| Article 1 With a view to deepening the foreign trade restructuring,sustain and guide the healthy development of the non state ownership economy, and make proactive efforts to help privately owned manufacturing enterprises and institutions of scientific research to participate in international competition, these provisions are hereby formulated in accordance with the Foreign Trade Law of the People'sRepublic of China. | | 第一条 为深化外贸体制改革，保持和引导非公有制经济健康发展，积极推动私营生产企业或科研院所参与国际竞争，根据《中华人民共和国对外贸易法》，制定本规定。 |

| Article 2 The privately owned manufacturing enterprises and institutions of scientific research, which are referred to in these provisions, shall mean all the manufacturing enterprises or institutions of scientific research (inclusive of wholly owned enterprises, partnerships, limited liability companies and joint stock companies limited) that are duly registered and in which private individuals are either the sole investors or take a controlling interest. | | 第二条 本规定所指的的私营生产企业和科研院所系指依法登记注册、资本属于私人所有或私人资本控股的生产性企业或科研机构（包括独资企业、合伙企业、有限责任公司和股份有限公司）。 |

| Article 3 Application qualifications: | | 第三条 申请资格 |

| I. A privately owned manufacturing enterprise that meets all the following conditions may apply for the right to self-manage imports and exports: | | 一、同时具备下列条件的私营生产企业可申请自营进出口权： |
| |
|
| (I) It has been duly registered with and obtained the business license from the administrative authorities for industry and commerce in the place where the manufacturing enterprise is based and its registered capital and net assets both exceed RMB 8.5 million yuan; | | （一）已经在生产企业所在地的工商行政管理机关登记注册、领取了营业执照，注册资本和净资产均在850万元人民币以上； |

| (II) For two consecutive years, its annual sales and the amount of export supplies have respectively exceeded RMB 50 million yuan and US $1 million (RMB 30 million yuan and US $ 500,000 for a manufacturer of machinery and electronic products); and | | （二）连续两年销售收入、出口供货分别在5000万元人民币和100万美元（机电产品生产企业年销售收入、出口供货额分别为3000万元人民币和50万美元）以上； |

| (III) It has professionals necessary for self management of the import and export business. | | （三）具有自营进出口业务所必需的专业人员。 |

II. A privately owned institution of scientific research (including a high-tech enterprises) that meets all of the following conditions may apply for the right to self-manage imports and exports:
