Measures for the Administration of the Clean Development Mechanism Fund 

中国清洁发展机制基金管理办法

(Promuglated by the Order No. 59 of the Ministry of Finance, the National Development and Reform Commission, the Ministry of Foreign Affairs, the Ministry of Science and Technology, the Ministry of Environmental Protection, the Ministry of Agriculture and the China Metrological Administration on September 14, 2010, and amended in accordance with the Order No. 95 of the Ministry of Finance, the National Development and Reform Commission, the Ministry of Foreign Affairs, the Ministry of Science and Technology, the Ministry of Environmental Protection, the Ministry of Agriculture and the China Meteorological Administration—Decision to Amend the Measures for the Administration of the China Clean Development Mechanism Fund, on December 29, 2017.)

Chapter I General Provisions 

第一章 总  则

 
Article 1 To strengthen and standardize the fund raising, management and use of the China Clean Development Mechanism Fund (hereinafter referred to as the "Fund") and achieve the objectives of the Fund, these Measures are formulated.   第一条 为加强和规范中国清洁发展机制基金(以下简称基金)的资金筹集、管理和使用,实现基金宗旨,制定本办法。
Article 2 The Fund is a policy-oriented fund established with the approval of the state and managed in the manner of a social fund.   第二条 基金是由国家批准设立的按照社会性基金模式管理的政策性基金。
Article 3 The Fund's objectives are to support the national response to climate changes and promote sustainable economic and social development.   第三条 基金的宗旨是支持国家应对气候变化工作,促进经济社会可持续发展。
Article 4 The fund raising, management and use of the Fund shall follow the principles of openness, fairness, safety, efficiency and dedicated use.   第四条 基金的筹集、管理和使用,应当遵循公开、公正、安全、效率、专款专用的原则。
Chapter II Administrative Bodies and Their Duties 

第二章 管理机构及其职责

Article 5 The Fund's administrative bodies consist of the Fund Board and the Fund Management Center.   第五条 基金的管理机构由基金审核理事会和基金管理中心组成。
Article 6 The Fund Board is an inter-ministerial deliberative body regarding the Fund affairs.   第六条 基金审核理事会是关于基金事务的部际议事机构。
The Fund Board comprises representatives from the National Development and Reform Commission, Ministry of Finance, Ministry of Foreign Affairs, Ministry of Science and Technology, Ministry of Environmental Protection, Ministry of Agriculture and the China Meteorological Association. 基金审核理事会由国家发展改革委、财政部、外交部、科技部、环境保护部、农业部和气象局的代表组成。
The National Development and Reform Commission and the Ministry of Finance shall designate representatives to perform the duties of the chairman and vice-chairman of the Fund Board respectively. 基金审核理事会设主席和副主席,分别由国家发展改革委和财政部派出代表履行职责。
The Fund Board is responsible for examining the following matters: 基金审核理事会负责审核下列事项:
1. the Fund's of basic management rules; (一)基金基本管理制度;
2. the Fund's strategic development plans, including annual plans for the use of funds; (二)基金发展战略规划,包括资金使用年度计划;
3. applications to the Fund for grants or major for-profit uses; (三)基金赠款项目和重大有偿使用项目申请;
4. the Fund's annual fiscal budget and final accounting; and (四)基金年度财务收支预算与决算;
5. other important business matters of the Fund. (五)基金其他重大业务事项。
After the Fund Board examines and unanimously agrees on a matter as mentioned in the preceding paragraph, the matter shall be reported for approval to the National Development and Reform Commission and the Ministry of Finance. 前款所列事项经基金审核理事会审核并取得一致意见后,报国家发展改革委、财政部批准。
Article 7 The Fund Management Center is the Fund's day-to-day administrative body, specifically responsible for the fund raising, management and use, and is under the administration of the Ministry of Finance.   第七条 基金管理中心是基金的日常管理机构,具体负责基金的筹集、管理和使用工作,由财政部归口管理。
Article 8 The Fund Management Center performs the following duties:   第八条 基金管理中心履行下列职责:
1. drawing up the Fund's basic management rules and establishing the Fund's specific operation and management rules; (一)起草基金基本管理制度,制定基金具体运行管理规定;
2. raising funds for the Fund; (二)筹集基金资金;
3. managing the funds of the Fund and organizing the for-profit use and wealth management of the Fund; (三)管理基金资金,组织开展基金的有偿使用和理财活动;
4. preparing and organizing the implementation of the Fund's annual fiscal budget and final accounting; (四)编制并组织实施基金的年度财务收支预算与决算;
5. overseeing and managing the operations of projects supported by the Fund; (五)监督管理基金所支持项目的运行;
6. reporting to the Fund Board on the Fund's major business matters; and (六)向基金审核理事会报告基金的重大业务事项;
7. carrying out other activities consistent with the Fund's objectives. (七)开展其他符合基金宗旨的活动。
Chapter III Fund Raising 

