To punish drug crimes at the source and prevent compound preparations of ephedrine from being illegally used to manufacture drugs, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security have formulated the Opinions on Several Issues concerning Application of Law in the Handling of Criminal Cases of Smuggling or Illegally Purchasing or Selling Compound Preparations of Ephedrine, which are hereby issued for your compliance and implementation. Please report any problems encountered in the implementation of these Opinions on a level-by-level basis to the Supreme People's Court, the Supreme People's Procuratorate, or the Ministry of Public Security in a timely manner. | |

最高人民法院、最高人民检察院、公安部关于办理走私、非法买卖麻黄碱类复方制剂等刑事案件适用法律若干问题的意见 |
To crack down on and contain drug crimes at the source, in accordance with the relevant provisions of the Criminal Law and in consideration of judicial practice, the following opinions are hereby offered on the relevant issues concerning application of law in the handling of criminal cases of smuggling or illegally purchasing or selling compound preparations of ephedrine: | |
为从源头上打击、遏制毒品犯罪，根据刑法等有关规定，结合司法实践，现就办理走私、非法买卖麻黄碱类复方制剂等刑事案件适用法律的若干问题，提出以下意见： |

| I. Determination of the nature of acts such as smuggling and illegal purchase and sale of compound preparations of ephedrine | | 一、关于走私、非法买卖麻黄碱类复方制剂等行为的定性 |
Whoever, for the purpose of processing or extracting drug precursors to manufacture drugs, purchases any compound preparations of ephedrine or transports, carries or mails any compound preparations of ephedrine into or out of China shall be convicted and punished for the crime of manufacturing drugs under Article 347 of the Criminal Law. | |
以加工、提炼制毒物品制造毒品为目的，购买麻黄碱类复方制剂，或者运输、携带、寄递麻黄碱类复方制剂进出境的，依照刑法第三百四十七条的规定，以制造毒品罪定罪处罚。 |
Whoever, for the purpose of processing or extracting drug precursors, purchases any compound preparations of ephedrine or transports, carries or mails any compound preparations of ephedrine into or out of China shall be convicted and punished for the crime of illegally purchasing or selling drug precursors or the crime of smuggling drug precursors under Article 350.1 or 350.3 of the Criminal Law. | |
以加工、提炼制毒物品为目的，购买麻黄碱类复方制剂，或者运输、携带、寄递麻黄碱类复方制剂进出境的，依照刑法第三百五十条第一款、第三款的规定，分别以非法买卖制毒物品罪、走私制毒物品罪定罪处罚。 |
Whoever smuggles or illegally purchases or sells compound preparations of ephedrine after such compound preparations of ephedrine are unpacked or changed in form or knowingly smuggles or illegally purchases or sells compound preparations of ephedrine that are unpacked or changed in form shall be convicted and punished for the crime of smuggling drug precursors or the crime of illegally purchasing or selling drug precursors under Article 350.1 or 350.3 of the Criminal Law.

将麻黄碱类复方制剂拆除包装、改变形态后进行走私或者非法买卖，或者明知是已拆除包装、改变形态的麻黄碱类复方制剂而进行走私或者非法买卖的，依照刑法第三百五十条第一款、第三款的规定，分别以走私制毒物品罪、非法买卖制毒物品罪定罪处罚。
