The Measures for the Administration of Business Training on Sales Promoters, which were adopted through deliberation at the 15th ministerial meeting of the Ministry of Commerce on October 19, 2005, and consented to by the Ministry of Public Security and the State Administration for Industry and Commerce, are hereby promulgated, and shall come into force as of December 1st, 2005. | |
《直销员业务培训管理办法》已经2005年10月19日商务部第15次部务会议审议通过，并经公安部、工商总局同意，现予以发布，自2005年12月1日起施行。 |

| Article 1 The present Measures are formulated in accordance with the provisions of paragraph three of Article 21 of the Regulation on Direct Selling Administration. | | 第一条 根据《直销管理条例》第二十一条第三款规定，制定本办法。 |

| Article 2 The present Measures shall be applicable to the holding of business training on sales promoters (hereinafter referred to as the direct selling training) and the examination activities within the territory of the People's Republic of China. | | 第二条 在中华人民共和国境内举办直销员业务培训（以下简称直销培训）及考试活动，适用本办法。 |

| Article 3 The direct selling training as mentioned in the present Measures shall refer to the various training activities conducted by direct selling companies to the sales promoters to be recruited by them and the sales promoters of their own companies on the relevant laws and regulations of the state and the basic direct selling knowledge. | | 第三条 本办法所称直销培训，是指直销企业对本企业拟招募的直销员和本企业的直销员进行国家相关法律法规规章、直销基础知识等各种培训活动。 |
The examination on sales promoters as mentioned in the present Measures shall refer to the examination conducted by a direct selling company to the sales promoters to be recruited by it. | |
本办法所称直销员考试是指直销企业对本企业拟招募的直销员的考试。 |

| Article 4 A direct selling company shall issue the Certificate of Sales Promoters and the Certificate of Direct Selling Trainers to the sales promoters and direct selling trainers who comply with the conditions as prescribed in the Regulation on Direct Selling Administration. | | 第四条 直销企业向符合《直销管理条例》规定条件的直销员、直销培训员颁发《直销员证》、《直销培训员证》。 |
A direct selling company shall, before the 15th day of each month, put on archives the name list of the personnel who have obtained the Certificate of Direct Selling Trainers in its company in the previous month at the Ministry of Commerce through the competent department of commerce at the level of the province where the company is located. No personnel who are not put on archives may carry out training on sales promoters. The direct selling trainers may only make training upon the appointment of their own companies. | |
直销企业应在每月15日前将本企业上一个月取得《直销培训员证》的人员名册，通过企业所在地省级商务主管部门向商务部备案。未经备案的人员，不得对直销员开展培训。直销培训员只能接受所属企业指派进行培训。 |
The Certificate of Sales Promoters and the Certificate of Direct Selling Trainers shall be printed by the direct selling companies in light of the standard design formulated by the Ministry of Commerce. | |
《直销员证》、《直销培训员证》由直销企业按商务部制定的规范式样印制。 |

| Article 5 A sales promoter shall wear the Certificate of Sales Promoters when selling products to any consumer, and a direct selling trainer shall wear the Certificate of Direct Selling Trainers when carrying out direct selling training activities. | | 第五条 直销员向消费者推销产品时、直销培训员在进行直销培训活动时，应佩戴《直销员证》、《直销培训员证》。 |
No one may forge, change, alter, lease, lend, transfer or sell the Certificate of Sales Promoters or the Certificate of Direct Selling Trainers. | |
不得伪造、变造、涂改、出租、出借、转让、出卖《直销员证》、《直销培训员证》。 |

Article 6 The contents of direct selling training shall focus on the relevant contents in the Regulation on Direct Selling Administration, Regulation on Prohibition of Pyramid Selling, Contract Law, Law on the Protection of the Rights and Interests of Consumers, Product Quality Law, Anti-Unfair Competition Law and in other laws and regulations, the ethnic rules of sales promoters, knowledge on the disclosure of direct selling risk and marketing, and other aspects.
