《亚洲运动会标志保护办法》已经中华人民共和国国家工商行政管理总局局务会议审议通过，现予公布，自公布之日起施行。

亚洲运动会标志保护办法
　　第一条　为了加强对亚洲运动会标志（以下简称亚运会标志）的保护，维护亚运会标志权利人的合法权益，根据《中华人民共和国商标法》、《中华人民共和国商标法实施条例》、《特殊标志管理条例》的规定，制定本办法。
　　第二条　本办法所称亚运会标志是指亚洲奥林匹克理事会、第16届亚运会组织机构按照《中华人民共和国商标法》、《中华人民共和国商标法实施条例》有关规定在国务院工商行政管理部门商标局作为商标依法核准注册以及按照《特殊标志管理条例》的规定在国务院工商行政管理部门商标局作为特殊标志核准登记的下列内容：
（一）亚洲奥林匹克理事会的名称（包括全称、简称、译名和缩写，下同）、会徽、会旗、会歌、格言等；
（二）第16届亚运会申办机构的名称、标识、口号和其他标志；
（三）第16届亚运会组织机构的名称、徽记和其他标志；
（四）第16届亚运会的名称、会徽、吉祥物、口号、会歌、会旗和其他标志；
（五）《亚奥理事会章程和规则》和《第16届亚运会主办城市合同》中规定的其他与第16届亚运会有关的标志。
　　第三条　本办法所称亚运会标志权利人，是指亚洲奥林匹克理事会和第16届亚运会组织机构。
亚洲奥林匹克理事会与第16届亚运会组织机构关于亚运会标志的权利划分，依照《亚奥理事会章程和规则》和《第16届亚运会主办城市合同》确定。
　　第四条　亚运会标志权利人依照《中华人民共和国商标法》、《中华人民共和国商标法实施条例》、《特殊标志管理条例》享有亚运会标志权。
