| The Decision of the Standing Committee of the National People's Congress to Amend the Patent Law of the People's Republic of China, as adopted at the 22nd Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on October 17, 2020, is hereby issued, and shall come into force on June 1, 2021. | | 《全国人民代表大会常务委员会关于修改＜中华人民共和国专利法＞的决定》已由中华人民共和国第十三届全国人民代表大会常务委员会第二十二次会议于2020年10月17日通过，现予公布，自2021年6月1日起施行。 |

| As decided at the 22nd Session of the Standing Committee of the Thirteenth National People's Congress, the Patent Law of the People's Republic of China is amended as follows: | | 第十三届全国人民代表大会常务委员会第二十二次会议决定对《中华人民共和国专利法》作如下修改： |
| 1. Paragraph 4 of Article 2 is amended to read: “‘Design' means a new design of the shape, pattern, or a combination thereof, as well as a combination of the color, shape and pattern, of the entirety or a portion of a product, which creates an aesthetic feeling and is fit for industrial application.” | | 一、将第二条第四款修改为：“外观设计，是指对产品的整体或者局部的形状、图案或者其结合以及色彩与形状、图案的结合所作出的富有美感并适于工业应用的新设计。” |
| 2. Paragraph 1 of Article 6 is amended to read: “An invention-creation made by a person in the execution of tasks of the entity employing the person or mainly by taking advantage of the entity's material and technical conditions is a service invention-creation. The right to apply for a patent for a service invention-creation belongs to the entity; and after the application is granted, the entity is the patentee. The entity may, in accordance with the law, dispose of its right to apply for the patent for the service invention-creation and the patent right, and promote the exploitation and application of the invention-creation.” | | 二、将第六条第一款修改为：“执行本单位的任务或者主要是利用本单位的物质技术条件所完成的发明创造为职务发明创造。职务发明创造申请专利的权利属于该单位，申请被批准后，该单位为专利权人。该单位可以依法处置其职务发明创造申请专利的权利和专利权，促进相关发明创造的实施和运用。” |
| 3. Article 14 is renumbered as Article 49. | | 三、将第十四条改为第四十九条。 |
| 4. Article 16 is renumbered as Article 15, and one paragraph is added as paragraph 2: “The state encourages entities to which patent rights are granted to implement property right incentives, and enable inventors or designers to rationally share the benefits of innovation in forms such as equities, options, and dividends.” | | 四、将第十六条改为第十五条，增加一款，作为第二款：“国家鼓励被授予专利权的单位实行产权激励，采取股权、期权、分红等方式，使发明人或者设计人合理分享创新收益。” |
| 5. One article is added as Article 20: “Patent applications and the exercise of patent rights shall adhere to the principle of good faith. Patent rights shall not be abused to damage the public interest or the lawful rights and interests of any other person. | | 五、增加一条，作为第二十条：“申请专利和行使专利权应当遵循诚实信用原则。不得滥用专利权损害公共利益或者他人合法权益。 |
| “Any abuse of patent rights to preclude or restrict competition, which constitutes a monopolistic act, shall be handled in accordance with the Anti-monopoly Law of the People's Republic of China.” | | “滥用专利权，排除或者限制竞争，构成垄断行为的，依照《中华人民共和国反垄断法》处理。” |
| 6. In paragraph 1 of Article 21, “and its patent reexamination board” is deleted. | | 六、删除第二十一条第一款中的“及其专利复审委员会”。 |
| Paragraph 2 is amended to read: “The patent administrative department of the State Council shall strengthen the construction of the patent information public service system, release patent information in a complete, accurate, and timely manner, provide basic patent data, publish patent gazettes on a periodical basis, and promote the dissemination and utilization of patent information.” | | 将第二款修改为：“国务院专利行政部门应当加强专利信息公共服务体系建设，完整、准确、及时发布专利信息，提供专利基础数据，定期出版专利公报，促进专利信息传播与利用。” |
| 7. One subparagraph is added in Article 24 as subparagraph (1): “It is disclosed to the public for the first time in the public interest, when a state of emergency or any extraordinary circumstance occurs in the country.” | | 七、在第二十四条中增加一项，作为第一项：“（一）在国家出现紧急状态或者非常情况时，为公共利益目的首次公开的”。 |
| 8. Subparagraph 1(5) of Article 25 is amended to read: “(5) Nuclear transformation methods and substances obtained in the method of nuclear transformation.” | | 八、将第二十五条第一款第五项修改为：“（五）原子核变换方法以及用原子核变换方法获得的物质”。 |
| 9. Paragraph 2 of Article 29 is amended to read: “Where, within 12 months from the date of filing of the first application for a patent for an invention or utility model in China, or within six months from the date of filing of the first application for a patent for a design in China, the applicant files again an application for a patent for the same subject matter with the patent administrative department of the State Council, the applicant may enjoy a right of priority.” | | 九、将第二十九条第二款修改为：“申请人自发明或者实用新型在中国第一次提出专利申请之日起十二个月内，或者自外观设计在中国第一次提出专利申请之日起六个月内，又向国务院专利行政部门就相同主题提出专利申请的，可以享有优先权。” |
| 10. Article 30 is amended to read: “An applicant which claims a right of priority for an invention or utility model patent shall file a written declaration at the time of application, and within 16 months from the date of filing of the first application, submit a duplicate of the first patent application documents. | | 十、将第三十条修改为：“申请人要求发明、实用新型专利优先权的，应当在申请的时候提出书面声明，并且在第一次提出申请之日起十六个月内，提交第一次提出的专利申请文件的副本。 |
| “An applicant which claims a right of priority for a design patent shall file a written declaration at the time of application, and submit a duplicate of the first patent application documents within three months. | | “申请人要求外观设计专利优先权的，应当在申请的时候提出书面声明，并且在三个月内提交第一次提出的专利申请文件的副本。 |
| “An applicant which fails to file the written declaration or submit the duplicate of the patent application documents within the prescribed time limit shall be deemed to have not claimed a right of priority.” | | “申请人未提出书面声明或者逾期未提交专利申请文件副本的，视为未要求优先权。” |
11. Article 41 is amended to read: “A patent applicant may file a request with the patent administrative department of the State Council for a review of the decision of the patent administrative department of the State Council to reject its application, within three months of receipt of a notice of the decision. After review, the patent administrative department of the State Council shall make a decision, and notify the patent applicant.
