| Article 1 To regulate the guarantee of police service by the judicial police of the people's courts in the trial of criminal cases, these Rules are formulated in accordance with the Criminal Procedure Law of the People's Republic of China, the People's Police Law of the People's Republic of China, Courtroom Rules of the People's Courts of the People's Republic of China, Interim Regulation on the Judicial Police of the People's Courts and other relevant laws and administrative regulations. | | 第一条 为规范人民法院司法警察（以下简称司法警察）刑事审判警务保障工作，根据《中华人民共和国刑事诉讼法》、《中华人民共和国人民警察法》、《中华人民共和国人民法院法庭规则》和《人民法院司法警察暂行条例》等有关法律、行政法规，制定本规则。 |

| Article 2 The term “guarantee of police services in the trial of criminal cases” (hereinafter referred to as the guarantee of police services) refers to the duty-related conducts performed by the judicial police according to law for the purpose of ensuring the smooth trial of criminal cases by the people's courts. | | 第二条 刑事审判警务保障（以下简称警务保障）是指司法警察为保证人民法院刑事审判工作的顺利进行，依法实施的职务行为。 |
Providing “guarantee of police services” as mentioned in these Rules shall include: maintaining order in the trial of criminal cases and guarding the courtroom; protecting the personal safety of the judges, public prosecutors, counsels and other litigation participants; preventing and curbing such violations and crimes impeding the trial of criminal cases; escorting and guarding the defendants and criminals according to law; conducting security inspections of the observers according to law; summoning the witnesses and appraisers, and passing and showing the evidence. | |
本规则所指警务保障包括：在刑事审判工作中维护审判秩序，警卫法庭安全；保护审判人员、公诉人、辩护人和其他诉讼参与人的人身安全；预防、制止妨碍刑事审判活动的违法犯罪行为；依法押解、看管被告人和罪犯；依法对旁听人员进行安全检查；传唤证人、鉴定人，传递、展示证据。 |

| Article 3 The judicial police shall, in providing guarantee of police services, strictly abide by the laws and administrative regulations and enforce the laws in a strict, regular and respectable manner; keep the trial secrets and work secrets; wear the prescribed uniform, keep a solemn and neat police appearance, behave gracefully; and hold the police certificate and other valid identity certificates. | | 第三条 司法警察在执行警务保障工作中应当做到：严格遵守法律、行政法规的规定，严格执法、文明执法、规范执法；保守审判秘密和工作秘密；按规定着装，保持警容严整，举止端庄；持有警官证等有效身份证明。 |
The on-duty judicial police in courtroom shall, in pursuance of law, perform the duties according to the commands of the presiding judge or sole judge. | |
值庭司法警察在法庭审判活动中，根据审判长、独任审判员的指令，依法履行职责。 |

| Article 4 The judicial police shall abide by the relevant provisions of the Regulation on the Use of Police Instruments and Weapons by the People's Police of the People's Republic of China in preparing and using the police instruments and weapons for providing guarantee of police services. | | 第四条 司法警察在执行警务保障任务中，配备、使用警械和武器，必须遵守《中华人民共和国人民警察使用警械和武器条例》的有关规定。 |

| II Organization and Commanding | | 二、组织指挥 |

| Article 5 During the work on providing guarantee of police services, the judicial police department shall, in light of the nature of the cases, number of defendants, ways of hearing and other information, arrange and assign the police force and prepare vehicles, weapons and police instruments. | | 第五条 在警务保障工作中，司法警察部门应当根据案件性质、被告人数量和审理方式等情况，安排、部署警力；配备车辆和武器、警械具。 |
The judicial police department shall have sufficient police force under relevant provisions and shall, according to the requirements for the guarantee of police services, form sub-teams (sub-groups) for escorting, guarding, being on-duty in courtroom, security inspection and emergency handling. | |
按照规定配备警力，根据警务保障要求，分别设立押解、看管、值庭、安全检查和处置突发事件分队（组）； |
The judicial police department shall have command vehicles and prison vans, and have reserved vehicles if necessary. | |
配备指挥车、囚车，必要时配备备用车辆； |
The judicial police department shall have weapons and police instruments. | |
配备武器、警械具。 |
Prior to providing guarantee of police services, the judicial police department shall maintain and check the vehicles, weapons and police instruments so as to ensure the applicability thereof. | |
执行警务保障任务前，应当对车辆、武器和警械具进行维护、检查，确保车辆、武器和警械具处于适用状态。 |

| Article 6 The judicial police department shall inspect the facilities in the courtroom and detainment places and shall renovate and eliminate the facilities and articles obstructing the guarantee of the police services. | | 第六条 检查审判法庭、羁押场所的设施，对于妨碍警务保障工作的设施和物品进行改造和清除。 |

| Article 7 As to the guarantee of police services for criminal cases involving a great number of defendants or other major criminal cases, the judicial police department shall work out an execution plan on the guarantee of police services. The execution plan shall include such contents as the organization and commanding, arrangement of police force and emergency handling scheme. | | 第七条 对于被告人人数较多或其他重大刑事案件的警务保障工作，司法警察部门应当制定“警务保障实施方案”。实施方案包含组织指挥、警力部署和“突发事件应急处置方案”等内容。 |

| Article 8 When providing guarantee of police services, the circumstance of insufficient police force shall be solved by following the Interim Rules on the Dispatch and Utilization of Judicial Police by the People's Courts. | | 第八条 在警务保障工作中，遇有警力不足情况时，按照《人民法院调动使用司法警察暂行规则》执行。 |

| Article 9 The general team of judicial police of each higher people's court shall be responsible for the guarantee of police services in second-instance cases involving death penalty, which shall uniformly organize and coordinate the assignment and arrangement of the police force. For a second-instance case involving death penalty which the Supreme People's Court or any higher people's court needs to try at the court of the detention place of the defendant(s) or interrogate the defendants there, in principle the judicial police department of the detention place of the defendant(s) shall provide the guarantee of police services. | | 第九条 各高级人民法院司法警察总队负责死刑第二审案件的警务保障工作，统一组织、协调警力的部署和安排。最高人民法院、各高级人民法院需要在被告人羁押地法院审理和提讯被告人的死刑第二审案件，原则上由被告人羁押地法院司法警察部门提供警务保障。 |

| Article 10 The judicial police department shall timely provide guarantee of police services by taking into account the needs of the corresponding people's court in the trial of criminal cases. | | 第十条 司法警察部门应当根据所在人民法院刑事审判工作的需要，及时提供警务保障。 |
| |

Article 11 If the criminal trial department needs to apply for utilizing judicial police to provide guarantee of police services for a case involving a great number of defendants or for any other major case, it shall file an application 3 working days prior to the utilization of police.
