions (hereinafter referred to as the “central entities”), and local project implementation entities with regard to the loan and grant projects of international financial institutions and foreign governments. | | 第二条 各级财政部门、中央项目实施单位或协调机构 (以下称中央单位)、地方项目实施单位，对国际金融组织和外国政府贷款赠款项目开展绩效评价工作，适用本办法。 |
| Article 3 For the purpose of the Measures, “performance evaluation of loan and grant projects of international financial institutions and foreign governments” (hereinafter referred to as the “performance evaluation”) means objective, impartial and scientific evaluation of project performance based on the pre-determined performance objectives of loan and grant projects of international financial institutions or foreign governments by using scientific and reasonable evaluation standards, indicators and methods. | | 第三条 本办法所称国际金融组织和外国政府贷款赠款项目绩效评价(以下称绩效评价)，是指运用科学合理的评价准则、指标和方法，结合国际金融组织或外国政府贷款赠款项目预先设定的绩效目标，对项目绩效进行客观、公正、科学的评价。 |
| Article 4 The performance evaluation work shall follow the basic principles as below: | | 第四条 绩效评价工作应当遵循以下基本原则： |
| 1. Evaluation based on law, science and standards: Performance evaluation shall be conducted in accordance with the relevant laws, regulations, policies and systems; and evaluation indicators shall be scientific and objective, evaluation methods shall be reasonable and standard, and basic data shall be true and accurate; | | (一)依法实施，科学规范。依据国家相关法律、法规和政策制度开展评价工作；评价指标要科学客观，评价方法要合理规范，基础数据要真实准确； |
| 2. Objectivity, impartiality, openness and transparency: Performance evaluation shall be conducted fairly and reasonably, follow a neutral stance, and proceed from objective realities based on facts; and evaluation results shall be released to the public according to law, and be properly supervised; | | (二)客观公正，公开透明。坚持中立立场，从客观实际出发，以事实为依据，公平合理开展评价工作；评价结果要依法公开，接受监督； |
| 3. Centralized leadership and management level by level: The Ministry of Finance shall be responsible for overall guidance for performance evaluation; and the central entities and local public finance departments shall be responsible for the organizational implementation and overall management of performance evaluation in their own departments and regions. | | (三)统一领导，分级管理。财政部负责总体指导绩效评价工作；中央单位和地方财政部门分别负责本部门、本地区的绩效评价的组织实施和总体管理工作； |
| 4. Objective-oriented approach with the participation of interested parties: The performance objectives of a project shall be taken as the starting point and criteria of the performance evaluation work; and the interested parties shall be encouraged to participate in the evaluation process. | | (四)目标导向，各方参与。以项目绩效目标作为绩效评价工作的起点和评价标准；在评价过程中推动利益相关方积极参与。 |
| Article 5 The primary basis of performance evaluation shall mainly include: | | 第五条 绩效评价的基本依据主要包括下列内容： |
| 1. the relevant national laws, regulations, rules and systems, as well as the national economic and social development plans and policies developed by governments at all levels; | | (一)国家相关法律、法规和规章制度及各级政府制定的国民经济与社会发展规划、相关政策等； |
| 2. the relevant industrial development plans and policies, industrial standards, and professional and technical norms; | | (二)相关行业发展规划及政策、行业标准及专业技术规范； |
| 3. the relevant policies and systems of lenders and donors, as well as the reports or summaries related to the performance of loan and grant projects; | | (三)贷款方及赠款方有关政策、制度以及与贷款赠款项目绩效相关的报告或结论； |
| 4. reports on project inspection or auditing work conducted by government departments at all levels; | | (四)政府各级职能部门对项目执行情况的检查或审计报告； |
| 5. project proposal, feasibility study report, project approval document, loan (grant) agreement, on-lending (execution) agreement, project acceptance report, and other project-related documents; and | | (五)项目建议书、可行性研究报告、立项审批文件、贷(赠)款协议、转贷(执行)协议、项目竣工验收报告等项目文件； |
| 6. other materials that can serve as evaluation basis. | | (六)其他可以作为评价依据的资料。 |
| Article 6 The central entities and the local public finance departments at all levels shall provide necessary fund guarantee for the performance evaluation work, and include the work in the fiscal budget of the public finance department at the same level according to the annual performance evaluation plan, so as to ensure the normal progress of the evaluation work. | | 第六条 中央单位、地方各级财政部门应当为绩效评价工作提供必要的经费保障，根据年度绩效评价工作计划列入同级财政部门年度预算，确保该项工作的正常开展。 |
| Chapter II Management departments and responsibilities | | 第二章 管理机构与职责 |
| Article 7 The Ministry of Finance shall be responsible for the overall guidance for performance evaluation, and shall fulfill the following responsibilities: | | 第七条 财政部负责总体指导绩效评价工作，履行下列工作职责： |
| 1. formulating the system of performance evaluation management; | | (一)制定绩效评价管理制度； |
2. guiding the performance evaluation work of the central entities and the provincial public finance departments, and, when necessary, organizing and conducting re-evaluation;
