院长利用职务之便收受他人财物的行为如何适用法律问题的答复

山东省人民检察院研究室：
你院《关于工人身份的乡镇卫生院院长利用职务之便收受贿赂如何适用法律问题的请示》（鲁检发研字[2001]第10号）收悉。经研究，答复如下：
经过乡镇政府或者主管行政机关任命的乡镇卫生院院长，在依法从事本区域卫生工作的管理与业务技术指导，承担医疗预防保健服务工作等公务活动时，属于刑法第九十三条第二款规定的其他依照法律从事公务的人员。对其利用职务上的便利，索取他人财物的，或者非法收受他人财物，为他人谋取利益的，应当依照刑法第三百八十五条、第三百八十六条的规定，以受贿罪追究刑事责任。
