It has been discovered recently in local law enforcement practice that certain construction projects violated the planning permission and the compulsory construction standards, but the illegal acts of the relevant responsible entities were not discovered until two years later. In investigating and punishing such illegal acts, the local authorities generally present two opinions. The first opinion is that in accordance with paragraph 1, Article 29 of the Administrative Penalty Law, where the illegal act of a relevant responsible entity is not discovered until more than two years later, the entity shall no longer be subject to liability for the violation. The second opinion is that construction, design or operation in violation of the planning permission or the compulsory construction standards is a continuing act, and the limitation of prosecution for administrative penalty shall begin from the date of correction of the illegal act.
．．．．．． | | 近日，地方在执法实践中发现，部分建设项目违反规划许可、工程建设强制性标准，相关责任单位的违法行为在2年后才被发现。地方在查处时大致有两种意见：一是认为依照《行政处罚法》第二十九条第一款，发现相关责任单位实施违法行为时超过2年，不应再追究其违法责任；二是认为违反规划许可、工程建设强制性标准进行建设、设计、施工，其行为有继续状态，应当自纠正违法行为之日起计算行政处罚追诉时效。
