Chapter I General Provisions 

第一章 总 则

Article 1 This Law is enacted in accordance with the Constitution for the purposes of improving the organization and working system of the National People's Congress and its Standing Committee, safeguarding and regulating their exercise of functions and powers, upholding and enhancing the people's congress system, and ensuring that the people run the country.   第一条 为了健全全国人民代表大会及其常务委员会的组织和工作制度,保障和规范其行使职权,坚持和完善人民代表大会制度,保证人民当家作主,根据宪法,制定本法。
Article 2 The National People's Congress is the highest organ of state power, and its permanent body is the Standing Committee of the National People's Congress.   第二条 全国人民代表大会是最高国家权力机关,其常设机关是全国人民代表大会常务委员会。
Article 3 The National People's Congress and its Standing Committee shall adhere to the leadership of the Communist Party of China, follow the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, and exercise functions and powers in accordance with the Constitution and the law.   第三条 全国人民代表大会及其常务委员会坚持中国共产党的领导,坚持以马克思列宁主义、毛泽东思想、邓小平理论、“三个代表”重要思想、科学发展观、习近平新时代中国特色社会主义思想为指导,依照宪法和法律规定行使职权。
Article 4 The National People's Congress shall be created through democratic election and shall be responsible to the people and subject to their oversight.   第四条 全国人民代表大会由民主选举产生,对人民负责,受人民监督。
The National People's Congress and its Standing Committee shall uphold democracy throughout the process, always maintain close contact with the people, listen to their opinions and suggestions, embody their will, and protect their rights and interests. 全国人民代表大会及其常务委员会坚持全过程民主,始终同人民保持密切联系,倾听人民的意见和建议,体现人民意志,保障人民权益。
Article 5 The National People's Congress and its Standing Committee shall exercise the legislative power of the state, decide on major matters, supervise the implementation of the Constitution and the law, safeguard the unity, dignity, and authority of the socialist legal system, and build a socialist country under the rule of law.   第五条 全国人民代表大会及其常务委员会行使国家立法权,决定重大事项,监督宪法和法律的实施,维护社会主义法制的统一、尊严、权威,建设社会主义法治国家。
Article 6 The National People's Congress and its Standing Committee shall practice the principle of democratic centralism, fully promote democracy, and collectively exercise functions and powers.   第六条 全国人民代表大会及其常务委员会实行民主集中制原则,充分发扬民主,集体行使职权。
Article 7 The National People's Congress and its Standing Committee shall actively engage in foreign relations and strengthen exchanges and cooperation with the parliaments of other countries and international and regional parliamentary organizations.   第七条 全国人民代表大会及其常务委员会积极开展对外交往,加强同各国议会、国际和地区议会组织的交流与合作。
Chapter II Sessions of the National People's Congress 