第三章 基金筹集

Article 9 The fund sources include:   第九条 基金来源包括:
1. state-owned part of the income obtained from the transfer of greenhouse gas emission reduction credits through a clean development mechanism project; (一)通过清洁发展机制项目转让温室气体减排量所获得收入中属于国家所有的部分;
2. operating income of the Fund; (二)基金运营收入;
3. donations from institutions, organizations and individuals at home and abroad; (三)国内外机构、组织和个人捐赠;
4. other sources. (四)其他来源。
Article 10 In these Measures, “emission reduction credits” refer to the greenhouse gas emission reduction credits that are transferred through a clean development mechanism project with the approval of the state; “emission reduction income” refers to the income obtained from the transfer of emission reduction credits.   第十条 本办法所称减排量,是指经国家批准,通过清洁发展机制项目转让的温室气体减排量;减排量收入,是指转让减排量所获得的收入。
Emission reduction income shall be divided between the state and the enterprise implementing a clean development mechanism project (hereinafter referred to as the "project owner") according to a prescribed proportion. The state-owned part of the emission reduction income (hereinafter referred to as the "state income") shall be contributed to the Fund in full. 减排量收入由国家和实施清洁发展机制项目的企业(以下称项目业主)按照规定的比例分别所有。减排量收入中属于国家所有的部分(以下称国家收入)全额纳入基金。
Article 11 The Fund Management Center is responsible for collecting the state income from the project owner or, as agreed on under the emission reduction credit transfer contract, from the purchaser of emission reduction credits.   第十一条 国家收入由基金管理中心负责向项目业主或按减排量转让合同约定向减排量购买方收取。
The project owner shall, within 15 working days after obtaining the emission reduction income, transfer the state income into a designated account according to the prescribed proportion. 项目业主应当在取得减排量收入后的15个工作日内,按照规定比例向指定账户支付国家收入。
Article 12 State income shall be collected in the currency as agreed upon under the emission reduction credit transfer contract.   第十二条 国家收入应当以减排量转让合同约定的币种取得。
Where the state income shall be paid in a foreign currency as agreed on under the emission reduction credit transfer contract but it is really necessary to make payment of the state income in Renminbi, with the consent of the Fund Management Center, the project owner shall transfer the state income in Renminbi to the designated account within 15 working days after obtaining the emission reduction income, with the exchange rate being the remittance buying price on the day of foreign exchange settlement. 减排量转让合同约定以外币支付,但确需以人民币支付国家收入的,经基金管理中心同意,项目业主应当在取得收入后的15个工作日内以人民币支付,汇率以结汇日现汇买入价为准。
Article 13 The emission reduction credit transfer contract shall be entered into by the project owner and the purchaser of emission reduction credits.   第十三条 减排量转让合同由项目业主和减排量购买方签订。
The project owner shall, within 15 working days from the effective date of the emission reduction credit transfer contract, file with the Fund Management Center a copy of the contract, a photocopy of its business license, and information on the contact persons and contact methods of both parties to the contract.