第二章 全国人民代表大会会议

Article 8 Each National People's Congress shall have a term of five years.   第八条 全国人民代表大会每届任期五年。
A session of the National People's Congress shall be held once every year and shall be convened by the Standing Committee of the National People's Congress. If the Standing Committee of the National People's Congress deems it necessary, or one-fifth or more of the deputies to the National People's Congress so propose, a session of the National People's Congress may be convened in the interim. 全国人民代表大会会议每年举行一次,由全国人民代表大会常务委员会召集。全国人民代表大会常务委员会认为必要,或者有五分之一以上的全国人民代表大会代表提议,可以临时召集全国人民代表大会会议。
Article 9 After deputies to the National People's Congress are elected, their credentials shall be examined by the Credentials Committee of the Standing Committee of the National People's Congress.   第九条 全国人民代表大会代表选出后,由全国人民代表大会常务委员会代表资格审查委员会进行审查。
The Standing Committee of the National People's Congress shall, on the basis of the reports submitted by the Credentials Committee, confirm the credentials of deputies or invalidate the election of individual deputies, and publish the list of confirmed deputies prior to the first session of each National People's Congress. 全国人民代表大会常务委员会根据代表资格审查委员会提出的报告,确认代表的资格或者确定个别代表的当选无效,在每届全国人民代表大会第一次会议前公布代表名单。
Deputies to the National People's Congress who are elected through by-elections shall be subject to credentials examination under the provisions of the preceding paragraph. 对补选的全国人民代表大会代表,依照前款规定进行代表资格审查。
Article 10 Deputies to the National People's Congress shall be grouped into delegations based on the organizations that elected them. Each delegation shall elect a head and deputy-heads.   第十条 全国人民代表大会代表按照选举单位组成代表团。各代表团分别推选代表团团长、副团长。
Before each session of the National People's Congress is held, the delegations shall discuss matters concerning preparations for the session put forward by the Standing Committee of the National People's Congress. During the session, the delegations shall deliberate on the proposals submitted to the National People's Congress, and the heads of delegations or representatives chosen by the delegations may give, on behalf of such delegations, opinions on the proposals under deliberation at meetings of the Presidium or at plenary meetings of the Congress. 代表团在每次全国人民代表大会会议举行前,讨论全国人民代表大会常务委员会提出的关于会议的准备事项;在会议期间,对全国人民代表大会的各项议案进行审议,并可以由代表团团长或者由代表团推派的代表,在主席团会议上或者大会全体会议上,代表代表团对审议的议案发表意见。
Article 11 Before each session of the National People's Congress, a preparatory meeting shall be held to elect a Presidium and a Secretary-General for the session and adopt an agenda for that session and decisions on other preparatory matters.   第十一条 全国人民代表大会每次会议举行预备会议,选举本次会议的主席团和秘书长,通过本次会议的议程和其他准备事项的决定。
A draft list of the Presidium and the Secretary-General shall be proposed by the Council of Chairpersons of the Standing Committee of the National People's Congress and, as deliberated and adopted at the meeting of the Standing Committee, submitted to the preparatory meeting. 主席团和秘书长的名单草案,由全国人民代表大会常务委员会委员长会议提出,经常务委员会会议审议通过后,提交预备会议。
Article 12 The Presidium shall preside over the session of the National People's Congress.   第十二条 主席团主持全国人民代表大会会议。
The Presidium shall elect standing chairpersons to convene and preside over meetings of the Presidium. 主席团推选常务主席若干人,召集并主持主席团会议。
The Presidium shall elect some of its members to respectively serve as executive chairpersons of each plenary meeting of the Congress, and designate one of the executive chairpersons to preside over the plenary meetings. 主席团推选主席团成员若干人分别担任每次大会全体会议的执行主席,并指定其中一人担任全体会议主持人。
Article 13 For each session, the National People's Congress shall set up a Secretariat which shall be composed of a Secretary-General and several Deputy Secretaries-General. The choice of Deputy Secretaries-General shall be determined by the Presidium.   第十三条 全国人民代表大会会议设立秘书处。秘书处由秘书长和副秘书长若干人组成。副秘书长的人选由主席团决定。
The Secretariat shall, under the leadership of the Secretary-General, dispose of matters assigned by the Presidium, and handle the routine affairs during the session. Deputy Secretaries-General shall assist the Secretary-General in his or her work. 秘书处在秘书长领导下,办理主席团交付的事项,处理会议日常事务工作。副秘书长协助秘书长工作。
Article 14 The Presidium shall handle the following matters:   第十四条 主席团处理下列事项:
(1) Deciding on the session schedule based on the agenda for the session. (一)根据会议议程决定会议日程;
(2) Deciding on the deadline for deputies to submit proposals during the session. (二)决定会议期间代表提出议案的截止时间;
(3) Hearing and deliberating on reports on the opinions on the handling of the proposals, and deciding whether to put the proposals submitted during the session on the agenda for the session. (三)听取和审议关于议案处理意见的报告,决定会议期间提出的议案是否列入会议议程;
(4) Hearing and deliberating on the reports by the Secretariat and relevant special committees on the deliberation and examination of proposals and reports, and deciding whether to put the proposals, draft decisions, or draft resolutions to a vote during the session. (四)听取和审议秘书处和有关专门委员会关于各项议案和报告审议、审查情况的报告,决定是否将议案和决定草案、决议草案提请会议表决;
(5) Hearing an explanation of the list of candidates for members of state organs from the standing chairpersons of the Presidium, nominating candidates for members of state organs to be elected at the session, and determining a formal list of candidates in accordance with statutory procedures. (五)听取主席团常务主席关于国家机构组成人员人选名单的说明,提名由会议选举的国家机构组成人员的人选,依照法定程序确定正式候选人名单;
(6) Presenting draft measures for election and decisions on appointments during the session. (六)提出会议选举和决定任命的办法草案;
(7) Organizing the pledge of allegiance to the constitution by members of state organs elected or appointed by decision during the session. (七)组织由会议选举或者决定任命的国家机构组成人员的宪法宣誓;
(8) Other matters that shall be handled by the Presidium. (八)其他应当由主席团处理的事项。
Article 15 The standing chairpersons of the Presidium shall, with respect to matters to be submitted to the Presidium for deliberation, hear the reports by the Secretariat and relevant special committees, and make recommendations to the Presidium.   第十五条 主席团常务主席就拟提请主席团审议事项,听取秘书处和有关专门委员会的报告,向主席团提出建议。
The standing chairpersons of the Presidium may make any necessary adjustment to the session schedule. 主席团常务主席可以对会议日程作必要的调整。
Article 16 The Presidium of the National People's Congress, the Standing Committee of the National People's Congress, the special committees of the National People's Congress, the State Council, the Central Military Commission, the National Oversight Commission, the Supreme People's Court, and the Supreme People's Procuratorate may submit to the National People's Congress proposals that fall within the scope of functions and powers of the National People's Congress.   第十六条 全国人民代表大会主席团,全国人民代表大会常务委员会,全国人民代表大会各专门委员会,国务院,中央军事委员会,国家监察委员会,最高人民法院,最高人民检察院,可以向全国人民代表大会提出属于全国人民代表大会职权范围内的议案。
Article 17 A delegation may, or 30 or more deputies may jointly, submit to the National People's Congress proposals that fall within the scope of functions and powers of the National People's Congress.   第十七条 一个代表团或者三十名以上的代表联名,可以向全国人民代表大会提出属于全国人民代表大会职权范围内的议案。
Article 18 Candidates for Chairperson, Vice-Chairpersons, Secretary-General, and other members of the Standing Committee of the National People's Congress, President and Vice-President of the People's Republic of China, Chairperson of the Central Military Commission, Chairperson of the National Oversight Commission, President of the Supreme People's Court, and Procurator-General of the Supreme People's Procuratorate shall be nominated by the Presidium which, after consultation among all delegations, shall determine a formal list of candidates, based on the opinion of the majority of deputies.

   第十八条 全国人民代表大会常务委员会委员长、副委员长、秘书长、委员的人选,中华人民共和国主席、副主席的人选,中央军事委员会主席的人选,国家监察委员会主任的人选,最高人民法院院长和最高人民检察院检察长的人选,由主席团提名,经各代表团酝酿协商后,再由主席团根据多数代表的意见确定正式候选人名单。
